Call to Order
The Otter Tail County Board of Commissioners convened Tuesday, January 14, 2014 at the Government
Services Center in Fergus Falls, MN, with Commissioners Wayne Johnson, Chairman; Roger Froemming,
Vice-Chairman; John Lindquist, Lee Rogness, and Doug Huebsch present.
Approval of Agenda
Chairman Johnson called for approval of the January 14, 2014 agenda. Motion by Rogness, second by
Huebsch, and unanimously carried to approve the Board of Commissioners agenda of January 14, 2014
with the following additions:
Discussion Regarding Public Transit
Resolution in Support of Reconsidering the Renewable Volume Obligation Reductions
Discussion Regarding Hourly Pay

Initiative Funds
Larry Krohn, County Administrator, briefed the Board on the method used to pay County employees. The
pay was based on 2080 work hours in a year. Employees were paid for the same number of hours each
pay period (87 hours) even though the actual number of hours in the pay period varied from month to
month_. The Fox Lawson Classification and Compensation plan identified exempt and non-exempt
employees. On July 9, 2013, Otter Tail County adopted the Hourly Pay and Accrued Leave Computation
Policy which authorized a change from salaried pay to hourly pay for non-exempt employees. This will
cause the paychecks for employees in the Sheriff's Department who work a 28-day work period to fiuctuate
greatly. To assist with the situation, Commissioner Huebsch offered a motion to approve a temporary
suspension of the implementation of hourly pay for hours worked in January 2014, for employees on a
28-day work period under the Fair Labor Standards Act. Commissioner Rogness seconded the motion
and it was carried with all Commissioners in favor.
IN SUPPORT OF PUBLIC TRANSIT IN OTTER TAIL COUNTY
Otter Tail County Resolution No. 2014 -11
Upon a motion offered by Commissioner Huebsch and seconded by Commissioner Rogness, the following
resolution was unanimously adopted:
WHEREAS, the Otter Tail County Economic Development Committee met on December 16, 2013 to
discuss agriculture and agricultural processing in Otter Tail County; and
WHEREAS, after several presentations from employers such as Bongard's Creameries, Jennie-O Turkey,
and KLN, it became evident that there are many jobs available in Otter Tail County; and
WHEREAS, several challenges to gain and retain employees were identified; one of the main challenges
being transportation to and from job sites; and
WHEREAS, a transportation system utilizing State Highway 78 and 210 with various other possibilities
should be investigated, and
WHEREAS, Otter Tail County currently has a partnership with Otter Express who provides some
transportation needs, mostly in and around the City of Fergus Falls.
NOW, THEREFORE, BE IT RESOLVED, that Otter Tail County will identify transportation needs and
investigate a public/private partnership to determine the viability of developing and sustaining an economic
transportation solution.
BE IT FURTHER RESOLVED, that the Otter Tail County Chairman has assigned Commissioners Huebsch
and Rogness to work with a sub-committee to identify Otter Tail County transportation needs and
solutions.

USFWS Land Acquisition Request-
Motion by Lindquist, second by Rogness, and unanimously carried to approve the following land
acquisition by the U.S. Fish and Wildlife Service from the Fergus Falls Fish and Game Club:
T.131 N. R.44 W. 5th P.M.
The Northwest corner of Section Ten (10) being the point of beginning: thence 460 feet East along the
north section line; thence South parallel to the west section line 375 feet; thence West parallel to the north
section line 460 feet, more or less, to the west section line; thence North along the west section line to the
point of beginning. ·

Otter Tail County .Resolution No. 2014 -12
EPA Resolution 101
Upon a motion offered by Commissioner Rogness and seconded by Commissioner Lindquist, the following
resolution was unanimously adopted:
WHEREAS, the County of Otter Tail, Minnesota, strongly encourages the EPA to reconsider the draft
renewa_ble volume obligation (RVO) reductions for 2014, and
WHEREAS, the County of Otter Tail and region have benefited by our local renewable fuels plant through
43 jobs directly, enhanced markets for locally grown corn, further utilizing our railroad and enhancing and
growing its services and jobs, providing value added a_nimal fe_ed and corn oil, and adding millions into the
economy through indirect and induced economic benefits. Reducing the RVO woul_d have harmful
econo,:nic effects on our local and regional economy.
WHEREAS, the County of Otter Tail held a County Commissioner meeting to consider this resolution.
NOW, THEREFORE, BE IT RESOLVED that the County of Otter Tail strongly encourages the EPA to
reconsider the draft renewable volume obligation reductions for 2014.

Forgiveness of Tax Penalty
Steve Andrews, Treasurer, and J_oy.ce Schmidt, Accounting Supervisor, discussed the "Guideline for
Forgiveness of Penalty Requests" with' the Board.' Commissioners affirmed the Guideline and the current
process the Treasurer's office has been following.
Mr. Andrews presented a written request for forgiveness of tax penalty from Tollef Ringdahl. Mr. Ringdahl
indicated that the County website was unavailable when he tried to pay his taxes prior to January 1, 2014.
Motion by Huebsch, second by Froemming, and unanimously carried to deny the request of Tollef
Ringdahl for forgiveness of late fees and/or penalties for parcels R76-000-99-0141-000, 71-002-99-1610-
000, and 71-002-99-0728-000. The County's website provider indicated that there were no problems with
the County website and other payments were received during the time indicated.
Committee Assignments for CY2014
Motion by Huebsch, second by Rogness, and unanimously carried to approve the CY2014 Board of
Commissioners' committee appointments that are part of these minutes as Attachment B.

Motion by Lindquist, second by Froemming, and unanimously carried to appoint Commissioner
Doug Huebsch to the State Community Health Services Advisory Committee for CY2014.
Motion by Rogness, second by Froemming, and unanimously carried to appoint Commissioner
Doug Huebsch to the Partnership4Health Community Health Board for CY2014.
Personnel Board of Appeals Recommendation
David Hauser, County Attorney, briefed Commissioners regarding a request from Marsha Bowman for
retroactive pay. He reported that Marsha Bowman and other employees from the Land & Resource office
requested a reclassification the early part of 2007 and it was approved to proceed; however, before a
decision was made, the County Board took action to stop all reclassifications due to issues with the system
being used at the time. This issue initially was brought to the Personnel Board. The Personnel Board
found no evidence that Ms. Bowman's position had been treated any different than other reclassification
requests. The· old and new classification systems utilized different methodologies that cannot transfer
retroactively. Any change under the old system is purely speculative. Ms. Bowman appealed to the
Personnel Board of Appeals, who met to review the issue November 25, 2013. The Personnel Board of
Appeals, while recognizing the situation was unfortunate, affirmed the decision of the Personnel Board.
Marsha Bowman read, for the record, a synopsis of the order of events and requested retroactive pay to
March 15, 2007. Discussion took place regarding the various classification systems the County has used
and the current Fox Lawson Compensation and Classification system. A motion was offered by
Commissioner Huebsch to deny the request for retroactive pay and follow the recommendation of the
Personnel Board of Appeals. · Commissioner Froemming seconded the motion and all commissioners
voted in favor.

At 11 :28 a.m., Chairman Johnson declared ·the meeting of the Otter Tail County Board of Commissioners
adjourned for committee meetings. The next County Board meeting is scheduled at 9:30 a.m. on Tuesday,
January 21, 2014. ·
