Fir Avenue, Fergus Falls, MN October 15, 2013 9:30 a.m. Call to Order The Otter Tail County Board of Commissioners convened Tuesday, October 15, 2013 at 9:32 a.m., at the Otter Tail County Government Services Center in Fergus Falls, MN, with Commissioners Doug Huebsch, Chairman; Wayne Johnson, Vice-Chair; Roger Froemming, John Lindquist, and Lee Rogness present. Approval of Agenda Chairman Huebsch called for approval of the October 15, 2013 agenda. Motion by Rogness, second by Froemming, and unanimously carried to approve the Board of Commissioners agenda of October 15, 2013 with the following additions: Request for Approval of the MFIP Biennial Plan County Wide Multi-Use Trail Master Plan Approval of Minutes Motion by Froemming, second by Lindquist, and unanimously carried to approve the October 1, 2013 Board of Commissioners meeting minutes as written. Approval to Pay Bills Motion by Lindquist, second by Froemming, and unanimously carried to approve payment of the County Board bills per Attachment A of these minutes. Public Meeting At 9:35 a.m., Chairman Huebsch declared the meeting open to the public for comments regarding a permit application for the Dreyer Dairy Farm located at 32691 County Hwy 127, Ottertail, MN. The public meeting is being held according to M.S. 116.07, Subd. 7(1). The State MPCA is responsible for issuing a permit for the dairy operation. The County provides a local forum for the public to express their opinions regarding the project. No one from the public was present and no written comments were received on the proposed project. Commissioners expressed their support of dairy agriculture which is a core component of Otter Tail County's economy. The public meeting was closed at 9:40 a.m. DWI Court Grant Agreement Motion by Johnson, second by Froemming, and unanimously carried to authorize the appropriate County Officials' signatures to execute an Agreement for Professional Services between the State of Minnesota, Seventh Judicial District and Otter Tail County Probation for the period of October 1, 2013 through September 30, 2014. The Grant Agreement provides $74,278.00 to Otter Tail County Probation tor DWI Court services with a requirement for matching funds of $18,570.00. County Attorney, David Hauser, indicated that a DWI Court cost benefit evaluation will be available next March. Commissioners discussed future funding for the program. eCitation Contract with SCA Motion by Froemming, second by Rogness, and unanimously carried to authorize the appropriate County Officials' signatures to execute the Court Data Services Subscriber Amendment to the Master Joint Powers Agreement for Bureau of Criminal Apprehension eCharging services as recommended by the Sheriff. The Amendment is between the State of Minnesota Department of Public Safety, BCA, and County of Otter Tail. This Report included comparison information to West Central Minnesota and the State. Total CY2012 cost per capita for the County's CHB was reported as $42.03 as compared to the State at $50.77 for the same time period. Ms. Thorson updated the Board regarding Public Health National Standards. Active 911 Textinq Program Motion by Johnson, second by Lindquist, and unanimously carried to authorize the County Auditor's office to serve as the fiscal host for the Active 911 Texting Program. The Auditor's office will be invoiced for the annual service fee of the program for all users and make the annual payment to the. vendor. The Auditor's office will invoice the participating outside agencies for their appropriate annual share/reimbursement of the program. This program is an additional way to dispatch firefighters and ambulance workers. Application for Exempt Permit Motion by Johnson, second by Lindquist, and unanimously carried to approve, with no waiting period, the LG220 Application for exempt Permit as submitted by the Pelican Rapids Jaycees for an event scheduled for Friday, October 25, 2013 at The Pelican located at 44086 US Highway 59, Pelican Rapids, MN. OTC Board of Commissioners' Minutes October 15, 2013 Page 3 NACO Membership Dues Motion by Rogness, second by Froemming, and unanimously carried to approve payment, in the amount of $1,146.00, to the National Association of Counties for Otter Tail County's 2014 membership dues. The grant is authorized by Minnesota Laws 2013 Chapter 142, Article 1, Section 14. The Department of Revenue is developing a centralized database for managing information received by the Property Tax Division making analysis simpler and reports more standard. Grant dollars will assist counties with the expense of upgrading software for compatibility. Tax Forfeited Demolition Projects Motion by Froemming, second by Lindquist, and unanimously carried to award Demolition Project 1, Mobile Home in Dane Prairie Township (parcel 13-000-05-0024-002) to the low bidder, JJ's Co. Excavating, LLC at a cost of $3,200.00. The motion included award of Demolition Projects 2 through 5 to the low bidder, Barry Construction, Inc. as follows: Project 2; Parcel 28-000-05-0033-002; Friberg Township Building Site Project 3; Parcel 65-000-06-0003-005; Clitherall City Building Site Project 4; Parcel 65-000-99-0080-000; Clitherall City Building Site Project 5; Parcel 66-000-99-0061-001; Dalton City Commercial Site $7,880.00 $11,500.00 $8,750.00 $7,720.00 The motion also included a project completion date of February 1, 2014. Failure to accept the award by either contractor will move the project award to the next lowest bidder on each project. Minnesota Family Investment Program (MFIP) Biennial Service Agreement Motion by Froemming, second by Rogness, and unanimously carried to certify the Otter tail County Human Services 2014-2015 MFIP Biennial Agreement effective October 15, 2013 as presented by the Community Services Director. The Agreement has been prepared as required and approved by the County Board under the provisions of Minnesota Statutes, section 256J. This plan authorizes annual use of consolidated federal and state funds totaling $563,008 per year for two years to provide the following services: OTC Board of Commissioners' Minutes October 15, 2013 Page4 o MFIP/DWP (Minnesota Family Investment Program/Diversionary Work Program) employment services provided by the Rural Minnesota CEP program o Emergency Assistance/Crisis Services funding for low income families o Income Maintenance Program Administration services to assist eligible low-income families to seek economic assistance benefits Planning Commission Recommendations Preliminary Plat -"Haqqart's Second Addition"-Carmon & Carole Lvnnes: Motion by Rogness, second by Lindquist, and unanimously carried to approve the Preliminary Plat of Carmon & Carole Lynnes titled "Haggart's Second Addition" consisting of three non-residential (attached) lots with a condition as recommended by the Planning Commission. The project is located on Lot 1 Haggart's Addition, Section 4 of Dunn Township; Pelican Lake (56-786), GD. Conditional Use Permit -Josh & Ho/Iv Burke: Motion by Froemming, second by Rogness, and unanimously carried to approve a Conditional Use Permit for a dog and cat boarding, grooming and daycare facility to approve a maximum of 15 doggie rooms as presented in the Applicant's revised request received at the October 9, 2013 Planning Commission meeting with conditions as recommended by the Planning Commission. The project is located on Klinger's Riverside Lot 9 ex pt E of Hwy, Section 27 of Rush Lake Township; Otter Tail River (56-OTR). Interim Use Permit -Ron & Kim Burd: Bill Kalar, Land & Resource Director, presented a request from Ron & Kim Burd for an Interim Use Permit to use a current dwelling while constructing a home and then repurpose the original dwelling for office use. Mr. Burd and his contractor spoke to the Board regarding the request and the recommendation from the Planning Commission. Lengthy discussion followed regarding two dwellings on a lot and the intent of the repurposing language in the Shoreland Management Ordinance. Motion by Johnson, second by Rogness, and unanimously carried to approve an Interim Use Permit for short term use of the current dwelling as recommended by the Planning Commission and for repurposing the current dwelling as requested by the Applicant, provided: 1) impervious surface rules are met; 2) setback rules are met; and 3) due to repurposing, the onsite septic system must be sized for an .additional bedroom. The project is located on Lot 10 Blk 1 Big Sandy Beach, Section 31 of Corliss Township; Big Pine Lake (56-130), GD. Conditional Use Permit -"Big McDonald Resort"-Chad & Lisa Gabrielson: Motion by Froemming, second by Johnson, and unanimously carried to approve a Conditional Use Permit to subdivide resort land with a condition as recommended by the Planning Commission. The proposal is located in Pt of GL 1, Lots 5-1 O First Addition . to Kozelnik Beach and Lots 1 & 2 Second Addition to Kozelnik Beach, Section 18 of Edna Township; Big McDonald Lake (56-386), RD. Tuition Assistance Request Motion by Johnson, second by Lindquist, and unanimously carried to approve Highway Department Tuition Assistance Agreements for Wade J. Bugbee and Jason M. Lee as presented by the Public Works Director. CSAH 3 Retaining Wall Repairs Motion by Rogness, second by Lindquist, and unanimously carried to authorize the appropriate County Officials' signatures to execute a Highway Construction Contract between the County of Otter Tail and Ben Wolden Landscaping of Fergus Falls, MN for retaining wall repairs on CSAH 3 at Bridge No. 56526 over the Otter Tail River. OTC Board of Commissioners' Minutes October 15, 2013 Page5 Retainaqe Reduction CSAH 73 Overlay Project Motion by Froemming, second by Rogness, and unanimously carried to authorize the Highway Department to reduce the retainage for the CSAH 73 overlay project from 5% to 2%. The project is complete except for the final paperwork. RESOLUTION SUPPORT FOR ADDITIONAL TRANSPORTATION INVESTMENTS Otter Tail County Resolution No. 2013 -56 Upon a motion by Johnson and second by Froemming, the following resolution was offered: WHEREAS: our State's transportation system should support Minnesota businesses, support our state's ability to compete for jobs, align with our growing and changing population, be up to date in design and safety features, and be able to compete with other regions of our country, and WHEREAS: the State of Minnesota through the results of the Minnesota GO 50 Year Vision for Transportation, the Minnesota State Highway Investment Plan 2014-2033 (MnSHIP) and the Transportation Financing Advisory Committee (TFAC) have identified needs for additional investments in the State system, and WHEREAS: these needs represent investments across the State including roads, bridges, transit, trails and support for freight, and WHEREAS: there are also needs for additional investments in transportation systems under the jurisdiction of local Minnesota governments, and NOW THEREFORE BE IT RESOLVED THAT: the Otter Tail County Board of Commissioners support the need for a long range comprehensive transportation investment plan that is multi modal, includes all jurisdictions, is indexed for future inflation, and addresses the varying needs across the state, and BE IT FURTHER RESOLVED THAT: the Otter Tail County Board of Commissioners urges the 2014 MN State Legislature to pass and the Governor sign a bill, that provides for this long range comprehensive transportation system investment. Motion by Johnson, second by Rogness, and unanimously carried to authorize the Highway Department to apply for a Department of Natural Resource (DNR) permit to lower the water elevation a minimum of 5' below the CH 112 shoulder elevation. Reducing the water elevation is necessary for the stability, safety, and long term condition of the road. Otter Tail County Trail Master Plan Motion by Rogness, second by Lindquist, and unanimously carried to authorize the appropriate County Officials' signatures to execute a proposal for professional services between the County of Otter Tail and SRF Consulting Group, Inc. for a comprehensive Otter Tail County trail development plan as submitted by the Public Works Director. County Ditch #37 Kevin Fellbaum, Ditch Inspector, requested approval on behalf of Mark Schoening to clean a portion of County Ditch #37. Motion by Johnson, second by Lindquist, and unanimously carried to authorize Mark Schoening of Sverdrup Township to clean out an area in Ditch #37 where tile from Bass Lake empties into the Ditch to where it inlets into a culvert that flows underneath a driveway. Mr. Fellbaum submitted a map with the area to be cleaned identified in blue. County Ditch #38 and 41/65 Mr. Fellbaum indicated that maintenance cleanouts need to be completed on a branch of Ditch #38 and two areas in Ditch #41 /65. Motion by Rogness, second by Johnson, and unanimously carried to clean out the areas in County Ditch #38 and #41 /65 as indicated in red on the maps submitted and as recommended by the Ditch Inspector. County Ditch #70 Mr. Fellbaum presented a preliminary plan from Houston Engineering regarding an alternate route for the Ditch #70 improvement project. Discussion followed regarding the options to keep the original outlet and add the alternate route, issues with maintenance on the original route, and the need for a public informational meeting. Mr. Fellbaum indicated that the Engineer needs to do additional work to determine the details of the plan. The Ditch Inspector will keep the Board updated on the proposed project. Annual Partnership Payment Motion by Johnson, second by Froemming, and unanimously carried to authorize payment of the annual partnership dues to the Otter Tail Family Services Collaborative for FY 2013/2014. Personnel Board of Appeals Motion by Froemming, second by Rogness, and unanimously carried to appoint Dennis Mosher of Dalton, MN to the Otter Tail County Personnel Board of Appeals effective January 1, 2013 for a three (3) year term ending December 31, 2015. Correction to Minutes Motion by Johnson, second by Lindquist, and unanimously carried to correct a typographical error in the September 10, 2013 minutes, Resolution No. 2013-51. In the last paragraph of the resolution, the Proposed Budget currently reads $80,500.00 and is corrected to read $80,500,000. Annual Township Meetings Motion by Rogness, second by Lindquist, and unanimously carried to authorize per diem and mileage expenses for Commissioners attending annual township meetings.
