Call to Order
The Otter Tail County Board of Commissioners convened Tuesday, October 1, 2013 at 9:30 a.m., at the
Otter Tail County Government Services Center in Fergus Falls, MN, with Commissioners Doug Huebsch,
Chairman; Wayne Johnson, Vice-Chair; Roger Froemming, John Lindquist, and Lee Rogness present.
Approval of Agenda
Chairman Huebsch called for approval of the October 1, 2013 agenda. Motion by Lindquist, second by
Johnson, and unanimously carried to approve the Board of Commissioners agenda of October 1, 2013
with the following addition:
Multi-Use Trail Discussion
Approval of Minutes
Motion by Johnson, second by Rogness, and unanimously carried to approve the September 17, 2013
Board of Commissioners meeting minutes as written.
Approval to Pay Bills
Motion by Johnson, second by Froemming, and unanimously carried to approve payment of the County
Board bills per Attachment A of these minutes.
A Workplace Accident and Injury Reduction Program (AWAIR)
Patrick Waletzko, Safety Program Liaison, presented a revised AWAIR policy which is the umbrella safety
policy for Otter Tail County. This policy incorporates the Division structure and reviews how the safety
program operates and identifies roles and responsibilities. Subsequent safety policies will be developed by
the Division Directors. The revised AWAIR policy includes a series of goals and objectives which is a
requirement of the MN Occupational Safety and Health Act. Motion by Johnson, second by Lindquist, and
unanimously carried to approve the AWAIR Program policy effective October 2, 2013 as presented by the
Safety Program Liaison.
Human Services Contracts
Motion by Johnson, second by Froemming, and unanimously carried to authorize the appropriate County
Officials' signatures to execute the following Human Services contracts:

Human Services Bills & Claims
Motion by Johnson, second by Froemming, and unanimously carried to approve the Human Services bills
and claims as presented.
Recess & Reconvene
At 9:50 a.m., Chairman Huebsch declared the meeting of the Otter Tail County Board of Commissioners
recessed for a short break. The meeting was reconvened at 9:59 a.m.
RELEASE OF RIGHT-OF-WAY
Otter Tail County Resolution No. 2013 -54
WHEREAS, the County of Otter Tail has received a request for the vacation of a portion of right-of-way on
County State Aid Highway 82, and which property is no longer required for right-of-way purposes; and
WHEREAS, there remains adequate right-of-way for highway purposes; and
WHEREAS, the following legal description was prepared by Anderson Land Surveying and approved by
the Otter Tail County Highway Department.
Any and all public roads located in that part of the Southwest Quarter of the Northwest Quarter of Section
11, Township 132, Range 43, Otter Tail County, Minnesota, described as follows
Commencing at the northwest corner of said Section 11; thence South 00 degrees 16 minutes 19 seconds
West on an assumed bearing along the west line of said Section 11, a distance of 1154.73 feet; thence
North 89 degrees 44 minutes 41 seconds East a distance of 495.37 feet; thence South 03 degrees 12
minutes 40 seconds West a distance of 288.57 feet; thence South 84 degrees 29 minutes 37 seconds East
a distance of 168.50 feet; thence South 00 degrees 40 minutes 08 seconds West a distance of 197.53 feet;
thence South 85 degrees 15 minutes 25 seconds East a distance of 309.46 feet; thence North 00 degrees
32 minutes 23 seconds West a distance of 61.10 feet to the southwest corner of that certain tract of land
described in Torrens Document No. 5625, according to the recorded files thereof; thence North 89 degrees
32 minutes 24 seconds East along the south line of said tract of land, a distance of 264.66 feet to the west
right-of-way line of County State Aid Highway No. 82, as monumented and constructed, the point of
beginning of the land to be described; thence southerly, along said west right-of-way line, on a non-
tangential curve concave to the east, having a radius of 2014.86 feet, a delta angle of 07 degrees 57
minutes 44 seconds and a chord bearing of South 06 degrees 20 minutes 24 seconds East, for an arc
distance of 280.00 feet; thence North 03 degrees 53 minutes 10 seconds West a distance of 278.80 feet to
the intersection with the easterly extension of said south line of the tract of land described in Torrens
Document No. 5625; thence South 89 degrees 32 minutes 24 seconds West along said south line, a
distance of 12.00 feet to the point of beginning.
Containing 2,577 square feet more or less
IT IS HEREBY RESOLVED that the above-described portion of the highway easement for County State
Aid Highway 82 is hereby vacated.
Upon the motion of Johnson, second by Froemming, and passed on a 5-0 vote, the above resolution is
hereby adopted by the Otter Tail County Board of Commissioners.

WHEREAS, the County of Otter Tail has received a request for the vacation of a portion of right-of-way on
County State Aid Highway 4, and which property is no longer required for right-of-way purposes; and
WHEREAS, there remains adequate right-of-way for highway purposes; and
WHEREAS, the following legal description was prepared by Meadowland Surveying, Inc. and approved by
the Otter Tail County Highway Department.
Any and all public roads located in that part of County State Aid Highway No. 4 right-of-way easement
located in Sublet 4 of the plat of SU BLOTS 2, 3 AND 4 OF GOVERNMENT LOTS 3 AND 4, SECTION 25,
T. 137, R. 41, said plat is recorded as Document No. 182423 in the office of the Recorder in Otter Tail
County, Minnesota, described as follow~:
Commencing at a found iron monument which designates the southwest c,o.rner of Section 25, Township
137 North, Range 41 West of the Fifth Principal Meridian in said County, thence South 89 · degrees 52
minutes 02 seconds East 700.07 feet on an assumed bearing along the south line of said Section 25 to the
intersection with the easterly line of the westerly 700.00 feet of said Section 25; thence North 00 degrees
39 minutes 16 seconds West 400.03 feet along said easterly line of the westerly 700.00 feet to the
northerly line of BENNETT'S SOUTH VIEW FIRST ADDITION, said plat is on file and of record in the office

minutes 44 seconds and a radius·of 101493'feet, for a distance of 235.81 feet (chord bearing South 58
degrees 34 minutes 37 seconds West) to the southeasterly right-of-way line of said County State Aid
Highway No. 4; thence North 73 degrees 16 minutes 58 seconds East 109.92 feetalong the southeasterly
right-of-way line said County State Aid Highway No. 4 to a found iron monument; thence northeasterly
continuing along the southeasterly right-of-way line of said County State Aid Highway No. 4 on a curve
concave to the northwest, having a central angle of 46 degrees 01 minute 29 seconds and a radius of
766.20 feet, for a distance of 615.48 feet (chord bearing North 50 degrees 16 minutes 13 seconds East) to
the point of beginning of said road vacation. The above described road vacation area contains 28,114
square feet (0.65 of an acre).
IT IS HEREBY RESOLVED that the above-described portion of the highway easement for County State
Aid Highway 4 is hereby vacated.
Upon the motion of Johnson, seconded by Froemming, and passed on a 5-0 vote, the above resolution is
hereby adopted by the Otter Tail County Board of Commissioners.

Findings of Facts and Order
Motion by Johnson, second by Lindquist, and unanimously carried to authorize the Chairman's signature to
execute two (2) Dog Bite Orders as follows:
• Finding of Facts and Order Regarding the mixed breed dog, Harley,
owned by Scott Rolland Sibert
• Finding of Facts and Order Regarding the dog named Bella owned by
Dustin Raymond Shepherd
Otter Tail County Logo
Members of the Branding Task Force provided samples of letterhead, vehicle decal, business card and
clothing with the proposed Otter Tail County Logo. Discussion followed. Motion by Rogness, second by
Johnson, and unanimously carried to approve the Logo as presented as the official Otter Tail County Logo.
The motion also included a directive to the Branding Task Force to develop a policy/guideline for style and
usage of the Logo.
Multi-Use Trails

Commissioner John Lindquist opened discussion regarding the County's various multi-use trail projects.
He indicated that he has received phone· calls concerned with the design of some of the trails and cost of
the trail projects. Discussion took place regarding the funding process and. use of federal enhancement
dollars and legacy funds. Commissioners requested that this topic be placed on a future agenda for
education from funding multi-use trails to project completion.
Presentation of Law Officer of the Year Award
Bill Schulz, representing the American Legion Post #30 of Fergus Falls, presented the Henkes-Mortensen
Law Officer of the Year award to Otter Tail County Chief Deputy, Stacy Paulseth, a 27-year law
enforcement veteran. Chief Deputy Paulseth humbly accepted the award and thanked the large crowd and
his wife for their recognition and support.
Recess & Reconvene
At 10:30 a.m., Chairman Huebsch declared the meeting of the Otter Tail County Board of Commissioners
recessed for a short break. The meeting was reconvened at 10:39 a.m.
Tobacco License Fee
Motion by Johnson, second by Froemming, and unanimously carried to increase the tobacco license fee
from $100.00 to $125.00 effective for the 2014 renewals.
Application for Exempt Permits
Motion by Froemming, second by Lindquist, and unanimously carried to approve the LG220 Application for
Exempt Permit as submitted by the Perham Jaycees for an event scheduled for Saturday, October 12,
2013 at the Cactus located at 43521 Fort Thunder Road, Perham, MN.
OTC Sewage Treatment System Property Transfer Form
Motion by Johnson, second by Rogness, and unanimously carried to grant the County Auditor discretion
regarding the requirement of the Otter Tail County Sewage Treatment System Property Transfer form
(exemption #4 of the form) for those documents that do not require a Certificate of Real Estate Value.
Project Award -Dead man ·Lake Field Access & Culvert
Motion by Rogness, second by Lindquist, and unanimously carried to award the Deadman Lake Field
Access and Culvert Project to Barry Construction of Fergus Falls, MN at a quotation amount of $12,849.26
as recommended by the Public Works Director.
Engineering Services -Proposed Bridge Replacement
Motion by Johnson, second by Froemming, and unanimously carried to approve the Engineering Services
of Braun lntertec, West Fargo, ND for a proposed Bridge Replacement project (SAP 056-599-061) over
Spruce Creek in Eastern Township at an estimated cost of $7,682.00.
Road Ditch Cleanout Application
Motion by Froemming, second by Rogness, and unanimously carried to authorize the appropriate County
Officials' signatures to execute an Application from David Harren for cleaning a County Road Ditch on
CSAH 46 about 2,150' from CH 141 intersection north.

CSAH 8 Culvert Replacement Contract
Motion by Rogness, second by Lindquist, and unanimously carried to authorize the appropriate County
Officials' signatures to execute a Highway Construction Contract between the County of Otter Tail and
Barry Construction, Inc. of Fergus Falls, MN for a Culvert Replacement project on CSAH 8 Northeast of
Perham. The estimated project cost is $35,875.00. ·
Draft Resolution of Support for Transportation Investment
Motion by Johnson and seconded by Rogness to adopt a draft Resolution of Support for additional
financial investment into the State Transportation System. Chairman Huebsch called for a roll call vote as
follows:

Ditch #70 Discussion
ABSTAIN
Kevin Fellbaum, Ditch Inspector, reported that he researched the possibility of applying for Clean Water
Funds for the proposed Ditch #70 Improvement project. A Board of Water and Soil Resources (BWSR)
representative indicated that the funding is for water quality; therefore, the Ditch #70 Improvement project
would likely not be funded through this grant. Due to the lengthy application process and small chance of
obtaining funding, Mr. Fellbaum recommended the possibility of using a new corridor for the Outlet
Improvement project. He will work with the Engineer on the project.

adjourned. The next regular County Board meeting is scheduled for Tuesday, October 15, 2013.
