Call to Order
The Otter Tail County Board of Commissioners convened Tuesday, September 17, 2013 at 9:30 a.m., at
the Otter Tail County Government Services Center in Fergus Falls, MN, with Commissioners
Wayne Johnson, Vice-Chair; Roger Froemming, John Lindquist, and Lee Rogness present. Chairman
Doug Huebsch was absent.
Approval of Agenda
Vice-Chair Johnson called for approval of the September 17, 2013 agenda. Motion by Lindquist, second
by Rogness, and unanimously carried to approve the Board of Commissioners agenda of September 17,
2013 with the following addition:
Approval of Auditor's License Renewals
Approval of Minutes
Motion by Froemming, second by Rogness, and unanimously carried to approve the September 10, 2013
Board of Commissioners meeting minutes as presented.
Approval to Pay Bills
Motion by Lindquist, second by Froemming, and unanimously carried to approve payment of the County
Board bills per Attachment A of these minutes.
Proposed Logo Presentation
Branding Task Force members presented various documents showing a revised Otter Tail County sample
logo. Pictures included the proposed logo on a business card, the side of County vehicles and on County
clothing. Discussion followed. Commissioners requested that the Task Force return to the County Board
at their next scheduled meeting.
Lease Agreement for Storage Building
Motion by Rogness, second by Lindquist, and unanimously carried to authorize the appropriate County
Officials' signatures to execute a Lease Agreement between the County of Otter Tail and City of Battle
Lake. The County will lease a City storage building to store County tractor/grader equipment. The
agreement has been reviewed by the County Attorney and the County's liability insurance carrier.
Transportation Funding
Motion by Rogness, second by Lindquist, and unanimously carried to authorize the Public Works Director
to draft a resolution in support of the MnDOT Commissioner's efforts in presenting the long term need for
increased funding (with indexing) for Minnesota's transportation system. The resolution will be sent to the
Governor and Legislators.
Multi-Use Trails Committee
Motion by Rogness, second by Lindquist, and unanimously carried to appoint Commissioners
Doug Huebsch and Wayne Johnson to serve on the Perham to Pelican Rapids Multi-Use Trails
Committee.

COMMUNITY HEAL TH BOARD
(Partnership4Health)
Otter Tail County Resolution No. 2013 -52
Commissioner Froemming offered the following and moved its adoption:
WHEREAS; The Otter Tail County Board of Commissioners desires to maintain a strong public health
infrastructure now and into the future; and
WHEREAS; The Otter Tail County Board, through one commissioner, the county administrator, a lay
community member, staff participation and consultation from the Minnesota Department of Health, has
thoroughly studied the opportunities and challenges associated with the fonmation of a Community Health
Board comprised of Becker, Clay, Otter Tail, and Wilkin Counties;
NOW THEREFORE BE IT RESOLVED: The Otter Tail County Board of Commissioners approves the
merging of the Otter Tail County Board of Health with Becker, Clay, Otter Tail and Wilkin County Boards of
Health into one Community Health Board (Partnership4Health) effective January 1, 2014;
BE IT FURTHER RESOLVED: The Otter Tail County Board of Commissioners commits to provide
Commissioner and staff participation necessary to continue the planning and development process.
Commissioner Rogness seconded the motion. The resolution was adopted on a 4 -0 vote.

Environmental Delegation Agreement
Motion by Rogness, second by Lindquist, and unanimously carried to affirm that Otter Tail County wishes
to pursue an Environmental Health Delegation agreement with the Minnesota Department of Health under
the new CHS structure.
Dog Bite Hearing -Dustin Shepherd
At 10:40 a.m., Vice-Chair Johnson opened a Dog Bite Hearing for a Pitbull named Bella owned by Dustin
Shepherd. Mr. Shepherd agreed that two bites have occurred; one on June 20, 2013 and one on
August 15, 2013 at his parent's place of residence. He presented a positive letter about the dog, Bella,
from his veterinarian which also indicated that Bella was up-to-date with all vaccines. Another letter, from
a friend, Angela Plummer, was read for the record. The letter stated Ms. Plummer's desire to take in Bella
and keep him in her fenced backyard or muzzle and leash when outside of her fenced area. Motion by
Lindquist, second by Froemming, and unanimously carried to follow the proposed agreement from Angela
Plummer with a condition that an additional bite would result in euthanasia. The County Attorney will draft
an Order of Findings and provide a copy to authorities in Cass County.

Dog Bite Hearing -Scott Sibert
At 11 :00 a.m., Vice-Chair Johnson opened a Dog Bite Hearing for a St. Bernard, Mastiff, and German
Shepherd mix named Harley owned by Scott Sibert. Mr. Sibert acknowledged that two bites have occurred
on his property; one on August 1, 2012 and one on August 14, 2013. Jessica Metzger, Public Health
Nurse, reported that there are several signs posted along the driveway warning of a guard dog on duty.
Lengthy discussion followed regarding a possible solution to avoid another bite. Motion by Lindquist,
second by Froemming, and unanimously carried to order that the dog, Harley, is a potentially dangerous
dog by Minnesota Statute and must be chained and muzzled until a solution has been offered in writing
and approved by the County Board.
Planning Commission Recommendations
Conditional Use Pennit -Richard & Charlotte Owens:
Motion by Lindquist, second by Froemming, and unanimously carried to approve a Conditional Use Permit
to raise the yard (357 cubic yards of clean sand) because of high water issues with a completion date of
November 1, 2013. The project is located on Harris Beach NEL Y 75' on lake x 82' in rear Lot 3, Section 15
of Edna Township; Paul Lake (56-335), RD.
Preliminary Plat -"Agri-Steel", Mike Kronemann:
Motion by Lindquist, second by Froemming, and unanimously carried to approve the Preliminary Plat titled
"Agri-Steel" consisting of five lots for light commercial use as requested. The proposal is located in
Pt. SE¼ (8 ac), Section 2 of Buse Township; Non-Shoreland.
Conditional Use Penni/-Otter Tail Beach Club, Inc., Joe Swanqler:
Motion by Froemming, second by Rogness, and unanimously carried to approve a Condition'aI Use Permit
to raise and replace the roof of an existing mobile home as requested. The project is located in Pt of GLs
3 & 5 (2.5 AC), Section 12 of Amor Township; Otter Tail Lake (56-242), GD.
Conditional Use Penni/-Mike & Andrea Tauer:
Motion by Froemming, second by Rogness, and unanimously carried to approve a Conditional Use Permit
to replace existing retaining walls and other minor changes with conditions as recommended by the
Planning Commission. The project is located on Lenius Beach 1st Addition Lot 18 & pt Lot 19, Section 3 of
Edna Township; Little McDonald Lake (56-328), GD.
Reguest for Reimbursement
Bill Kalar, Land & Resource Director, presented a letter dated August 28, 2013 from Robert Mitchell
regarding an abatement notice on his septic system issued in 2010. The property is located on Albert Lake
(56-118) in Section 6 of Otto Township. The septic system was replaced with a chambered septic system.
Mr. Mitchell's letter indicates that the new system has failed possibly due to gophers. Motion by Rogness,
second by Lindquist, and unanimously carried to deny Robert Mitchell's request for the County to pay for
the cost of repairing his septic system. This is an issue that should be resolved by the contractor and the
customer.
Recess & Reconvene
At 11 :48 a.m., Vice-Chair Johnson declared the meeting of the Otter Tail County Board of Commissioners
recessed for committee meetings and lunch break. The meeting was reconvened at 1 :45 p.m.

MNsure Information
John Dinsmore, Community Services Director, provided a packet of information regarding the Minnesota
Health Insurance Exchange. Minnesota is one of seventeen states that are developing a State-based
Exchange with seven states planning a Partnership Exchange and twenty-seven states defaulting to the
Federal Exchange. The MNsure Exchange is a result of the Affordable Care Act (ACA) and is scheduled
to open October 1, 2013 for health insurance coverage starting January 1, 2014. II is expected that the
MNsure Exchange will serve 1 out of every 5 Minnesotans. Mr. Dinsmore also discussed Medicaid
expansion. He showed a Kaiser Family Foundation video about the MNsure Exchange.
Vehicle Purchase
Motion by Rogness, second by Lindquist and unanimously carried to authorize the Community Services
Director to purchase four (4) new vehicles from the Minnesota State bid list to replace six (6) old, high
mileage vehicles. This will reduce the agency's vehicle fleet from 16 to 14.
Children's Mental Health Local Advisory Council {LAC}
Jane Patrick, Children's MH LAC Coordinator, updated the Board on activities the LAC has worked on over
the past year including education and awareness of various mental health issues, bullying, and promoting
parent/consumer involvement in children's lives. The Children's MH LAC continues to advise Otter Tail
County Human Services based on state statute through professional and consumer memberships on the
Council

Proclamation
Otter Tail County Resolution No. 2013 -53
WHEREAS, the U.S. Surgeon General states that mental health is fundamental to health and
indispensable to personal well-being, family and interpersonal relationships, and contributes to community
and society; and
WHEREAS, the U.S. Surgeon General confirms that mental illness affects one in five Americans every
year, regardless of age, gender, race, ethnicity, religion or economic status; and
WHEREAS, the U.S. Surgeon General has found that a range of treatment exists for most mental
disorders and the efficacy of mental health treatments are well documented; and
WHEREAS, Otter Tail County has made a commitment to community-based systems of mental health care
for all residents and has appointed Local Mental Health Advisory Committee for children and adults.
WHEREAS, the guiding principles of community mental health care have always been
comprehensiveness, cost-efficiency, effective management and high-quality and consumer responsive
services, and these principles are now being adopted by private and public healthcare payers; and
WHEREAS, the National Mental Health Association, the National Council for Community Behavioral
Healthcare and their national partners, the National Alliance for the Mentally Ill and their local affiliates
observe Mental Health Awareness Week as October 6th -12th 2013 to raise awareness and
understanding of mental health and illness;

THEREFORE, we, The Otter Tail County Board of Commissioners, by virtue of the authori~ vested in
us as County Commissioners of Otter Tail County, do hereby proclaim October 6th -12 2013 as
Mental Health Awareness Week in Otter Tail County. As County Commissioners of Otter Tail County
we call all citizens, government agencies, public and private institutions, business and schools to recommit
our community to increasing awareness and understanding of mental illness and the need for appropriate
and accessible services for all people with mental illness.
Upon the motion of Commissioner Froemming, seconded by Commissioner Rogness, the Otter Tail
County Board of Commissioners adopts the foregoing resolution by a unanimous vote:

Adult Mental Health Local Advisory Council (LACI
LuAnne Hanson and Beth Nelson, members of the Adult MH LAC, updated the Board regarding their
activities. The LAC provides recommendations to the Otter Tail County Human Services Agency. The
LAC is instrumental in early intervention projects, works with the jail, housing and homelessness, and
provides mental health awareness materials. The Crisis Center at Productive Alternatives has added
space from two beds to four beds so that people are not turned away. Currently, the Adult MH LAC is
working to develop alternative resources for emergency transportation. Mr. Dinsmore reported that a nine-
county mental health needs analysis is underway with results and recommendations expected by February
of 2014.

At 2:56 p.m., Vice-Chair Johnson declared the meeting of the Otter Tail County Board of Commissioners
recessed for a short break. The meeting was reconvened at 3:02 p.m.
Ditch #25 Engineering Services Agreement
Motion by Froemming, second by Rogness, and unanimously carried to authorize the appropriate County
Officials' signatures to execute an Agreement between the County of Otter Tail and Widseth Smith Nolting
& Associates to execute the County Ditch #25 Engineer's Repair Report.
County Ditch #70
Kevin Fellbaum, Ditch Inspector, submitted data regarding Ditch #70 as previously requested. The report
identifies 3,095.34 benefited acres in Ditch #70 with a total benefit amount of $363,002.07. The Engineer's
project cost for the Ditch is $600,000 to $900,000. Lengthy discussion followed regarding improvement
value of the Ditch and project scope and cost. The Public Works Director and Ditch Inspector will research
the situation further.

Motion by Johnson, second by Lindquist, and unanimously carried to approve per diem and mileage for
Commissioners attending the West Central Snowfghters 1 y!h Annual Truck Rodeo held on Wednesday,
September 11, 2013.

Motion by Lindquist, second by Johnson, and unanimously carried to approve per diem and mileage for
Commissioners attending the Workplace Accident & Injury Reduction program or the Tour of the Mille Lacs
Academy both held on September 19, 2013.

At 3:36 p.m., Vice-Chair Johnson declared the meeting of the Otter Tail County Board of Commissioners
adjourned. The next regular County Board meeting is scheduled for Tuesday, October 1, 2013.
