Call to Order
The Otter Tail County Board of Commissioners convened Tuesday, July 16, 2013 at 8:30 a.m., at the Otter
Tail County Government Services Center in Fergus Falls, MN, with Commissioners Doug Huebsch, Chair;
Wayne Johnson, Vice-Chair; Roger Froemming, John Lindquist, and Lee Rogness present.
Approval of Agenda
Chairman Huebsch called for approval of the July 16, 2013 agenda. Motion by Froemming, second by
Johnson, and unanimously carried to approve the Board of Commissioners agenda of July 16, 2013 with
the following modifications:
Branding Task Force Replaced with a Budget Committee Meeting
Add Capital Improvement Committee Meeting
Exempt/Non-Exempt Status Discussion
Approval of Minutes
Motion by Froemming, second by Rogness, and unanimously carried to approve the July 9, 2013 Board of
Commissioners meeting minutes as presented.
Approval to Pay Bills
Motion by Lindquist, second by Rogness, and unanimously carried to approve payment of the County
Board bills per Attachment A of these minutes.
Memorandum of Understanding for Emergency Services
Motion by Lindquist, second by Johnson, and unanimously carried to authorize the Chairman's signature to
execute a Mutual Aid Agreement between Becker County and Otter Tail County for reciprocal emergency
management aid and assistance in an emergency or disaster.
Liquor License Refund
Motion by Johnson, second by Lindquist, and unanimously carried to approve the request of
Lee Horstmann of the Pelican Supper Club and Lounge, for a refund of the 2013/2014 On-Sale Liquor and
Sunday Liquor License Fee of $2,200.00. The planned business partnership will not be operating the
business and the request for the refund was received prior to the issuance of the license.
Drainage System #70 Petition Report
Wayne Stein, Auditor, submitted several documents detailing the benefited parcels on Ditch #70 and the
accepted signatures of property owners on the Ditch #70 Petition for Improvement. The parcel and
signature data showed 22.52% of the property owners signed the Petition for Improvement. An additional
spreadsheet indicated that 42.18% of the total benefited acres and 32.88% of the total benefit amount was
represented by the accepted property owner signatures as found on the submitted Petition. The area of
land benefited satisfies the criteria for a valid petition. Motion by Rogness, second by Johnson, and
unanimously carried to accept the Petition for Improvement for Otter Tail County Ditch #70 as submitted
with a letter dated July 5, 2013. The motion further authorizes hiring an Engineer to proceed with an
Improvement Plan.

Recess & Reconvene
At 9:10 a.m., Chairman Huebsch declared the meeting of the Otter Tail County Board of Commissioners
recessed for a Budget Committee meeting. The meeting was reconvened at 9:17 a.m.
Motorola Service Agreement
Motion by Froemming, second by Lindquist, and unanimously carried to authorize the Chairman's
signature to execute a 911 hardware and software Maintenance & Support Services Agreement (Contract
#S00001018954) between the County of Otter Tail and Motorola Solutions of Schaumburg, IL, in the
amount of $37,495.20. The contract period is April 1, 2013 through March 31, 2014.
Cooperative Agreement for Sharing 911 Call Handling System
Motion by Lindquist, second by Johnson, and unanimously carried to authorize the appropriate County
Officials' signatures to execute a Cooperative Agreement for Shared/Hosted 911 Call Handling System
with Traverse and Wilkin counties. This agreement allows sharing of the backup system and the ability to
backup calls if an individual system should be inoperable.
Exempt/Non-Exempt Classification Status
Motion by Froemming, second by Rogness, and unanimously carried to use the exempt or non-exempt
status as has been identified in the County's classification system and follows the Fair Labor Standards
Act. Effective July 1, 2013, employees designated as Exempt will not be eligible for overtime pay and
employees designated as Non-Exempt should log overtime hours worked for payroll purposes. Some
positions classified as Exempt under the FLSA may be eligible for overtime pay based on the applicable
collective bargaining agreement.
Animal Bite Hearing
At 9:35 a.m., testimony was received regarding a cat bite by an animal that is a cross between a domestic
cat and another unknown species of cat. The cat is owned by Oliver Julsrud. The owner did not appear at
the Animal Bite Hearing. Under oath, Jessica Metzger, Public Health Nurse, provided two documents; 1) a
summary of the incident and Public Health's recommendations completed by Ms. Metzger, and 2) a report
from the Emergency Room on the day of the bite (6/21/2013). Concern was expressed due to substantial
bodily harm to a victim from a bite on June 21, 2013 and for the ongoing safety and health of others who
may visit the property. For reasons stated, a motion was offered by Lindquist, seconded by Johnson, and
unanimously carried to order the animal known as Salen owned by Oliver Julsrud to be euthanized and
submitted for rabies testing. The County Attorney will prepare an Order of Findings for this Hearing.
County Ditch #37
Kevin Fellbaum, Ditch Inspector, updated the Board regarding a branch of County Ditch #37 where repair
work is needed. A Public Information meeting will be held July 22, 2013 to explore the possibility of
combining Ditch #18 and Ditch #37.
Recess & Reconvene
At 10:52 a.m., Chairman Huebsch declared the meeting of the Otter Tail County Board of Commissioners
recessed for a short break. The meeting was reconvened at 11 :01 a.m.
Systems Preservation Study
Rick West, Public Works Director, briefed the Commissioners on the Systems Preservation Study which
reviews the current highway system, condition and funding sources. Also, the study will provide
recommendations as to future funding needs to maintain the highway system in its current condition and to
enhance the conditions. Because the local wheelage tax option needs to be decided by August 1, 2013,
Mr. West recommended that Otter Tail County educate the public on highway funding needs before
implementing the tax. By general consensus, Commissioners agreed that public education should be the
first step prior to implementing local tax.
Dalton Garage

Mr. West submitted costs to operate Garage #16 in Dalton from 2007 through 2011 with a total cost of
$114,952.00. He recommended that the two trucks stored in Dalton at this lime be relocated for the
2013/2014 season. After the winter season, an evaluation will take place to determine the feasibility of
selling the Dalton Garage. Motion by Rogness, second by Lindquist, and unanimously carried to approve
the Public Works Director's plan as described.
CSAH 72 Bridge Discussion
Concern has been expressed regarding the concrete dam structure under the CSAH 72 Bridge in the case
of individual(s) who may not recognize the safety hazard of jumping off the bridge. Commissioners
indicated that bridges are not safe to jump off of at any time and ask that citizens recognize the danger
without the need to provide signage on all bridges in the County.
Phelps Mill Park Donation
Motion by Johnson, second by Froemming, and unanimously carried to thank the Kiwanis Club of Otter
Risers for a generous donation of $400.00 to be used towards the cost of the Phelps Mill Park Playground.
Commuting with County Vehicles
Motion by Johnson, second by Froemming, and unanimously carried to authorize the following Highway
Department employees to commute with County Vehicles while working on a County Wide Sealcoat
project (S.A.P. 056-604-014 & Etc.):

recessed for a short break. The meeting was reconvened at 11 :00 a.m.
Planning Commission Recommendations
Preliminary Plat -"Smith Estates". Smith Family Trust:
Motion by Rogness, second by Froemming, and unanimously carried to approve the Preliminary Plat titled
"Smith Estates" consisting of two single family residential lots. The proposal is located in Pt of GL 3
(2.06 AC), Section 5 of Rush Lake Township; Marion Lake (56-243), GD.
Conditional Use Permit Monica Kaiser {JL Crew LLC/Buyer/:
Motion by Johnson, second by Lindquist, and unanimously carried to approve a Conditional Use Permit to
construct an Event Center with conditions as recommended by the Planning Commission. The property is
described as Pt NW¼ SW¼ & pt NE¼ SW¼ pt of GL 4 & pt GL 5, 5.02 AC, Section 20 of Dunn Township;
Lake Lizzie (56-760), RD.
Conditional Use Permit -David & Sharon Ditch:
Motion by Froemming, second by Johnson, and unanimously carried to approve a Conditional Use Permit
to construct a house based on the revised plan received by the Land & Resource office on June 20, 2013.
The project is located in Klix Bay, Lot 3 Blk 1, Section 27 of Lida Township; Lake Lida (56-747), GD.
Conditional Use Permit -Stacy Montella:
Motion by Froemming, second by Johnson, and unanimously carried to approve a Conditional Use Permit
to operate a commercial business with a condition as recommended by the Planning Commission. The
proposal is located in Pt GL 7, Section 4 of Otter Tail Township; Otter Tail River (56-OTR), Transition.

Conditional Use Permit -Edna Township:
Motion by Johnson, second by Lindquist, and unanimously carried to approve a Conditional Use Permit to
rebuild a Township Road (Devils Lake Road) with a condition as recommended by the Planning
Commission. The project is located in the E½ NW¼ (Hanna), Part of Nedberg-Nye Survey Lots of GL 1, 2,
& 3 (Economon) & SE½ SE¼ & Lots 1, 2, & 3 ex Tracts (Ziegler), all in Section 1, Edna Township; Devils
Lake (56-245), GD.
Conditional Use Permit-Otter Tail County Highway Department:
Motion by Froemming, second by Rogness, and unanimously carried to approve a Conditional Use Permit
for S.A.P. 056-650-007, reconstruction of a portion of CSAH 50 and CSAH 67 North and South
connections as presented. The project located in the Shoreland Area: From Station 5+70 to 13+00,
totaling 730' (total project: 1.004 Miles of CSAH 67), located in Section 25 Leaf Lake Township & Section
30 of Deer Creek Township; East Leaf Lake (56-116), RD.
Conditional Use Permit -Michael Noesen:
Motion by Froemming, second by Johnson, and unanimously carried to approve a Conditional Use Permit
to remove existing beach house, retaining wall and house, and construct a new house with conditions as
recommended by the Planning Commission. The project is located in Pt GL 7 lying east of Co Hwy 41
(.50 ac), Section 32 of Dora Township; East Silent Lake (56-517), RD.
Sanitation Code Amendments
Motion by Johnson, second by Froemming and unanimously carried on a roll call vote, to approve the
Amendments to the Sanitation Code of Otter Tail County effective August 1, 2013. The Amendments to
the Sanitation Code include a Point of Sale Certification of Compliance under Compliance Criteria, 56.0060
Sub. 5, and some language clean up. A copy of the changes is on file at the Auditor's Office and the Office
of Land and Resource Management at the Government Services Center, and is also posted on the county
website, http://www.co.ottertail.mn.us/.
Final Plats
Geren Breck Addition:
Motion by Rogness, seconded by Lindquist, and unanimously carried to extend the proposed Final Plat
filing date for "Geren Breck Addition" to December 1 , 2013 subject to the Final Plat meeting current
ordinance(s) requirements.
Marion Ridge:
Motion by Froemming, second by Johnson, and unanimously carried to approve the Final Plat titled
"Marion Ridge" consisting of nine single family residential backlots located in Section 5 of Rush Lake
Township; Marion Lake (56-253). The Land & Resource Director indicated that the surveyor will file a plat
correction for a minor mathematical error on the plat.
Star Lake Improvement District
Motion by Johnson, second by Rogness, and unanimously carried to approve and authorize the
Chairman's signature to execute the "Order Establishing Star Lake Improvement District" as submitted by
the County Attorney. A copy of the complete Order is on file at the Auditor's Office at the Government
Services Center and is also posted on the Otter Tail County website, http://www.co.ottertail.mn.us/. The
LID is established thirty days after publication.
County Administrator Contract
Motion by Rogness, second by Lindquist, and unanimously carried to authorize the appropriate County
Officials' signatures to execute an Employment Contract between the County of Otter Tail and the County
Administrator as submitted.
