Fir Avenue, Fergus Falls, MN May 7, 2013 9:30 a.m. Call to Order The Otter Tail County Board of Commissioners convened Tuesday, May 7, 2013 at 9:30 a.m., at the Otter Tail County Government Services Center in Fergus Falls, MN, with Commissioners Doug Huebsch, Chair; Wayne Johnson, Vice-Chair; Roger Froemming, John Lindquist, and Lee Rogness present. Approval of Agenda Chairman Huebsch called for approval of the May 7, 2013 agenda. Motion by Froemming, second by Johnson, and unanimously carried to approve the Board of Commissioners agenda of May 7, 2013 as presented. Approval of Minutes Motion by Lindquist, second by Rogness, and unanimously carried to approve the April 23, 2013 Board of Commissioners meeting minutes as written. Motion by Rogness, second by Lindquist, and unanimously carried to approve the April 29, 2013 minutes of the Shoreland Management and Sanitation Ordinance Public Hearing as written. Approval to Pay Bills Motion by Froemming, second by Johnson, and unanimously carried to approve payment of the County Board bills per Attachment A of these minutes. U.S. Fish & Wildlife Service Wetland Easement USFWS Representatives appeared before the Board and requested certification of a small wetland easement that is needed to restore a nearby wetland of about 8 acres. Motion by Froemming, second by Johnson, and unanimously carried to approve certification for USFWS acquisition of the following wetland easement: Minnesota W.A.; Otter Tail Moen, Violet T.132N., R.39W., 5th P.M. Section 35, N½SW¼ Annual Prometheus M.C. Zoo Run On behalf of the Prometheus Motorcycle Club, Chuck Edner and Eric Marts requested approval for the 28th Annual Zoo Run event scheduled June 27th through June 30th of 2013. All proceeds of the motorcycle ride event are given to the Chahinkapa Park Zoo in Wahpeton, ND. Discussion took place regarding a loud noise complaint from last year. The Event Planners agreed to be respectful of the level of noise in the early morning hours. Motion by Rogness, second by Lindquist, and unanimously carried to authorize exemption to the OTC Shows and Exhibitions Ordinance for this charity event subject to providing security, adequate portable facilities and notification to law enforcement regarding the event which has been past practice. OTC Board of Commissioners' Minutes May 7, 2013 Page 2 Bid Award -Fergus Falls Transfer Station Mike Hanan, Solid Waste Director, explained that a leak was discovered during a pressure test on the waterline that feeds the sprinkler system at the Fergus Falls Transfer Station. He provided a bid summary document outlining the options for repair. Lengthy discussion took place about the options. Motion by Rogness, second by Johnson, and unanimously carried to award the Waterline Repair project to Delzer Construction of Fergus Falls, MN on a time and material basis not to exceed $36,709.00 with discretion for the repair work needed based on the location of the leak. Recess & Reconvene At 10:06 a.m., Chairman Huebsch declared the meeting of the Otter Tail County Board of Commissioners recessed for a short break. The meeting was reconvened at 10: 12 a.m. Treasurer's Office Staffing Motion by Rogness, second by Lindquist, and unanimously carried to authorize hiring a temporary employee to assist at tax time in May and again in October of 2013. Sheriff's Office Staffing Motion by Lindquist, second by Rogness, and unanimously carried to authorize hiring two part time Court Security Officers as recommended by the Sheriff. Boat and Water Grant Agreement Motion by Johnson, second by Froemming, and unanimously carried to authorize the appropriate County Officials' signatures to execute a 2013 Federal Boating Enforcement Supplemental Grant between the County of Otter Tail and the Minnesota DNR for additional patrol hours from May 10 -September 2, 2013. Conference Motion by Johnson, second by Lindquist, and unanimously carried to authorize the Commissioners to attend a Cultural Conference to build thriving communities at the University of Minnesota Morris on June 5th and 6th of 2013. Correspondence Acknowledged Chairman Huebsch reported that he received a certified letter from the EMS Regulatory Board regarding efforts by Allina Health to operate a statewide ambulance service. Motion by Rogness, second by Johnson, and unanimously carried to request Administration to talk with the local ambulance services on potential impact(s) of this proposal and report back to the County Board. Professional Services Agreement for Construction Manager Motion by Johnson, second by Rogness, and unanimously carried to authorize the appropriate County Officials' signatures to execute a Professional Services Agreement between the County of Otter Tail and Marland Hoff of Detroit Lakes, MN. Mr. Hoff will provide construction management services for the period of June 1, 2013 through July 31, 2014 at a rate of $55.00 per hour. Administration Staffing Motion by Rogness, second by Johnson, and unanimously carried to approve filling one temporary Receptionist position and one temporary HR Administrative Assistant position, as recommended by the County Administrator. The positions are approved from May through September of 2013. Hwy 22, Erhard, MN) On/Off Sale 3.2 Malt Liquor and On Sale Wine Renewal of Consumption & Display Permit Ye Olde School House Bar & Grill On/Off Sale 3.2 Malt Liquor 24028 Emery Drive Erhard, MN 56534 (The above applications are subject to approval of the County Attorney and County Sheriffs offices.) Sale of Property Motion by Rogness, second by Lindquist, and unanimously carried to authorize the Auditor to proceed with the process for sale of the following County owned property: · · Parcel 38-000-99-0808-000, Maine Township, Lot 1, Block 3 of Oakview Shores, 5.21 acre backlot Highway Contracts Motion by Johnson, second by Rogness, and unanimously carried to authorize the appropriate County Officials' signatures to execute a Contract between the County of Otter Tail and Wadena Asphalt, Inc. of Wadena, MN, for East Otter Tail County Seasonal Supply of Hot Mix Bituminous, subject to the approval of the County Attorney. Motion by Froemming, second by Lindquist, and unanimously carried to authorize the appropriate County Officials' signatures to execute a Contract between the County of Otter Tail and Tri-City Paving, Inc. of Little Falls, MN, for S.A.P. 056-673-006 on CSAH 73 from CSAH40 to TH 29, subject to the approval of the County Attorney. Motion by Johnson, second by Froemming, and unanimously carried to authorize the appropriate County Officials' signatures to execute a Contract between the County of Otter Tail and Mark Sand & Gravel Co. of Fergus Falls, MN, for S.A.P. 056-611-016 & Etc. on CSAH 11, 21, 31, and 32, subject to the approval of the County Attorney. Maintenance Cooperative Agreement Between Otter Tail County and MN DNR Central Lakes State Trail Maintenance Otter Tall County Resolution No. 2013 -39 Commissioner Johnson offered the following and moved its adoption: WHEREAS, pursuant to Minnesota Statutes 84.026 and 471.59, Subd. 10, the State is empowered to engage such assistance as deemed necessary and the State is in need of routine maintenance services on the Central Lakes Trail in Otter Tail County, and OTC Board of Commissioners' Minutes May 7, 2013 Page 4 WHEREAS, Otter Tail County is agreeable to provide the routine maintenance services as described in the Maintenance Cooperative Agreement for an annual rate of $1,100.00 per mile. BE IT RESOLVED, that Otter Tail County will provide the maintenance services as per the Maintenance Cooperative Agreement expiring December 31, 2013 at the annual rate of $1,100.00 per mile on the Central Lakes Trail. BE IT FURTHER RESOLVED, the County Board Chair and The County Board Clerk are hereby authorized and directed for and on behalf of the County of Otter Tail to execute and enter into an agreement with the MN Commissioner of Natural Resources prescribing the terms and conditions of same Maintenance Cooperative Agreement for the routine maintenance of the Central Lakes Trail expiring December 31, 2013. Commissioner Froemming seconded the motion and upon being put to a vote, the resolution was unanimously adopted. A letter of appreciation to thank the Club was also approved. Bid Award -CSAH 15 Culvert Replacements After advertising for bids for the CSAH 15 Culvert Replacements project, four quotations were received and opened on April 30, 2013. Motion by Johnson, second by Lindquist, and unanimously carried to award the CSAH 15 Culvert Replacements project to the low bidder, Landwehr Construction, Inc. of St. Cloud, MN, in the amount of $33,356.00 as recommended by the Highway Engineer. Ditch #70: OTC Board of Commissioners' Minutes May 7, 2013 Page 5 County Drainage Systems Discussion A letter from Gerhard Knutson with the work that has been completed towards a proposed improvement on Ditch #70 was submitted to the Board. Lengthy discussion took place regarding the signatures needed, funding, and elevation. The next important step in the process is whether the project will be an improvement or repair of the Ditch #70 drainage system. The Board will continue to be updated. Ditch #45: Kevin Fellbaum, Ditch Inspector, informed the Board that Dennis Behnke and Delvyn & Dean Hollatz, of Effington Township will be tiling into Ditch #45 with conditions as outlined in a document dated April 25, 2013. Ditch #41 & #65: Motion by Lindquist, second by Froemming, and unanimously carried to authorize the Ditch Inspector to hire Richard Carlund to trap beavers in Ditch #41 & #65 so that a newly built beaver dam can be removed. Ditch #16: Motion by Johnson, second by Rogness, and unanimously carried to authorize the Ditch Inspector to hire a contractor to remove sediment that has built up on the north side of the culvert near Al Mashik's home on North Clitherall Lake Road in County Ditch #16. Ditch #38: Motion by Johnson, second by Lindquist, and unanimously carried to authorize the Ditch Inspector to remove two culverts and reset the top culvert on Industrial Park Road East of New York Mills. The culvert is not at the depth of the original culvert and is holding back water. Ditch Viewers Training Course Mr. Fellbaum submitted a document dated April 16, 2013 from the Minnesota River Board (MRB) requesting $1,000 towards development of a Ditch Viewers Training Course. Motion by Rogness, second by Lindquist, and unanimously carried to contribute $1,000 to help Ridgewater College of Willmar, MN, develop a training course for proper techniques for ditch viewing. By committing funding to this program, Otter Tail County will have the opportunity to hire newly trained individuals for upcoming ditch redetermination projects.
