Fir Avenue, Fergus Falls, MN April 9, 2013 9:30 a.m. Call to Order The Otter Tail County Board of Commissioners convened Tuesday, April 9, 2013 at 9:30 a.m., at the Otter Tail County Government Services Center in Fergus Falls, MN, with Commissioners Doug Huebsch, Chair; Wayne Johnson, Vice-Chair; Roger Froemming, and Lee Rogness present. Commissioner John Lindquist was absent. Approval of Agenda Chairman Huebsch called for approval of the April 9, 2013 agenda. Motion by Johnson, second by Rogness, and unanimously carried to approve the Board of Commissioners agenda of April 9, 2013 with the following addition: Appointment to Planning Commission Approval of Minutes Motion by Froemming, second by Johnson, and unanimously carried to approve the April 2, 2013 Board of Commissioners meeting minutes as amended. Approval to Pay Bills Motion by Johnson, second by Rogness, and unanimously carried to approve payment of the County Board bills per Attachment A of these minutes. Planning Commission Appointment Motion by Johnson, second by Rogness, and unanimously carried to appoint Bernie Larson from Pelican Rapids to the Otter Tail County Planning Commission replacing the position held by Joe Maske. Commissioners expressed appreciation for Mr. Maske's past service to the County. Noxious Weed Appeal Committee Brad Mergens, WOTSWCD Manager, reported that the Soil & Water Conservation Districts and township officials have discussed the agriculture inspector's duties and townships' responsibilities regarding the State noxious weed law. Mr. Mergens presented recommendations for the Appeal Committee. OTC Board of Commissioners' Minutes April 9, 2013 Page 2 Upgrades to County Website Brian Armstrong, Land/Property Division Director, requested approval of a contract to facilitate the creation of CPI and live editing on the County website. Motion by Johnson, second by Rogness, and unanimously carried to authorize the appropriate County Officials' signatures to execute a contract between the County of Otter Tail and Houston Engineering, Inc. of Maple Grove, MN, for professional services as presented by Mr. Armstrong. Estimated contract cost is $26,000.00. Motion by Rogness, second by Johnson, and unanimously carried to authorize the appropriate County Officials' signatures to execute an agreement between the County of Otter Tail and Houston Engineering, Inc. for on-site FlashBuilder and Esri-Flex training for GIS staff at a cost of $5,427.00. New York Mills Improvements Motion by Rogness, second by Froemming, and unanimously carried to approve Change Order No. 2, in the amount of $10,818.65, payable to Comstock Construction, Inc. of Minnesota for work completed on Project Number 1113. Owner's Construction Representative Motion by Rogness, second by Johnson, and unanimously carried to authorize the appropriate County Officials' signatures to execute a Professional Service Agreement between the County of Otter Tail and Marland Hoff of Detroit Lakes, MN. Mr. Hoff will be Otter Tail County's representative during continued Courthouse remodeling and other County construction projects at an hourly rate of $55.00 per hour not to exceed 32 hours per week. License Renewal Motion by Johnson, second by Froemming, and unanimously carried to approve the following applications for license: BPOE Elks Lodge 1093 20970 Elks Point Road Fergus Falls, MN 56537 Campground Pub Heisler's Country Pub 31870 County Highway 130 Vergas, MN 56587 On-Sale Seasonal and Sunday Liquor Renewal of Consumption & Display Permit PREMISE PERMIT Otter Tail County Resolution No. 2013 -28 Commissioner Froemming offered the following and moved its adoption: WHEREAS, the responsibility for the regulation of lawful gambling and the issuance of licenses and permits for the conduct of lawful gambling lies with the Minnesota Gambling Control Board; and WHEREAS, the Underwood Area Lions Club, Underwood, MN, has made an application to the Gambling Control Board of the purpose of conducting lawful gambling at Zorbaz, located at 36108 County Highway 72 in Everts Township of Otter Tail County; and WHEREAS, Minnesota Statute 349.213 provides that the Gambling Control Board may not issue an initial premise permit unless they receive a resolution from the Otter Tail County Board of Commissioners approving the application for a permit; and OTC Board of Commissioners' Minutes April 9, 2013 Page 3 WHEREAS, the Otter Tail County Board of Commissioners is aware of no reason to oppose the conduct of lawful gambling by the Underwood Area Lions Club, Underwood, MN, at Zorbaz, located at 36108 County Highway 72 in Everts Township of Otter Tail County. NOW, THEREFORE, BE IT RESOLVED, that the Otter Tail County Board of Commissioners hereby approves the conduct of lawful gambling by the Underwood Area Lions Club, Underwood, MN, at Zorbaz located at 36108 County Highway 72 in Everts Township of Otter Tail County, provided the applicant meets all the necessary criteria for the licenses and permits as required by the Gambling Control Board. IT IS FURTHER RESOLVED, that notice of this application and approval shall be provided to the Township of Everts by sending them a copy of this resolution. Commissioner Johnson seconded the motion and upon being put to a vote, the motion was unanimously carried. Dated: _()_L/+/2'--"'·{p+/~f ,3~--OTTER TAIL COUNTY BOARD OF COMMISSIONERS Recess & Reconvene At 10:15 a.m., Chairman Huebsch declared the meeting of the Otter Tail County Board of Commissioners recessed for a short break. The meeting was reconvened at 10:25 a.m. Ag Advisory Committee Update Members of the Ag Advisory Committee and the Board discussed topics that are of interest for active farmers. Ag Committee members mentioned the impact of the Green Acres law, regulations related to water (potential buffer zones), animal agriculture, water resource as it relates to irrigation, and .·. conservation draining. They provided a handout from the National Resource Conservation Service announcing an Environmental Quality Incentive Program for farmers and indicated that the BRRWD will be a pilot district for best management practices. Homestead at Ottertail RV Park and Resort At 10:50 a.m., Bill Kalar, Land & Resource Director, briefed the Board regarding the mandatory Environmental Assessment Worksheet and associated comment period for the Homestead at Ottertail RV Park and Resort and submitted the following documentation: • Chronology-Homestead at Ottertail RV Park and Resort dated April 9, 2013 • Otter Tail County Assessor Value Per Frontage Foot for Years 2003-2013 • Summary-Timely Public And Agency Comments Received February 18, 2013 Through March 20, 2013 for the Environmental Assessment Worksheet for the project • Decision On Need For EIS (Environmental Impact Statement) Minnesota Rules 4410.1700 Mr. Kalar indicated that the decision before the County Board is whether or not an EIS is needed for the proposed Homestead at Ottertail RV Park project. The decision must be provided to the EQB (Environmental Quality Board) on or before April 19, 2013. David Hauser, County Attorney, reported that if the County Board determines that an EIS is not needed, a negative declaration will be prepared and if the County Board determines that an EIS is needed, a positive declaration will be prepared. If a positive .. declaration is made, the scope or specificity of the additional information needed will be identified. If the additional information can be obtained within thirty (30) days, the County Board may specify a delay of up to thirty (30) days. OTC Board of Commissioners' Minutes April 9, 2013 Page4 The sign-in sheet contained 36 signatures from members of the public. Several County Officials were present in addition to the County Board. There were 241 comments about the project received during the authorized comment period. There were 11 late comments received. Mr. Kalar showed a map of the proposed project area and described the area that lies within 1,000 ft. of Otter Tail Lake (shoreland area). He explained that the project requires a Conditional Use Permit for the complete property because a portion of the property is within the shoreland area. Due to the large number of comments received, a summary of the comments was prepared in the format of the EAW worksheet. The County Board considered each comment and indicated 1) if the comment was an environmental issue; 2) if the comment related to an environmental issue, would it be addressed and potentially mitigated in the Conditional Use Process; 3) if additional information is needed to address the comment; and 4) whether or not there is potential for significant environmental effects. Several members of the public spoke in opposition to the project due to density, impervious surface, run off, increased traffic, and concerns with use of the Wayside Rest. One member of the public spoke in favor of the project. None indicated that any additional information is needed. Based on the Commissioners discussions while reviewing the summary of EAW comments, the County Attorney stated that the Board will consider a negative declaration for an EIS for The Homestead on Ottertail RV Park and Resort at the next regular Board meeting. Recess & Reconvene At 1 :05 p.m., Chairman Huebsch declared the meeting of the Otter Tail County Board of Commissioners recessed for lunch break. The meeting was reconvened at 1 :32 p.m. Adult Mental Health Local Advisory Committee Luanne Hanson, representing the Adult MH LAC, briefed the Board regarding the LAC's activities. The LAC is a mandated council and 60% of the membership is filled by consumers and family members. In addition to the annual education/awareness events, the LAC continues to work on the jail/prison and affordable housing projects. MAY IS MENTAL HEALTH MONTH PROCLAMATION Otter Tail County Resolution No. 2013 -30 Commissioner Johnson offered the following and moved its adoption: WHEREAS, the U.S. Surgeon General states that mental health is fundamental to health and indispensable to personal well-being, family and interpersonal relationships, and contributes to community and society; and WHEREAS, the U.S. Surgeon General confirms that mental illness affects one in five Americans every year, regardless of age, gender, race, ethnicity, religion or economic status; and WHEREAS, the U.S. Surgeon General has found that a range of treatment exists for most mental disorders and the efficacy of mental health treatments are well documented; and WHEREAS, Otter Tail County has made a commitment to community-based systems of mental health care for all residents and has appointed Local Mental Health Advisory Committee for children and adults. WHEREAS, the guiding principles of community mental health care have always been comprehensiveness, cost-efficiency, effective management and high-quality and consumer responsive services, and these principles are now being adopted by private and public healthcare payers; and OTC Board of Commissioners' Minutes April 9, 2013 Page 5 WHEREAS, the National Mental Health Association, the National Council for Community Behavioral Healthcare and their national partners, the National Alliance for the Mentally Ill and their local affiliates observe Mental Health Month every May to raise awareness and understanding of mental health and illness; THEREFORE, we, The Otter Tail County Board of Commissioners, by virtue of the authority vested in us as County Commissioners of Otter Tail County, do hereby proclaim May 2013 Mental Health Month in Otter Tail County. As County Commissioners of Otter Tail County we call all citizens, government agencies, public and private institutions. business and schools to recommit our community to increasing awareness and understanding of mental illness and the need for appropriate and accessible services for all people with mental illness. Commissioner Rogness seconded the motion and the resolution was unanimously adopted. Family Services Collaborative Contract Motion by Froemming, second by Rogness, and unanimously carried to renew a contract between Otter Tail Family Services Collaborative and the County of Otter Tail through the Community Services Division for Local Collaborative Time Study (LCTS) funding subject to the approval of the County Attorney. Otter Tail County is the fiscal host and collects the funding for the collaborative. This motion authorizes the Community Services Director to sign the contract. Sheriff's Office Staffing Motion by Froemming, second by Rogness, and unanimously carried to approve the reinstatement or new hiring for six (6) part time Seasonal Water Patrol positions. Motion by Rogness, second by Johnson, and unanimously carried to approve replacement of two full time Corrections Officer positions. Motion by Rogness, second by Froemming, and unanimously carried to approve replacement of a full time Records Technician position in the Detention Facility. Motion by Rogness, second by Froemming, and unanimously carried to replace, due to retirement, a full time Deputy Sheriff position May 1, 2013. OTC Board of Commissioners' Minutes April 9, 2013 Page 6 Toward Zero Deaths (TZD) Tom Kummrow, representing Northwest Minnesota for the Department of Traffic Safety, serves as a liaison between local agencies and the State of Minnesota. He provided statistics regarding motor vehicle fatalities, impaired driving, and distracted driving and submitted a document entitled "Vehicle Accident Report" for CY2003 through 2012. Mr. Kummrow nominated the Otter Tail County Sheriffs Office for equipment and consequently, presented new radar equipment for new patrol cars to the Sheriff, Motion by Froemming, second by Johnson, and unanimously carried to thank Mr. Kummrow for his presentation and accept the radar equipment RESOLUTION SUPPORT FOR ADDITIONAL STATE TRANSPORTATION FUNDING Otter Tail County Resolution No. 2013 -29 Upon motion by Johnson, seconded by Rogness, and unanimously carried, the following resolution was adopted: WHEREAS: Minnesota Counties have had to rely increasingly on the local property tax to maintain our roads and bridges; and WHEREAS: the annual transportation funding gap for counties has resulted in deferring basic maintenance, delaying reconstruction projects with resulting safety concerns, mounting congestion and missed economic growth for business and commuters; and WHEREAS: rural road networks in the state should be adequate to safely and efficiently bring goods to market; and WHEREAS: transportation-related jobs put over $2.8 billion in the pockets of Minnesotans and generated almost $195 million in income tax revenue in 2011; and WHEREAS: according to the Federal Highway Administration, (FHWA) every $1 billion invested in highway construction would support approximately 27,800 jobs; and WHEREAS: the overall transportation and transit funding gap for Minnesota exceeds $2.1 billion dollars per year for the next twenty years; and WHEREAS: transportation funding comes primarily from user fees and are constitutionally dedicated to transportation purposes; and WHEREAS: the wheelage fee and local option sales tax for transportation should be options for all county boards to implement to meet their specific county needs; and WHEREAS: a comprehensive transportation solution should include funding for roads, bridges and transit, and address the varying needs in different parts of the state; NOT THERFORE BE IT RESOLVED THAT: the Otter Tail County Board of Commissioners encourages the Minnesota Legislature to pass and the Governor to sign a bill that brings adequate funding to Minnesota's statewide transportation system. County Ditch # 18 & #3 7: Motion by Rogness, second by Johnson, and unanimously carried to establish a Public Informational Meeting for County Ditch# 18 and #37 for Monday, July 22, 2013 at 7:00 p.m. at the Government Services Center in Fergus Falls to discuss the potential to combine the two ditches. Animal Control Ordinance Diane Thorson, Public Health Director, reported that the Otter Tail County Animal Control Ordinance needs to be updated. Discussion followed.
