Fir Avenue, Fergus Falls, MN January 29, 2013 9:30 a.m. Call to Order The Otter Tail County Board of Commissioners convened Tuesday, January 29, 2013 at 9:33 a.m., at the Otter Tail County Government Services Center in Fergus Falls, MN, with Commissioners Doug Huebsch, Chairman; Wayne Johnson, Vice-Chair; Roger Froemming, John Lindquist, and Lee Rogness present. Approval of Agenda Chairman Huebsch called for approval of the January 29, 2013 agenda. Motion by Froemming, second by Johnson, and unanimously carried to approve the Board of Commissioners agenda of January 29, 2013 with the following change: • Canceled BRRWD Discussion Approval of Minutes Motion by Rogness, second by Froemming, and unanimously carried to approve the January 22, 2013 Board of Commissioners meeting minutes as written. Approval to Pay Bills Motion by Johnson, second by Rogness, and unanimously carried to approve payment of the County Board bills per·Attachment A of these minutes. MNDOT DETOUR ROUTE FOR WORK ON T.H. 78 Otter Tail County Resolution No. 2013 -14 IT IS RESOLVED that Otter Tail County enter into Mn/DOT Agreement No. 02397 with the State of Minnesota, Department of Transportation for the following purposes: To provide for payment by the State to the County for the use of County State Aid Highway 52 and County State Aid Highway 67 as a detour route during contract construction to be performed upon, along and adjacent to Trunk Highway No. 78 from R.P. 21.54 to R.P. 47.26 under State Project No. 5621-23 (T.H. 78). IT IS FURTHER RESOLVED that the County Board Chair and the County Board Clerk are authorized to execute the Agreement and any amendments to the Agreement. Upon a motion by Commissioner Rogness and seconded by Commissioner Froemming, the Otter Tail County Board of Commissioners adopts the foregoing resolution by a unanimous vote: Adopted this 29th day of January, 2013 Dated: 1 /2J, /,.3 Attest: ~ ;f£J LarryKohn, Clerk OTC Board of Commissioners' Minutes January 29, 2013 Page 2 Highway Department Seasonal Staff Motion by Rogness, second by Lindquist, and unanimously carried to authorize hiring three seasonal Engineering Aide or Technicians and two seasonal Sign Workers for the CY2013-2014 highway construction season as recommended by the Public Works Director. Lake Assessments Update Darren Newville, EOTSWCD Manager, briefed the County Board regarding Lake Assessments that have been completed in Otter Tail County and additional Assessments planned for 2014. He submitted two documents entitled "Otter Tail County Lakes Assessment -2012" and a County Water Quality Factsheet for Lake Seven (56-358). Lengthy discussion took place regarding the data and how the data will be used. Mr. Newville indicated that the lakes are maintaining water quality and efforts will revolve around protection. He indicated that the MPCA plans to do an Otter Tail River Assessment beginning in 2016 which will be a three year process. Mr. Newville also briefed the Board on the SWCD's Adaptive Ag program and explained how this is assisting producers with nitrogen management. LEAN Training Discussion took place regarding the Association of Minnesota Counties LEAN "Train the Trainer" program. Classes are available in February and April of 2013. Motion by Johnson, seconded by Rogness, and unanimously carried to fund the LEAN training. The County Administrator indicated that this will be discussed at the next Division Leader meeting. Request for Forgiveness of Taxes and Penalty Wayne Stein presented a letter from Rich Scarlato requesting forgiveness of taxes in the amount of $486.00 plus penalty and interest. The taxes from 2007 are a result of a classification situation during transfer of property. Motion by Froemming, second by Rogness, and unanimously carried to regretfully deny the request for forgiveness of tax and penalty for property at 38433 Eagle Lake Road S, Battle Lake, MN (parcel no. 18000990422000). Real Estate taxes are a lien against the property not the home owner. Tobacco License Applications Motion by Lindquist, second by Froemming, and unanimously carried to approve the following applications for license: The Otter Supper Club & Lodge 306 N Highway 78, PO Box 268 Ottertail, MN 56571 Dalton Municipal Liquor Store 104 Sunset Dr. Dalton, MN 56324 OSHA 300 Report Tobacco Tobacco Motion by Froemming, second by Rogness, and unanimously carried to authorize the Risk Management Coordinator to sign the CY2012 OSHA 300A Form which is a required summary of work related injuries and illnesses. The motion authorizes the signature of the Risk Management Coordinator in subsequent years. The form will be posted as required by federal law. 60-Bed CD Facility Consultant Motion by Rogness, second by Froemming, and unanimously carried to approve continued engineering consulting work by Mcfarlane Consulting, LLC to assist the County through .the 60-Bed CD Facility litigation. The original agreement of work not to exceed $5,000.00 has been completed. OTC Board of Commissioners' Minutes January 29, 2013 Page 3 Labor Agreements Approved Motion by Rogness, second by Johnson, and unanimously carried to authorize the appropriate County Officials' signatures to execute the following Labor Agreements between the County of Otter Tail and the Teamsters local 320 (rengel file no. 2012-3713): Human Services Support Specialists & Public January 1, 2013 through December 31, 2015 Health Staff Human Services Professional Unit (Social Workers\ Januarv 1, 2013 throuah December 31, 2015 Public Health Professional Unit of Nurses Januarv 1, 2013 throuah December 31, 2015 Facilities Maintenance Employees January 1, 2013 throusih December 31, 2015 Planning Commission Reappointment Motion by Froemming, second by Johnson, and unanimously carried to reappoint Marion Gill of Perham, MN to the Otter Tail County Planning Commission effective January 1, 2013 for a three year term. Upcoming Meetings Commissioners Rogness, Huebsch, and Johnson plan to attend the Economic Development Committee meeting on February 25, 2013 at Lakes Country Service Cooperative. Commissioners Lindquist and Froemming plan to attend the annual Lakeland Mental Health Center meeting February 25, 2013.
