Fir Avenue, Fergus Falls, MN January 15, 2013 9:30 a.m. Call to Order The Otter Tail County Board of Commissioners convened Tuesday, January 15, 2013 at 9:34 a.m., at the Otter Tail County Government Services Center in Fergus Falls, MN, with Commissioners Doug Huebsch, Chairman; Wayne Johnson, Vice-Chair; Roger Froemming and John Lindquist present. Commissioner Lee Rogness was absent. Approval of Agenda Chairman Huebsch called for approval of the January 15, 2013 agenda. Motion by Johnson, second by Froemming, and unanimously carried to approve the Board of Commissioners agenda of January 15, 2013 with the following amendments: • Add County Auditor Requests • Under Land & Resource Agenda Item: add AIS Delegation Agreement and Miscellaneous Approval of Minutes Motion by Johnson, second by Lindquist, and unanimously carried to approve the January 8, 2013 Board of Commissioners meeting minutes as written. Approval to Pay Bills .,, Motion by Lindquist, second by Froemming, and unanimously carried to approve payment of the County Board bills per Attachment A of these minutes. National Association of Minnesota Counties {NACOi Update Joe Vene, 2013 AMC President and Kay Braaten, past President of NACO, briefed the County Board regarding the benefits of NACO. They provided several handouts showing their 2013 legislative priorities including rural development, renewable energy, immigration reform, opposition to federal mandates, support of federal land revenue sharing programs, and support of the Farm Bill. Ms. Braaten discussed the benefits of NACO especially the value of the NACO website and the education it provides. She indicated that the current NACO President comes from a rural setting and is sensitive to rural issues. They stated that NACO's voice is heard at the federal legislative level with 3,068 counties in the United States. Commissioners indicated that NACO can help with lobbying for increased funding for Payment in Lieu of Taxes (PIL T) program, support for reworking the Farm Bill to preserve rural America, and opposition to reduction in the federal highway bill to reduce 10% funding for rural roads. Affordability Care Act Update John Dinsmore, Community Services Director, submitted a document entitled "Minnesota's Health Insurance Exchange -Implementing the Requirements of the Affordable Care Act". He briefed the Board and provided recommended educational resources on the development of health insurance exchanges. Mr. Dinsmore included a map showing the states developing their own health exchanges and the states that will go to the federal government for their health exchange. Mr. Dinsmore discussed.the impact in the public sector starting October of 2013 when residents will apply for their health care by computer through the State health exchange instead of visiting County Human Service offices. OTC Board of Commissioners' Minutes January 15, 2013 Page 2 Recess & Reconvene At 10:16 a.m., Chairman Huebsch declared the meeting of the Otter Tail County Board of Commissioners recessed for a short break. The meeting was reconvened at 10:28 a.m. Red River Basin Commission Conference Motion by Froemming, second by Johnson, and unanimously carried to authorize and pay expenses for either a Commissioner or Otter Tail County Resident to attend the Red River Basin Commission Annual Conference January 22nd through the January 24th at the Alerus Center in Grand Forks, ND. Sheriff's Office Staffing Motion by Lindquist, second by Froemming, and unanimously carried to approve hiring a full time Corrections/Bailiff Officer to replace a current vacancy and establish an eligibility list for future hires. Motion by Froemming, second by Lindquist, and unanimously carried to approve hiring a part time Dispatcher to replace a current vacancy and establish an eligibility list for future hires. Motion by Johnson, second by Froemming, and unanimously carried to hire a part time Court Security Officer to accommodate an updated security process at the Courthouse. High Speed Internet Discussion Commissioner Johnson presented the need to create a Task Force to look at countywide high speed internet service which would create economic development and potentially keep the dollars for the service local. Lengthy discussion took place regarding membership for the Task Force and the need to research how other counties/entities have accomplished this goal. Commissioners requested that the County Administrator collaborate with Lake Region Community Partners on this topic. Tobacco License Applications Motion by Froemming, second by Johnson, and unanimously carried to approve the following applications for tobacco license: Dalton Corner Store 101 West Main St. Tobacco Dalton, MN 56324 Lakes Area Cooperative -Battle Lake Lakes Area Cooperative -Ottertail Oasis 36879 Highway 210 W. 245 N. Highway 78 Tobacco Battle Lake, MN 56515 Ottertail, MN 56571 Lakes Area Cooperative-Perham Oasis Lakes Area Cooperative -Dent Oasis 43937 Fort Thunder Road 112 Main St. Tobacco Perham, MN 56573 Dent, MN 56528 Application for Exempt Permit Motion by Froemming, second by Huebsch, and unanimously carried to approve, with no waiting period, the LG220 Application for Exempt Permit as submitted by the Minnesota Deer Hunters Association -EQT Chapter for an event scheduled for Friday, April 5, 2013 at Whiskey River located at 43974 390th St, Perham, MN. Payment Approval Motion by Johnson, second by Lindquist, and unanimously carried to approve payment, in the amount of $553.24, to the Otter Tail County Highway Department from the Capital Improvement Fund for construction engineering services related to the Phelps Mill Park restroom project. - OTC Board of Commissioners' Minutes January 15, 2013 Page 3 Planning Commission Recommendations Preliminary Plat "Lonesome Dove'1/James & Pamela Haugen: Bill Kalar, Land & Resource Administrator, reported that the Planning Commission recommended approval of a Preliminary Plat entitled "Lonesome Dove" consisting of 10 single family residential lots on Jolly Ann Lake. The recommendation included a condition regarding the location of sewage systems. Motion by Johnson and second by Froemming to approve the Preliminary Plat owned by Jim Haugen known as "Lonesome Dove" as recommended by the Planning Commission. Les Bensch, owner of property on the East side of Jolly Ann Lake spoke against the proposal because Jolly Ann Lake is a natural environment lake with very sensitive shoreline in this proposed development area. He stated that this area is not compatible with the surrounding environment; the number of lots should be reduced and project is detrimental to the lake. Jason Lina, Attorney for Paul and Allen Brutlag, referred to a decision in 2008 when 11 lots in this area were denied with clearly stated reasons. He indicated that when the road was constructed to serve the plat, there was an understanding that the lots would be 5 acre lots. Mr. Lina requested that the County Board send this request back to the Planning Commission. Mr. Kalar discussed the situation with the indicated locations of the sewage systems. The owner indicated that the Sewage System Designer will work with the Land & Resource Office to confirm the exact locations of the septic systems. If land space is not adequate, 2 lots will need to be changed to 1 lot. Chairman Huebsch called for a vote on the motion. Motion carried with Huebsch, Johnson, and Froemming voting in favor, Lindquist abstaining, and Rogness absent. Central Minnesota Emergency Services Board Motion by Johnson, second by Lindquist, and unanimously carried to reappoint the County's membership on the CM ESB User Committee as presented. Conditional Use Permit Request-Thomas & Pauline Parish Motion by Johnson, second by Froemming, and unanimously carried to confirm that the Thomas & Pauline Parish Conditional Use Permit request will be tabled until the April Planning Commission meeting. A letter has been received from the applicants (owners) agreeing to table the request until April. This project is located in Section 28 of Girard Township on West Battle Lake (56-239). Aquatic Invasive Species (AISl Prevention Motion by Lindquist, second by Froemming, and unanimously carried to authorize the appropriate County Officials' signatures to execute the AIS Prevention Inspection of Water-related Equipment Delegation Agreement between the County of Otter Tail and the MN Department of Natural Resources. The 2013 reimbursement grant request is $7,750.00.
