Call to Order
The Otter Tail County Board of Commissioners convened Tuesday, September 18, 2012 at 9:30 a.m., at
the Otter Tail County Government Services Center in Fergus Falls, MN, with Commissioners Lee Rogness,
Chairman; Doug Huebsch, Vice-Chair; Wayne Johnson, John Lindquist, and Roger Froemming present.
Approval of Agenda
Chairman Rogness called for approval of the September 18, 2012 agenda. Motion by Lindquist, second by
Froemming, and unanimously carried to approve the Board of Commissioners agenda of September 18,
2012 with the following addition:
General Discussion -Bois De Sioux Watershed District
Approval of Minutes
Motion by Johnson, second by Froemming, and unanimously carried to approve the September 11, 2012
Board of Commissioners meeting minutes as presented.
Approval to Pay Bills
Motion by Lindquist, second by Huebsch, and unanimously carried to approve payment of the County
Board bills per Attachment A of these minutes.
Classification/Compensation Plan Presentation
Mike Verdoorn, Fox Lawson & Associates Consultant, provided a power point presentation entitled "Otter
Tail County Classification and Compensation Study Final Report" dated September 18, 2012. He provided
background information on the process and briefed the Board on the following phases of the project:
1) Study Initiation and Administration, 2) Job Analysis & Classification, 3) Job Evaluation,
4) Compensation, and 5) Final Report. Discussion followed regarding the decision band methodology and
timeframe and process for employees to receive classification information. David Hauser, County
Attorney, indicated that the Board has several decisions to make in the process including: 1) affirmative or
not affirmative to adopt the decision band method for classification, 2) if affirmative, does the Board wish to
adopt a pay plan for the non-union group, 3) look at positions that are under or over the proposed pay plan,
and 4) implementation. No action was taken. The County Administrator will return to the Board with
updates.
Veterans Service Officer
Bernie Gamber, VSO, submitted a letter requesting not to be reappointed for the County's VSO position.
Commissioners accepted the letter and thanked Mr. Gamber for his service to Otter Tail County and
County veterans.
Recess & Reconvene
At 10:45 a.m., Chair Rogness declared the meeting of the Otter Tail County Board of Commissioners
recessed for a short break. The meeting was reconvened at 10:55 a.m.

Bois de Sioux Watershed District
Commissioner John Lindquist briefed Board members regarding a potential immediate solution for the
Rabbit River flooding. Motion by Lindquist, second by Huebsch, and unanimously carried to pursue a
practical solution with the Bois de Sioux WO for the Rabbit River fiooding in consultation with the County
Attorney and the Chair of the Wilkin County Board of Commissioners. The practical, less expensive
proposal is likely to help the situation and the proposed impoundment can still be completed if the interim
proposal is not sufficient.
Planning Commission Recommendations
Conditional Use Permit -Mark Fens/ad/Roger Fens/ad:
Motion by Huebsch, second by Lindquist, and unanimously carried to approve a Conditional Use Permit for
topographical alterations as submitted on the revised drawing (including the erosion control plan) dated
August 23, 2012. The proposal is located in Engstrom Beach Fifth Addition Lot 14 Blk 1, Section 18 of
Edna Township; Big McDonald Lake (56-386), RD.
Prelimina!V Plat-"Marion Ridge'1/Lasalle Street Services, LLC:
Motion by Huebsch, second by Johnson, and unanimously carried to approve the Preliminary Plat known
as "Marion Ridge" consisting of 9 single family residential back lots. The property is described as Parcel
14B AKA pt GL 3 & 4 and pt NW¼ SE¼ (15.59 AC), Section 5 of Rush Lake Township, Marion Lake
(56-243), GD.
Conditional Use Permit William & Karen Rohrich and Grego!V & Pam Fordyce:
Motion by Huebsch, second by Johnson, and unanimously carried to approve a Conditional Use Permit to
bring the lot up approximately 2' with washed sand and install driveway to building site with conditions as
recommended by the Planning Commission. The project is located in Nedberg Nye Survey Lots called
Lot 1 & Nedberg Nye Survey Lots GL 1, 2 & 3 on lake frt (called Lot #12) and Nedberg Nye Survey Lots
GL 1, 2 & 3 no lk ft (called Lot #110), Section 1 of Edna Township; Devils Lake (56-245), GD.
Conditional Use Permit -Church of Jesus Christ and Mike & Laural Blaskowski !Cutler's Cottages):
A motion was offered by Johnson and seconded by Froemming to approve a Conditional Use Permit to
allow operation of a resort with 3 cabins with conditions as recommended by the Planning Commission.
Neighbor, Jim Eitzen expressed trespass concerns. Discussion took place. Commissioners encouraged
Mr. Eitzen to pursue a solution with his neighbor regarding installation of a fence between the properties.
The Chairman called for a vote on the motion. Motion carried unanimously.
Land & Resource Management Items
Bill Kalar, Land & Resource Administrator, updated the Board regarding membership of the AIS Task
Force.
Mr. Kalar submitted a letter from Donald Rudnick requesting waiver of the Site Permit fee. Commissioners
expressed empathy for Mr. Rudnick's situation and suggested that he may wish to pursue removal of the
culvert that is not operating instead of raising the cabin; however, waiver of the Site Permit fee may not be
appropriate. Motion by Lindquist, second by Huebsch, and unanimously carried to deny the Site Permit
fee waiver as requested.
Closed to the Public
At 11:43 a.m., Chairman Rogness declared the Board of Commissioners meeting closed to the public for
purposes of discussing labor negotiation strategies regarding the Human Services, Nurses, and Facilities
Maintenance unions. Present were all five seated Commissioners, County Attorney, County Administrator,
and Board Secretary.

Recess & Reconvene
At 12:05 p.m., Chair Rogness declared the meeting of the Otter Tail County Board of Commissioners
recessed for lunch break. The meeting was reconvened at 1:10 p.m.
Management Representation Letter
Motion by Huebsch, second by Johnson, and unanimously carried to authorize the Board Chair, County
Administrator, and County Auditor to sign the Management Representation Letter for the audit of the
December 31, 2011 year-end financial statements.
Payment Approvals
Motion by Froemming, second by Lindquist, and unanimously carried to approve payment of the following
costs incurred under the provision of Minnesota Statutes 609.35:

Motion by Johnson, second by Lindquist and unanimously carried to authorize Otter Tail County to hire a
Negotiator for labor/union contract negotiations for those contracts ending December 31, 2012. The
motion includes that this decision is on a trial basis to gain outside perspective for negotiations, save staff
time, and coincides with a new negotiator representing the unions.
Construction Remodel Change Orders
Motion by Johnson, second by Froemming, and unanimously carried to approve Change Order No. 1 for
the New York Mills Improvements general construction (Project No. 1113). This decreased amount of
($40,080.29) is due to some deletions of expected work.
Motion by Johnson, second by Huebsch, and unanimously carried to approve Change Order No. 1 for the
Otter Tail County Courthouse Remodeling Phase I Project (No. 1119), in the amount of $10,146.41 and
Change Order No. 2, in the amount of $51,729.21, payable to Comstock Construction, Inc. of Fergus Falls,
MN. A brief Courthouse Project update was provided to the Board. Timeline for completion of the Phase I
portion of the project is February of 2013.
Public Health Department Contracts
Motion by Huebsch, second by Lindquist, and unanimously carried to authorize the appropriate County
Officials' signatures to execute the following Public Health contracts:
• Family Home Visiting contract with the MN Department of Health for expenses related to Nurse
Family Partnership for training and fees, in the amount of $30,918.00, to the National Service
Office; and .
Nurse Family Partnersh_ip National Service Office for support, training, and data system for the next
three year period; and . . . .
Becker County Human Services for shared staffing for the NFP.
• Childhood Immunization contract with MN Department of Health for Perinatal Hepatitis B Case
Management with reimbursement based upon the various tasks and number of referrals during the
contract period.
• Early Hearing Detection and Intervention and Birth Defects Case Management with the MN
Department of Health. Reimbursement is case by case and depends on the number of referrals
during the contract period.

Easement for Construction and Maintenance of Water Control Structure
Don Schultz, MN DNR Area Wildlife Supervisor, presented several documents and requested approval to
purchase an easement to install a water control structure at the outlet of Mud Lake. The project would
improve and maintain the lake as a valuable wildlife migratory feeding and resting area. Motion by
Lindquist, second by Johnson, and unanimously carried to approve purchase of the following easement as
part of a plan to manage water levels on Mud Lake to improve water quality and wildlife habitat through
temporary draw downs and controlling undesirable fish populations:

• The area encompasses approximately 26 acres and is described as Government Lot 5, Section 23,

County Ditch #70
Rick West, Interim Ditch Inspector, opened discussion regarding potential repairs or improvements to be
recommended for Ditch #70. He submitted a document dated September 17, 2012 from Gerhard Knutson
which indicated an intention to file a petition for improvement after harvest is complete. Discussion
followed. Motion by Huebsch, second by Johnson, and unanimously carried to direct the Interim Ditch
Inspector to return to the Board by October 16, 2012, with cost estimates for repair of Ditch #70 as
originally constructed with the estimates/quotations including completion of the project this fall and an
alternate estimate for completion next spring.
Bid Award -S.P. 056-090-011
After previously advertising and re-bidding for S.P. 056-090-011, bids were opened as follows:

Mark Sand & Gravel Co.
$329,233.47
$378,369.00
Motion by Huebsch, second by Johnson, and carried with Lindquist opposed, to award the CSAH 16 Multi
Use Trail project to the low bidder, Central Specialties, Inc. at a bid amount of $329,233.47. This bid
award will maximize the amount of federal and state funding available for the trail project.
Adjournment
At 2:54 p.m., Chairman Rogness declared the meeting of the Otter Tail County Board of Commissioners
adjourned until 9:30 a.m. on Tuesday, September 25, 2012, at the Perham City Hall.
