Call to Order
The Otter Tail County Board of Commissioners convened Tuesday, September 11, 2012 at 9:30 a.m., at
the Otter Tail County Government Services Center in Fergus Falls, MN, with Commissioners Lee Rogness,
Chairman; Doug Huebsch, Vice-Chair; Wayne Johnson, John Lindquist, and Roger Froemming present.
Approval of Agenda
Chairman Rogness called for approva1·of the September 11, 2012 agenda. Motion by Froemming, second
by Johnson, and unanimously carried to approve the Board of Commissioners agenda of September 11,
2012 with the following addition:

Approval of Minutes
Motion by Johnson, second by Huebsch, and unanimously carried to approve the September 4, 2012
Board of Commissioners meeting minutes as amended.
Approval to Pay Bills
Motion by Lindquist, second by Johnson, and unanimously carried to approve payment of the County
Board bills per Attachment A of these minutes.
Approval to Pay Bills & Claims
Motion by Johnson, second by Huebsch, and unanimously carried to approve payment of the Human
Services bills and claims as presented.
Order Establishing Marion Lake Improvement District
David Hauser, County Attorney, presented a draft Order to establish the Marion Lake Improvement District
(LID). He reviewed the draft Order and discussion followed. Motion by Johnson, second by Huebsch, and
unanimously carried to adopt the Order Establishing Marion Lake Improvement District as amended and
attached to these minutes (identified as Attachment B) .

NATIONAL·PREPAREDNESS MONTH, SEPTEMBER 2012
OTTER TAIL COUNTY RESOLUTION NO. 2012 -51
Commissioner Johnson offered the foll9wing and moved its adoption:
WHEREAS, "National Preparedness Month" creates an important opportunity for every resident of Otter
Tail County to prepare their homes, businesses, and communities for any type of emergency including
natural, biological, technological, and human made disasters; and
WHEREAS, investing in the preparedness of ourselves, our families, businesses, and communities can
reduce fatalities and economic devastation in our communities and in our nation; and
WHEREAS, the Federal Emergency Management Agency's Ready Campaign and other federal, state,
local, tribal, territorial, private, and volunteer agencies are working to increase public activities in preparing
for emergencies and to educate individuals on how to take action; and

WHEREAS, emergency preparedness is the responsibility of every citizen of Otter Tail County and all
citizens are urged to make preparedness a priority and work together, as a team, to ensure that
individuals, families, and communities are prepared for disasters and emergencies of any type; and
THEREFORE, BE IT RESOLVED that the Otter Tail County Board of Commissioners hereby proclaims
September 2012 as National Preparedness Month, and encourages all citizens and businesses to develop
their own emergency preparedness plan, and work together toward creating a more prepared society.
Commissioner Lindquist seconded the motion and upon being put to vote, the resolution was unanimously
adopted.

RESOLUTION AUTHORIZING EXECUTION OF AGREEMENT
Otter Tail County Resolution No. 2012 -50
Commissioner Froemming offered the following and moved its adoption:
BE IT RESOLVED that the Otter Tail County Sheriffs Office enters into a grant agreement with the
Minnesota Department of Public Safety for traffic safety enforcement projects during the period from
October 1, 2012 through September 30, 2014.
Sheriff, Brian Schlueter is hereby authorized to execute such agreements and amendments as are
necessary to implement the project on behalf of the Otter Tail County Sheriffs Office and to be the fiscal
agent and administer the grant.
Commissioner Huebsch seconded the motion and upon being put to vote, the resolution was unanimously
adopted this 11 th day of September 2012.

Canvassing Board Date Established
November 13. 2012 Board of Commissioners' Meeting Cancelled
Motion by Froemming, second by Huebsch, and unanimously carried to canvass the Tuesday, November
6, 2012 State General Election at 9:30 a.m. on Tuesday, November 13, 2012 and to cancel the regular
November 13, 2012 Board of Commissioners meeting. This motion also authorizes Commissioners to
attend the annual Minnesota Agri-Growth Conference at the Minneapolis Convention Center on
November 13th.

Canvassing Board Appointments
Motion by Lindquist, second by Huebsch, and unanimously carried to appoint Commissioner Froemming
and Commissioner Johnson to the Otter Tail County Canvassing Board for the Tuesday, November 6,
2012 State General Election.
Budget & Levy Public Hearing
Motion by Johnson, second by Huebsch, and unanimously carried to set the Budget and Levy Public
Hearing at 6:00 p.m. on Wednesday, December 5, 2012 and to add December 5, 2012 at 6:00 p.m. as a
regular Board of Commissioners meeting.

WHEREAS, on or before September 15, 2012, Otter Tail County must adopt a Proposed Budget for
Fiscal/Calendar Year 2013 and must adopt and certify a proposed net property tax levy for Payable Year
2013,and
WHEREAS, the Otter Tail County Auditor's office has accumulated the departmental and outside agency
requests, and
WHEREAS, the Otter Tail County Budget Committee has met to discuss and review in general terms levy
and budgetary guidelines, as well as the proposed department budgets and various agency requests, and
WHEREAS, the Otter Tail County Budget Committee and Capital Improvement Committee will complete
additional review and discussion, as needed and required, of the 2013 proposed tax levy and budget prior
to final adoption in December of 2012,
NOW, THEREFORE, BE IT RESOLVED, by the Otter Tail County Board of Commissioners of Otter Tail
County, Minnesota, that
The amount of $34,007,967 be adopted as Otter Tail County's Proposed Gross Property Tax Levy for the
Payable Year 2013 representing a 5.05% increase from the Gross Property Tax Levy for the Payable Year
2012, and that the amount of $32,372,925 be adopted as Otter Tail County's Proposed Net Property Tax
Levy for the Payable Year 2013 representing a 4.04% increase over the Net Property Tax Levy for the
Payable Year 2012, and that
The amount of $253,150 be adopted by Otter Tail County as the Proposed Lake Improvement District
Property Tax Levies for the Payable Year 2013, representing a 6.3% increase from the Lake Improvement
District Property Tax Levies as adopted by Otter Tail County for the Payable Year 2012, and that
The amount of $416,000 be adopted by Otter Tail County as the Proposed Otter Tail County HRA Special
District Property Tax Levy for the Payable Year 2013, representing no change from the Property Tax Levy
as adopted by Otter Tail County for the Payable Year 2012.
BE IT FURTHER RESOLVED, that the amount of $71,400,000 be adopted as Otter Tail County's
Proposed Budget for the General Fund, for the Budgeted Special Revenue Funds and for the Budgeted
Debt Service Funds for the Fiscal/Calendar Year 2013 (Expenditures/Transfers/Other Uses).
Commissioner Johnson seconded the motion and upon being put to vote, the resolution was unanimously
adopted this 11 th day of September 2012.

For Agreement to State Transportation Fund (Bridge Bonds)
Grant Terms and Conditions
SP 056-672-004
Otter Tail County Resolution No. 2012 -53
Commissioner Johnson offered the following resolution:
WHEREAS, Otter Tail County has applied to the Commissioner of Transportation for a grant from the
Minnesota State Transportation Fund for construction of Bridge No. 56538; and
WHEREAS, the Commissioner of Transportation has given notice that funding for this bridge is available;
and
WHEREAS, the amount of the grant has been determined to be $232,203.50 by reason of the lowest
responsible bid;
NOW THEREFORE, be it resolved that Otter Tail County does hereby agree to the terms and conditions of
the grant consistent with Minnesota Statutes, section 174.50, subdivision 5, clause (3), and will pay any
additional amount by which the cost exceeds the estimate, and will return to the Minnesota State
Transportation Fund any amount appropriated for the bridge but not required. The proper county officers
are authorized to execute a grant agreement with the Commissioner of Transportation concerning the
above-referenced grant.
BE IT FURTHER RESOLVED, that whereas federal-aid funds are being used to participate in the cost of
the bridge, the Minnesota State Transportation Fund grant shall be deposited directly into the federal-aid
agency account and that the records of the County shall so state.
Commissioner Lindquist seconded the motion and, upon being put to vote, the resolution was unanimously
adopted.
Adopted at Fergus Falls, Minnesota, this 11 th.day of September, 2012.

County Ditch #17: .
Motion by Huebsch, second by Froemming, and unanimously carried to authorize'Ron Ehnert.(land owner)
to proceed with repair to clean out Branch 5 of Ditch #17 to its original construction. This project is located
north of CH 58 and east of 507'" Avenue. Cost of the repairs will be paid by the local farmers/property
owners.

County Ditch #45:
Motion by Froemming, second by Lindquist, and unanimously carried to authorize the land owner,
Glen Kramer, to clean out part of the main ditch of County Ditch #45 from State Highway 235 to Fish Lake
and after that work is complete, clean out Branch 11 of Ditch #45 from S.H. 235 to the Main Ditch. The
land owner will hire a contractor to complete the work and is responsible for the co~t of the project.
Amendment to S.P. 5607-42
Motion by Huebsch, second by Johnson, and unanimously carried to approve Amendment No. 1 (MnDOT
Contract no. 00774-1) to the original agreement for SAP 056-634-010 between the State of Minnesota
Department of Transportation and the County of Otter Tail, to fund the right of way acquisition process.
Lake Elevations Update
Mr. West submitted lake elevations from 2006 through 2012 for several pumping projects that continue to
be monitored.
Order and Findings for Dog Bite Hearing
Motion by Froemming, second by Lindquist, and unanimously carried to authorize the Chairman's
signature to execute the Findings of Fact and Order regarding the dog Contessa owned by Mayme and
Ron Hofland as submitted by the County Attorney.
Closed to the Public
At 11 :22 a.m., Chairman Rogness declared the meeting closed to the public to discuss pending litigation
with architects and contractors in the matter of the construction of the 60-Bed Chemical Dependency
Facility. At 11 :34 a.m., Chairman Rogness declared the meeting closed to the public to discuss pending
litigation with the Teamsters Union for their Social Worker and Support Specialist groups. The closed
sessions are authorized under Attorney/Client privilege. Present were all five seated Commissioners,
County Attorney, County Administrator, and Board Secretary.

At 11 :38 a.m., Chairman Rogness declared the Board of Commissioners meeting closed to the public for
purposes of discussing labor negotiation strategies regarding the Human Services, Nurses, and Facilities
Maintenance unions. Present were all five seated Commissioners, County Attorney, County Administrator,
and Board Secretary.

ORDER ESTABLISHING MARION LAKE IMPROVEMENT DISTRICT
The matter or establishing a Lake Improvement District came before the Otter Tail
County Board of Commissioners on the 4th day of September, 2012, upon a Resolution of the
County Board #2012-44, and following a public hearing held at the Ottertail Operation Center,
Ottertail, Minnesota, on August 20, 2012, The Board, having considered the request for a lake
Improvement Uistril.'.t, written comments provided, and the comments made at the public
hearing, and being fully advised in the premise, makes the following rindings and Order:
FINDINGS

The County Board adopted a Resolution of Intent to establish a Lake Improvement
District for Marion Lake, #2012-44, adopted July 17, 2012.

Notice of the public hearing was published in the Fergus Falls Daily Journal on July 27,
29 and 30, 2012; and also published in the East Otter Tail Focus on August 2 and August 9,
2012.

All owners of property on Marion Lake, including corporations and utilities, were given
notice of the Resolution and the public hearing by mail, on July 23, 2012, as were the Townships
of Rush Lake and Dead Lake, the Rast Otter Tail Soil and Water Conservation District, the
Minnesota Pollution Control Agency and the Depurtrnent of natural Resources.
IV.
The Department of Natural Resources and the Pollution Control Agency of the State of
Minnesota were notified of the proposed Luke Improvement District, and the Department of
Natural Resources provided its Advisory Report, dated August 13, 2012, which report was read
into the record at the public hearing held August 20,2 012.
V.
The purpose and objective oCthe Lake lmprovement District is to provide a means by
which the property owners can meet and deal with specific needs relating to water quality and
water management.

That there are no itnmediate problems facing Marion Lake, but there art! concerns for
potential infestation of Aquatic lnvusive Species and for continued monitoring of water quality
and to be in a position to address these concerns timely when they arise.
VII.
Although the DNR Report questioned whether the Lake Improvement District needed all
of the authorities authorized by the law, all of them are of potential use and can best be
implemented by decisions within the Lake Improvement District rather than imposed by the
County Board.

That all of the property included in the District will benefit by the establishment of the
District. Agricultural lands are being excluded because they arc not likely to benefit from the
projects of the District.
IX.
The formation of Lhe District will not cause or contribute to the long range cnvirnnmentul
pollution, but will provide an opportunity to address environmental concerns and limit pollution.
X.
The establishment of the Lake Improvement District is appropriate and will promote the
public welfare and will preserve, protect and improve the quality of the lakes,

Lake Improvement Districts are authorized by Minnesota Stats. § l 038.50 t R 103B.58 ! .
ORDER
NOW, THERErORE, IT IS HEREBY ORDERED:
1. Tht: name of the proposed Lake Improvement District shall be:
Marion Lake Improvement District
2. The boundaries of the proposed Lake Improvement District shall include parcels that
have lake frontage on Marion Lake or otherwise have riparian rights, including access by
manmade channel or deeded ucccss, but shall exch1dc agricultural land.

As the use of agricultural lands within the District changes to non-agricultural
use, the District shall, by confinning the change of use to the County Auditor and
Assessm, and by notit)'ing the owner of property and the Administrator of the
Otter Tail County Department or I ,and and Resource Management, include those
formerly agricultural lands in the District.
3. The water and related land resource management programs to be undertaken hy the
District may include:
a. Develop and implement a comprehensive plan to eliminate water pollution;
b. Receive fimmcial assistance from and participate in projects or enter into contracts
with federal and state agencies for the study and treatment of pollution problems and
related demonstration programs:
c. Undertake research to detem1im: the condition and development of the body of water
included within the Lake Improvement District to transmit the studies of the
Department of Natural Resources, the Minnesota Pollution Control Agency and other
interested authorities;
d. Make cooperative agreements with the United States or slate government or other
county or city to effectuate water and related land resource programs;
e. Conduct programs of water improvement and conservation;
f. Implement a water monitoring system;
g. Serve as local sponsor for state and f'ederal projects or grants;
h. Regulate water surface as deemed necessary and reasonable; or
1. Such other programs, plans, studies, developments or implementations us are allowed
or permitted by law, and approved by the Cot1nty Board from time to time.
4. The Otter Tail County Board delegates to the Lake Improvement District pursuant to
Minnesot~ Statutes § 103B.551, Subd. 3, authoriry to:
a. Acquire by gift or purchase, equipment, structures or control works that affects the
level of wuter.s in the District.
b. Construct and operate water control structures, equipment or control works that are
approved by the Commissioner of Natural Resources under section § l 030.245.

c. Undertake projects to change the course current or cross section of public waters lhat
are approved by the Commissioner of Natural Resources under section 1030.245.
d. Acquire property, equipment or other facilities, by gift or purchase to improve
navigation.
c. Contracts with a board or managers of a watershed district within the lake
improvement district or the board of supervisors of a soil and water conservation
district within the district for improvements under chapter I 03C and 1030.
f. Undertake research to determine the condilion and development of the body of water
and the water entering it and to trnnsmit the results of the studies to the Pollution
Control Agency and other interested authorities.
g. Develop and implement a comprehensive plan to eliminate water pollution.
h. Conduct a program of water improvement and conservation.
i. Construct water, sewer, or water and sewer system in the manner provided by section
444.075 or other applicable laws.
j. Receive financial assistance from and participate in projects or enter into contracts
with federal and state agencies for Lhe study and treatment of pollution problems anti
related demonstration programs.
k. Make cooperative agreements with the United States or state govemment or other
counties or cities to effectuate water and related land r~source programs.
I. Maintain public beaches, public ducks and other public facilities for access to tbe
body of water.
m. Provide and finance a governmem service of the county or statutory or home rult! city
that is not provided throughout the county or, if the govcmmcnt service is provided,
the service is at an increased level within the Dislrict.
n. Regulate water surface use as provided in section 868.205, I 030.605 and l 03G.62 l,
5. Funding for the Lake Improvement District shall be:
a. Start-up funds will be provided from the Marion Lake Association.
b. Lukt: Improvement District activities may be funded by the levying of an ad valomm
tax solely on property within the District. No establishment or increase in the ad
valorum property tax will be allowed ifit affects Lhe county levy subject to state-
imposed levy limits.

c. Lake lmprovemenl District activities may also be funded by assessment of costs of
projects upon the benefitted property within the District in the manner provided under
Minnesota Stat. Chapter 429.
d. Lake Improvement Dislrict activities may also by funded by imposition of service
charges on users of the Lake Improvement District services within the District
(Minnesota Statute §428A.05).
e. The Lake Improvement District may ulso finance projects and services of the District
by issuing obligations as provided in Minnesota Stat. §429.091.
6. The Administrator of the Otter Tail County Department of Land and Resource
Management shall be responsible for supervising the programs of the District.
7. Tht! Botud of Directors of the Luke Improvement District shall consist of seven members.
The Board members must own properly within the Lake Improvement District, and a
majority of the Directors must be re-sidents of the District. The initial Directors will be
appointed to alternating terms or one, two and three year terms. No Director may serve
more than two successive complete terms. Directors may be removed by a two-thirds
vote of the property owners at a special or annual meeting. Vacancies in the Board of
Directors may be filled by n majority vote of the remaining Directors, subject to approvril
ofa majority vote of the property owners present at the next annual meeting. A Director
elected to fill a vacancy shall serve the unexpired term. Property owners not present at the
annual meeting may participate in the election ol'the District Board by absentee ballot.
8. This Order shall be published in the official newspaper of the County, and the effective
dated of the establishment of the Lake Improvement District shall be 30 days after
publication.
9. ·'-copy of the Order shall be liled with the Secretary of State, the Pollution Control
Agency and the Commissioner or Natural Resources.
