Fir Avenue, Fergus Falls, MN September 4, 2012 9:30 a.m. Call to Order The Otter Tail County Board of Commissioners convened Tuesday, September 4, 2012 at 9:30 a.m., at the Otter Tail County Government Services Center in Fergus Falls, MN, with Commissioners Lee Rogness, Chairman; Doug Huebsch, Vice-Chair; Wayne Johnson, John Lindquist, and Roger Froemming present. Approval of Agenda Chairman Rogness called for approval of the September 4, 2012 agenda. Motion by Froemming, second by Lindquist, and unanimously carried to approve the Board of Commissioners agenda of September 4, 2012 with the following addition: 11 :45 -Closed Sessions for Labor Negotiations and Attorney Client Privilege Approval of Minutes Motion by Johnson, second by Lindquist, and unanimously carried to approve the August 28, 2012 Board of Commissioners meeting minutes with a clarification regarding County Ditch #70 as presented. Approval to Pay Bills Motion by Huebsch, second by Johnson, and unanimously carried to approve payment of the County Board bills per Attachment A of these minutes. Human Services Department Contracts Motion by Froemming, second by Huebsch, and unanimously carried to authorize the appropriate County Officials' signatures to execute an Addendum to the Long Term Recovery Services agreement between the County of Otter Tail and Otter Tail-Wadena CAC to provide funding, not to exceed $29,964.00, to the victims of the 2010 tornado disaster. The Addendum is effective from 08/01/12 through 08/31/12. Motion by Johnson, second by Froemming, and unanimously carried to authorize the appropriate County Officials' signatures to execute an Addendum to the Children's Day Treatment Program contract to provide for recovery of funding obtained from the Minnesota Health Care Programs. The Addendum is effective for the period of 07/01/12 through 06/30/13. Motion by Johnson, second by Lindquist, and unanimously carried to authorize the appropriate County Officials' signatures to execute a contract between the County of Otter Tail and the Wings Family Supportive Services for the Father's Resource Program for the period of 10/01/12 through 09/30/13. Otter Tail County will provide $11,110.88 to provide the service. Marion Lake Improvement District (LID) Lengthy discussion took place regarding the proposed Marion LID. Discussion included voting membership, service fee vs. ad valorem tax, LID authorities, and the democratic process. Motion by Huebsch, second by Lindquist, and unanimously carried to approve the establishment of the Marion Lake Improvement District and direct the County Attorney to draft the Order to establish the LID. OTC Board of Commissioners' Minutes September 4, 2012 Page 2 Recess & Reconvene At 10:25 a.m., Chair Rogness declared the meeting of the Otter Tail County Board of Commissioners recessed for a short break. The meeting was reconvened at 10:30 a.m. Sheriffs Department Staffing Motion by Lindquist, second by Froemming, and unanimously carried to authorize hiring a Records Technician for the Detention Facility. This will replace the current Administrative Secretary position as recommended by the Personnel Committee. Fire Department 800 MHz Radio Project Wayne Stein, County Auditor, submitted a financial summary for the 800 MHz communications equipment for County fire departments. License Approval Motion by Froemming, second by Lindquist, and unanimously carried to approve the following application for license: The Corner Store on Otter Tail Lake, Inc. 28045 County Highway 145 Battle Lake, MN 56515 Tobacco Public Health Nuisance Abatement Motion by Huebsch, second by Froemming, and unanimously carried to approve the payment plan (dated August 27, 2012) for recovery of the public health nuisance abatement costs incurred by Otter Tail County Public Health on Parcel #75-000-50-0056-001 located at 927 S. Otter Avenue in Parkers Prairie owned by Kelly Rud. If a default occurs on this payment plan, the abatement costs would be certified against the property. 60-Bed Chemical Dependency Facility Construction Motion by Johnson, second by Lindquist, and unanimously carried that it was and is the intention of the County Board to pursue Otter Tail County's claims regarding the 60-Bed Chemical Dependency facility including the litigation with the architect and contractor which is now pending and was initiated by the Pemberton Law Firm at the request of the County Board. Emergency Preparedness Planning Motion by Johnson, second by Froemming, and unanimously carried to authorize the appropriate County Officials' signatures on the Minnesota Responds Contract between the County of Otter Tail and St. Cloud Hospital to merge funding for recruitment and training of volunteers for health related emergency preparedness planning. Nurse Family Partnership Motion by Froemming, second by Huebsch, and unanimously carried to authorize the appropriate County Officials' signature to execute a Shared Staffing contract between the County of Otter Tail and Douglas County for the Nurse Family Partnership program. Partnership 4 Health Ms. Thorson submitted a Partnership 4 Health Planning Initiative Status Report dated August 2012. The report summarized activities in Phase I of the program and identified grant funding as an outcome of the partnership. Dog Bite Training Plan OTC Board of Commissioners' Minutes September 4, 2012 Page 3 Ms. Thorson presented a training plan from Ron & Mayme Hofland for their dog, Contessa. Motion by Lindquist, second by Froemming, and unanimously carried to approve the plan as presented and direct the County Attorney to draft an Order for the next County Board meeting. Highway Projects Update Public Services Director, Rick West, submitted a project update. He reviewed all construction and design projects in process at this time. School Speed Zone Motion by Lindquist, second by Huebsch, and unanimously carried to approve a 20 MPH speed limit by the Underwood School from the intersection of East St. and Southern Avenue (CH 122) east to Cleveland Ave (CSAH 35) as recommended after completion of a school safety study. Perham Interchange and CSAH 34 Project Motion by Huebsch, second by Lindquist, and unanimously carried to change the Board of Commissioners regular meeting on September 25, 2012 to the Perham City Hall to accommodate attendance at the opening ceremony of the Perham Highway 10 and CSAH 34 Interchange. County Ditch #25 Redetermination of Benefits Discussion took place regarding the County Ditch #25 redetermination of benefits process. Rick West, Public Works Director, and David Hauser, County Attorney, will report back to the Board on this issue. Recess & Reconvene At 11 :59 a.m., Chair Rogness declared the meeting of the Otter Tail County Board of Commissioners recessed for a short break. Closed to the Public At 12:06 p.m., Chairman Rogness reconvened the Board of Commissioner's meeting and declared the meeting closed to the public to discuss pending litigation with the Teamsters Union for their Social Worker and Support Specialist groups. The closed session is authorized under Attorney/Client privilege. Present were all five seated Commissioners, County Attorney, County Administrator, and Board Secretary. Closed to the Public At 12:20 p.m., Chairman Rogness declared the Board of Commissioners meeting closed to the public for purposes of discussing labor negotiation strategies regarding the Human Services, Nurses, and Facilities Maintenance unions. Present were all five seated Commissioners, County Attorney, County Administrator, and Board Secretary. Adjournment At 12:45 p.m., Chairman Rogness declared the meeting of the Otter Tail County Board of Commissioners adjourned until 9:30 a.m. on Tuesday, September 11, 2012.
