Fir Avenue, Fergus Falls, MN August 7, 2012 8:30 a.m. Call to Order The Otter Tail County Board of Commissioners convened Tuesday, August 7, 2012 at 8:30 a.m., at the Otter Tail County Government Services Center in Fergus Falls, MN, with Commissioners Doug Huebsch, Vice-Chair; Wayne Johnson, John Lindquist, and Roger Froemming present. Chairman Rogness was absent. Approval of Agenda Vice-Chair Huebsch called for approval of the August 7, 2012 agenda. Motion by Froemming, second by Johnson, and unanimously carried to approve the Board of Commissioners agenda of August 7, 2012 as presented. Approval of Minutes Motion by Froemming, second by Johnson, and unanimously carried to approve the July 31, 2012 Board of Commissioners meeting minutes. Approval to Pay Bills Motion by Lindquist, second by Johnson, and unanimously carried to approve payment of the County Board bills per Attachment A of these minutes. Proposed Big McDonald Lake Improvement District Roger Fenstad, President of the Big McDonald Lake Association, and several other Lake Association Officers, requested the Commission to consider passing a resolution of intent to form a LID for Big McDonald Lake. Copies of petitions showing support for a LID and related documentation were submitted. David Hauser, County Attorney, will present a Resolution of Intent to establish the Big McDonald LID at the next regular County Board meeting. A Public Hearing is required to gain public input regarding the proposed LID. Commuting with County Vehicle Motion by Johnson, second by Froemming, and unanimously carried to authorize David Boen, Phelps Mill Park Caretaker, use of a County vehicle for commuting to work until the Phelps Mill Park Residence is available for occupancy. The projected length of time is until August 13, 2012. Highway Department Reports Rick West, Public Works Director, provided copies of the Otter Tail County Highway Department 2011 Annual Report. Mr. West submitted winter snow removal costs from the 2005-2006 season through the present. Highway Department Agreement Motion by Johnson, second by Lindquist, and unanimously carried to authorize the appropriate County Officials' signatures to execute a Contract between the County of Otter Tail and Leitch Excavating, LLC for construction of restrooms at the Phelps Mill Park contingent upon the approval of the County Attorney. OTC Board of Commissioners' Minutes August 7, 2012 Page 2 County Ditch Discussion Motion by Lindquist, second by Johnson, and unanimously carried to authorize removal of beaver dams in Ditch No. 29 near New York Mills south of County Highway 54 as requested by the Interim Ditch Inspector. Mr. West updated the Board regarding the run out elevation of County Ditch No. 16. Application for Exempt Permit Motion by Froemming, second by Huebsch, and unanimously carried to approve, with no waiting period, the LG220 Application for Exempt Permit as submitted by Holy Cross Church for an event scheduled for Sunday, September 9, 2012 at Holy Cross Church, 54216 County Highway 148, New York Mills, MN. Cost Allocation Plans Motion by Lindquist, second by Froemming, and unanimously carried to authorize the County Auditor's signature to execute an agreement between the County of Otter Tail and Government Management Group for the preparation of Otter Tail County's 2012, 2013, and 2014 Central Services Cost Allocation Plans at a cost of $6,300 per plan year. Recess & Reconvene At 9:20 a.m., Vice-Chair Huebsch declared the meeting of the Otter Tail County Board of Commissioners recessed for a short break. The meeting was reconvened at 9:34 a.m. Waterfowl Easement Requests Lynn Sebek from the US Fish and Wildlife Service described two wetland easement properties and requested approval. Motion by Lindquist, second by Johnson, and unanimously carried to certify the following USFWS wetland easements to protect wetlands and waterfowl: Stoddard, David T. 131 N .• R. 43 W .• 5th P.M. Section 31, that part of the SE¼SE¼ and ttiat part of the NE¼SE¼ described as follows: Beginning at the southeast corner of said Section 31; thence North 00 degrees 01 minutes 30 seconds West (assumed bearing) along the east line of said Section 31 a distance of 1066.19 feet; thence North 87 degrees 21 minutes 48 seconds West a distance of 339.77 feet; thence North 00 degrees 28 minutes 14 seconds West a distance of 414.08 feet; thence North 89 degrees 15 minutes 18 seconds West a distance of 468.40 feet; thence South 83 degrees 25 minutes 52 seconds West a distance of 245.84 feet; thence South 01 degrees 26 minutes 15 seconds East a distance of 4 78.67 feet; thence South 88 degrees 19 minutes 41 seconds West a distance of 257.26 feet to the west line of said SE¼SE¼; thence South 00 degrees 16 minutes 24 seconds West along said west line a distance of 951.12 feet to the south line of said Section 31; thence South 88 degrees 23 minutes 18 seconds East along the south line of said Section 31 a distance of 1306.06 feet to the point of beginning. Containing 37.95 acres, more or less. Subject to an easement for County Road No. 28 over and across the south 50.00 feet thereof. Also subject to an easement for 175th Avenue along the easterly line thereof. The above described tract of land is delineated on a plat bearing the date of May 15, 2001, recorded February 10, 2006, as Document No. 992705, in the Office of the County Recorder, Otter Tail County, Minnesota, prepared by Terry Lee Anderson, Registered Land Surveyor, Minnesota License No. 14676. Human Services Department Staffing Motion by Lindquist, second by Froemming, and unanimously carried to authorize the Community Services Director to hire a Temporary Social Worker to assist the Department during an authorized Leave of Absence.
