Fir Avenue, Fergus Falls, MN July 10, 2012 8:30 a.m. Call to Order The Otter Tail County Board of Commissioners convened Tuesday, July 10, 2012 at 8:31 a.m., at the Otter Tail County Government Services Center in Fergus Falls, MN, with Commissioners Lee Rogness, Chair; Doug Huebsch: Vice-Chair; Wayne Johnson, John Lindquist, and Roger Froemming present. Approval of Agenda Chairman Rogness called for approval of the July 10, 2012 agenda. Motion by Froemming, second by Johnson, and unanimously carried to approve the Board of Commissioners agenda of July 10, 2012 with the following changes: . Add -Personnel Committee with Community Services Director at 2:30 p.m. ' Cancel -Personnel Committee Meeting with Public Health Director Change Time for Public Works Director to Start at 1 :00 p.m. Approval of Minutes Motion by Johnson, second by Froemming, and unanimously carried to approve the Board of Commissioners meeting minutes of June 26, 2012 with a change under Acquisition of WMA Land on East Lost Lake motion to include the roll call vote as follows: From: . "Motion by Johnson, second by Huebsch, with Froemming and Rogness opposed, to deny the request for acquisition by the MN DNR Fish & Wildlife Division of land on East Lost Lake. Motion carried with a 3-2 vote." To: "Motion by Johnson, second by Huebsch, to deny the request for acquisition by the MN DNR Fish & Wildlife Division of land on East Lost Lake. Motion carried with a 3 -2 vote as follows: Lindquist -Yea Froemming-Nay Johnson -Yea Huebsch -Yea Rogness -Nay Approval to Pay Bills Motion by Huebsch, second by Johnson, and unanimously carried to approve payment of the County Board bills per Attachment A of these minutes. Economic Development Committee Discussion The County Board reviewed a list of volunteers for the Economic Development Committee and proposed meeting dates :and agendas. Motion by Huebsch, second by Johnson, and unanimously carried to accept and support the materials to establish the Economic Development Committee as presented with the addition of another Ex-Officio member. OTC Board of Commissioners' Minutes July 10, 2012 Page 2 Proposed Solid Waste Ordinance Discussion Solid Waste Director, Mike Hanan provided a handout with the proposed Ordinance Table of Contents and discussion topics. Items were discussed. Motion by Froemming, second by Johnson and unanimously carried to set a Public Hearing for the Proposed Solid Waste Ordinance on September 25th at the regular County Board meeting. Out-of-State Travel Request Motion by Lindquist, second by Johnson, and unanimously carried approving the out-of-state travel request of the Jail Administrator to send a staff member to Peotone, Illinois, July 23 -25, 2012 for a National Gang Crime Research Training. Expenses for the training will be paid from the Detention Facilities training budget. Rapid Response Emergency Revolving Loan Fund Application Emergency Manager, Patrick Waletzko provided the final fund policy, as adopted by the Board on June 26, 2012, and reviewed the loan application as developed by staff. The process will be for a governmental unit to complete the application and schedule a time to meet with the Budget Committee and present to the County Board. It was noted that there would need to be a joint powers agreement in place to qualify for a loan. Recess & Reconvene At 9:25 a.m., Chairman Rogness declared the meeting of the Otter Tail County Board of Commissioners recessed for a short break. The meeting was reconvened at 9:34 a.m. Impassable Road -Lake Street County Attorney; David Hauser reminded the Board that the matter before them is to decide if Lake Street is an impassable road and if so, what the Board would order the township to do. A lengthy discussion followed. The Board appointed a committee to review all the documentation and options and bring a recommendation back. This committee will consist of an Otter Tail Township Official, Tim Lueders; Land and Resource Director, Bill Kalar; County Attorney, David Hauser; Commissioners Roger Froemming and Lee Rogness; and Public Works Director, Rick West. Recess & Reconvene At 10:14 a.m., Chairman Rogness declared the meeting of the Otter Tail County Board of Commissioners recessed for a short break. The meeting was reconvened at 10:22 a.m. Dog Bite Order Motion by Froemming, second by Lindquist, and unanimously carried to approve the Finding of Fact and Order as submitted by the County Attorney for a pit bull named Wiggie owned by Jake Hughes. Discussion DNR AMA Proposed Acquisition Dave Thompson, Fisherman's Village Resort owner, provided the Board with a binder of information regarding the proposed acquisition of land on East Lost Lake that the County Board denied. A lengthy discussion followed. The Board indicated a desire to have requests for public land acquisitions reviewed by the County Legacy Fund Conservation Committee. Additionally, County Board would like to receive more information and notice from public agencies requesting county approval. OTC Board of Commissioners' Minutes July 10, 2012 Page 3 County Ditch #25/Outlet for LMKP Lakes Rick West, Pub.lie Works Director and Interim Ditch Inspector, discussed with the Board that the purpose of this item on the agenda is to discuss and review the draft Operation Plan for the Petition for Outlet into County Ditch #25. Following discussion by the County Board and participation from audience members, the Board asked the Little McDonald Lake Outlet Ad Hoc Committee to meet to bring back one plan with details. The Ad Hoc Committee is scheduled to meet Monday, July 16, at 7:00 p.m. Consideration of the petition to use County Ditch #25 as an outlet for LMKP Lakes is scheduled as an action item at the County Board's regular meeting on Tuesday, July 24, 2012. Recess & Reconvene At 11 :57 a.m., Chairman Rogness declared the meeting of the Otter Tail County Board of Commissioners recessed for lunch. The meeting was reconvened at 1 :02 p.m. Recommendations for Award C.P. 12:MILL REST After previously advertising, bids were opened for C.P. 12:MILL REST, Phelps Mill County Park Restroom, at 1 :00 p.m. on June 27, 2012. Motion by Lindquist, second by Froemming, and unanimously carried to award the project to Leitch Excavating, LLC of Fergus Falls in the amount of $41,085 as recommended. Recommendations for Award S.P. 056-090-011 CSAH 16 Multi Use Trail After previously advertising, bids were opened for S.P. 056-090-011, CSAH 16 Multi-Use Trail, at 1 :00 p.m., June 26, 2012. Motion by Huebsch, second by Froemming, and unanimously carried to reject all bids and re-evaluate the project as recommended by the County Engineer. Request for Approval -Geotechnical Services Motion by Lindquist, second by Johnson, and unanimously carried to authorize the appropriate County Officials' signatures to execute Proposals FA-12-03951, FA-12-03975 and FA-12-03957 between the County of Otter Tail and Braun lntertec Corporation for Geotechnical Services on CSAH 35 (Underwood to CSAH 18, CSAH 35 to CSAH 18 to CSAH 1 and CSAH 35 from CSAH 82 to TH 210). Highway Contracts Motion by Froemming, second by Lindquist, and unanimously carried to authorize the appropriate County Officials' signatures to execute a contract between Otter Tail County and Larson Painting of Parkers Prairie, MN for exterior painting of Otter Tail County Garage #3, subject to the approval of the County Attorney. Motion by Huebsch, second by Froemming, and unanimously carried to authorize the appropriate County Officials' signatures to execute a contract between Otter Tail County and Fargo Electric Construction, Inc. of Fargo, ND for District 4 Rural Intersection Lighting (S.P. 080-070-033), subject to approval of the County Attorney. Western Area City/County Cooperative IWACCOl Dues Motion by Johnson, second by Froemming, and unanimously carried to approve the 2012 annual membership dues to WACCO, in the amount of $5,000, which will allow the Highway Department to purchase salt at a reduced rate for the 2012-2013 winter season. Highway Maintenance Supervisor Salary Motion by Huebsch, second by Lindquist, and unanimously carried to offer Step 4 to the leading candidate for the Highway Maintenance Supervisor position. OTC Board of Commissioners' Minutes July 10, 2012 Page 4 Contract Addendum Motion by Johnson, second by Lindquist, and unanimously carried to approve an addendum to the Engineering Services Agreement for the CSAH 72 Bridge Replacement Project between the County of Otter Tail and Interstate Engineering. Commuting with County Vehi.cles Motion by Huebsch, second by Johnson, and unanimously carried to authorize Highway Engineering Technician Ill, Kirk Sjolie, to commute with a County vehicle while working on SAP 056-609-003 as recommended by the Public Works Director. Commissioner Rogness was absent at 1 :30 p.m. Human Service Fiscal Report Community Services Director, John Dinsmore, provided the Human Services Second Quarter Fiscal Report. He reported total Agency expenses at 48% and revenue at 45%. Human Services Agency Work-site LMC Mid-Year Report Mr. Dinsmore provided the Otter Tail County Human Services Work-site Labor Management Committee Agency Wide Meeting Overview dated July 2012. The top five Labor Management Committees Goals/Priorities for 2012 were identified. Father's Resource Program Motion by Lindquist, second by Froemming and unanimously carried to support the consolidation of the Fathers Resource Program under WINGS Family Services that serves a nine-county region.
