Fir Avenue, Fergus Falls, MN June 26, 2012 8:30a.m. Call to Order The Otter Tail County Board of Commissioners convened Tuesday, June 26, 2012 at 8:30 a.m., at the Otter Tail County Government Services Center in Fergus Falls, MN, with Commissioners Lee Rogness, Chair: Doug Huebsch, Vice-Chair: Wayne Johnson, John Lindquist, and Roger Froemming present. Approval of Agenda Chairman Rogness called for approval of the June 26, 2012 agenda. Motion by Froemming, second by Johnson, and unanimously carried to approve the Board of Commissioners agenda of June 26, 2012 with the following addition: 9:40 a.m. -Solid Waste Director, Mike Hanan -Request for Emergency Assistance Approval of Minutes Motion by Johnson, second by Froemming, and unanimously carried to approve the Board of Commissioners meeting minutes of June 19, 2012 as presented. Approval to Pay Bills Motion by Johnson, second by Huebsch, and unanimously carried to approve payment of the County Board bills per Attachment A of these minutes. Request for Emergency Assistance Motion by Lindquist, second by Froemming, and unanimously carried to approve sending one of the certified Household Hazardous Waste staff to Duluth, MN to help with the clean-up from the recent floods. Smoke Free Grounds Policy Wellness Coordinator, Janet Lindberg presented a packet of information that will be provided to employees for information regarding the upcoming implementation of the Smoke Free Grounds policy on January l, 2013. Employees will receive the information three times before implementation date. The implementation of a Tobacco Free Policy was discussed. Motion by Lindquist, second by Huebsch and unanimously carried to approve the packet of information as Memorandum of Understanding. Motion by Lindquist, second by Huebsch and unanimously carried for the Wellness Committee to proceed with the process to go Tobacco Free by 2014. OTC Board of Commissioners· Minutes June 26, 2012 Page4 Dog Bite Hearing Jessica Metzger, PHN reported that a Pit Bull named Wiggy has two bites on record; therefore, the County Animal Bite and Control Ordinance requires that a hearing be held. Ms. Metzger explained the bite situations; Wiggy has 2 bites on record with a previous owner. The current owner of Wiggy, Jake Hughes has not been reached. Letters regarding the hearing have been returned and phone calls not answered. Wiggy is currently at the Humane Society and while housed there has also bitten a staff member. Motion by Huebsch, second by Johnson and unanimously carried that Wiggy be euthanized. The County Attorney will draft an Order of Findings and return to the Board for their approval. Public Health Contract Motion by Lindquist, second by Johnson and unanimously carried to authorize the appropriate County Officials' signatures on the Professional and Technical Services contract between the State of MN and Otter Tail County Public Health. Recess & Reconvene At 9:13 a.m., Chairman Rogness declared the meeting of the Otter Tail County Board of Commissioners recessed for a short break. The meeting was reconvened at 9:17 a.m. West Central Regional Juvenile Center Probation Director. Chuck Kitzman provided a packet of information on the West Central Regional Juvenile Center. Discussion followed. Request for Forgiveness of Tax Penalty Treasurer, Steve Andrews, presented a request for forgiveness of tax penalty from William Boedigheimer on Parcel No. 73-000-99-0523-000 due to the owner paying taxes on the escrowed parcel instead of commercial parcel. Motion by Huebsch, second by Johnson and unanimously carried to forgive penalty of $108.72 but charge a $25 correction fee. Performance Measures Resolution Otter Tall County Resolution No. 2012-42 Commissioner Johnson offered the following and moved for its adoption: WHEREAS, Otter Tail County has adopted and implemented the minimum 10 performance measures developed by the Council on Local Results and Innovation; and WHEREAS, Otter Tail County has implemented or is in the process of implementing a local performance measurement system as developed by the Council on Local Results and Innovation; and WHEREAS, Otter Tail County has or will report the results of the l O adopted measures to its residents before the end of the calendar year through publication, direct mailing, posting on the entity's website, or through a public hearing at which the budget and levy will be discussed and public input allowed; and WHEREAS, Otter Tail County has or will survey its residents by the end of the calendar year on the services included in the performance benchmarks. .. Rogness, Board o missioners Chair Rapid Response Emergency Revolving Loan Fund Policy Motion by Huebsch, second by Johnson, with Lindquist opposed because he feels that more details need to be developed before implementation, to adopt the Otter Tail County Rapid Response Emergency Fund Policy, with the following amendments: a) rename the fund to "Otter Tail County Rapid Response Emergency Revolving Loan Fund," b) initial funds of $250,000 will come from county reserves, and c) the fund shall not exceed $1,000,000. The Board directed staff to take the next steps to develop an application for interested parties. Use of the fund will require a Budget Committee recommendation and County Board approval. The earliest opportunity for this to occur would be at the July l 0, 2012 Board meeting. Acquisition of WMA Land on Easf Lost Lake Motion by Johnson, second by Huebsch, with Froemming and Rogness opposed, to deny the request for acquisition by the MN DNR Fish & Wildlife Division of land on East Lost Lake. Motion carried with a 3-2 vote. Approval to Pay Bills & Claims Motion by Johnson, second by Huebsch, and unanimously carried to approve payment of the Human Services bills and claims as presented. Reassignment Requests Motion by Froemming, second by Lindquist and unanimously carried to approve a temporary out of class reassignment for Veterans Service Officer, Charlie Kampa to serve as Acting Veterans Services Director and to reassign a current Human Services employee to the Assistant Veterans Service Officer Position. The meeting was reconvened at 11 :40 a.m. Request for Forgiveness of Tax Penalty Property owner Dale Menze requested forgiveness of tax penalty for Parcels #47-000-20-8197-000, #47-000-31-0207-000 & #47-000-31-021 l-000. Mr. Menze stated he did not receive tax statements for these three parcels: therefore, did not pay them when he paid the rest of his property taxes. Treasurer, Steve Andrews stated that the statement was mailed and was not received back from the post office. REGULAR TO MUNICIPAL ADVANCE RESOLUTION Otter Tail County Resolution No.2012 -43 A motion was offered by Johnson, seconded by Lindquist and unanimously carried to adopt the following resolution: WHEREAS, the County of Otter Tail has obtained the Commissioner's approval of the plans for the following County State-Aid Project(~): Project # S.A.P. 056-634-010 AND, WHEREAS, said County is prepared to proceed with the construction of said project(s) by providing county regular funds to supplement the available funds in the County Municipal Account, and WHEREAS, repayment of the funds so advanced by the County is desired in accordance with the provisions of Minnesota Statutes 162.08, Subd. 5, & 7 and Minnesota Rules 8820.1500, Subp. 9. NOW, THEREFORE, BE IT RESOLVED: That the Commissioner of Transportation be and is hereby requested to approve this basis for financing said construction project(s) and to authorize repayments from subsequent accruals to said Account, in the amounts as herein indicated.
