Fir Avenue, Fergus Falls, MN June 12, 2012 8:30 a.m. Call to Order The Otter Tail County Board of Commissioners convened Tuesday, June 12, 2012 at 8:31 a.m., at the Otter Tail County Government Services Center in Fergus Falls, MN, with Commissioners Lee Rogness, Chair; Doug Huebsch, Vice-Chair; Wayne Johnson, John Lindquist, and Roger Froemming present. Approval of Agenda Chairman Rogness called for approval of the June 12, 2012 agenda. Motion by Froemming, second by Johnson, and unanimously carried to approve the Board of Commissioners agenda of June 12, 2012 with the following addition: 9:35 a.m. -Distribution of Materials & Brief Discussion Regarding Impassable Road known as Lake Street Approval of Minutes Motion by Johnson, second by Lindquist, and unanimously carried to approve the Board of Commissioners meeting minutes of June 5, 2012 as presented. Approval to Pay Bills Motion by Huebsch, second by Johnson, and unanimously carried to approve payment of the County Board bills per Attachment A of these minutes. Public Health Staffing Motion by Huebsch, second by Lindquist, and unanimously carried to approve an intermittent, on-call Public Health Nurse position (with Spanish speaking ability) for Annette Wigert effective January 1, 2012 through December 31, 2012. Out-of-State Travel Request Motion by Johnson, second by Lindquist, and unanimously carried to approve out-of-state travel to San Francisco, CA for Diane Thorson, Public Health Director, to make a presentation at the American Public Health Conference. Cohort Leadership Program Motion by Lindquist, second by Huebsch, and unanimously carried to approve funding for the Cohort Leadership Program for CY2012 with $6,000 in the 2012 budget and additional cost of $2,000 to $4,000 to be paid out of the General Revenue Fund. Out-of-State Travel Request Motion by Johnson, second by Froemming, and unanimously carried to approve out-of-state travel to Wahpeton, ND for Patrick Waletzko, Emergency Manager, to attend the North Dakota Boys State Program. Independence Day Parade Motion by Froemming, second by Huebsch, and unanimously carried to approve the Annual Independence Day Parade and corresponding road closure(s) on the west end of Otter Tail Lake on July 1, 2012, as requested. This motion is contingent upon approval of the Sheriffs Department, proof of insurance and that Otter Tail County is held harmless relative to liability. OTC Board of Commissioners' Minutes June 12, 2012 Page 2 ' , Highway Staffing Motion by Lindquist, second by Johnson, and unanimously carried to approve filling a Highway Maintenance Worker position July 1, 2012, due to a recent retirement and as recommended by the Personnel Committee. Conditional Use Permit Application Richard & Patricia Hoganson: Bill Kalar, Land & Resource Administrator, reported on the continuation of the Conditional Use Permit (CUP) application request from Richard and Patricia Hoganson. On May 9, 2012, the Planning Commission recommended denial of this after-the-fact CUP request. On May 15, 2012, the Board of Commissioners tabled the CUP request for thirty (30) days for an opportunity to develop a restoration plan for work completed on Hoganson's property in Crystal Hills. Mr. Kalar referred to a letter he received from a civil engineer who indicated that it would be better if the rock stairway stayed in place as removal could cause additional environmental damage. The rock stairway was installed to replace a rotted, wood staircase; however, this would not have been approved because it is in a bluff impact zone. Mr. Kalar reviewed Mr. Hoganson's proposed restorative grading plan. Lengthy discussion followed. Motion by Johnson, second by Lindquist, and unanimously carried to deny an after-the-fact Conditional Use Permit to replace retaining walls and work in the shore impact zone with conditions as documented in the May 9, 2012 Planning Commission minutes. Mr. Hoganson will work with the Land & Resource Management Office for corrective and restorative action. The project is located on Lot 68 Blk 3 Crystal Hills, Section 11 of Lida Township; Crystal Lake (56-749). License Applications Motion by Froemming, second by Huebsch, and unanimously carried to approve the following license applications: Oakwood Golf Course 47388 County Highway 16 Henning, MN 56551 Oakwood Supper Club 47420 County Highway 16 Henning, MN 56551 St. Lawrence Church 46404 County Highway 14 Perham, MN 56573 On-Sale 3.2 Malt Liquor On-Sale Liquor and Sunday Liquor Temporary On-Sale 3.2 Malt Liquor (August 5, 2012) (Where applicable, subject to review of County Attorney and Sheriff Offices and the submission of all required forms) Payment Approval Motion by Lindquist, second by Froemming, and unanimously carried to approve payment, in the amount of $6,776.50, to Leitch Excavating, LLC for the installation of pipe in County Drainage System No. 37. Application for Exempt Permit Motion by Huebsch, second by Lindquist, and unanimously carried to approve, with no waiting period, the LG220 Application for Exempt Permit as submitted by the St. Lawrence Catholic Church for an event scheduled for Sunday, August 5, 2012 at the St. Lawrence Catholic Church located at 46404 County Highway 14, Perham, MN. Surveyor's Certificate of Correction to Plat Motion by Johnson, second by Lindquist, and unanimously carried to authorize the Chairman's signature to execute a Surveyor's Certificate of Plat Correction for the plat of Robinson's Addition to Clitherall (MN Document Number 91783) dated May 25, 2012. OTC Board of Commissioners' Minutes June 12, 2012 Page 3 Discussion -Impassable Road Public Meeting David Hauser, -,County Attorney, reviewed documents to be made part of the record for the Impassable Road (Lake Street) Public meeting. Documents provided at the meeting of June 11, 2012 were provided to Commissioners and also made part of the official record. Mr. Hauser reviewed M.S. 505.01, 164.11, and 164.08 and advised the Board regarding their options in the matter. .. Recess & Reconvene At 10:14 a.m., Chairman Rogness declared the meeting of the Otter Tail County Board of Commissioners recessed for a short break. MACSSA Legislative Overview John Dinsmore, Community Services Director, presented the Minnesota Association of County Social Service Administrator's 2012 Legislative Session Summary of Laws. He briefed the Board on the State's positive budget forecast, a change in legislation for a safe place for newborns, mental health certification for Adult Foster Homes, and restoration of the 20% reduction for relative-provided personal care attendant services. He indicated that the MAGIC Act proposed legislation was stalled in the House Ways and Means Committee. He also discussed improved delivery system performance standards. Out-of-State Travel Request Motion by Lindquist, second by Froemming, and unanimously carried to approve out-of-state travel for Sandy Holo, Investigation/Collections Supervisor, to the National Organization of Fraud Investigator's annual meeting. Ms. Holo is currently the Treasurer of the national organization.
