Call to Order
The Otter Tail County Board of Commissioners convened Tuesday, June 5, 2012 at 8:32 a.m., at the Otter
Tail County Government Services Center in Fergus Falls, MN, with Commissioners Lee Rogness, Chair;
Doug Huebsqh, Vice-Chair; Wayne Johnson, John Lindquist, and Roger Froemming present.
i i Approval of Agenda
Chairman Rqgness called for approval of the June 5, 2012 agenda. Motion by Huebsch, second by
Lindquist, and unanimously carried to approve the Board of Commissioners agenda of June 5, 2012 with
the following additions:

Forgiveness of Penalty Request

Approval of Minutes
Motion by ffroemming, second by Huebsch, and unanimously carried to approve the Board of
Commissioners meeting minutes of May 22, 2012 as mailed.

Motion by Li~dquist, second by Froemming, and unanimously carried to approve payment of the County
Board bills pefAttachment A of these minutes.

Seasonal Staff Request -Recorder's Office
Motion by Lindquist, second by Froemming, and unanimously carried to authorize the Recorder to fill a
Seasonal Data Entry position during the summer of 2012. Funding for the position will be from the
Technology Fund.
Out-of-State Travel Approvals
Motion by J9hnson, second by Lindquist, and unanimously carried to approve out-of-state travel to
Hudson, WI for two Detention Officers to attend the Turn-Key Corrections training for the canteen program.
Motion by Huebsch, second by Johnson, and unanimously carried to confirm out-of-state travel to
Nashville, TN, for training for Hallie Metcalf, Probation Agent. Most expenses are covered by a State grant.
, Leadership Symposium
Motion by Johnson, second by Froemming, and unanimously carried to approve Commissioners Huebsch
and Lindquisi ·to attend the 2012 Symposium on Small Towns June 12-14, 2012 at the University of
Minnesota Morris.

j Approval of Right of Way Easement
Motion by Jo~nson, second by Froemming, and unanimously carried to authorize the Chairman's signature
to execute Right of Way No. 123214 between the County of Otter Tail and Otter Tail Power Company for
rerouting the electricity for the new Fergus Falls Police Station and Courthouse remodel project.

Crop Equlvalency Ratings
Brian Armstrong, GIS Coordinator, and Doug Walvatne, Assessor, presented a draft request to the East
and West Farm Service Agency requesting GIS generated field boundaries to add to the County's GIS files
to allow for proper calculation of crop productivity index. Discussion followed. Motion by Johnson, second
by Lindquist, and unanimously carried to send the request/information and a cover letter with appropriate
County Officials' signatures to David Hauge, FSA Chair and Representative Collin Peterson.
Association of Minnesota Counties
Motion by Johnson, second by Lindquist, and unanimously carried to authorize Commissioners Huebsch,
Lindquist, and Rogness to attend the District IV AMC meeting on Friday, June 8, 2012 in Moorhead, MN.
Final Plats
Motion by Huebsch, second by Johnson, and unanimously carried to approve the Final Plat entitled "Chuck
Ponto Estates", a one lot subdivision located in Section 27 in Hobart Township, Long Lake (56-388).
Motion by Froemming, second by Lindquist, and unanimously carried to approve the Final Plat of
Elaine J. Kientiz entitled "Freye's Beauty Beach" located in Section 15 of Girard Township, West Battle
Lake (56-239), subject to filing a plat correction to correct a mathematical calculation.
Motion by Johnson, second by Froemming, and unanimously carried to approve the Final Plat of
Dave Majkrzak, entitled "Dave and Deb's Subdivision" located in Sections 3 and 10 of Dunn Township,
Pelican Lake (56-786).
Aquatic Invasive Species Task Force
Bill Kalar, Land & Resource Administrator, submitted the Otter Tail County Aquatic Invasive Species Task
Force Minutes dated May 23, 2012. Roger Neitzke, AIS Task Force member, spoke with the Board
regarding future funding of the Watercraft Inspection Program. Mark Stuart, representing the AIS Billboard
Committee, briefed the Board on billboard pricing from Newman Sign and requested approval for billboard
advertising. Motion by Huebsch, second by Johnson, and unanimously carried to approve approximately
$8,300.00 for AIS billboard advertising obtained by Newman Sign for five locations on a 90 day rotating
basis. This is part of the AIS education process. The AIS Task Force will return to the County Board with
an update regarding University of Minnesota's AIS research.
2012 HAVA Operating Grant Contract
Motion by Johnson, second by Huebsch, and unanimously carried to authorize the appropriate County
Officials' signatures to sign the 2012 Help America Vote Act (HAVA) Operating Grant Contract between the
State of Minnesota, acting through its Secretary of State and Otter Tail County (Grantee), in the amount of
$19,898.25, to defray operating costs associated with assistive voting and vote-counting equipment used
on election day in Otter Tail County's polling locations.
Payment Approval
Motion by Froemming, second by Johnson, and unanimously carried to approve payment, in the amount of
$974.16 from the Capital Improvement Fund to Kadrmas, Lee & Jackson, Inc. as approved by the
Assistant Highway Engineer, for design engineering services related to SP 56-090-07, the Historic Phelps
Mill Bridge Restoration Project.
Application for Exempt Permit
Motion by Huebsch, second by Lindquist, and unanimously carried to approve with no waiting period, the
LG220 Application for Exempt Permit as submitted by St. James Catholic Church for an event scheduled
for Sunday, July 22, 2012 at the St. James Catholic Church located at 32009 County Highway 74,
Underwood, MN.

Premise Permit
Otter Tail County Resolution No. 2012 -39
Commissioner Froemming offered the following and moved its adoption:
WHEREAS, the responsibility for the regulation of lawful gambling and the issuance of licenses and
permits for the conduct of lawful gambling lies with the Minnesota Gambling Control Board; and
WHEREAS, the Bluffton Baseball Association has made an application to the Gambling Control Board for
the purpose of conducting lawful gambling at Firehouse Bar & Grille, Inc, located at 63131 US Highway 10
in Compton Township of Otter Tail County; and l i
WHEREAS, Minnesota Statute 349.213 provides that the Gambling Control Board may not issue an initial
premise permit unless they receive a resolution from the Otter Tail County Board of Commissioners
approving the' application for a permit; and

WHEREAS, the Otter Tail County Board of Commissioners is aware of no reason to oppose the conduct of
lawful gambling by the Bluffton Baseball Association at Firehouse Bar & Grille, Inc, located at 63131 US
Highway 10 ir\ Compton Township of Otter Tail County. I.
NOW, THEREFORE, BE IT RESOLVED, that the Otter Tail County Board of Commissioners hereby
approves the1 conduct of lawful gambling by the Bluffton Baseball Association at Firehouse Bar & Grille,
Inc, located at 63131 US Highway 10 in Compton Township of Otter Tail County, provided the applicant
meets all the necessary criteria for the licenses and permits as required by the Gambling Control Board.

IT IS FURTHER RESOLVED, that notice of this application and approval shall be provided to the Township
of Compton by sending them a copy of this resolution.
Commissioner Johnson seconded the motion, and upon being put ta a vote, the resolution was
unanimously adopted.

Recess & Reconvene
At 9:57 a.m., Chairman Rogness declared the meeting of the Otter Tail County Board of Commissioners
recessed for a short break. The meeting was reconvened at 10:04 a.m.
Bois de Sioux Watershed District Advisory Committee
Brad Mergens, WOTSWCD Manager, briefed the Board regarding compliance requirements for Advisory
Committees for Watershed Districts. Motion by Johnson, second by Froemming, and unanimously carried
to nominate John Lindquist, Otter Tail County Commissioner and Vernyl Fronning, Otter Tail County
Citizen Member, to the BdSWD Board of Managers for consideration of appointment to the BdSWD
Advisory Committee.
Buffalo-Red River Watershed District
Motion by Lindquist, second by Johnson, and unanimously carried to request that the Administrator invite
the BRRWD Administrator to meet with the County Board regarding the process for providing
representation for Otter Tail County on the BRRWD.
Central Minnesota Emergency Services Board Committees
Motion by Froemming, second by Huebsch, and unanimously carried to approve the following
representatives:

West Central Initiative Updates
Greg Wagner, WCI Economic Development Planner, submitted a Comprehensive Economic Development
Strategy Executive Summary dated June 5, 2012. Lengthy discussion followed regarding the need for
additional agriculture and tourist industry data and strategies to grow a more vibrant economy. Tom
McSparron, WCI Donor Services Officer, submitted a packet of information regarding last year's WCI
activities and grant dollars brought into the 9-County Region.

COMPREHENSIVE ECONOMIC DEVELOPMENT STRATEGY
FOR WEST CENTRAL MINNESOTA
Otter Tall County Resolution No. 2012 • 38
WHEREAS, vyest Central Initiative has prepared a Comprehensive Economic Development Strategy
(CEDS) for the region containing Becker, Clay, Douglas, Grant, Otter Tail, Pope, Stevens, Traverse, and
Wilkin Counties of Minnesota (west central Minnesota); and

WHEREAS, ~he CEDS contains analysis, demographic data, economic data, economic development
projects, andlgoals and objectives for the betterment of the region; and

' WHEREAS, l,lvailability of an approved CEDS and related annual updates are a condition for qualifying for
grants for local economic development projects from the Economic Development Administration of the U.S.
Department df Commerce.
' NOW THEREFORE BE IT RESOLVED, That the Board of County Commissioners of Otter Tail County,
Minnesota, approves the 2011-2016 Comprehensive Economic Development Strategy for west central
Minnesota. :

Upon the motion of Johnson and seconded by Huebsch, the Otter Tail County Board of Commissioners
passes the fo'regoing resolution on a unanimous vote.

Evidence Technician as recommended.
Request for Forgiveness of Penalty
Steve Andrews, Treasurer, presented a letter from Rev. Sharon Johnson requesting forgiveness of
penalty. Du~ io failure of the website to accept Rev. Johnson's payment the evening of May 15, 2012, a
motion was offered by Huebsch and seconded by Johnson to forgive the penalty of $31.53 for Parcel Nos.
25-000-26-0161-011 & 25-000-99-1029-000. The motion passed on a 3-2 vote with Commissioners
Lindquist and! Froemming opposed.

Motion by Johnson, second by Froemming, and unanimously carried to authorize Final Payment to
Comstock Construction, Inc. of Minnesota, in the amount of $24,559.03, for completion of the Dispatch
Center remodel project.

Construction Contracts
Motion by Huebsch, second by Johnson, and unanimously carried to authorize the Chairman's signature to
execute Construction Contracts between the County of Otter Tail and Comstock Construction, Inc. of
Minnesota, for the Otter Tail County Courthouse Phase I Improvements (Project #1119) and the New York
Mills Improvements (Project #1113).
Construction Management Contract
Motion by Johnson, second by Huebsch, and unanimously carried to authorize the Chairman's signature to
execute a Professional Service Agreement between the County of Otter Tail and Marland Hoff of Detroit
Lakes, MN for construction management services for the Courthouse remodel project for the period of
June 1, 2012 through May 31, 2013.
Amendment No. 1 to MnDOT Contract No. 98317
Motion by Huebsch, second by Lindquist, and unanimously carried to authorize the appropriate County
Officials' signatures to execute Amendment No. 1 to the Perham Interchange and CSAH 34 project.
Final Payment-S.A.P. 056-667-033
Motion by Froemming, second by Johnson, and unanimously carried to approve Final Payment, to
Landwehr Construction of St. Cloud, MN per Final Estimate No. 5, in the amount of $9,023.58, for
completion of overlay and bridge work (Bridge No. 56J20).
Highway Construction Contracts

Motion by Lindquist, second by Froemming, and unanimously carried to authorize the appropriate County
Officials' signatures to execute a Highway Construction Contract between the County of Otter Tail and
Traffic Marking Service, Inc. of Maple Lake, MN for signage & pavement markings.

Motion by Froemming, second by·Jcihnson, and unanimously carried to authorize the appropriate County
Officials' signatures to ·execui'e a Highway Construction Contract between the County of Otter Tail and
Mark Sand & Gravel, Co. of Fergus Falls, MN for overlay work on CSAH 42, CSAH 50, and CH 135.

Motion by Johnson, second by Lindquist, and unanimously carried to authorize the appropriate County
Officials' signatures to execute a Highway Construction Contract between the County of Otter Tail and
AAA Striping Service Co., of St. Michael, MN for annual restriping services.
Professional Engineering Services
Motion by Froemming, second by Lindquist, and unanimously carried to authorize the appropriate County
Officials' signatures to execute Supplementary Agreement No. 2 for expanded professional engineering
services between the County of Otter Tail and Kadrmas, Lee & Jackson, Inc. of Moorhead, MN, for the
Phelps Mill Bridge Restoration project
Highway Project Retainage Reduction
Motion by Huebsch, second by Lindquist, and unanimously carried to authorize the request of Barry
Construction to reduce retainage from 5% to 1 % for the Lake Iverson project as recommended by the
Highway Engineer.
Commuting with County Vehicle
Motion by Johnson, second by Froemming, and unanimously carried to authorize commuting with a County
vehicle for SAP. 056-599-058, Dunn Township Bridge No. 56542 for Wade Bugbee, Engineering
Technician, due to the closer proximity of his home to the project than the main office.
