Fir Avenue, Fergus Falls, MN April 3, 2012 9:30 a.m. Call to Order The Otter Tail County Board of Commissioners convened Tuesday, April 3, 2012 at 9:30 a.m., at the Otter Tail County Government Services Center in Fergus Falls, MN, with Commissioners Lee Rogness, Chair; Doug Huebsch, Vice-Chair; Wayne Johnson, John Lindquist, and Roger Froemming present. Approval of Agenda Chairman Rogness called for approval of the April 3, 2012 agenda. Motion by Lindquist, second by Froemming, and unanimously carried to approve the Board of Commissioners agenda of April 3, 2012 with the following addition: 9:55 a.m. -Sheriff Brian Schlueter -Staffing Requests Approval of Minutes Motion by Froemming, second by Johnson, and unanimously carried to approve the Board of Commissioners meeting minutes of March 27, 2012 as mailed. Approval to Pay Bills Motion by Huebsch, second by Johnson, and unanimously carried to approve payment of the County Board bills per Attachment A ofthese minutes. Probation Advisory Committee Motion by Huebsch, second by Froemming, and unanimously carried to appoint Scott Bjerke, Middle School Principal, to complete the term of Bob Wilkowski (representing the First District) on the Probation Advisory Committee and to appoint for the next three year term. Mr. Bjerke's term will end December 31, 2015. Motion by Huebsch, second by Lindquist, and unanimously carried to extend the County's appreciation for Bob Wilkowski's service on the OTC Probation Advisory Committee throughout the past years. WCR Juvenile Center Chuck Kitzman, Probation Director, submitted the 2011 Yearly Review document for WCRJC. He reviewed some pertinent capacity statistics for the secure and non-secure units. The next WCRJC Advisory Board meeting is scheduled at 10:30 a.m. on Thursday, April 19, 2012. Mr. Kitzman will report back to the Board after the Advisory Board meeting. Driver Improvement Program Mr. Kitzman briefed the Board on a Driver Improvement Program for youth under 18 years of age who have a permit or driver's license and have received a citation for violation of Minnesota Traffic Law(s). The cost of the program will be paid by the juvenile traffic offender. OTC Conservation Committee Commissioner Johnson and Lindquist reported on a recent meeting of the Otter Tail County Conservation Committee. They indicated that, in their opinion, more citizens should be part of the committee in place of some of the government and/or former government officials. Motion by Huebsch, second by Froemming and unanimously carried to appoint Commissioner Johnson on the OTC Conservation Committee in place of Commissioner Huebsch. Commissioners Johnson and Lindquist will serve on the Committee on a regular basis and report back to the full County Board. OTC Board of Commissioners' Minutes April 3, 2012 Page 2 Sheriffs Department Staffing Motion by Froemming, second by Johnson, and unanimously carried to authorize the Sheriff to hire a Temporary employee to assist with office records during the summer. Motion by Lindquist, second by Johnson, and unanimously carried to reinstate Boat and Water staff for the 2012 summer boating season. Motion by Huebsch, second by Lindquist, and unanimously carried to authorize the Sheriff to replace a Corrections Officer from the full time Corrections Officer eligibility list, update the part time Corrections Officer eligibility list, and backfill two part time Corrections Officer positions as part time staff have moved to full time positions. Mahube-Otwa Community Action Partnership Leah Pigatti, Mahube-Otwa Executive Director, provided the 2011 Mahube Community Council, Inc. Annual Report and community demographic information for Becker, Hubbard, Mahnomen, Otter Tail and Wadena counties. She explained that Mahube and the Otter Tail Wadena Community Action Councils are consolidating and are now officially recognized as Mahube-Otwa Community Action Partnership. Discussion took place regarding programs, grants, and the process to bring more services into Otter Tail and Wadena counties. Commissioners thanked Ms. Pigatti for her report and requested that a press release be prepared to inform the public of the consolidation. Recess & Reconvene At 10:16 a.m., Chairman Rogness declared the meeting of the Otter Tail County Board of Commissioners recessed for a short break. The meeting was reconvened at 10:21 a.m. Courthouse Remodeling Discussion David Shultz, Architect, presented a site schematic for the courthouse remodeling project. He explained the proposed site changes and strategy to make the north primary entrance handicap accessible. Motion by Huebsch, second by Johnson, and unanimously carried to approve the concept presented for the courthouse site and outside sidewalks. The concept should preserve and emulate the existing structure of the north steps. Payment Approvals Motion by Johnson, second by Froemming, and unanimously carried to approve payment to Moore Costello & Hart, PLLP or Pemberton Sorlie Rufer & Kershner PLLP, in the amount of $696.11, for professional (mediation) services provided in the matter of Otter Tail County vs. Young & Associates, LTD et.al pursuant to Invoice No. 01143. Motion by Froemming, second by Huebsch, and unanimously carried to approve payment of $493.83 from the Capital Improvement Fund and $115.33 from the General Fund to the Otter Tail County Highway Department for Phelps Mill Foundation repair and other miscellaneous costs related to the Phelps Mill Park. Red River Basin Commission Funding Request Motion by Johnson, second by Lindquist, and unanimously carried to deny the request of the Red River Basin Commission for 2012 funding in the amount of $400.00. This expense has not been approved in the past and is not included in the budget. License Approval Motion by Johnson, second by Lindquist, and unanimously carried to approve the issuance of an Otter Tail County Tobacco License to Pelican Hills RV Park. CISCO Phone System OTC Board of Commissioners' Minutes April 3, 2012 Page 3 Motion by Huebsch, second by Johnson, and unanimously carried to authorize completion of the acceptance certificate for the CISCO phone system and approve final payment, in the amount of $58,299.40, to MARCO for the purchase and installation of the system. The motion includes direction to KeyBank National Association, as Escrow Agent under the Escrow Agreement dated August 9, 2011, to release $41,410.51 (balance) from the escrow account and approve payment of the balance due from the Capital Improvement Fund, in the amount of $16,888.89. County Ditches 41 and 65 Motion by Huebsch, second by Johnson, and unanimously carried to approve the Order for Redetermination of Benefits and Consolidation for County Drainage Systems #41 and #65 as submitted by the County Attorney. The Order will be attached to the ditch viewers' amended report and mailed to affected property owners. The drainage systems will be consolidated and referred to as County Ditch #41. Resolution Designating an Otter Tail County Commissioner to Serve as a Board Member on the New Five County Community Action Agency -Mahube/Otwa Representing Otter Tail County Otter Tail County Resolution No. 2012 -22 Upon a motion offered by Froemming, seconded by Lindquist, and unanimously carried, the following resolution was adopted: WHEREAS, Otter Tail-Wadena Community Action Council, Inc. has agreed to consolidate its services and service area with Mahube Community Council (the Community Action Agency currently serving Mahnomen, Hubbard and Becker counties); and WHEREAS, the State Department of Human Services, Office of Economic Opportunity has designated Mahube/Otwa as the new five county Community Action agency serving the counties of Mahnomen, Hubbard, Becker, Otter Tail, and Wadena counties; and WHEREAS, Federal and State statutes mandate that there be an elected official from each county serving on the Community Action Board of Directors; and_ NOW, THEREFORE, BE IT RESOLVED by the County Board of Commissioners of the County of Otter Tail that Commissioner Roger Froemming is appointed as the Otter Tail County Board of Commissioners representative on the Mahube/Otwa Board of Directors. Adopted at Fergus Falls, Minnesota, this 3rd day of April, 2012 Attest ~ ~ La;;;Kron, Cunty8oard Clerk missioners Chair OTC Board of Commissioners' Minutes April 3, 2012 Page 4 Drainage Inspector Motion by Johnson, second by Lindquist, and unanimously carried to authorize the hiring process for a full time Drainage Inspector to be located in the Highway Department at a salary grade equivalent to an Engineering Tech Ill. Motion by Lindquist, second by Johnson, and unanimously carried to appoint Rick West, Highway Engineer, as the County's interim Drainage Inspector. Lake Elevations Update Mr. West submitted current lake elevations for all of the County's pumping projects including; Lake Olaf, Johnson Lake, Oscar Lake, South & North Turtle Lakes, and Iverson Lake. Encroachment Permit Motion by Huebsch, second by Johnson, and unanimously carried to authorize the Chairman's signature to execute an Otter Tail County Encroachment Permit between the County of Otter Tail and R.D. Offutt Company referencing the following property: Part of the Northwest Quarter of Section 15, Township 136 North, Range 39 West, Otter Tail County, Minnesota. Closed to the Public At 11 :45 a.m., Chairman Rogness declared the Board of Commissioner's meeting closed to the public to discuss the pending appeal with the Board of Water and Soil Resources on a Wetland Conservation Act r,NCA) exemption claim for David Stock. The closed session is authorized under Attorney/Client privilege. Present were all five seated Commissioners, County Attorney, Land & Resource Director, Brad Mergens of the WOTSWCD, Kyle Westergard from the Land & Resource Department, a BWSR representative, and Board Secretary. At 12:23 p.m., the closed session continued under Attorney/Client privilege to discuss litigation strategies for the 60 Bed CARE facility. Present were all five seated Commissioners, County Attorney, and Board Secretary. Adjournment Upon completion of the closed session, at 12:40 p.m., Chairman Rogness declared the meeting of the Otter Tail County Board of Commissioners adjourned until 9:30 a.m. on Tuesday, April 10, 2012.
