Fir Avenue, Fergus Falls, MN March 27, 2012 9:30 a.m. Call to Order The Otter Tail County Board of Commissioners convened Tuesday, March 27, 2012 at 9:30 a.m., at the Otter Tail County Government Services Center in Fergus Falls, MN, with Commissioners Lee Rogness, Chair; Doug Huebsch, Vice-Chair; Wayne Johnson, John Lindquist, and Roger Froemming present. Approval of Agenda Chairman Rogness called for approval of the March 27, 2012 agenda. Motion by Froemming, second by Huebsch, and unanimously carried to approve the Board of Commissioners agenda of March 27, 2012 as mailed. Approval of Minutes Motion by Johnson, second by Huebsch, and unanimously carried to approve the Board of Commissioners meeting minut~s of March 20, 2012 as mailed. Approval to Pay Bills Motion by Lindquist, second by Johnson, and unanimously carried to approve payment of the County Board bills per Attachment A of these minutes. Little McDonald Lake Outlet Project Discussion Bill Kalar, Land & Resource Management Administrator, reported that a decision was made on February 21, 2012 by the County Board that an additional thirty (30) days was needed to answer questions/comments received during the Environmental Assessment Worksheet (EAW) public comment period for the Little McDonald Lake Outlet project. It was determined that additional information could reasonably be obtained and incorporated into the County Board's discussion for the Need for an Environmental Impact Statement (EIS). Since that time, an EAW Committee has met and additional research is being completed; however, an additional thirty (30) days is needed. Roger Neitzke, representing the Little McDonald, Kerbs & Paul Lake Improvement District, submitted a written statement indicating that the LMKP LID is in favor of extending the timeline. The County Attorney stated that when the research is complete and EAW concerns have been addressed, the County Board must decide whether or not there is the potential for significant environmental affects and if so, the scope of what needs to be addressed further. Motion by Johnson, second by Lindquist, and unanimously carried to approve an additional thirty (30) day extension for the EIS decision regarding the Little McDonald Lake Outlet project. A decision is planned for April 24, 2012, with previous discussion scheduled on the County Board's agenda April17,2012.· . . . . . Human Services Legislative Session Update John Dinsmore, Community Services Director, provided the March 23, 2012 MACSSA Legislative Update document. He highlighted SF 1402, known as the Children's Equal and Shared Parenting Act and HF 2294 which includes MACSSA revisions to the Vulnerable Children and Adults (VGA) formula and disagreements about the recommended funding formula. OTC Board of Commissioners' Minutes March 27, 2012 Page 2 2011 Human Services Annual Report Mr. Dinsmore submitted the 2011 Human Services Department Annual Report. He reviewed the introduction page including the County's total population of 57,303 residents and discussed various population groups. Commissioners requested time to review the remainder of the report. Mr. Dinsmore will return to the Board for further discussion. CHILD ABUSE PREVENTION PROCLAMATION Otter Tail County Resolution No. 2012 21 Upon a motion offered by Froemming, seconded by Huebsch, and unanimously carried, the following resolution was adopted: WHEREAS, child abuse prevention is a community problem and finding solutions depends on involvement among people throughout the community; WHEREAS, the effects of child abuse are felt by whole communities and need to be addressed by the entire community. WHEREAS, effective child abuse prevention succeeds because of partnerships created between parents, practitioners, schools, faith communities, health care organizations, law enforcement agencies, and the business community; WHEREAS, family-serving, youth-focused prevention programs offer positive alternatives for young people and encourage parents and youth to develop strong ties to their communities; WHEREAS, all citizens need to be more aware of child abuse and neglect and its prevention within the community, and be involved in supporting parents to raise their children in a safe, nurturing society. NOW, THEREFORE, BE IT RESOLVED, That the Otter Tail County Board of Commissioners hereby proclaim April 2012 as Child Abuse Prevention Month in Otter Tail County, and call upon all citizens, community agencies, religious organizations, medical facilities, and businesses to increase their participation in efforts to prevent child abuse and neglect, thereby strengthening the communities in which we live. Recess & Reconvene OTC Board of Commissioners' Minutes March 27, 2012 Page 3 At 10:07 a.m., Chairman Rogness declared the meeting of the Otter Tail County Board of Commissioners recessed for a short break. The meeting was reconvened at 10:12 a.m. Closed to the Public Chairman Rogness declared the meeting of the Otter Tail County Board of Commissioners closed to the public for purposes of discussing labor negotiation strategies regarding the Facilities Maintenance bargaining unit. Present were all five seated Commissioners, County Attorney, County Administrator, Interim Physical Plant Manager, Operations Supervisor, and Board Secretary. Fisheries Land Acquisition (Aquatic Management Areas) At 10:40 a.m., upon conclusion of the closed session, Howard Fullhart, DNR Fisheries Specialist, discussed DNR procedures for the acquisition of aquatic management areas. Mr. Fullhart explained the donation and funding requirements for the acquisitions. He indicated that the DNR Fisheries Department's main objective is to preserve shoreline around lakes. Commissioner Huebsch requested better transparency regarding the purchase price of acquired properties. Commissioners thanked Mr. Fullhart for the update and explanation of the process. Registered Land Survey Motion by Huebsch, second by Johnson, and unanimously carried to approve Registered Land Survey #17 as recommended by the Recorder. The survey corrects legal descriptions of the properties. AIS Task Force Update Bill Kalar submitted minutes from the March 21, 2012 AIS Task Force committee meeting. He reported that the three subcommittees; 1) Public Awareness, 2) Containment & Enforcement, and 3) Research & Policies, met prior to the AIS Task Force meeting. On behalf of the Task Force, Mr. Kalar requested approval of a laminated educational post card developed by the Association of Cass County Lakes. Chairman Rogness suggested that the postcard contain more white space for improved readability. Motion by Lindquist, second by Huebsch, and unanimously carried to authorize the Task Force to print and distribute 20,000 gloss coated AIS educational postcards at an approximate cost of $1,334.00 with the OTC logo that includes "Be A Part Of The Solution". The MN Aquatic Invasive Species video presentation will either be posted on the Otter Tail County website or the applicable links provided on the website. Lengthy discussion took place regarding watercraft inspections. Mr. Kalar informed the Board that the DNR will be providing six inspectors to cover about 2,046 hours of public access inspections. Commissioners suggested that, because there are 134 public accesses, that property owners around the lakes participate with volunteer time to match inspection time provided by the State and/or County. Motion by Huebsch, second by Froemming, and unanimously carried to accept the Local Government Unit reimbursement grant for hiring inspectors, in the amount of $7,750.00 and to send this back to the AIS committee to determine how it will be spent. Review of Courthouse Remodeling Plan David Shultz, Architect, submitted the Otter Tail County Facilities Master Plan and discussed the Courthouse building layout. He reviewed the layout on each floor of the Courthouse. Discussion followed. Motion by Huebsch, second by Johnson, and unanimously carried to proceed with bid preparations for the Otter Tail County Courthouse Phase I plan. Phase I includes Courthouse infrastructure, exterior improvements,, site work, courthouse security, remodel of the Law Enforcement Center, and structural repairs at the New York Mills office site at an approximate cost of $5,246,272.00. Anticipated Bid Opening date is May 3, 2012. Mr. Shultz will return to the Board next week for continued discussion regarding the site plan and various parking options. Bid Award -Highway Seasonal Supplies After previously advertising, bids were opened at 1 :00 p.m. on March 21, 2012, for the 2012 Highway Seasonal Supplies. Bids were presented to the County Board. Public Hearing Date Established Motion by Lindquist, second by Froemming, and unanimously carried to establish a Public Hearing at 10:00 a.m. on Tuesday, April 24, 2012, for the purpose of considering plans for redistricting of county commissioner districts in accordance with Minnesota Statutes, Section 375.01 to 375.025. Dog Bite Order Motion by Huebsch, second by Froemming, and unanimously carried to approve the Finding of Fact and Order as submitted by the County Attorney for a black lab named Jack owned by Harold and Kathryn Phillips. Committee Appointment Chairman Rogness appointed Commissioner Froemming to the MAHUBE Community Action Council Board as Otter Tail County's representative. Commissioner Froemming was previously on the Wadena/Otter Tail Community Action Council Board. The WOTCAC will now be a part of the MAHUBE organization.
