Fir Avenue, Fergus Falls, MN March 20, 2012 9:30 a.m. Call to Order The Otter Tail County Board of Commissioners convened Tuesday, March 20, 2012 at 9:33 a.m., at the Otter Tail County Government Services Center in Fergus Falls, MN, with Commissioners Lee Rogness, Chair; Doug Huebsch, Vice-Chair; Wayne Johnson, John Lindquist, and Roger Froemming present. Approval of Agenda Chairman Rogness called for approval of the March 20, 2012 agenda. Motion by Froemming, second by Lindquist, and unanimously carried to approve the Board of Commissioners agenda of March 20, 2012 as mailed. Approval of Minutes Motion by Huebsch, second by Froemming, and unanimously carried to approve the Board of Commissioners meeting minutes of March 13, 2012 as mailed. Approval to Pay Bills Motion by Lindquist, second by Johnson, and unanimously carried to approve payment of the County Board bills per Attachment A of these minutes. Years of Service Awards Employees' Committee Members, Scott Backstrom and Lynn Larson, presented "Years of Service Awards" to recognize County employees who have completed from 5 to 35 years of service with Otter Tail County. The Board expressed appreciation for their dedicated work. Recess & Reconvene At 9:40 a.m., Chairman Rogness declared the meeting of the Otter Tail County Board of Commissioners recessed to personally acknowledge employees receiving service awards. The meeting was reconvened at 10:00 a.m. Dog Bite Hearing Jessica Metzger, PHN reported that a black lab named Jack has two bites on record; therefore, the County Animal Bite and Control Ordinance requires that a hearing be held. Ms. Metzger explained the bite situations and submitted an Animal Bite Report. David Hauser, County Attorney, stated that the owner of the dog, Harold Phillips, does not dispute the fact that the bites occurred. The owners have a proposal and agreement with the Public Health Department that the dog will be kept in an indoor wire kennel when children are present in the house. The County Attorney will draft an Order of Findings and return to the Board for their approval. CARE Facility David Hauser reported that a letter has been received from the Pemberton Sorlie Rufer Kershner LLP law firm indicating that work on the case regarding the CARE Facility has moved to a contingency basis. Invoice 18437 (Services & Consultations) 688.00 Motion by Froemming, second by Huebsch, and unanimously carried to approve the following payments for costs related to the Courthouse Remodeling contracts approved in 2011 and as recommended by the Interim Physical Plant Manager: Otter Electric, LLC Shultz & Associates, LTD Invoice 728 (install sirens for panic buttons) Invoice 236 (construction administration) Transfer of Funds $2,916.16 1,200.00 Motion by Johnson, second by Lindquist, and unanimously carried to approve a transfer, in the amount of $431,231.68, from the Capital Improvement Fund to the Road and Bridge Fund for the following: Two Tandem Axle Mack Granite Series GU713 Trucks State Contract 443436 and 444042 Capital Improvement Committee Approval Code 20110405301004 Public Safety Discussion took place regarding Hillbilly's, a business that has a liquor license issued through the City of Erhard and a caterer's permit issued through the State Department of Public Safety. Commissioners expressed some concern for public safety in regard to events catered on lakes. The County currently does not have an ordinance to regulate catering. Commissioners referred this issue to the County's Emergency Manager to look into response to potential emergencies related to businesses operated on a lake(s). Agreement for Reconstruction of CSAH No. 34 Motion by Huebsch, second by Johnson, and unanimously carried to authorize the appropriate County Officials' signatures to execute an agreement between the County of Otter Tail and the City of Perham, MN for the reconstruction of CSAH No. 34, S.A.P. 056-634-010. Final Payment for S.A.P. 056-601-046 Motion by Lindquist, second by Froemming, and unanimously carried to approve Final Payment pursuant to Final Estimate No. 15, in the amount of $49,372.76, payable to Riley Bros Construction for a reconstruction project on CSAH No. 1, as recommended by the Highway Engineer. RESOLUTION Maintenance Cooperative Agreement between Otter Tail County and MN DNR Central Lakes State Trail Maintenance Otter Tail County Resolution No. 2012 -20 Upon a motion offered by Froemming, seconded by Huebsch, and unanimously carried, the following resolution was adopted: OTC Board of Commissioners' Minutes March 20, 2012 Page 3 WHEREAS, pursuant to Minnesota Statutes 84.026 and 471.59, subd. 10, the State is empowered to engage such assistance as deemed necessary and the State is in need of routine maintenance services on the Central Lakes Trail in Otter Tail County, AND WHEREAS, Otter Tail County is agreeable to provide the routine maintenance services as described in the Maintenance Cooperative Agreement for an annual rate of $1,100.00 per mile. BE IT RESOLVED, that Otter Tail County will provide the maintenance services as per the Maintenance Cooperative Agreement expiring December 25, 2012 at the annual rate of $1,100.00 per mile on the Central Lakes Trail. BE IT FURTHER RESOLVED, the County Board Chair and the County Board Clerk are hereby authorized and directed for and on behalf of the County of Otter Tail to execute and enter into an agreement with the MN Commissioner of Natural Resources prescribing the terms and conditions of same Maintenance Cooperative Agreement for the routine maintenance of the Central Lakes Trail expiring December 25, 2012. Adopted at Fergus Falls, Minnesota, this 20th day of March, 2012 Attest: /µ~ " Larrf Kroh~ County Board Clerk By: L Continuation of Public Hearing for County Ditch No. 41 & 65 At 10:32 a.m., Chair Rogness opened the Public Hearing for County Drainage Systems No. 41165. Speaking on behalf of the Ditch Viewers, Tiny Holm reported that three parcels were reviewed with two out of the three assessments being modified. Mr. Holm discussed the reasons for the changes. Motion by Johnson, second by Huebsch, and unanimously carried to accept the County Drainage System No. 41165 Ditch Viewers Report as amended and submitted on March 20, 2012. Chairman Rogness closed the Public Hearing at 10:45 a.m. 2012 Boat and Water Grant Motion by Huebsch, second by Johnson, and unanimously carried to authorize the appropriate County Officials' signatures to execute the 2012 State of Minnesota Annual County Boat and Water Safety Grant Agreement (contract #42569) between the County of Otter Tail and State of Minnesota. The State grant dollars, in the amount of $44,602.00, will be used toward Boat and Water Officer salaries. There is no local grant match requirement. Committee Updates Commissioner Huebsch updated the Board on his testimony at the State Environmental Committee regarding a proposed amendment that would make it difficult to pump water out of the State of Minnesota. He indicated that the resolution passed committee and was sent to the Association of Minnesota Counties. Motion by Johnson, second by Lindquist, and unanimously carried to authorize per diem and expenses for Commissioner Huebsch to testify at the Environmental Committee. Commissioner Huebsch updated the Board regarding potential cumulative testing for air modeling for the Perham Resource Recovery Facility construction project. Chairman Rogness authorized Commissioner Johnson to attend the OTC Conservation Advisory Committee meeting on March 21, 2012, in place of Commissioner Huebsch.
