Fir Avenue, Fergus Falls, MN March 13, 2012 9:30 a.m. Call to Order The Otter Tail County Board of Commissioners convened Tuesday, March 13, 2012 at 9:30 a.m., at the Otter Tail County Government Services Center in Fergus Falls, MN, with Commissioners Lee Rogness, Chair; Doug Huebsch, Vice-Chair; Wayne Johnson, John Lindquist, and Roger Froemming present. Approval of Agenda Chairman Rogness called for approval of the March 13, 2012 agenda. Motion by Froemming, second by Lindquist, and unanimously carried to approve the Board of Commissioners agenda of March 13, 2012 with the following change: Reschedule the Personnel Committee meeting with the Facilities Maintenance Department to the March 20, 2012 meeting to allow Commissioners to attend annual township meetings Approval of Minutes Motion by Johnson, second by Froemming, and unanimously carried to approve the Board of Commissioners meeting minutes of March 6, 2012 as presented. Approval to Pay Bills Motion by Huebsch, second by Johnson, and unanimously carried to approve payment of the County Board bills per Attachment A of these minutes. Seasonal Staff -Solid Waste Department Motion by Huebsch, second by Lindquist, and unanimously carried to approve the following Solid Waste staffing decisions as recommended by the Solid Waste Director: (1) For May of 2012 through September of 2012 -move a Recycling Worker to a Recycling Operator position which is a working out of classification assignment; and (2) Hire two (2) temporary Recycling Workers for the summer season Solid Waste Hauler's License Motion by Huebsch, second by Lindquist, and unanimously carried to approve a Solid Waste Hauler's License for Big Red Boxes, Robert Stockinger, located at 18613 Co. Hwy. 10, Elizabeth, MN 56533. Fraud & Collection Annual Report Sandy Halo, Investigator/Collections Supervisor, submitted a 2011 annual Fraud Investigation Program Activity Report. She reviewed the administrative disqualification activities resulting from overpayments to Human Services clients. Total reimbursements of $29,908 were reported for calendar year 2011. Crystal Herman, Collections Officer, reported collections (mostly for recovery of medical assistance expenses) of $969,358.96 for 2011 with $284,529.25 retained by Otter Tail County and the remainder sent to the State arid Federal government. LeeAnn Sudbeck from Income Maintenance, submitted a report regarding chemical dependency assessment, detox fees, and out of home placement fee recoveries. She reported recovery fees of $162,018.22. Total combined collections for the year were reported as $1,131,377.18. OTC Board of Commissioners' Minutes March 13, 2012 Page 2 Human Services Contract Renewals Motion by Lindquist, second by Froemming, and unanimously carried to authorize the appropriate County Officials' signatures to execute the following Contract renewals with Otter Tail County Human Services: Effective Targeted Amount of Contract & Agency Program Date Population Funding Source 01-01-12 Clients eligible for AC/EW/CADl!TBI or CAC Waiver Arvig's Enterprise, Supplies & Equipment through ACIEWICADl!TBI Funds (unit cost not to exceed Inc. or CAC/MRRC 12-31-12 Waiver Funds $29.95 per month) Good Samaritan 02-01-12 AC/EW/CADl!TBI or CAC Waiver Society, Pelican Customized Living Services through Elderly Funds (per rate schedule) Raoids Senior Livina 12-31-13 Human Services Staffing Motion by Lindquist, second by Huebsch, and unanimously carried to authorize the Community Services Division Director to replace a Financial Assistance Supervisor position due to a recent retirement. Human Service Bills & Claims Motion by Johnson, second by Lindquist and unanimously carried to approve the Human Services Bills and Claims as presented. Auditor's Informational Handouts Wayne Stein, Auditor, provided the following documents to Board members: 1. March 13, 2012 Township Annual Meeting Schedule 2. Pay 2012 Tax Rates 3. Township Levy Information 4. DNR Letter dated March 8, 2012 regarding an 8.1 acre parcel in Sections 8 and 17 of Buse Township (Dayton Hollow Reservoir) 5. Ditch No. 41/65 Worksheet Liquor License Application Motion by Johnson, second by Lindquist, and unanimously carried to approve the following application for license: Fair Hills Resort 24270 County Highway 20 PO Box6 Detroit Lakes, MN 56502 On-Sale Seasonal Liquor and Sunday Liquor (This application is subject to the approval of the Otter Tail County Sheriff and Attorney's Offices.) Recess & Reconvene At 10:16 a.m., Chairman Rogness declared the meeting of the Otter Tail County Board of Commissioners recessed for a short break. The meeting was reconvened at 10:20 a.m. Aggregate Production Tax Fred Corrigan, Executive Director of Aggregate and Ready Mix Association of Minnesota, referred to a resolution the Board passed March 6, 2012, in support of the City of Vergas to request the State Legislature to enable the City to implement and collect a gravel extraction tax. He expressed concerns about local government's ability to collect and monitor the proposed gravel extraction tax dollars. He stated that Otter Tail County is rich in aggregate and this resource is expected to become scarce. He expressed concerns regarding gravel preservation and reclamation of abandoned gravel pits, discussed the tax formula and indicated that the tax amount for local entities has been increased. ,. OTC Board of Commissioners' Minutes March 13, 2012 Page 3 Mr. Corrigan requested that the County enact a gravel extraction tax rather than local entities. Several contractors spoke against a gravel tax; however, they would prefer a county wide tax rather than random local entities enacting the tax. Chairman Rogness thanked everyone for their input. Commissioners requested time to study this issue further and consider various options. MINNESOTA'S STRATEGIC & CRITICAL RESOURCE Otter Tail County Resolution #2012 -17 WHEREAS, the Water Allocation Priority Bill is proposed to amend Minnesota Statutes 2010, sections 103G.261; 103G.265, subdivision 2, by adding a subdivision; and WHEREAS, the diversion or sale of water out of Minnesota could have a long-term detrimental effect on Otter Tail County; and WHEREAS, Otter Tail County citizens' life styles depend on water for food production, manufacturing, energy and tourism; and WHEREAS, water is Minnesota's strategic and critical resource that must be conserved and reserved for the future; and WHEREAS, water is one of the most limiting resources in the world and it is the resource that gives Minnesota, and Otter Tail County, a competitive advantage; and WHEREAS, unlike other natural resources such as oil and other minerals that we mine and sell, we use our water and then put it back in our aquifer; and WHEREAS, if Minnesota's water were allowed to be sold or diverted, Otter Tail County risks being unable to live our lives.as we are accustomed; and WHEREAS, during wet times, the aquifers fill up and recharge so during dry times, we use it to grow food and live; and WHEREAS, this is our cycle to preserve our water resources and it works; and WHEREAS, if ~ater is exported, jobs and livelihoods will leave with it; and WHEREAS, exporting water could cause aquifers to run dry or at the very least, negatively affect ground water for basic needs. NOW, THEREFORE, IT IS HEREBY RESOLVED that the Otter Tail County Board of Commissioners supports amending Sec. 3. Minnesota Statutes 2010, section 103G.265, by adding Subd. 2a. entitled Legislative approval for diversion or sale: and Upon the motion of Commissioner Lindquist, seconded by Commissioner Froemming, the Otter Tail County Board 91 Commissioners passes the foregoing resolution by the following vote: Board of County Commissioners Wayne D.Johnson Roger Froemming John Lindquist Douglas A. OTTER COUNTRY TRAIL ASSOCIATION (OCTA) GRANT-IN-AID FUNDING Otter Tail County Resolution No. 2012 • 18 Commissioner Huebsch offered the following and moved its adoption: WHEREAS, Otter Tail County has sponsored Grant-In-Aid Systems in the past; and WHEREAS, acceptance of the Grant-In-Aid Systems proposed extensions are subject to the review and approval of the County Attorney. THEREFORE, BE IT RESOLVED that Otter Tail County shall continue to sponsor Grant-In-Aid Trail Systems as they exist for the Otter Country Trail Association Snowmobile Club for the 2012-2013 snowmobile season and proposed extensions of Grant-In-Aid Trails with the aforementioned condition. Commissioner Froemming seconded the resolution and, upon being put to vote, the resolution was unanimously adopted. Adopted this 13th day of March, 2012 Dated: --=0=3:..,/,....,~=.,.,...,/~"-"o"'/ <&""'-- Attest: _.4t.,... ... ~"'1"""1'-L~-~----Larry Kr&hn,Clerk LIMITED USE PERMIT FOR SNOWMOBILE TRAIL Otter Tail County Resolution No. 2012 • 19 NERS At a regular meeting of the Otter Tail County Board of Commissioners, duly held on the 13th day of March, 2012, the following resolution was offered by Commissioner Froemming and seconded by Commissioner Johnson: WHEREAS, the Commissioner of Transportation of the State of Minnesota has made available certain Trunk Highway right-of-way as shown in red on exhibit "A" in the Limited Use Permit Snowmobile Trail Agreement (LUP #5602-0023) made part thereof, for the purpose of constructing, maintaining and operating a snowmobile trail; and OTC Board of Commissioners' Minutes March 13, 2012 Page 5 WHEREAS, the County of Otter Tail desires to make available to its citizens and visitors, such an area for the aforementioned purposes, in harmony and keeping with its recreational plan; and WHEREAS, the County of Otter Tail is willing to operate, maintain, and safeguard the facility as set forth in the Limited Use Permit for Snowmobile Trail Agreement (C.S. 5602 T.H.210, et al.). NOW THEREFORE, BE IT RESOLVED, that the Chairperson of the Board of County Commissioners execute the aforesaid Limited Use Permit. Chairman Rogness called for a vote and the resolution was adopted unanimously. The Land & Resource Administrator and County Attorney will return to the Board with a draft response. Otter Tail County Conservation Advisory Committee Motion by Johnson, second by Froemming, and unanimously carried to appoint Commissioners Lindquist and Huebsch to serve on the Otter Tail County Conservation Advisory Committee. The first meeting is March 21, 2012 at the Prairie Wetland Learning Center in Fergus Falls. Adjournment At 11:14 a.m., Chairman Rogness declared the meeting of the Otter Tail County Board of Commissioners adjourned until 9:30 a.m. on Tuesday, March 20, 2012.
