Fir Avenue, Fergus Falls, MN March 6, 2012 9:30 a.m. Call to Order The Otter Tail County Board of Commissioners convened Tuesday, March 6, 2012 at 9:33 a.m., at the Otter Tail County Government Services Center in Fergus Falls, MN, with Commissioners Lee Rogness, Chair; Wayne Johnson, John Lindquist, and Roger Froemming present. Approval of Agenda Motion by Lindquist, second by Johnson, and unanimously carried to approve the Board of Commissioners agenda of March 6, 2012 with the following changes: Add Auditor Wayne Stein at 10:30 a.m. Add Resolution to Support the City of Vergas Request to Enact a Gravel Tax 10:10 a.m. Add Closed Session at end of meeting for Labor Negotiation strategies Approval of Minutes Motion by Johnson, second '.by Undquist;-and unanimously carried to approve the Board of Commissioners meeting minutes of February 28, 2012 as presented. Approval to Pay Bills Motion by Froemming, second by Johnson, and unanimously carried to approve payment of the County Board bills per Attachment A of these minutes. Update on Intelligent Transportation Systems Max Donath, Director of the Intelligent Transportation Systems Institute gave a presentation to the Board on how the ITS Institute is using emerging technologies that are human centered to help reduce fatalities. One of their focuses is on the Teen Driver project. ITS is working on a Teen Driver Support System that relies on the capabilities of a teens smartphone to detect things such as seatbelt latch detection and passenger occupancy. Another focus is intersection crashes. Review and Recommendation for Award S.A.P. 056-599-058 After previously advertising and reviewing bids for SAP. 056-599-058, (Grading and Agg. Base, Bit, Surfacing Agg. Shoulders and Bridge Construction, Bridge No. 56542) the Highway Engineer presented his bid award recommendation. Motion by Johnson, second by Lindquist and unanimously carried to award SAP. 056-599-058 to Korby Contracting Co, Inc. of Fergus Falls, MN for the amount of $340,945.85 as recommended by the Highway Engineer. Central Lakes Trail Agreement Renewal Motion by Froemming, second by Lindquist and unanimously carried to renew the maintenance agreement with the DNR for the Central Lakes Trail. Support of the City of Vergas Request to Enact a Gravel Tax Otter Tail County Resolution No. 2012-16 A RESOLUTION IN SUPPORT OF THE CITY OF VERGAS TO REQUEST THE STATE LEGISLATURE TO ENABLE THE CITY OF VERGAS, OTTER TAIL COUNTY TO IMPLEMENT AND COLLECT A GRAVEL EXTRACTION TAX. Commissioner Johnson offered the following and moved for its adoption: WHEREAS, The City of Vergas has a large deposit of aggregate material within the city. OTC Board of Commissioners' Minutes March 6, 2012 Page 2 WHEREAS, The City of Vergas has a large volume of truck traffic through the city. WHEREAS, The City of Vergas may someday have to deal with the reclamation of the gravel mine within its borders. WHERAS, Otter Tail County has declined to enact a county wide gravel extraction tax because the county Commission feels it may adversely affect some smaller operations in Otter Tail County. NOW , THEREFORE BE IT RESOLVED, That the Otter Tail County Board of Commissioners of Otter Tail County, Minnesota, does hereby request that the state legislature enact legislation pursuant to Minnesota Statutes Chapter 298, allowing the City of Vergas to implement a gravel extraction until such a time that Otter Tail County would implement a county wide gravel extraction tax. Staffing Request Motion by Lindquist, second by Johnson and unanimously carried to approve the Public Health Director to hire two full time Public Health Nurse Positions. Exempt Permit Motion by Froemming, second by Johnson and unanimously carried to approve, with no waiting period the LG220 Application for Exempt Permit as submitted by the East Otter Tail Deer Hunter's Chapter for an event scheduled for Friday, April 13, 2012 at Whiskey River located at 43974 390th St. Payments Approval Motion by Lindquist, second by Froemming and unanimously carried to approve payment from the Capital Improvement Fund Phelps Mill Account: Barr Engineering Co Invoice No. 23561011.00-1 $5,068.23 Motion by Johnson, second by Froemming and unanimously carried to approve payment from the Capital Improvement Fund Building Maintenance Account: G&R Controls, Inc Invoice No. F0330FED $25,959.92 Motion by Lindquist, second by Froemming and unanimously carried to approve payment from the General Revenue Fund: Pemberton Sorlie-Rufer Kershner PLLP 56201200945 $320.00' Pemberton Sorlie Rufer Kershner PLLP 56201200946 100.00" '(Civil Filing Fee -Otter Tail County vs Young & Associates Architects, Ltd and Comstock Construction) .. (Jury Fee -Otter Tail County vs Young & Associates Architects, Ltd and Comstock Construction) Recess & Reconvene OTC Board of Commissioners' Minutes March 6, 2012 Page 3 At 10:32 a.m., Chairman Rogness declared the meeting of the Otter Tail County Board of Commissioners recessed for a short break. The meeting was reconvened at 10:38 a.m. with Commissioner Huebsch present. Buffalo-Red Watershed District Letter Motion by Johnson , second by Lindquist and unanimously carried to approve sending a letter from the Board to the Executive Director of the MN Board of Water and Soil Resources regarding the Petition to enlarge the Buffalo-Red River Watershed District with the changes as discussed. Community Services Division Manager Position County Administrator, Larry Krohn announced that John Dinsmore has been appointed as the Community Services Division Manager. Motion by Huebsch, second by Johnson and unanimously carried that the County Board acknowledged that both candidates for the position were very well qualified, did an excellent job in presentations and that the choice was very difficult. Purchase of Can Crusher for Household Hazardous Waste Motion by Huebsch, second by Johnson and unanimously carried to accept the bid of $20,800 from TeeMark of Aitkin, MN for the purchase of a can crusher for the Household Hazardous Waste Department. The Solid Waste department will ·1ook into selling ·the old equipment. Recess & Reconvene At 11 :02 a.m., Chairman Rogness declared the meeting of the Otter Tail County Board of Commissioners recessed for Committee meetings and lunch. The meeting was reconvened at 1:00 p.m. Public Hearing for County Ditch No. 41 & 65 Sheldon Holm reviewed the Ditch Viewers report and changes made to the original report. A letter was received from Scott Anderson asking for his property to be reviewed. Property owners, Kevin Dryer (represented by Wendell Dryer) and Larry Drager also asked to have their properties reviewed again. Motion made by Froemming, second by Lindquist and unanimously carried to review all three properties. Motion made by Johnson, second by Lindquist and unanimously carried to continue the Public Hearing for County Ditch No. 41 & 65 until March 20, 2012 at 10:30 a.m. Meeting Attendance Motion by Johnson, second by Froemming and unanimously carried to have Commissioner Lindquist and Commissioner Rogness attend the Courthouse Remodeling Planning Meeting scheduled for Wednesday, March 7, 2012 at 7:30 a.m. at the Courthouse. Recess & Reconvene At 1:33 p.m., Chairman Rogness declared the meeting of the Otter Tail County Board of Commissioners recessed for a Personnel Committee meeting. The meeting reconvened at 1 :56 p.m. County Wide Zoning Discussion Land and Resource Director, Bill Kalar provided a copy of the recommendations from the 1998 Land Use Study Advisory Committee. This committee was formed back then to look into Country Wide Zoning. A lengthy discussion followed. Motion was made by Johnson, second by Huebsch and unanimously carried to have the County Administrator propose a plan on how to proceed with a comprehensive land use plan. Closed to the Public At 3:11 p.m., Chairman Rogness declared the meeting of the Otter Tail County Board of Commissioners closed to the public for purposes of discussing labor negotiation strategies relative to the re-opener provision of the Facilities Operations collective bargaining agreement. Present were all five seated Commissioners, County Administrator, County Attorney, and Acting Board Secretary. OTC Board of Commissioners' Minutes March 6, 2012 Page 4 Reconvene The meeting of the Otter Tail County Board of Commissioners was reconvened at 3:32 p.m. Buffalo-Red Watershed District Letter Motion made by Huebsch, second by Froemming and unanimously carried to include in the letter previously approved to the Executive Director of the MN Board of Water and Soil Resources regarding the Petition to enlarge the Buffalo-Red River Watershed District language, stating that managers for each County will be appointed by their respective County Boards. Adjournment At 3:52 p.m., a motion was offered by Huebsch, seconded by Lindquist and carried, to declare the meeting of the Otter Tail County Board of Commissioners adjourned until 9:30 a.m. on Tuesday, March 13, 2012.
