Fir Avenue, Fergus Falls, MN February 7, 2012 9:30 a.m. Call to Order The Otter Tail County Board of Commissioners convened Tuesday, February 7. 2012 at 9:30 a.m., at the Otter Tail County Government Services Center in Fergus Falls, MN, with Commissioners Lee Rogness, Chair; Doug Huebsch, Vice-Chair; Wayne Johnson, John Lindquist, and Roger Froemming present. Approval of Agenda Chairman Rogriess called for approval of the February 7, 2012 agenda. Motion by Huebsch, second by Froemming, and unanimously carried to approve the Board of Commissioners agenda of February 7, 2012 with the following additions: 11 :25 a.m. -Emergency Manager, Patrick Waletzko 11:55 a.m. -Highway Committee Meeting Approval of Minutes Motion by Lindquist, second by Johnson, and unanimously carried to approve the Board of Commissioners meeting minutes of January 24. 2012 as presented. Approval to Pay BIiis Motion by Huebsch, second by Johnson. and unanimously carried to approve payment of the County Board bills per Attachment A of these minutes. DWI Court Funding Motion by Lindquist, second by Johnson, and unanimously carried to authorize the appropriate County Officials' signatures to execute an Agreement for Professional Services between State of Minnesota, Seventh Judicial District and Otter Tail County Probation for the period of October 1, 2011 through September 30, 2012. The agreement identifies services provided for the State DWI Court Program with the enhancement grant dollars. 2011 Probation Annual Report Chuck Kitzman, Probation Director. and Amy Kampa, Administrative Assistant, presented the Otter Tail County Probation 2011 Annual Report. Mr. Kitzman reviewed types of offenses, age of offenders. and various probation programs utilized during calendar year 2011. He provided a document entitled Probation Officer Duties and Responsibilities dated 02/07/12 and identified probation duties that have been added by the legislature since 1980. He indicated that. because of added duties, each case requires more time and review. Presentation of United Way Awards Chairman Rogness presented resolutions of appreciation for work with the United Way to Scott Backstrom and Steve Andrews. Mr. Backstrom accepted an award on behalf of Otter Tail County employees who have donated generously to the United Way Campaign and to Steve Andrews, County Treasurer, for many hours of volunteer service with the organization OTC Board of Commissioners' Minutes February 7, 2012 Page 2 Lakes Wind 116kV Transmission Line Project Motion by Johnson, second by Froemming, and unanimously carried to approve a letter to the Clay County Board of Commissioners dated February 7, 2012, as submitted by the County Attorney. The letter agrees that Clay County proceed as the local Government Unit for the environmental review for the Lakes Wind Transmission Line project. Commissioner Johnson stated that ProJect Resources Corporation will be conducting a public hearing on the project at Scambler Town Hall to insure Otter Tail County residents a venue to provide comment and/or concerns. Recess & Reconvene At 10:11 a.m., Chairman Rogness declared the meeting of the Otter Tail County Board of Commissioners recessed for a short break. The meeting was reconvened at 10:16 a.m. Cohorts Leadership Program Motion by Huebsch, second by Lindquist, and unanimously carried to continue the Cohort Leadership program provided that there are twenty (20) employees who agree to participate. The motion is also subject to the requirement that all Division Leaders attend the next Cohort Leadership session. Highway Department Staffing Motion by Johnson, second by Huebsch, and unanimously carried to replace the Highway Maintenance Supervisor position as recommended by the Highway Engineer. Motion by Huebsch, second by Lindquist, and unanimously carried to authorize a promotion for Ryan Anderson from Engineering Technician II to Engineering Technician Ill effective January 1, 2012, due to completion of educational requirements. CITY OF PARKERS PRAIRIE RESOLUTION NO. 12-08 A RESOLUTION PERMITTING ENCROACHMENT AND OTTER TAIL COUNTY ENCROACHMENT PERMIT OTTER TAIL COUNTY RESOLUTION NO. 2012 • 07 THIS ENCROACHMENT PERMIT is granted by the City of Parkers Prairie, a municipal corporation under the laws of the State of Minnesota ("City") and Otter Tail County, Minnesota (the "County"). RECITALS A. Sanford Clinic North, a North Dakota non-profit corporation ("Owner") is the owner of the following described real property located in the City of Parkers Prairie, County of Otter Tail. State of Minnesota: lots 4, 5 and 6, Block 31, LAKE VIEW ADDITION TO PARKERS PRAIRIE, Otter Tail County, Minnesota, according to the recorded plat on file and of record in the office of the County Recorder, Otter Tail County, Minnesota. ("Owner's Property") B. Adjacent lo and North of the Owner's Property lies Sao Street, also known as County State Aid Highway 42, consisting of a 100' right-of-way ("Sao"). Soo was dedicated as part of the plat for the Lakeview Addition to the City of Parkers Prairie. and is maintained by Otter Tail County. A recent survey of the Owner's Property disclosed that the North line of the building located on· Owner's 'P'roperty encroaches onto Sao ("Encroachment") approximately one foot (current survey shows 'a maximum encroachment of 0.7 feet) (the "Encroachment Area"). D. · The Owner has requested the City and the County to grant a permit allowing the Encroachment to remain on Sao, and the City and County are willing lo do so on certain terms and conditions PERMIT NOW, THEREFORE, the City and County agree as follows: 1. To the extent of the City and County's respective jurisdiction and control over Sao St., the Encroachment: shall be permitted to remain in the Encroachment Area, and may be maintained and repaired as reasonably required. However, no enlargement of the Encroachment, including any repair or modification which would result in an addition .to, or enlargement of, the Encroachment, shall be made without the prior written approval of the City and the County. 2. In the event the Encroachment or any portion thereof is removed or destroyed, or damaged so as to make, repair or replacement thereof unfeasible, this permit will terminate as to the Encroachment or that portion'so removed, destroyed or damaged, and the Encroachments or such portion thereof may not be rebuilt, except within the boundary lines of Owner's Property. 3. · This permit shall be appurtenant to and run with the Owner's Property. Upon the motion of Commissioner Froemming, seconded by Commissioner Johnson, the Otter Tail County Board of Commissioners adopts the foregoing resolution by a unanimous vote. CONSTRUCTION AGREEMENT NO. 00470 Otter TaH County Resolution No. 2012 -12 IT IS RESOLVED that Otter Tail County enter into Mn/DOT Agreement No. 00470 with the State of Minnesota, Department of Transportation for the following purposes: OTC Board of Commissioners' Minutes February 7, 2012 Page4 To provide for payment by the County to the State of the County's share of the costs of the intersection improvement construction and other associated construction to be performed upon, along and adjacent to Trunk Highway No. 210 at County State Aid Highway No. 82/Pebbte Lake Road with the corporate limits of the City of Fergus Falls under State Aid Project No. 056-682-010, State Aid Project No. 126-132-002 and State Project No. 5602-21. IT IS FURTHER RESOLVED that Leland R. Rogness, County Board Chair and Larry Krohn, County Board Clerk, are authorized to execute the Agreement and any amendments to the Agreement. Upon the motion of Commissioner Johnson, seconded by Commissioner Lindquist and unanimously carried, the Otter Tail County Board of Commissioners adopts the foregoing resolution. Payment Approvals Motion by Froemming, second by Johnson, and unanimously carried to authorize the County Auditor to apply for a 2012 HAVA Operating Grant through the Office of the Minnesota Secretary of State. The grant amount is limited to $300 per polling location. Motion by Lindquist, second by Huebsch, and unan·Imously earned to approve payment, in the amount of $3,198.01, from the Capital Improvement Fund {Phelps Mill Account) to Kadrmas, Lee and Jackson, Inc. for design· engineering services provided' for the Historic Phelps Mill Bridge Restoration pro1ect (S.P. 56-090-07) through the period ending December 31, 2011. Motion by Froemming, second by Johnson, and unanimously carried to approve payment, in the amount of $675.00, from the General Revenue Fund to Braun lntertec for building science services provided through December 31, 2011 for the CARE Facility. Application for License Motion by Johnson, second by Lindquist. and unanimously carried to approve the following application for license: Wee Villa Resort LLLP Wee Villa Lodge 31126 County Highway 27 Fergus Falls, MN 56537 Renewal of Consumption and Display Permit Date Change for Exempt Permit Application Motion by Johnson, second by Froemming, and unanimously carried to approve, with no waiting period, the LG220 Application for Exempt Permit as submitted by Pelican Rapids Jaycees for an event scheduled for Saturday, February 11, 2012 at Lake Lida in Lida Township. This is a date change from January 28. 2012 to February 11, 2012. OTC Board of Commissioners· Minutes February 7, 2012 Page 5 Red River Valley Development Association Reappointment Motion by Rogness, second by Froemming, and unanimously carried to reappoint Daniel Roehl to the Red River Valley Development Association Board of Directors. Mr. Roehl's three (3) year term will begin at the annual meeting in March of 2012. Ditch No. 41 & 65 Redetermination of Benefits Wayne Stein, County Auditor. submitted the Redetermination of Benefits for Ditch No. 41 & 65 as previously reported for the January 9, 2012 Public Hearing and the revised Redetermination of Benefits for the March 6, 2012 Public Hearing. The original total value of the ditches was $471,117.04 with the revised total value rep9rted as $459,324.34. Motion by Huebsch, second by Johnson, and unanimously carried to send a cover letter and a report to the property owners on Ditch No. 41 & 65 including the parcels reviewed by the ditch viewers and their recommended changes. The complete amended Auditor's Statement will be posted to the Otter Tail County website. The motion also indicated that due to a decreased total value of the redetermination, the percentage may increase for some parcels; however all accumulated changes will be less than 3%. This is a sub- committee of the Central Minnesota Emergency Services Board. Delta Dental Contract Motion by Johnson, second by Lindquist, and unanimously carried to approve, as submitted, the Delta Dental of Minnesota Group Plan/Policy effective January 1, 2012. OTC Board of Commissioners' Minutes February 7, 2012 Page 6 Public Employee Retirement Association Seminars Motion by Huebsch, second· by Johnson, and unanimously carried to approve attendance at PERA retirement counseling sessions for employees within 2-5 years of retirement. Informational sessions for all members will also be available with attendance based on departmental needs. The meetings are tentatively scheduled on May 3, 2012 at the Government Services Center. OTTER TAIL COUNTY RESOLUTION #2012-11 Aquatic Invasive Species WHEREAS. aquatic invasive species are undesirable as they destroy existing natural habitats and compete with native species for resources; and WHEREAS, zebra mussels have proven to be a very aggressive aquatic invasive species that damage businesses, tourism and property values in addition to the environmental harm to fisheries and aquatic life, negatively affecting our quality of life; and WHEREAS, it is recognized that the Department of Natural Resources has a limited capacity, with the number of Conservation Officers available, to strictly enforce all the laws relating to aquatic invasive species; and WHEREAS, the limited funds available from the state provided some funding opportunities to provide inspections at public accesses, however, Otter Tail County applied for the inspection grants but did not receive any funding; and WHEREAS, Otter Tail County has 134 public accesses; and WHEREAS, Otter Tail County has 1,049 lakes, 1,174 miles of rivers, and 276,568 acres of wetlands, which are an endangered resource to the county and state; and WHEREAS, the Department of Natural Resources continues to purchase additional lands in the state, taking them out of productive agricultural use, and such lands are often not being managed well, including permitting noxious weeds and invasive species to spread; and WHEREAS, properties purchased by the Department of Natural Resources are taken off the tax rolls, and although there are some payments made in lieu of taxation, they are less than the taxes would have been and payments from the state are proving to be less reliable, limiting local units of government's ability to fund programs; and WHEREAS, the Department of Natural Resources would better serve the state by protecting existing resources than expanding publicly owned resources; and WHEREAS, a Constitutional Amendment, Article VI I section 15, Outdoor Heriiage (Lessard Sams), provides additional funding for the outdoor heritage, clean water, parks and trails, and arts and cultural heritage, and WHEREAS, educational programs regarding aquatic invasive species, limiting the spread of aquatic invasive species, and changing behaviors contributing to the spread need to be expanded. NOW, THEREFORE, IT IS HEREBY RESOLVED that the Department of Natural Resources spend less money expanding government ownership of lands, and instead spend those funds to protect the existing resources of the state including clean water; and OTC Board of Commissioners' Minutes February 7, 2012 Page 7 BE IT FURTHER RESOLVED that the Department of Natural Resources also uses Lessard-Sams money to protect our lakes and rivers. Upon the motion of Commissioner Huebsch, seconded by Commissioner Johnson, the Otter Tail County Board of Commissioners passes the foregoing resolution by the following vote: Board of County Commissioners Wayne D. The Agreement period is from January 1, 2012 through December 31, 2019 Closed to the Public At 11 :44 a.m., :Chairman Rogness declared the Board of Commissioner's meeting closed to the public to discuss litigation strategies for the 60 Bed CARE facility as authorized under Attorney/Client privilege. Present were all five seated Commissioners, County Attorney, County Administrator, and Board Secretary Adjournment At 11 :59 a.m., a motion was offered by Johnson, seconded by Froemming and carried, to declare the meeting of the Otter Tail County Board of Commissioners adjourned until 9:30 a.m. on Tuesday, February 14, 2012.
