Call to Order
The Otter Tail County Board of Commissioners convened Tuesday. January 17, 2012, at 9:33 a.m., at the
Otter Tail County Government Services Center in Fergus Falls, MN, with Commissioners Lee Rogness,
Chair; Doug Huebsch, Vice-Chair; Wayne Johnson, John Lindquist, and Roger Froemming present.
Approval of Agenda
Chairman Rogness called for approval of the January 17, 2012 agenda. Motion by Froemming, second by
Lindquist, and unanimously carried to approve the Board of Commissioners agenda of January 17, 2012,
with the following modifications:
Solid Waste Committee Meeting-changed from 11:15 a.m. to 9:00 a.m.
Ditch No. 41 & 65-Redetermination-10:15 a.m. under General Discussion
Approval of Minutes
Motion by Johnson, second by Huebsch, and unanimously carried to approve the Board of Commissioners
meeting minutes of January 1 O. 2012 as mailed.
Approval to Pay BIiis
Motion by Johnson, second by Huebsch, and unanimously carried to approve payment of the County
Board bills per Attachment A of these minutes.
USFWS Fee Acquisition Request
Chairman Rogness requested that Don Kleven, USFWS Realty Specialist, present his acquisition request
which will be. added to the January 24, 2012 County Board agenda for action. This will provide
commissioners time to further research the request. Mr. Kleven requested certification to purchase 338.5
acres of land as a fee purchase from John P. Tungseth, Trustee. The land is located in Sections 14 and
15 in Buse Township. There is a Wetland Protection Area CNPA) north of the proposed acquisition. The
property consists of 145 acres of wetlands in twelve wetland basins, crop land, grass, and an unused
building site. A lengthy discussion followed regarding the one-time payment to the County of $32,150.00
and the shared revenue payment of $1,030.00 to offset the loss of tax revenue on the property.
Discussion also took place regarding the enhancement of the property to the Wetlands Learning Center,
the large amount of tillable crop land on the property, and the issue of how much government owned land
is the right amount for Otter Tail County. Dave Sanderson, Friends of the Prairie Weilands Learning
Center President spoke in favor of this land acquisition due to its benefits to the Learning Center.
Jean Bowman, of the Fergus Falls Convention· & Visitors Bureau, spoke in favor of this acquisition for
visitors, wildlife, and hiking. Traill Vosberg, Chairman of Buse Township spoke against ·the proposed
acquisition due to loss of tax base for the Township and concern that there is too much government owned
land and not enough funding to properly maintain the land. Motion by Johnson, second by Lindquist, and
unanimously carried to table this request until January 24, 2012.
Depository Resolution
Otter Tail County Resolution No. 2012 -03
Commissioner Huebsch offered the following and moved its adoption:
RESOLVED by the Board of Commissioners of Otter Tail County, Minnesota, that all financial institutions in
Otter Tail County, including state and federal banks be and are hereby designated as depositories of
County funds.

At 10:05 a.m., Chairman Rogness declared the meeting of the Board of Commissioners closed to the
public for purposes of discussing pending litigation in a tax appeal matter with the Westridge Mall in Fergus
Falls, MN, as authorized under Attorney/Client Privilege. Present were all five seated Commissioners,
County Administrator, County Attorney, County Assessor, and Board Secretary.
Recess & Reconvene
At 10:26 a.m., Chairman Rogness declared the meeting of the Otter Tail County Board of Commissioners
recessed for a short break. The meeting was reconvened at 10:30 a.m.

Lakes Wind Transmission Line Permit Request
Attorney, Bob Bigwood, representing Westwood Professional Services, spoke to the Board regarding the
question of Otter Tail County's authority to act as the LGU in the permitting process for this transmission
line due to' the fact that Otter Tail County does not have Comprehensive County Wide Zoning.
David Hauser, County Attorney, reported that the Highway Department has issued permits to utilities for
projects in ttie highway right-of-ways. He will continue to research the issue and return to the Board at
their January 24, 2012, Board meeting.
Engineering Services -S.P. 088-070-033
Motion by Froemming, second by Huebsch, and unanimously carried to authorize the appropriate County
Officials' signatures to execute a contract between the County of Otter Tail and JK Engineering for
electrical engineering services for the Mn DOT District 4 Counties Intersection Lighting project.
Drainage Svstems No. 41 & 65 Redetermination of Benefits
Motion by Johnson, second by Lindquist, and unanimously carried to allow additional requests for review of
parcels, in the Ditch Viewers' Report of Benefits as re-determined, for Otter Tail County Drainage Systems
Number 41 a'nd 65.
Pavment Approval
Motion by Johnson, second by Lindquist, and unanimously carried to approve payment, in the amount of
$208.50, from· the General Revenue Fund to MFRA, Inc. for professional services provided through
November 30, 2011, for the drainage review of the CARE facility.
Contract Approvals for Auditors Office
Motion by Froemming, second by Johnson, and unanimously carried to authorize the County Auditor to
sign the addendum contract for arbitrage monitoring services for the following debt issues:
$5,400,000 General Obligation Capital Improvement Plan Bonds, Series 20118 and
$4,780,000 General Obligation Bonds, Series 2012A
Motion by Lindquist, second by Huebsch, and unanimously carried to authorize the Board Chair, County
Administrator, and County Auditor to sign the Audit Engagement Letter for services provided pursuant to
Minnesota Statute 6.48 for the year ending December 31, 2011.
Motion by Froemming, second by Johnson, and unanimously carried to authorize the Auditor to sign the
Agreement for Consulting Services with Hildi, Inc. for the preparation of the January 1, 2012 GASS 45
actuarialvaluation report. The report can be_ used for two disclosure cycles ending December 31, 2012
and December 31, 2013. · · · ·
. Applic~tion for Exempt Permit
Motion by Lindquist, second by Huebsch and unanimously carried to approve, with n,o waiting period, the
LG220 Application for Exempt Permit as submitted by Lake Country Sportsmen's Club of Otter Tail County
for an event scheduled Monday, February 27, 2012, at Amor Rumors Restaurant.
Extension Committee
Motion by Lindquist, second by Johnson, and unanimously carried to reappoint Julian Sjostrom to the Otter
Tail County Extension Committee for a three year term effective January 1, 2012.
Sheriff Department Transports
Motion by Johnson, second by Froemming, and unanimously carried to authorize the Sheriff to utilize
temporary employees for female-accompanied transportation at his discretion.

BOO MHz EMS Radios
Sheriff Schlueter reported that a grant has been awarded that could be used for 800 MHz radios for a
public agency. Motion by Johnson, second by Huebsch, and carried with Lindquist opposed, to authorize
the Sheriff to negotiate use of this grant, not to exceed $35,000, with Ringdahl Ambulance for equipment to
integrate the ambulance service with the new 800 MHz Communication System. The motion includes that
the grant, which requires a match of about 25%, may only be used for equipment in Otter Tail County.
Eligibility List
Motion by Lindquist, second by Johnson, and unanimously carried to establish an Eligibility List for Hiring
Deputy Patrol positions in the Sheriffs Department.
Funding Agreement for Household Hazardous Waste Program
Motion by Johnson, second by Froemming, and unanimously carried to authorize the Chairman's signature
to execute Amendment 1 to Contract No. 27197 (formerly B10829) between the Minnesota Pollution
Control Agency and County of Otter Tail. This is the Operating Agreement for the HHW Management
Program for Otter Tail, Grant, Stevens, Traverse, Wadena, and Wilkin counties. The agreement ends
December 31, 2012 and is subject to the approval of the County Attorney.
Buffalo Red River Watershed District
Mr. Hauser reported that the enlargement of the BRRWD meeting is scheduled Thursday, February 23,
2012 in Barnesville because there is no availability for a meeting space in Rothsay. The Board did not
have objections to the location of the meeting.
Tour of Dispatch Center
Closed to the Public
At 11:35 a.m., the Board of Commissioners recessed and reconvened at the Otter Tail County Courthouse
for a tour of the new dispatch center and mechanical facilities. At the Courthouse, the Board meeting was
closed to the public for a short period of time to discuss litigation strategies as it relates to the 60 Bed
CARE facility as authorized under Attorney/Client privilege. Present were all five seated Commissioners,
County Attorney, County Administrator, and Acting Facilities Operations Manager.
Adjournment
At 1:00 p.m .. Chairman Rogness declared the meeting of the Otter Tail County Board of Commissioners
adjourned until 9:30 a.m. on Tuesday, January 24, 2012.
