Fir Avenue, Fergus Falls, MN Tuesday, December 13, 2011 9:30 a.m. Call to Order The Otter Tail County Board of Commissioners convened Tuesday, December 13, 2011, at 9:33 a.m. at the Otter Tail County Government Services Center in Fergus Falls, MN, with Commissioners John Lindquist, Chair; Lee Rogness, Vice-Chair; Doug Huebsch, Wayne Johnson, and Roger Froemming present. Approval of Agenda Motion by Rogness, second by Johnson, and unanimously carried to approve the Board of Commissioners agenda of December 13, 2011, with the following modifications: 10:30 a.m. -Tax Classification Issue Canceled 10:30 a.m. -Land & Resource Committee Meeting Watershed Enlargement Petition Approval of Minutes Motion by Froemming, second by Johnson, and unanimously carried to approve the Board of Commissioners meeting minutes of November 29, 2011, as presented. Approval to Pay Bills Motion by Hueqsch, second by Rogness, and unanimously carried to approve payment of the County Board bills per Attachment A of these minutes. Emergency Operations Plan Review Patrick Waletzkp, Emergency Operations Manager, briefed the Board regarding the Otter Tail County Emergency Operations Plan. Every year, the EOP is reviewed and updated by a different entity. This year, the approving entity is the Otter Tail County Board. Mr. Waletzko explained why we have a plan, statutory authority for the plan, contents of the plan, and a list of the requirements that must be in the plan which have been identified by Homeland Security. The EOP is the framework for emergency response, planning, and recovery and identifies the responsibilities of each agency. Discussion took place regarding the plan and upcoming tabletop exercises. Mr. Waltezko will return to the County Board to request approval after their review of the proposed plan. Emergency Management Performance Grant Motion by Huebsch, second by Rogness, and unanimously carried to authorize the appropriate County Officials' signatures to execute Otter Tail County's EMPG (Grant# A-EMPG-2011-OTTERCO-00285), in the amount of $35,470.00, between the County and Homeland Security and Emergency Management, MN Department of P_ublic Safety. Coyote Bounty Commissioners discussed a law change, M.S. 348.125, which allows a County or Town Board to offer a bounty for the taking of coyotes. Discussion also took place regarding a bounty for the taking of beavers under M.S. 97B.667. Commissioner Johnson offered to contact Gary Forsberg, a Conservation Officer, and Administrator Krohn will contact the Association of Minnesota Counties to research what other counties are doing regarding this issue. OTC Board of Commissioners' Minutes December 13, 2011 Page 2 Water Elevations & GIS Monuments Brian Armstrong, GIS Coordinator; Bill Kalar, Land & Resource Administrator; and Julie Aadland, DNR Hydrologist; spoke to the Board regarding elevation datum. Mr. Armstrong provided Elevation Datum Project maps and explained that LIDAR (mapping software) runs from 1988 vertical datum. When 1912 or 1929 vertical datum is received, conversions must be made for mapping. He requested approval to move towards using one data set. The 1988 datum is the official datum used in the country at this time. This project could include new benchmarks and permanent gauges on lakes. Ms. Aadland spoke in support of this project. Motion by Huebsch, second by Johnson, and unanimously carried to support moving towards the use of 1988 vertical datum in Otter Tail County. Recess & Reconvene At 10:36 a.m., Chairman Lindquist declared the meeting of the Otter Tail County Board of Commissioners recessed for a Land & Resource Committee meeting. The Board of Commissioners meeting was reconvened at 10:58 a.m. Probation Department Staffing Motion by Rogness, second by Froemming, and unanimously carried to authorize the Probation Director to hire a .5 FTE Assistant Probation Officer due to a recent resignation. Board of Commissioners Meeting Motion by Lindquist, second by Johnson, and unanimously carried to set the January 10, 2012 County Board meeting at 1 :00 p.m. at Arvig Communication Systems in Perham, MN. The Board of Commissioners will attend an Economic Development Administration Summit at 8:30 a.m. on January 10th in Perham, MN. Public Health Contract Motion by Johnson, second by Huebsch, and unanimously carried to authorize the Chairman's signature to execute a Contract between the County of Otter Tail and the MN Department of Human Services for the Child and Teen Checkup outreach program. The Contract provides grant funding in the amount of $141,431. Public Health Department Staffing Motion by Rogness, second by Froemming, and unanimously carried to recognize the retirement of a part time nurse and replace the hours by; 1) increasing two 20 hour per week positions to 24 hours per week, and 2) fill a 24 hour per week nurse position. Community Health Services Advisory Committee Motion by Huebsch, second by Froemming, and unanimously carried to sunset the Public Health CHS Advisory Committee effective December 31, 2011. Commissioners expressed appreciation to all committee members who have served on the committee. Request for Forgiveness of Tax Penalty Motion by Froemming, second by Johnson, and unanimously carried to deny a Forgiveness of Penalty request from Genie Buer, in the amount of $60.00 for parcel #R 20-000-99-0593-000, because the late penalty was no,t the result of County error or a reason that qualifies under the established guidelines. Lakeland Mental Health Center Board Motion by Froemming, second by Rogness, and unanimously carried to appoint Robert Block of Fergus Falls, MN, to the LMHC Board eff_ective February 27, 2012 for a three year term. Planning Commission Appointment Motion by Froemming, second by Lindquist, and unanimously carried to reappoint David Trites of Clitherall, MN to the Otter Tail County Planning Commission for CY2012. Recess & Reconvene At 11 :45 a.m., Chairman Lindquist declared the meeting of the Otter Tail County Board of Commissioners recessed for lunch break. The meeting was reconvened at 1 :00 p.m. Aquatic Invasive Species Presentation Tera Guetter, Pelican River Watershed District Administrator and Jeff Stabnow, OTC Coalition of Lake Association President, briefed the Board on various invasive species infecting Minnesota waters. Ms. Guettner reviewed the various educational initiatives that Becker County has supported to gain public awareness of this problem. On January 14, 2012, a Legislative Summit will take place to educate area legislators. Lengthy discussion took place regarding the steps needed to put together short term and long term plans to avoid infestations of invasive species in lakes currently not infected. The plans could also OTC Board of Commissioners' Minutes December 13, 2011 Page 4 leverage grant dollars for prevention to hire people to regulate public accesses and/or for purchase of decontamination units. Ms. Guetter discussed the need to train all licensed peace officers regarding AIS because volunteers have no enforcement authority. Motion by Rogness, second by Johnson, and unanimously carried to form a Task Force to provide recommendations to the County Board. Administrator, Larry Krohn; COLA President, Jeff Stabnow; Representatives from the State DNR; and Land and Resource Administrator, Bill Kalar; were named to coordinate the process. ASSOCIATION OF MINNESOTA COUNTY (AMC) POLICY TO SUPPORT LEGISLATION TO CONTROL THE SPREAD OF AQUATIC INVASIVE SPECIES AND TO INCREASE PENALTIES FOR VIOLATING LAWS Otter Tail County Resolution No. 2011 -69 Upon the motion of Huebsch, seconded by Froemming, and upon a unanimous vote, the following resolution was adopted: WHEREAS, Aquatic Invasive Species (AIS) are rapidly spreading throughout Minnesota with the Zebra Mussel being associated with the latest epidemic in Otter Tail County, and WHEREAS, A Zebra Mussel infestation would not only have an environmental impact, but an economic impact in relationship to property values, home sales, and tourism in Otter Tail County, and WHEREAS, Legislation needs to be amended or created to help control the spread of Aquatic Invasive Species, such as Zebra Mussels, by increasing the participation of the State of Minnesota and increasing penalties for violating AIS laws, and WHEREAS, The Association of Minnesota Counties has an active legislative presence and vested interest in the control of Aquatic Invasive Species, and NOW, THEREFORE BE IT RESOLVED, That the Board of County Commissioners of Otter Tail County, Minnesota, support and encourages AMC to add Aquatic Invasive Species to the legislative platform asking for more State Regulation and Enforcement. RESOLUTION SUPPORTING THE DEVELOPMENT OF COMPLETE STREETS POLICY Otter Tail County Resolution No. 2011 -70 Upon the motiori of Huebsch, seconded by Rogness, and upon a unanimous vote, the following resolution was adopted: WHEREAS, the mobility of freight and passengers and the safety, convenience, and comfort of motorists, cyclists, pedestrians -including people requiring mobility aids, transit riders, and neighborhood residents of all ages and abilities should all be considered when planning and designing highways and streets under the jurisdiction of Otter Tail County, AND WHEREAS, highways are a critical component of public space and play a major role in establishing the image and identity of a community, providing a key framework for current and future development, AND WHEREAS, highways are a critical component of public space and play a major role in establishing the image and identity of a community, providing a key framework for current and future development, AND WHEREAS, active living integrates physical activity into daily routines and Active Living communities encourage individuals of all ages and abilities to be more physically active, AND WHEREAS, the goal of complete streets is to improve the access and mobility for all users of highways in the community by improving safety through reducing conflict and encouraging non-motorized transportation and transit, which will enhance the promotion of active living as a means to improve the health of the community residents, and improve environmental conditions, including air quality. ; ' NOW THEREFORE, BE IT RESOLVED, that the Otter Tail County Board of Commissioners in Otter Tail County, Minnesota is supportive of the Complete Streets concept and will move forward with the development of a Complete Streets Policy. Quit-Claim Deed Motion by Huebsch, second by Johnson, and unanimously carried to approve a Quit-Claim Deed to convey the following right of way property from the County of Otter Tail to the City of New York Mills at a cost of $0.50 per sq. ft.: That part of the Northwest Quarter of the Southwest Quarter and that part of the Northeast Quarter of the Southwest Quarter all in Section 8, Township 135 North, Range 37 West of the Fifth Principal Meridian in Otter Tail County, Minnesota described as follows: Commencing at a found cast iron monument which designates the west quarter corner of said Section 8; thence South 89 degrees 25 minutes 21 seconds East on an assumed bearing along the east- west quarter line of said Section 8 for a distance of 383.66 feet to the point of beginning of the land to be described; thence continuing South 89 degrees 25 minutes 21 seconds East along the east-west quarter line of said Section 8 for a distance of 55.78 feet to the northerly right of way line of County State Aid Highway No. 84; thence southeasterly along the northerly right of way line of said County State Aid Highway No. 84 on a curve concave to the southwest, having a central angle of 06 degrees 31 minutes 07 seconds and a radius of 3576.75 feet, for a distance of 406.93 feet (chord bearing South 64 degrees 44 minutes 03 seconds East); thence South 61 degrees 28 minutes 30 seconds East continuing along the northerly right of way line of said County State Aid Highway No. 84 for a distance of 639.00 feet; thence South 27 degrees 14 minutes 22 seconds West continuing along the northerly right of way line of said County State Aid Highway No. 84 for a distance of 20.00 feet; thence North 61 degrees 28 minutes 30 seconds West for a distance of 639.45 feet; thence northwesterly on a curve concave to the southwest, having a central angle of 07 degrees 21 minutes 18 seconds and a radius of 3556.75 feet, for a distance of 456.58 feet (chord bearing North 65 degrees 09 minutes 08 seconds West) to the point of beginning. The above described tract contains 21,413 square feet. Drainage System #8 Motion by Froemming, second by Johnson, and unanimously carried to authorize Dean Eckhoff, Property Owner, to clean a portion of Ditch #8 at his expense as recommended by the Ditch Inspector. The area is located in Section 11 of Inman Township. Enlargement Petition A motion was offered by Huebsch and seconded by Johnson to approve the Enlargement Petition in the matter of enlarging the Buffalo-Red River Watershed District as submitted by the County Attorney. Closed to the Public At 3:03 p.m., Chairman Lindquist declared the meeting of the Board of Commissioners closed to the public for purposes of discussing pending litigation as authorized under Attorney/Client Privilege in the matter of the 60 Bed CARE Facility. Present were all five seated Commissioners, County Administrator, County Attorney, Acting Facilities Manager, Facilities Supervisor, and Board Secretary.
