Call to Order
The Otter Tail County Board of Commissioners convened Tuesday, August 9, 2011, at 8:30 a.m. at the
Otter Tail County Government Services Center in Fergus Falls, MN, with Commissioners John Lindquist,
Chair; Lee Rogness, Vice-Chair; Doug Huebsch, Wayne Johnson, and Roger Froemming present
Approval of Agenda
Motion by Froemming, second by Johnson, and unanimously carried to approve the Board of
Commissioners agenda of August 9, 2011, as mailed.
Approval of Minutes
Motion by Johnson, second by Froemming, and unanimously carried to approve the Board of
Commissioners meeting minutes of August 2, 2011, as mailed.
Approval to Pay Bills
Motion by Lindquist, seconded by Johnson, and unanimously carried to approve payment of the County
Board bills per Attachment A of these minutes.
800MHz Fire Department Radio Grant
Matt McGuire, Lieutenant, reported that Pat Conroy, of Widseth Smith Nolting Partners, has been
hired as the lead person to write the grant for 800 MHz radios for the County's fire departments. The
data gathering process has begun. Mr. McGuire reported that the plan is to write the grant splitting
East and West Otter Tail County to keep a 10% match in place. Other grant writing strategies were
discussed.
Annual CHS Conference
Diane Thorson, Public Health Director, reported on the upcoming Annual Community Health
Conference.
Public Health Contract Approval
Motion by Huebsch, second by Rogness, and unanimously carried to authorize the Chairman's
signature to execute a Project Agreement between the County of Otter Tail and Concordia College for
continued work developing curriculum for nursing education as it relates to breast feeding.
Child Support Program Overview
Brooks Andersen, Child Support Collections Supervisor, provided a Fact Sheet regarding the Child
Support program. The Child Support program is legally mandated. Local expenditures for collecting
child support payments are eligible for 66% federal reimbursement. Federal performance measures
were provided in comparison to similar counties. Otter Tail County's collection rate for federal
FY201 O was 70% with total child support due reported as $6,338,959.00.

CHILD SUPPORT PROCLAMATION
Otter Tail County Resolution No. 2011 -43
Commissioner Froemming offered the following and moved its adoption:
WHEREAS: Children are Minnesota's most valuable resource and Minnesotans have a responsibility
to promote and nurture their well-being; and
WHEREAS: Child Support Awareness Month reminds us that children need the emotional care and
financial support of both parents to reach their full potential; and
WHEREAS: County and State child support staff annually provide child support services for more
than 396,000 custodial and non-custodial parents and their 256,000 children in Minnesota; and
WHEREAS: Child support services have a direct impact on helping meet children's basic needs and
helping families work toward financial stability; and
WHEREAS: Child support professionals help families work toward becoming and remaining self-
sufficient by establishing paternity, establishing and modifying child support orders, and collecting and
disbursing child support on behalf of children.
NOW, THEREFORE, WE, The Otter Tail County Board of Commissioners do hereby proclaim the
month of August, 2011 as:
CHILD SUPPORT AWARENESS MONTH
Commissioner Huebsch seconded the motion, and upon being put to a vote, the resolution was
unanimously adopted.

OTTER TAI D OF COMMISSIONERS
Human Services Legislative Update
John Dinsmore, Human Services Director, discussed the following reductions in funding due to
legislative action taken during the recent State Special Session: $140,000 in the CCSA Block Grant,
$71,000 in Adult Mental Health Grant, $62,000 for Minnesota Family Investment Program, increase in
the County's share of payment for services in the Consolidated Chemical Dependency fund from 16%
to 23% with an approximate net reduction of $144,000, and reduction in County Program Aid.
Mr. Dinsmore estimated total funding reductions to Human Services at about $750,000. Mr. Dinsmore
discussed strategies to make up for the upcoming funding reductions.

Highway Construction Contract -S.A.P. 056-600-025
Motion by Johnson, second by Rogness, and unanimously carried to approve the appropriate County
Officials' signatures to execute a Highway Construction Contract between the County of Otter Tail and
Mark Sand & Gravel, Co. of Fergus Falls, MN for overlay of East Lake Lida Road from TH 108, ¼ mile
East of Maplewood Park Entrance to CSAH 4, 3 miles East of CSAH 31.
Commuting with County Vehicles for S.A.P. 056-600-025
Motion by Rogness, second by Lindquist, and unanimously carried to authorize Dave Sillerud,
Engineering Technician Ill and Wade Bugbee, Engineering Technician 11, to use County vehicles for
commuting for the East Lake Lida Road overlay project as requested by the Highway Engineer.
2010 Annual Highway Department Report
Charles Grotte, Assistant Highway Engineer, submitted the Otter Tail County Highway Department
2010 Annual Report for Commissioners' review.

High Water Projects
Commissioners discussed several high water concerns related to County roads. Discussion included
CR 112 and 15, CR 110, and CR 27 as well as a philosophical discussion regarding the County's
ditch systems. Commissioners expressed a desire to expedite projects with water concerns before
winter because spring will not be the time to pump and move water. They requested a High Water
Road Project check-off list to keep updated when projects are completed.
OTTER TAIL COUNTY RESOLUTION #2011 -42
RESOLUTION OF INTENT TO ESTABLISH A LAKE IMPROVEMENT DISTRICT
DEVILS AND LITTLE DEVILS LAKES
WHEREAS, Minnesota law provides that in order to preserve and protect the State of Minnesota and
to increase and enhance the use and enjoyment of its lakes, it is in the public interest that there be
established a statewide lake improvement program to preserve, protect and improve the quality of
lakes; and
WHEREAS, Minnesota law permits the creation of lake improvement districts initiated by the request
and upon a resolution of a County Board; and
WHEREAS, the Otter Tail County Board of Commissioners has received a request from the Devils
Lake Association, who also reported that more than 50 percent of the property owners within the
boundaries of the proposed lake improvement district are in support of its establishment; and
WHEREAS, the immediate problem facing the Devils lakes is high water, with the lakes overflowing
their banks, flooding residences such that they can't be occupied, and the Board has received
numerous letters from residents of the proposed district in support of its creation, copies of which are
on record with the county auditor; and
WHEREAS, one possible solution involves using County Ditch 25 as an outlet, for which a petition has
been filed with the county, this could affect downstream interests, a public hearing will be held August
22, and the county is to receive an engineer's report 10 days prior, these records are or will be on
record with the county auditor; and
WHEREAS, there is a public access on the northwest shore of Devils Lake, owned and operated by
the Department of Natural Recourses, the concrete ramp is currently underwater; and
WHEREAS, a map showing the boundaries of the proposed district, the number and location of
permanent homes and seasonal dwellings, the scale, and basic geographical information is on record
with the county auditor; and
WHEREAS, there are proposed to be 5 directors for the district; and
WHEREAS, there is no surface water ordinance regulating Devils Lakes, but the Otter Tail County
Shoreland Management Ordinance, copies of which are available at the county's Office of Land and
Resource Management, regulates the shoreland including the public access; and
WHEREAS, the proposed district has an Estimated Market Value of $19,160,000 (Land-$10,763,000
and Buildings-$8,397,000), a Taxable Market Value of $19,160,000 (Land-$10,763,000 and
Buildings-$8,397,000), and a Net Tax Capacity of $189,445; and

WHEREAS, all of the documentation mentioned herein that is on record with the county is available
for review on the county's website: www.co.ottertail.mn.us
NOW, THEREFORE, IT IS HEREBY RESOLVED that the Otter Tail County Board of Commissioners
hereby declares its intent to establish the Devils and Little Devils Lakes Improvement District.
BE IT FURTHER RESOLVED that the following information be provided, as required by Minnesota
Statute §103B.515, Subd. 1:
1. The name of the proposed Lake Improvement District shall be:
Devils and Little Devils Lakes Improvement District
2. The boundaries of the proposed lake improvement district shall include parcels that
have lake frontage on Devils Lake and Little Devils Lake Otter Tail County, but shall exclude
agricultural land.
As the use of agricultural lands within the 1,000 foot boundary of the district changes to
non-agricultural use, the district may, by confirming the change of use to the County Auditor
and Assessor, and by notifying the owner of the property and the Administrator of the Otter
Tail County Department of Land and Resource Management, include those formerly
agricultural lands in the district.
3. The water and related land resource management programs to be undertaken by the
district may include:
a. Develop and implement a comprehensive plan to eliminate water pollution;
b. Receive financial assistance from and participate in projects or enter into
contracts with federal and state agencies for the study and treatment of pollution
problems and related demonstration programs;
c. Undertake research to determine the condition and development of the body of
water included within the lake improvement district to transmit the studies of the
Department of Natural Resources, the Minnesota Pollution Control Agency and other
interested authorities;
d. Make cooperative agreements with the United States or state government or
other county or city to effectuate water and related land resource programs;
e. Conduct programs of water improvement and conservation;
f. Implement a water monitoring system;
g. Serve as local sponsor for state and federal projects or grants;
h. Regulate water surface as deemed necessary and reasonable; or
i. Such other programs, plans, studies, developments or implementations as are
allowed or permitted by law, and approved by the County Board from time to time.
4. The Otter Tail County Board may delegate to the lake improvement district pursuant to
Minnesota Statute §103B.551, Subd. 3, authority to:
a. Acquire by gift or purchase, equipment, structures or control works that affects
the level of waters in the district.

b. Construct and operate water control structures, equipment or control works that
are approved by the commissioner of natural resources under section 103G.245
c. Undertake projects to change the course current or cross section of public
waters that are approved by the commissioner of natural resources under section
103G.245.
d. Acquire property, equipment or other facilities, by gift or purchase to improve
navigation.
e. Contract with a board of managers of a watershed district within the lake
improvement district or the board of supervisors of a soil and water conservation
district within the district for improvements under chapters 103C and 1030.
f. Undertake research to determine the condition and development of the body of
water and the water entering it and to transmit the results of the studies to the pollution
control agency and other interested authorities.
g. Develop and implement a comprehensive plan to eliminate water pollution.
h. Conduct a program of water improvement and conservation.
i. Construct a water, sewer, or water and sewer system in the manner provided
by section 444.075 or other applicable laws.
j. Receive financial assistance from and participate in projects or enter into
contracts with federal and state agencies for the study and treatment of pollution
problems and related demonstration programs.
k. Make cooperative agreements with the United States or state government or
other counties or cities to effectuate water and related land resource programs.
I. Maintain public beaches, public docks and other public facilities for access to
the body of water.
m. Provide and finance a government service of the county or statutory or home
rule city that is not provided throughout the county or, if the government service is
provided, the service is at an increased level within the district
n. Regulate water surface use as provided in sections 868.205, 103G.605 and
103G.621.
5. Funding for the lake improvement district shall be:
a. Start-up funds will be provided from the Devils Lake Association.
b. Lake improvement district activities may be funded by the levying of an ad
valorum tax solely on property within the district. No establishment or increase in the
ad valorum property tax will be allowed if it affects the county levy subject to state-
imposed levy limits.
c. Lake improvement district activities may also be funded by assessment of costs
of projects upon the benefitted property within the district in the manner provided under
Minnesota Statutes Chapter 429.
d. Lake improvement district activities may also be funded by imposition of service
charges on users of the lake improvement district services within the district
(Minnesota Statute §428A.05).
e. The Lake Improvement District may also finance projects and services of the
district by issuing obligations as provided in Minnesota Statute §429.091.

6. The Administrator of the Otter Tail County Department of Land and Resource
Management shall be responsible for supervising the programs of the district. A public hearing
will be held on whether the Devils and Little Devils Lakes Improvement District should be
established on September 19, 2011, at 7:00 p.m. in the Council Chambers of the Perham City
Hall, 125 2nd Avenue NE, Perham, Minnesota.
Upon the motion of Huebsch, seconded by Johnson, the Otter Tail County Board of
Commissioners adopts the foregoing resolution #2011 -42 as follows:

Recess & Reconvene
At 9:42 a.m., Chairman Lindquist declared the meeting of the Otter Tail County Board of
Commissioners recessed for a short break. The meeting was reconvened at 9:51 a.m.
Payment Approval
Motion by Huebsch, second by Rogness, and unanimously carried to approve payment, in the amount
of $10,150.39, to Wilkin County for Otter Tail County's share of Judicial Ditch No. 2 expenditures
incurred during the period of February 16, 2011 through March 10, 2011.
Truth in Taxation Statements
Motion by Froemming, second by Huebsch, and unanimously carried to authorize the County
Auditor's signature on the agreement with National Business Systems (NBS) for the printing and
mailing of Otter Tail County's Pay 2012 Truth in Taxation Statements at an estimated cost of $0.36
per statement.
Application for Exempt Permit
Motion by Huebsch, second by Lindquist, and unanimously carried to approve, with no waiting period,
the LG220 Application for Exempt Permit as submitted by the Holy Cross Church for an event
scheduled for Sunday, September 11, 2011 at the Holy Cross Church located on CH148.

Motion by Johnson, second by Huebsch, and unanimously carried to amend the Phone
Communication System motion of July 19, 2011, to include sales tax to the cost of the Cisco Phone
System.
Refinance Discussion of GSC Bonds
Carolyn Drude, of Ehlers and Associates, briefed the Board on the procedures to refinance the
Government Services Building Lease Revenue Bonds of the HRA, Series 2002A. The estimated
savings to refinance to General Obligation Capital Improvement Bonds was reported as $400,000.00.
A five year plan and Public Hearing would be required. Motion by Rogness, second by Froemming,
and unanimously carried to direct the County Administrator, Auditor, and Building Committee to work
with the Bond Consultant to prepare a case study of refinance options for the GSC bonds and
consider pending capital improvement projects such as the Courthouse remodel and 800MHz
communication projects.
Public Meeting
At 10:40 a.m., Chairman Lindquist declared the meeting open to the public for comments regarding a
proposal to build two new barns with a total capacity of 30,000 turkeys (540 animal units). The two
new barns in addition to the existing barns would hold 84,000 turkeys (1,512 animal units); however,
an existing barn may be demolished bringing the total to 71,000 turkeys. Andy Larson, Jennie-O
Foods Complex Supervisor, represented the request. The public meeting is being held according to
M.S. 116.07, Subd. 7(1). No one from the public was present or commented on the proposed
expansion. Commissioners expressed their support for this proposal, the importance of the turkey
industry for the economy in Otter Tail County, and support for agriculture in general. The public
meeting was closed at 10:45 a.m.
Adjournment
At 10:55 a.m., Chairman Lindquist declared the meeting of the Otter Tail County Board of
Commissioners adjourned until 8:30 a. m. on Tuesday, August 16, 2011.
