Call to Order
The Otter Tail County Board of Commissioners convened Tuesday, June 14, 2011, at 9:34 a.m. at the
Otter Tail County Government Services Center in Fergus Falls, MN, with Commissioners
John Lindquist, Chair; Lee Rogness, Vice-Chair; Doug Huebsch, Wayne Johnson, and
Roger Froemming present.
Approval of Agenda
Motion by Froemming, second by Rogness, and unanimously carried to approve the Board of
Commissioners agenda of June 14, 2011, as mailed.
Approval of Minutes
Motion by Johnson, second by Huebsch, and unanimously carried to approve the Board of
Commissioners meeting minutes of June 7, 2011, as mailed.
Approval to Pay Bills
Motion by Rogness, seconded by Froemming, and unanimously carried to approve payment of the
County Board bills per Attachment A of these minutes.
West Central Initiative Program Update
Greg Wagner, WCI Planner, presented a Comprehensive Economic Development Strategy Executive
Summary dated June 14, 2011. The CEDS is a five-year plan that uses census and community
survey data to be a forward-looking document rather than a report of what has already occurred. Key
components of the plan include regional goals and objectives, labor force and population analysis,
and a list of resources for economic development. Mr. Wagner referred to 67 projects listed in the
CEDS, of which, 31 are considering the Federal EDA as a potential funding source. Discussion
occurred regarding a potential challenge to the latest census numbers. Commissioners spoke in favor
of the inclusion of the farm data in the CEDS because of its economic importance in the region.
Nancy Straw, President of WCI, discussed various programs provided through WCI and announced
WCl's 25th Anniversary. She discussed the financial impact of WCI in the region with 3.3 million
dollars extended in loans and grants this year. Otter Tail County has received grants, in the amount
of $6,484,389 .and loans, in the amount of $7,192,854 over the past 24 years. She discussed the
dental services program for children and the value of volunteers in developing needed programs.
Ms. Straw requested that the County's FY2012 Budget continue with the commitment of $20,000 per
year for five years. Gifts to the endowment fund are matched dollar-for-dollar by the McKnight
Foundation.

RESOLUTION
IN SUPPORT OF
2011-2016 COMPREHENSIVE ECONOMIC DEVELOPMENT STRATEGY
FOR WEST CENTRAL MINNESOTA
Otter Tail County Resolution No. 2011 -36
Commissioner Rogness offered the following and moved its adoption:
WHEREAS, West Central Initiative has prepared a Comprehensive Economic Development Strategy
(CEDS) for the region containing Becker, Clay, Douglas, Grant, Otter Tail, Pope, Stevens, Traverse,
and Wilkin Counties of Minnesota (west central Minnesota); and
WHEREAS, The CEDS contains analysis, demographic data, economic data, economic development
projects, and goals and objectives for the betterment of the region; and
WHEREAS, Availability of an approved CEDS and related annual updates are a condition for
qualifying for grants for local economic development projects from the Economic Development
Administration of the U.S. Department of Commerce; and
NOW THEREFORE BE IT RESOLVED, That the Board of County Commissioners of Otter Tail
County, Minnesota, approves the 2011-2016 Comprehensive Economic Development Strategy for
west central Minnesota.
Commissioner Huebsch seconded the motion and upon a vote, the resolution was unanimously
adopted.

Developmental Disabilities Service Report
Margaret Williams, DD Supervisor, introduced DD Case Management Staff. She briefed the Board
regarding the DD service area, population served, programs, and funding sources. The briefing
included a payment report with total cost of services in CY2010 at $9,217,706. A Service Guide
brochure was provided.

Motion by Rogness, second by Huebsch, and unanimously carried to approve the attached
(Attachment B) Detox and Chemical Use Assessment sliding fee schedules which follow the federal
poverty guidelines.

Approval to Pay Bills & Claims
Motion by Huebsch, second by Johnson, and unanimously carried to approve payment of the Human
Services bills and claims as presented.
MIR3 Notification
Larry Krohn, County Administrator, discussed response notification and community notification. He
noted that community notification is a broad topic that needs more research. Tim Brand, IT Director,
submitted a recommendation from the Emergency Management Committee to purchase a MIR3
upgrade to the County's current response notification system. Motion by Huebsch, second by
Rogness, and unanimously carried to approve purchase of the MIR3 Intelligent Notification Platform at
a cost of $28,000. Thereafter, the annual license fee for MIR3 Enterprise is about $22,000.

Additional costs are a sliding scale function of usage, number of recipients, and number of initiators.
Income generated by new subscribers will offset the ongoing costs and reduce the initial cost to the
County.
Arbitrage Monitoring Service
Motion by Johnson, second by Froemming, and unanimously carried to approve the Addendum to the
Master for Arbitrage Monitoring Service with Ehlers to include the General Obligation Disposal System
Revenue Bonds, Series 2011.

Otter Tail County Resolution No. 2011 -37
Commissioner Doug Huebsch offered the following resolution and moved for its adoption:
WHEREAS, on January 27, 1937 the following described parcel forfeited to the State of Minnesota for
nonpayment of taxes delinquent on real estate, and
Lots 1 and 2 Block 2 Water's Fourth Addition (Parcel No. 71-001-99-0858-001)
WHEREAS, pursuant to Laws 1941, Chapter 511 the City of Fergus Falls acquired the above
described property from the State of Minnesota on October 29, 1941 by a conditional use deed, which
was recorded December 31, 1943 (Document No. 312892), and
WHEREAS, the above described property per the requirements of the above noted document is to be
used exclusively for public park and recreational purposes, and

WHEREAS, the City of Fergus Falls has discontinued/abandoned the authorized public use for which
the property was originally acquired; therefore, the above noted document is null and void as it relates
to the above described property, and
WHEREAS, per an email from the Minnesota Department of Revenue dated May 18, 2011 the above
described property has reverted back to the State of Minnesota in trust for local taxing districts, and
WHEREAS, the County Board of Commissioners may privately sell any parcel of non-conservation
tax-forfeited land to a governmental subdivision for the property's market value as determined by the
County Board plus the additional costs, for any authorized public purpose for which the government
subdivision is authorized to acquire property, and
WHEREAS, the City of Fergus Falls has indicated no interest in acquiring the above described
property for either an authorized public use or an authorized public purpose as evidenced by
Document Number 1090477 conveying the above described property to Independent School District
#544 thereby allowing the school district to proceed with their verbal request to acquire the above
described property from the State of Minnesota for any authorized public purpose for which
Independent School District #544 is authorized to acquire property, and
WHEREAS, the purchase of the above described property by a governmental subdivision for an
authorized public purpose will remove conditional deed restriction, and
NOW, THEREFORE BE IT RESOLVED, that the Otter Tail County Board of Commissioners hereby
approves the request of Independent School District #544 to acquire the following described property
for an authorized public purpose, and
Lots 1 and 2 Block 2 Water's Fourth Addition (Parcel No. 71-001-99-0858-001)
BE IT FURTHER RESOLVED, that the market value of the property as determined by the Otter Tail
County Board of Commissioners be established at $5,000 and that the purchase price for the above
described property will be the value as determined by the Otter Tail County Board of Commissioners
plus the appropriate fees (deed fee, 3% surcharge, deed tax and recording fee).
BE IT ADDITIONALLY RESOLVED, to direct the County Auditor's office to proceed with the
completion and submission of the Application for State Deed for Tax-Forfeited Land and the Wetland
Certification Form.

At 11 :01 a.m., Chairman Lindquist declared the meeting of the Otter Tail County Board of
Commissioners recessed for a short break. The meeting was reconvened at 11 :05 a.m.
Planning Commission Recommendations
Conditional Use Permit Kevin & Sheri Zitzow:
Motion by Huebsch, second by Froemming, and unanimously carried to approve a Conditional Use
Permit for excavation to facilitate a new home with conditions as recommended by the Planning
Commission. The property is described as Lot 6 Blk 1 Jamielind Shore, Section 30 of Edna
Township; Big McDonald Lake (56-386), RD.
Conditional Use Permit -Joe & Eileen Koep:
Motion by Rogness, second by Froemming, and unanimously carried to approve a Conditional Use
Permit to add a small resort to Inspiration Point Bible Camp as part of its current and ongoing
operations with a condition as recommended by the Planning Commission. The property is described
as GL 5 ex tr to Bible Camp ex tr and GL 6 ex platted, Section 17 of Leaf Mountain Township; Spitzer
Lake (56-160) NE.
Conditional Use Permit Renee C. & Jason M. Goff:
Motion by Huebsch, second by Froemming, and unanimously carried to approve a Conditional Use
Permit to lower the water level of High Island Lake with conditions as recommended by the Plarining
Commission. The property is described as SW1/4 SE1/4 & SE1/4 SW1/4 ex tr & GL 6, Section 11,
Friberg Township; High Island Lake (56-697), NE.
Conditional Use Permit -James & Bonnie Mark:
Motion by Johnson, second by Lindquist, and unanimously carried to approve a Conditional Use
Permit to construct a new driveway as revised (3'd plan submitted) and recommended by the Planning
Commission. The property is described as Pt GL 7 (56.01 AC), Section 23, Dane Prairie Township;
Unnamed Lake (56-644), NE.
Conditional Use Permit -Brent 0. & Barbara Kuehne et al:
Motion by Huebsch, second by Rogness, and unanimously carried to approve a Conditional Use
Permit for topographical excavation to accommodate a walk-out basement with conditions as
recommended by the Planning Commission. The property is described as Pt GL 5 (Tract A),
Section 21 of Hobart Township; Rose Lake (56-360), RD.
Shoreline Restoration Discussion
Bill Kalar, Land & Resource Director, discussed issues with shoreline damage experienced by high
water conditions. Currently, the Land & Resource Office is working with property owners on a variety
of lakes raising rip rap and filling behind the rip rap. Black dirt is not being allowed as fill behind the
rip rap in case the water continues to rise; however, granular fill is allowed. Reclamation of land may
be requested if water levels go down. Mr. Kalar noted that this will need to be considered depending
on the particular area and conditions. Commissioners requested that Mr. Kalar develop some
guidelines for the public and return to the next regular County Board meeting.

Land Use Policy Discussion
Cynthia Johnson, Ag Committee Chair, and Ag Committee members appeared before the Board to
discuss the potential for developing a county wide Land Use Policy. The history of land use policy
discussions was provided. Motion by Rogness, second by Huebsch, and unanimously carried to refer
the request to develop a county wide Land Use Policy to the Land & Resource Director. After working
with the Land & Resource Committee and other stakeholders when the construction season is over,
the Land & Resource Director will return to the Board with a recommendation on how to proceed with
this issue.
Recess & Reconvene
At 11 :59 a.m., Chairman Lindquist declared the meeting of the Otter Tail County Board of
Commissioners recessed for a lunch break. The meeting was reconvened at 1 :01 p.m.
County Road 1 Culvert Issue
Mr. Kalar provided a letter dated May 11, 2011, from several property owners on Otter Tail Lake. The
letter identified a problem with too much water flow from a culvert under CR 1 into the downstream
culverts resulting in standing water on several properties. Mr. Kalar submitted a map of the area with
an explanation of the water flow and size of various culverts. Property owners requested that a flow
restrictor gate be installed on the 36" culvert under CR 1. It was reported that the County Highway
Engineer was opposed to the request. Motion by Rogness, second by Froemming, and unanimously
carried to request that the County GIS Department shoot elevations for Long and Otter Tail Lakes to
assist the property owners to determine the best course of action. Commissioners requested a report
back.
Drainage System #38 Follow-Up
Mr. Kalar and Randy Wasvick, Ditch Inspector, updated the Board regarding Branch 1 of Ditch
System #38. Motion by Huebsch, second by Rogness, and unanimously carried to authorize the
Ditch Inspector to apply for a permit for a clean out from the DNR, remove a collapsed 36" culvert
under an abandoned road, take elevations and place a rock base, as recommended by the Ditch
Inspector.
Ditch Viewer Update
Mr. Kalar spoke with the Board regarding compensation for Ditch Viewers. Motion by Lindquist,
second by Huebsch, and carried with Johnson abstaining to authorize a base pay of $25 per hour for
Ditch Viewers with a minimum of four (4) hours pay per day and a maximum of eight (8) hours per
day.
Health Insurance Consultant
A health insurance update and request to hire a consultant to assist the Insurance Committee was
submitted to the Board. Motion by Froemming, second by Rogness, and unanimously carried to
authorize hiring Eric Shelstad from Shelstad Financial Services for professional services at a cost of
$50 per hour.
Recess & Reconvene
At 1 :54 p.m., Chairman Lindquist declared the meeting of the Otter Tail County Board of
Commissioners recessed for several committee meetings. The meeting was reconvened at 2:54 p.m.
with Commissioners Lindquist, Huebsch, and Froemming present. Commissioners Rogness and
Johnson were present at 3: 15 p.m.
Phelps Mill Festival

Teresa and Jaime Brause, Festival Coordinators, and Jerome Holicky, Phelps Mill Country Board
Chair, briefed the Board regarding the annual Phelps Mill Festival scheduled July 9 and 10, 2011.
They submitted brochures and a power point presentation regarding the past activities and economic
value of the festival. Because Phelps Mill Park is very wet due to high water, the grounds cannot be
used for exhibitors this year. The park road will be used for food vendors and exhibitors will be moved
to the tarred parking lot. The plan has been reviewed with the Highway Engineer and the Sheriff's
Department. Mr. Holicky requested funding to install temporary electric service due to the change in
location of exhibitors. Commissioners did not take action regarding the temporary electric service.
Fencing will be used to keep the public out of the wet park grounds.
Performance Measurement Program
Larry Krohn, County Administrator, recommended participation in the Performance Measurement
Program developed by the Council on Local Results and Innovation. The program involves a
standard set of ten performance measures for counties that will aid residents, taxpayers, and state
and local elected officials in determining efficacy in providing services and measure residents'
opinions of those services. Motion by Rogness, second by Johnson, and unanimously carried to
accept the recommendation of the County Administrator to participate in the Performance
Measurement Program.
Communication System
Tim Brand requested direction from the Board as it relates to the phone systems and whether or not
the Technology Committee should be viewing systems for potential purchase or upgrade. Motion by
Huebsch, second by Froemming, and unanimously carried to authorize the Technology Committee to
view a Cisco phone system and NEC upgrade to review the information.
Acceptance of Retirement
Motion by Froemming, second by Johnson, and unanimously carried to regretfully, accept a letter of
retirement from Rick Sytsma, Facilities Operations Manager. They expressed their appreciation for
Mr. Sytsma's years of service with the County.
. Out-of-State Travel Request
Motion by Froemming, second by Johnson, and unanimously carried to authorize out-of-state travel to
California for the Fraud Investigator to attend the Annual National Fraud Investigation meeting as
recommended by the County Attorney. The Fraud Investigator is the Secretary of the organization.
The cost is about $1,500 to be paid out of the County Attorney's budget with reimbursement of about
one-half of the cost.

At 4:02 p.m., Chairman Lindquist adjourned the meeting of the Otter Tail County Board of
Commissioners until 9:30 a.m. on Tuesday, June 21, 2011.
