Fir Avenue, Fergus Falls, MN April 19, 2011 9:30 a.m. Call to Order The Otter Tail County Board of Commissioners convened Tuesday, April 19, 2011 at 9:31 a.m., at the Otter Tail County Government Services Center in Fergus Falls, MN, with Commissioners John Lindquist, Chair; Lee Rogness, Vice-Chair; Doug Huebsch, Wayne Johnson, and Roger Froemming present. Approval of Agenda Motion by Rogness, second by Froemming, and unanimously carried to approve the Board of Commissioners agenda of April 19, 2011, with the following changes Request for Approval of HHW Mobile Collection Contracts Update Regarding Flooding and FEMA Discussion Regarding National Association of Counties (NACO) Approval of Minutes Motion by Froemming, second by Johnson, and unanimously carried to approve the Board of Commissioners meeting minutes of April 12, 2011, as presented. Approval to Pay Bills Motion by Huebsch, second by Rogness, and unanimously carried to approve payment of the County Board bills per Attachment A of these minutes. Congested Area Flight Plan West Central Ag-Air Inc. Aerial Sprayer, Ryan Lubben, requested permission to fly over congested areas in Otter Tail County. The congested areas are shoreland property with the purpose of spraying biological insecticide for control of forest tent caterpillars. Motion by Rogness, second by Huebsch, and unanimously carried to approve West Central Ag-Air's congested area flight plan, as requested by the Federal Aviation Administration, for the purpose of controlling forest tent caterpillars. West Central Ag has been hired by property owners for this service. US Fish & Wildlife Service Wetland Easement Acquisition Motion by Huebsch, second by Johnson, and unanimously carried to certify the following USFWS wetland easement requests to protect wetlands and waterfowl while allowing agricultural use of the property: Olson, Michael J. Containing 2.27 acres more or less. Subject to the Township Road. Spring Flooding/FEMA Update Emergency Manager, Larry Krohn, updated the Board regarding potential reimbursements for flooded disaster areas. He indicated that the State Department of Homeland Security will send out a team with a person from FEMA this week to complete a damage assessment. The damages in Otter Tail County must exceed $186,000 with a State wide damage assessment over 6.4 million dollars in order to make a Presidential Declaration. A Presidential Declaration is needed for FEMA reimbursement for county and township infrastructure expenses. Public Meeting At 9:55 a.m., Chairman Lindquist declared the meeting open to the public for comments regarding a proposed increase in animal units at the Fraki Dairy Farm, Inc. located in Leaf Lake Township. The public meeting is being held according to M.S. 116.07, Subd. 7(1). No one from the public was present or commented on the proposed expansion. Commissioners discussed the manure management plan and stated their support for animal agriculture. The public meeting was closed at 10:00 a.m. Recess & Reconvene At 10:00 am, Chairman Lindquist declared the meeting of the Otter Tail County Board of Commissioners recessed for a short break. The meeting was reconvened at 10:05 a.m. Social Media Policy OTC Board of Commissioners' Minutes April 19, 2011 Page 3 Technology Committee Members, Tim Brand and Sherri Leabo, presented a proposed Social Media Policy designed to allow appropriate County use of social media communications. Motion by Huebsch, second by Rogness, and unanimously carried to approve the Social Media Policy as Appendix C to the Otter Tail County Electronic Communications Policy. The new Social Media Policy is attached to these minutes as Attachment B. Proposed Watershed District Update SWCD Manager, Brad Mergens, reported that the Board of Water and Soil Resources Northern Committee met last week and recommended that the Upper Red Lower Otter Tail Watershed District petition be moved forward to the Public Hearing process. Lengthy discussion took place regarding deficiencies in the petition, size of the proposed Otter Tail County portion of the watershed, increased layers of government, and attendance at the upcoming BWSR Public Hearing. Discussion took place regarding the proposed Watershed Improvement Area. Commissioners requested that the GIS Coordinator and County Auditor develop a listing of parcels that would be included in the WIA Motion by Rogness, second by Johnson, and unanimously carried to set a Public Hearing for comments regarding a Watershed Improvement Area at 7:00 p.m. on Tuesday, May 24, 2011 at the Government Services Center in Fergus Falls, MN. Agreement for Work Release Motion by Johnson. second by Froemming, and unanimously carried to authorize the appropriate County Officials' signatures to execute an Agreement between the State of Minnesota DOC and the County of Otter Tail which establishes work release services for the period of July 1, 2011 to June 30, 2012. The State DOC reimburses the County $55.00 per day to provide the service. License Application Approvals Motion by Huebsch, second by Froemming, and unanimously carried to approve the following applications for license Pelican Hills Seasonal Park. OTC Board of Commissioners' Minutes April 19, 2011 Page 4 National Association of Counties (NACO) Membership Commissioners discussed the pros and cons of becoming members of NACO. Motion by Froemming, and seconded by Huebsch to rejoin the National Association of Counties. A motion was offered by Commissioner Huebsch and seconded by Commissioner Rogness to table a decision regarding NACO membership until the next regular County Board meeting, at which time, a presentation of NACO benefits will be provided. Motion to table carried unanimously. The meeting was reconvened at 11 :03 a.m. Planning Commission Recommendations Conditional Use Permit -Jewett Lake Association.- Land & Resource Director, Bill Kalar, reported that this CUP request was for modifications of the terms and conditions of CUP#5753. The Planning Commission recommended denial for the three reasons cited in the April 13, 2011 Planning Commission minutes. Commissioner Johnson reported that a meeting of representatives of all parties involved is scheduled at 7:00 p.m. on Thursday, April 28, 2011 at the Government Services Center in Fergus Falls, MN. Mr. Johnson stated that there are high water issues on both Jewett Lake and Long Lake and the meeting is to discuss solutions to draw down the high water in the area. Motion by Johnson, second by Rogness, and unanimously carried to table the Conditional Use Permit request of the Jewett Lake Association with the applicant waiving the 60 day rule. The project is located in Pt of GL 1, 2, & 3, Section 13 of Elizabeth Township; Conditional Use Permit Application recorded as Document #854806; Jewett Lake (56-877), GD. Conditional Use Permit -Doug & Kim Richards: Motion by Johnson, second by Froemming, and unanimously carried to approve a Conditional Use Permit to operate a Hair Salon as presented. OTC Board of Commissioners' Minutes April 19, 2011 Page 5 Conditional Use Permit -Miller's Buchanan Oaks, CIC#64/Mary D Banz & Greg Miller,, Motion by Froemming, second by Huebsch, and unanimously carried to approve a Conditional Use Permit for Common Interest Community No, 64 entitled "Miller's Buchanan Oaks" as presented, The property is described as Lot 6 Blk 1 Buchanan Oaks, Section 35 of Rush Lake Township; Buchanan Lake (56-209), GD, Conditional Use Permit-RD Offutt Company,, Motion by Huebsch, second by Froemming and carried with Rogness abstaining, to approve a Conditional Use Permit to build irrigation runways through a wetland as presented, The property is described as N½ SW¼ ex trs, S½ NW¼ ex tr & NW¼ NW¼ (160,70 AC), Section 31 of Amor Township; Brown Lake (56-315), NE, Shoreland Management Ordinance Amendments Land & Resource Director, Bill Kalar, and Board members discussed the proposed revisions to the SMO, Motion by Froemming, second by Johnson, and unanimously carried to adopt the attached Amendments (see Attachment C of these minutes) to the Otter Tail County Shoreland Management Ordinance, The amendments to the SMO will be effective the first of the month following publication in the Daily Journal. OTTER TRAIL RIDERS TRAIL ASSOCIATION GRANT-IN-AID FUNDING Otter Tail County Resolution No, 2011 25 Commissioner Huebsch offered the following and moved its adoption: WHEREAS, Otter Tail County has sponsored Grant-In-Aid Systems in the past and WHEREAS, acceptance of the Grant-In-Aid Systems proposed extensions are subject to the review and approval of the County Attorney, THEREFORE, BE IT RESOLVED that Otter Tail County shall continue to sponsor Grant-In-Aid Trail Systems as they exist for the Otter Trail Riders Trail Association Snowmobile Club for the 2011-2012 snowmobile season and proposed extensions of Grant-In-Aid Trails with the aforementioned condition, Commissioner Johnson seconded the resolution and, upon being put to vote, the resolution was unanimously adopted, Adopted this 19th day of April, 2011 Dated f/pci/ JI., rlQII OTTER TAIL COUNT~ OARD OF COMMISSIONERS , By~.,_::'::_:, _::\,_:_:V,j~,:___:_~~---- Lindquist, Board of Co Larry Kr hn, Clerk OTC Board of Comm1ss1oners· Minutes April 19, 2011 Page 6 Land & Resource Seasonal Staff Request Mr. Kalar reported that he previously met with the Personnel Committee in regards to hiring two Septic System Inspectors and an Office Technician for the busy summer season. Discussion took place regarding the County's septic system abatement process. Motion by Lindquist, second by Rogness, and carried with Johnson opposed, to hire two seasonal Septic System Inspectors and approve a job share arrangement with the GIS Department for Office Technician duties. Commissioners requested that Mr Kalar return to the Board with a recommendation on how to handle the septic system abatement process. Adjournment At 12:24 p.m., Chairman Lindquist adjourned the meeting of the Otter Tail County Board of Commissioners until 6:00 p.m on Tuesday, April 26, 2011. County officials and County organizations have the ability to publish articles. facilitate discussions and communicate information through various media related to conducting County business. Social media facilitates further discussion of'County issues. upcrations and services by providing members of the public the opportunity to participate in milny ways using the Internet. POLICY 1. All County social media sites shall be (a) Approved by the Tcchnology Committee and the requesting Department Head using the appropriate form (b) Published using approved County social networking platform and tools (c) Administered by the Technology \Vcb Team or thcir designee. Designces can be any department employee or volunteer design.itcd by the requesting Department Head that has a complete undcrstanding of this policy and has appropriate cnntent and k·chnical experience. 2. Page I SHORELANDMANAGEMENTORDINANCEAMENDMENT The purpose of the amendment is to Coordinate the ordinance with the recently adopted Wind Energy Conversion Systems Ordinance, change some definitions, and remove the site permit exemption for decks. The amendments are outlined as follows: II. DEFINITIONS 12. Buildable Area: The minimum continuous area remaining on a lot or parcel of land atier all setback requirements, bluffs, areas with slopes greater than 25 percent, all easements and right-of-ways, signilicant historic sites, wetlands, and land less than 3' above belew the OHWL of public waters are subtracted. 25. Dwelling Unit: Any structure or portion of a structure. or other shelter designed as shrn1 or long term living quarters for one or more persons, including, but not limited to, rental or timeshare accommodations such as cottage, house, motel. hotel and resort rooms. cabins. tents. R¥s RCUs and manufactured homes. 78. Tower: Framework or structure exceeding 35 lcct in height. and any wmd generating tEH•,er. telephone communication tower and any structure required by any other regulations to have warning lights. 82. Wind Energy Conversion System (WECS): An electrical generating facility comprised of one or more wind turbines and accessory facilities, including but not limited to: power lines. transformers. and substations that operate by converting the kinetic energy of wind into electrical energy, and MET. The energy maybe used on-site or distributed into the electrical grid. IV. GENERAL REQUIREMENTS 13. Exemptions: C.
