Fir Avenue, Fergus Falls, MN April 12, 2011 9:30 a.m. Call to Order The Otter Tail County Board of Commissioners convened Tuesday, April 12, 2011 at 9:30 a.m., at the Otter Tail County Government Services Center in Fergus Falls, MN, with Commissioners John Lindquist, Chair; Lee Rogness, Vice-Chair; Doug Huebsch, Wayne Johnson, and Roger Froemming present. I Approval of Agenda Motion by Froemming, second by Johnson, and unanimously carried to approve the Board of Commissioners agenda of April 12, 2011, with the following changes: Postpone -Highway Committee Meeting Postpone -WCI Report Add -Capital Improvement Committee Meeting & Personnel Board Meeting Approval of Minutes Motion by Rogness, second by Johnson, and unanimously carried to approve the Board of Commissioners meeting minutes of April 5, 2011, as presented (with a format change for clarity purposes). Approval to Pay Bills Motion by Johnson, second by Froemming, and unanimously carried to approve payment of the County Board bills per Attachment A of these minutes. US Fish & Wildlife Service Wetland Easement Acquisition Motion by Huebsch, second by Johnson, and unanimously carried to certify the following USFWS wetland easement request to protect wetlands and waterfowl while allowing agricultural use of the property: Frederick, Charles T.133N. R.38W 5th PM Section 27, All those portions of the SE¼NW¼ and the SW¼NE¼ lying southeasterly of Minnesota Trunk Highway #210. Informatics Institute Training Motion by Johnson, second by Rogness, and unanimously carried to approve the Public Health Director's participation in the Public Health Informatics Institute Training April 24, 2011 through April 28, 2011: This motion includes approval for out-of-state travel with expenses paid for lodging, airfare, and meals by the Institute. The project is to develop a template for the items needed by public health agencies in an information system. The template will be shared with public health agencies across the nation. OTC Board of Commissioners' Minutes April 12, 2011 Page 2 County Health Rankings Public Health Director, Diane Thorson, presented a handout identified as County Health Rankings 2011 for the State of Minnesota. Out of 85 counties, Otter Tail County is ranked 50th in Healthy Behaviors, 37th in Clinical Care, 49th in Social and Economic Factors, and 47 th in Physical Environment. Ms. Thorson compared these rankings to last year's data and indicated that most factors have shown ranking improvement. Jane Patrick, Coordinator of the Safe Communities Coalition, requested approval of the following proclamation: DISTRACTION-FREE DRIVING DAY Otter Tail County Resolution No. 2011 -22 A Proclamation by the Otter Tail County Safe Communities Coalition: WHEREAS, the safety and security of the citizens of Otter Tail County and surrounding areas are vitally important; and WHEREAS, a large percentage of our citizens regularly drive or ride in motor vehicles on our roadways; and WHEREAS, according to the Office of Traffic Safety, each year in Minnesota, distracted or inattentive driving is a factor in one in four crashes, resulting in at least 70 deaths and 350 serious injuries; and WHEREAS, the Otter Tail County Safe Communities Coalition supports efforts that help raise awareness of the dangers of distracted driving, particularly amongst teenagers, in order to both reduce the number of distracted driving crashes and to better educate drivers; and WHEREAS, across the state 86 law enforcement agencies will actively be participating in the distracted driving enforcement mobilization on Thursday, April 21, 2011 to reduce the risk of injury and death caused in traffic crashes related to distracted or inattentive driving; and WHEREAS, text-messaging, emailing or accessing the web on a wireless device while driving - including while stopped in traffic -became illegal on Minnesota roads effective August 1, 2008; and WHEREAS, one of the most effective means of encouraging safer and smarter behavior by motorists involves convincing drivers of the need to devote their full attention and energy to driving by avoiding distractions such as phone calls, texting, eating, drinking, adjusting vehicle and music controls, and reaching for items; and WHEREAS, in order to reduce the number of crashes as well as improve driver safety, Otter Tail County motorists should dedicate themselves to adopting and maintaining safe behavior while behind the wheel. Upon a motion by Commissioner Rogness and seconded by Commissioner Johnson, the foregoing resolution was unanimously adopted. Adopted on April 12, 2011 Dated fl:pci j l'J. ,;JD I I Case Management Contract Motion by Rogness, second by Huebsch, and unanimously carried to authorize the Chairman's signature to execute a Grant Project Agreement between the Otter Tail County CHB and Minnesota DOH for tuberculosis case management. The grant. in the amount of $1,199.00, is for the period of May 1, 2011 to June 30, 2011. Public Health Fee Schedule Motion by Rogness, second by Huebsch, and unanimously carried to approve the Public Health Fee Schedule effective May 1, 2011 and attached to these minutes as Attachment B. Update Regarding County Vending Services Facilities Operations Manager, Rick Sytsma, briefed the Board regarding the Request for Proposal process for vending services. He reported that a pre-bid meeting to answer questions will take place April 13th with the bid opening scheduled at 10:30 a. m. on April 20, 2011. Discussion took place regarding various aspects of the RFP and vending services issues. SUPPORT SERVICES FOR LONG-TERM HOMELESS PEOPLE LIVING IN NORTHWESTERN MINNESOTA LETTER OF AGREEMENT OTTER TAIL COUNTY/RESERVATION Otter Tail County Resolution No. 2011 -23 WHEREAS, the Otter Tail County Board of Commissioners agrees to participate in "Support Service Funds for Long Term Homeless People" from the Department of Human Services. in collaboration with a multi-county consortium consisting of Northwest Regions 2 and 3, and West Central Region 4. Hubbard County will serve as the Lead County and Grantee for this project. Leech Lake Indian Reservation, White Earth Indian Reservation, and Red Lake Indian Reservation will partner with the multi-county consortium and will receive services as a result of this project. OTC Board of Commissioners' Minutes April 12, 2011 Page 4 WHEREAS, the Otter Tail County Board of Commissioners affirms to fully cooperate and participate in the collaborative project to provide support services to individuals and families who experience long-term homelessness. WHEREAS, the Otter Tail County Board of Commissioners and Mahube Community Council, Inc. agrees to communicate with partners of the multi-county consortium on a regular basis, receiving reports and information regarding progress of the project from the Service Provider Partner. WHEREAS, the Otter Tail County Board of Commissioners agrees to review the service plan and provide feedback to the Service Provider Partner regarding expectations and services provided. WHEREAS, the Otter Tail County Board of Commissioners will participate in decision making for the project with the multi-county consortium. WHEREAS, In the event that full funding is not received, secured funds will be pro-rated relative to each county/agency/tribe's original request. WHEREAS, the contact person for the Northwestern Minnesota Support Services for Long-Term Homeless People project is Leah Pigatti and the administrative agent for the project is Mahube Community Council, Inc. NOW, THEREFORE, BE IT RESOLVED, that the Otter Tail County Board of Commissioners supports the grant application of the Otter Tail Wadena Community Action Council in collaboration with the multi-county consortium to secure OHS funding to address the issue of long term homelessness. Upon a motion by Commissioner Froemming and seconded by Commissioner Johnson, the foregoing resolution was unanimously adopted. The meeting was reconvened at 10:29 a.m. 800 MHz Communication System Sheriff, Brian Schlueter, and Lieutenant, Matt McGuire, updated the Board regarding the County's progress towards implementing the new statewide 800 MHz communication system. Lengthy discussion took place regarding funding the various aspects of the project including new radios needed for law enforcement, ambulance, and fire department personnel. Motion by Rogness, second by Froemming, and unanimously carried to request the following employees assistance in developing a concept/plan to proceed forward with the law enforcement communication system project: OTC Board of Commissioners' Minutes April 12, 2011 Page 5 Sheriff, Brian Schlueter; Lieutenant, Matt McGuire; 911 Dispatch Supervisor, Judy Siggerud; Commissioner John Lindquist; Auditor, Wayne Stein; and Coordinator, Larry Krohn A recommendation from the group will be reviewed by the County Board at their regular meeting on May 3, 2011. Demolition Material from Tornado Aftermath Pastor Del Moen, Chair of the Wadena Otter Tail Long Term Recovery Committee, presented a plan to organize individuals to fix up and clean up their properties from tornado related damage. There are 18 individual projects targeted for fix up in Almora. Mr. Moen stated that the disposal of demolition material is expensive and requested that this material be accepted at the Henning Landfill without fees. Discussion followed By consensus, Board members suggested that the Long Term Recovery Team find a site that the City of Almora or Elmo Township owns that could be used for the demolition material and obtain a permit by rule. If a local entity has land, it could be used for the demolition material and green space could be built over the top when the projects are completed. Perham Resource Recovery Facility Financial Update Solid Waste Director, Mike Hanan, submitted background information for solid waste recovery facilities in Otter Tail County dating back to 1986. The documentation showed Otter Tail County's original debt obligation for the operation of the PRRF at $3.039,550 with the 2011 debt obligation at $4,752,300. The 2011 debt obligation includes the proposed expansion and upgrade of the facility. Lengthy discussion continued regarding the project. Resource Recovery Association Meeting Motion by Rogness, second by Johnson, and unanimously carried to authorize Commissioner Huebsch to attend the Minnesota Resource Recovery Association meeting on April 15, 2011 in Perham, MN. SNOW CRUISERS TRAIL ASSOCIATION GRANT-IN-AID FUNDING Otter Tail County Resolution No, 2011 18 Commissioner Froemming offered the following and moved its adoption: WHEREAS, Otter Tail County has sponsored Grant-In-Aid Systems in the past; and WHEREAS, acceptance of the Grant-In-Aid Systems proposed extensions are subject to the review and approval of the County Attorney. THEREFORE, BE IT RESOLVED that Otter Tail County shall continue to sponsor Grant-In-Aid Trail Systems as they exist for the Snow Cruisers Trail Association Snowmobile Club for the 2011-2012 snowmobile season and proposed extensions of Grant-In-Aid Trails with the aforementioned condition. Commissioner Huebsch seconded the resolution and, upon being put to vote, the resolution was unanimously adopted. Fergus Falls, MN Central Specialties, Inc. Alexandria, MN Wadena Asphalt, Inc. Wadena, MN Seasonal Supply Seasonal Supply of Hot Mix Bituminous North, West & East Otter Tail County Seasonal Supply of Hot Mix Bituminous North, West, & East Otter Tail County Seasonal Supply of Hot Mix Bituminous East Otter Tail County Spring Flooding Highway Engineer, Rick West, discussed several areas of high water including Highway 108 (Annie Lake area) and the Little McDonald, Paul and Devils Lake area. He reported that next week the State Disaster Evaluation Team will visit Otter Tail County to complete a preliminary damage assessment. 2011-2012 Highway Salt Purchase Mr. West presented price comparisons between the State Bid and Western Areas Cities Counties Organization (WACCO) for salt for the 2011-2012 winter season. The salt purchased from WACCO would be delivered upon purchase, stored under cover and mixed with sand in the fall. Total savings ordering from WACCO rather than the state bid was reported as $35,687.75. Motion by Froemming, second by Johnson, and unanimously carried to purchase the 2011-2012 salt supply from WACCO consisting of 2,600 tons of salt at a total approximate cost of $184,782.00 plus $5,000 to be paid to WACCO for their 2011 annual membership fee. Highway Maintenance Staff Motion by Rogness, second by Huebsch, and unanimously carried to authorize the Highway Engineer to proceed with replacing a vacant Highway Maintenance position. Recess & Reconvene At 12:20 p.m., Chairman Lindquist declared the meeting of the Otter Tail County Board of Commissioners recessed for lunch break. The meeting was reconvened at 1 :01 p.m. with Commissioners Johnson, Huebsch, Rogness, and Lindquist present. OTC Board of Commissioners' Minutes April 12, 2011 Page 7 Adult Mental Health Local Advisory Council Adult MH Local Advisory Council members, Jeanie Jaros and Fonda Knudson, reported on LAC activities for 2011. They briefed the Board on the 10th annual Mental Health Workshop scheduled for May 12, 2011, and other educational opportunities and events to create awareness of services that are available in the community. MAY IS MENTAL HEALTH MONTH PROCLAMATION Otter Tail County Resolution No. 2011 -24 WHEREAS, the U.S. Surgeon General states that mental health is fundamental to health and indispensable to personal well-being, family and interpersonal relationships, and contributes to community and society; and WHEREAS, the U.S. Surgeon General confirms that mental illness affects one in five Americans every year, regardless of age, gender, race, ethnicity, religion or economic status; and WHEREAS, the U.S. Surgeon General has found that a range of treatment exists for most mental disorders and the efficacy of mental health treatments are well documented; and WHEREAS, Otter Tail County has made a commitment to community-based systems of mental health care for all residents and has appointed a Local Mental Health Advisory Committee for children and adults; and WHEREAS, the guiding principles of community mental health care have always been comprehensiveness, cost-efficiency, effective management and high-quality and consumer responsive services, and these principles are now being adopted by private and public healthcare payers; and WHEREAS, the National Mental Health Association, the National Council for Community Behavioral Healthcare and their national partners, the National Alliance for the Mentally Ill and their local affiliates observe Mental Health Month every May to raise awareness and understanding of mental health and illness. THEREFORE, WE, The Otter Tail County Board of Commissioners, by virtue of the authority vested in us as County Commissioners of Otter Tail County, do hereby proclaim May 2011 Mental Health Month in Otter Tail County. As County Commissioners of Otter Tail County we call all citizens, government agencies, public and private institutions, business and schools to recommit our community to increasing awareness and understanding of mental illness and the need for appropriate and accessible services for all people with mental illness. Mental Health Initiative Update LuAnne Hanson provided an update of various programs funded through the Becker, Clay, Otter Tail, Wadena (BCOW) Mental Health Initiative. One of the goals, of the programs, is to avoid hospitalizations through case management by connecting individuals with services. Otter Tail County is the fiscal host for the Initiative and this regional collaboration has been established for about 15 years. Fiscal & MACSSA Reports Human Services Director, John Dinsmore, provided the Human Services first quarter financial report and a Minnesota Association of County Social Service Administrator Legislative Update. Purchase of Service Agreement Motion by Rogness, second by Johnson, and unanimously carried to authorize the appropriate County Officials' signatures to execute a Purchase of Service Agreement between Otter Tail County and Otter Tail-Wadena Community Action Council for long term tornado recovery services not to exceed $57,928.00. Approval to Pay Bills & Claims Motion by Rogness, second by Lindquist, and unanimously carried to approve payment of the Human Services bills and claims as presented. RESOLUTION DECLARING A STATE OF EMERGENCY Otter Tail County Resolution #2011-19 WHEREAS the 2011 spring flooding is expected to impact the population of Otter Tail County and its cities; and WHEREAS, the event is expected to cause a significant amount of public property damage; and WHEREAS, the Otter Tail County Department of Emergency Management requests the Otter Tail County Board of Commissioners to declare Otter Tail County in a STATE OF EMERGENCY for the Spring Flood event of 2011. NOW, THEREFORE, BE IT RESOLVED, that the Otter Tail County Board of Commissioners declares Otter Tail County in a STATE OF EMERGENCY in order to prepare and do advance measures to protect the County from this spring flooding event. Upon the motion of Commissioner Rogness and seconded by Commissioner Johnson, the foregoing resolution was adopted with Commissioners Johnson, Huebsch, Rogness, and Lindquist voting in favor. Adopted on April 12, 2011 Dated ftpril /9, ao,1 Attest /~ ~ La7ry Kron, 5 rk OTC Board of Commissioners' Minutes April 12, 2011 Page 9 RESOLUTION REQUESTING A PRESIDENTIAL DECLARATION OF A MAJOR DISASTER Otter Tail County Resolution #2011-20 WHEREAS, the County of Otter Tail has sustained severe losses of major proportion, caused by the Spring Flood event of 2011; and WHEREAS, Otter Tail County is a public entity within the State of Minnesota; and WHEREAS, substantial damage has been sustained to public and private property, as outlined in the attached damage assessment forms; and WHEREAS, the cost of recovery from this disaster is beyond the resources available within Otter Tail County; therefore, state and federal resources are necessary. NOW, THEREFORE, BE IT RESOLVED, that the Board of Commissioners for and on behalf of the citizens of Otter Tail County, request the Governor of the State of Minnesota to petition the President of the United States to declare the County of Otter Tail, Minnesota to be a major disaster area, through appropriate channels. BE IT FURTHER RESOLVED, that this request is for The Public Assistance and Individual Assistance Programs. BE IT FURTHER RESOLVED, that the County Emergency Management Director is authorized to coordinate the damage assessment teams with local government, and assist in the administration of the disaster recovery process, as needed. Upon the motion of Commissioner Lindquist and seconded by Commissioner Johnson, the foregoing resolution was adopted with Commissioners Johnson, Huebsch, Rogness, and Lindquist voting in favor. Adopted on April 12, 2011 Dated A-p,-;I /'I, qOII D OF COMMISSIONERS OTC Board of Commissioners' Minutes April 12, 2011 Page 10 Otter Tail County Resolution #2011-21 Amendment to Personnel Rules WHEREAS, The County Board needs to amend the Personnel Rules to correct the statutory citation in section 8:35, paragraph L. This relates to the state mandate that county owned vehicles are required to be identified. Section 168012 should have been cited as Subd. 10) not 1(g), but the whole section also covers the exemptions. NOW, THEREFORE, BE IT RESOLVED: That paragraph L of section 8.35 is hereby amended to read as follows: L. County vehicles are to be identified with the name of the County. Unless specifically exempted, all County vehicles are to be identified as required by Minnesota Statutes 471.346 and 168.012. Upon the motion of Commissioner Rogness, seconded by Commissioner Huebsch, the foregoing resolution was adopted with Commissioners Johnson, Huebsch, Rogness, and Lindquist voting in favor.
