Fir Avenue, Fergus Falls, MN February 15, 2011 9:30 a.m. Call to Order The Otter Tail County Board of Commissioners convened Tuesday, February 15, 2011, at 9:30 a.m., at the Otter Tail County Government Services Center in Fergus Falls, MN, with Commissione1s John Lindquist, Chair; Doug Huebsch, Wayne Johnson, and Roger Froemming present. Vice-Chair, Lee Rogness was absent. Approval of Agenda Motion by Froemming, second by Johnson, and unanimously carried to approve the Board of Commissioners agenda of February 15, 2011, with the following additions: County Auditor's Agenda Items Request for Approval of Labor Agreements Approval of Minutes Motion by Froemming, second by Johnson, and unanimously carried to approve the Board of Commissioners meeting minutes of February 8, 2011, as mailed. Approval to Pay Bills Motion by Huebsch, second by Johnson, and unanimously carried to approve payment of the County Board bills per Attachment A of these minutes. Boat & Water Grant Agreement Motion by Huebsch, second by Johnson, and unanimously carried to authorize the appropriate County officials' signatures to execute the Annual County Boat and Water Safety Grant Agreement between the State of Minnesota DNR and the County of Otter Tail. The grant funds, in the amount of, $48,826.00, are used for salaries for Otter Tail County boat and water enforcement employees. Sheriff's 2010 Year End Report Sheriff, Brian Schlueter, presented the Sheriff's Department Otter Tail County 2010 Year End Report entitled "Protecting a Great County". The Sheriff reviewed the data and statistics. He referred to the tornado this past summer and the successful response from the Sheriff's Department. Valuable lessons were learned from the disaster that will be useful in future emergency events. He noted that the training center at the Ottertail City location is very successful. Otter Tail County experienced a high number of fatality accidents; however the total number of accidents including personal injury and property damage were down. The Sheriff reported a trend of reduced inmate days and reduced crime which is similar to state and national trends. Sheriff's Department Staffing Due to upcoming retirements, a motion was offered by Huebsch, seconded by Johnson, and unanimously carried to replace a Lieutenant position and Detective Sergeant position by internal promotions. After the internal promotion process is completed, there will be two vacant Deputy positions which will be filled by competitive hire. The motion also included authorization to promote the new Lieutenant thirty (30) days in advance of the retirement of the current Lieutenant for continuity and training purposes. OTC Board of Commissioners' Minutes February 15, 2011 Page 2 Probation Advisory Committee Motion by Lindquist, second by Johnson, and unanimously carried to reappoint Janyne Hoff of Fergus Falls, MN, to the Otter Tail County Probation Advisory Committee for a three year term effective January 1, 2011. Probation Department 2010 Annual Report Probation Director, Chuck Kitzman, reviewed the Otter Tail County Probation 2010 Annual Report. Discussion included types of juvenile offenses with 272 total delinquent and petty offenses reported, which is a decrease from 2009. There were 259 adult offenses placed under supervision during 2010, also a decrease from the previous year. Mr. Kitzman discussed the cost of out of home placement and changes, through the years, in how supervision cases are managed. Recess & Reconvene At 10:18 a.m., Chairman Lindquist declared the meeting of the Otter Tail County Board of Commissioners recessed for a short break. The meeting was reconvened at 10:21 a.m. Emergency Management Planning Emergency Management Committee members briefed the Board on emergency preparedness. MIS Director, Tim Brand, reported that he is researching a product that will allow access to social networking sites but will block the site if there are malicious codes detected. He will return to the Board at the next meeting with a recommendation on the best product. Mr. Brand also indicated that the Technology Committee is working on a user's policy regarding access to social network sites. Discussion continued regarding reverse 911 and other potential emergency notification systems. Land & Resource Director, Bill Kalar, indicated that if citizens within the shoreland zone have time to request a permit when sandbagging or diking, they should complete the application for the request. If the situation is an emergency, citizens can proceed with work to protect their dwelling and remove the sandbags after the flooding threat has dissipated. Individuals needing to dike or berm should call the Land & Resource Office to report the situation. If the dike or berm becomes a permanent situation, those property owners will be required to obtain a permit; but will not be required to pay the after-the-fact fee. GIS Coordinator, Brian Armstrong, reported that a map has been developed showing low areas around lakes that have the potential to flood. This map is for planning purposes only and is not to be used as a prediction tool. Discussion took place regarding sandbags. Motion by Johnson, second by Froemming, and unanimously carried to charge $0.20 per sandbag if an individual or entity wishes to purchase just the bags. If an individual or entity wishes to fill the sandbags at one of the County's distribution sites with sand and haul them away to be used, there will be no charge. The rationale for this policy is to encourage use of the sandbags not simply taking sandbags in case of flooding, wherein the risk of hoarding could occur. The County will ask for citizen's cooperation in prioritizing protection of homes and businesses before property. Motion by Huebsch, second by Johnson, and unanimously carried to authorize opening designated sandbagging sites no later than Friday, February 25, 2011. Identification information will be collected when an individual(s) fills sandbags which will be used if a FEMA declaration occurs at a later date. The Committee will also work on identification of closed roads due to flooding to help emergency services. Drainage System #70 Brian Fronning, property owner within the Ditch #70 catchment basin, presented documentation showing the original elevation of Sewell Lake established in 1913 at 1292.5'. The current DNR established Ordinary High Water Level (OHWL) for Sewell Lake is 1298'. Sewell Lake's elevation is currently higher than 1298' and is flowing over the top. This drainage system has been redetermined for benefits and the next step is to hire an engineer to develop a project to allow the system to work as designed. Commissioners assured Mr. Fronning that his information will be provided to the engineer for consideration when developing a proposed project. Tour of Hospice House OTC Board of Commissioners' Minutes February 15, 2011 Page 3 At 11:25 a.m., Chairman Lindquist recessed the Board of Commissioners' meeting to tour the Hospice House located at 394 Woodland Drive in Fergus Falls. Commissioners arrived at the Hospice House at 11 :30 a.m., toured the 8-bed facility, and learned about patient's hospice benefits and rights. After a light lunch, at 1 :00 p.m., Commissioners returned to the Government Services Center. Chairman Lindquist reconvened the meeting at 1 :05 p.m. Planning Commission Reappointments Motion by Froemming, second by Huebsch, and unanimously carried to reappoint the following members to the Otter Tail County Planning Commission effective January 1, 2011 for a three year term: Member's Name Bert Olson Robert Schwartz Rick Wilson Rod Boyer District Appointment Third District Fourth District Fifth District First District Shoreland Management Ordinance Term Expiration Date December 31, 2013 December 31, 2013 December 31, 2013 December 31, 2013 Land & Resource Director, Bill Kalar, submitted a document entitled "Shoreland Management Ordinance Proposed Changes" dated February 15, 2011. Discussion took place regarding the proposed changes, most of which are needed to coordinate with the new Wind Energy Conversion System (WECS) Ordinance. Lengthy discussion took place regarding the inclusion of landscape rock in the calculation of impervious surface and setback requirement for a septic system from a deck. A septic system that was in compliance when constructed (prior to 1992) could now be out of compliance. Mr. Kalar will return to the Board in two weeks for further discussion regarding the proposed SMO changes. Rabbit River Blow Out WOTSWCD Manager, Brad Mergens, and Highway Engineer, Rick West, discussed the issues related to the Rabbit River blow out. Mr. Mergens reported that Wilkin County is planning to temporarily repair the Rabbit River blow out even though this area is under the Bois de Sioux Watershed District's jurisdiction. The Bois de Sioux Watershed District has not identified a short term solution; but has indicated that impoundment is their long term solution to the issue. Discussion took place regarding the potential affects downstream and spring flooding concerns. Concern was also expressed that the Watershed District should be taking the lead on the project. Commissioners requested that a letter be sent to the Bois de Sioux Watershed District to inquire what their plan is both short term and long term to repair the Rabbit River blow out. (Commissioner Froemming was absent at 2:30 p.m.) Proposed Upper Red Lower Otter Tail Watershed District Petition Mr. Mergens updated the Board on the proposed watershed district petition that Wilkin County filed with the Board of Water and Soil Resources (BWSR). On April 13, 2011, the BWSR Regional Committee will meet and make a recommendation to the full BWSR Board on April 27, 2011. Mr. Mergens cited three concerns with the proposed petition; 1) incorrect citation of statute, 2) lack of managers from Otter Tail County, and 3) proposed watershed boundary map. The meeting on April 13, 2011, is open to the public. OTC Board of Commissioners' Minutes February 15, 2011 Page 4 Approval of Labor Agreements Motion by Johnson, second by Huebsch, and unanimously carried to approve the following Collective Bargaining Agreements effective January 1, 2011 through December 31, 2013: Labor Agreement between the County of Otter Tail and Minnesota Teamsters Public and Law Enforcement Employees Union, Local No. 320 Representing the Government Services Technical Unit And Labor Agreement between Otter Tail County and the AFSCME, Local Union No. 1830 representing the Highway Maintenance Workers Extension Committee Members Motion by Johnson, second by Lindquist, and unanimously carried to appoint Steven Schwartz and reappoint Donna Gill to the Otter Tail County Extension Committee for a three year term effective January 1, 2011.
