Fir Avenue, Fergus Falls, MN February 8, 2011 9:30 a.m. Call to Order The Otter Tail County Board of Commissioners convened Tuesday, February 8, 2011, at 9:35 a.m., at the Otter Tail County Government Services Center in Fergus Falls, MN, with Commissioners John Lindquist, Chair; Lee Rogness, Vice-Chair; Doug Huebsch, Wayne Johnson, and Roger Froemming present. Approval of Agenda Motion by Rogness, second by Froemming, and unanimously carried to approve the Board of Commissioners agenda of February 8, 2011, with the following modifications: 11 :DO a.m. -Bid Award of Generator for Courthouse 11 :20 a.m. -Personnel Committee Meeting with Sheriff Reorganization Meeting Update Approval of Minutes Motion by Froemming, second by Rogness, and unanimously carried to approve the Board of Commissioners meeting minutes of February 1, 2011, as mailed. Approval to Pay Bills Motion by Rogness, second by Johnson, and unanimously carried to approve payment of the County Board bills per Attachment A of these minutes. Ditch Hearing Process Land & Resource Director, Bill Kalar, and Ditch Inspector, Randy Wasvick, discussed the informal ditch hearing process with the Board. The Board requested that an Agenda for informal ditch hearings be developed which should include the following: Why the County is holding a public ditch meeting An overview of ditch law & determination of benefits A timeline handout showing the steps required to complete a ditch project Map(s) showing the ditch, catchment area, and identification of the areas with known problems Brochures explaining water regulations of other entities such as NRCS, WCA, & Public Waters Q & A time with the public (requiring name of person speaking) Guideline for Forgiveness of Penalty Requests Treasurer, Steve Andrews, reported that several County Officials met and developed a guideline for considering forgiveness of tax penalty requests. A Jetter was received by Commissioners from Cheryl Harris in favor of the current County practice that tax penalties are not forgiven unless the County has made an error causing the late tax payment. A motion was offered by Huebsch, seconded by Rogness, and carried with Froemming opposed, to approve the following Guideline for Forgiveness of Penalty Requests: OTC Board of Commissioners Minutes February 8, 2011 Page 2 Otter Tail County Guideline for forgiveness of penalty is limited to hardship. Hardship is defined as a tragedy or casualty suffered by the taxpayer, such as a death in the family, extreme or extended illness, accident, fire or other extreme hardship that is documented to the County Treasurer or Auditor that made timely payment impossible. Hardship does not apply to business entities unless documentation is also presented that demonstrates that no other persons, such as associates, partners, consultants or accountants, other than the applicant are involved in or have responsibility of property tax matters. Financial hardship alone does not fall within this definition. Award of Right of Way Platting Quotations for S.A.P 056-634-010 After previously advertising for quotations for the CSAH No. 34 Reconstruction project from TH 10 East to CSAH 80 in Perham, the following quotes were opened: Ulteig Engineers $ 5,871.00 Detroit Lakes, MN Anderson Land Surveying, Inc. Fergus Falls, MN Moore Engineering Fergus Falls, MN Houston Engineering Fargo, ND 8,900.00 9,650.00 11,790.00 Interstate Engineering, Inc. 12,100.00 Fergus Falls, MN Motion by Huebsch, second by Rogness, and unanimously carried to award RIV\/ Platting for S.A.P. 056-634-010 to the low bidder, Ulteig Engineers of Detroit Lakes, MN, in the amount of $5,871.00. Award of Right of Way Platting Quotations for S.A.P 056-627-013 & 056-627-014 After previously advertising for quotations for the CSAH No. 27 Reconstruction project from Fir Avenue in Fergus Falls North 1 mile (Phase I) and from 1 mile North of Fir Avenue to CSAH 10 (Phase 2), the following quotes were opened: Ulteig Engineers $21,090.00 Detroit Lakes, MN Moore Engineering Fergus Falls, MN Anderson Land Surveying, Inc. Fergus Falls, MN Interstate Engineering, Inc. Fergus Falls, MN 21,925.00 31,645.00 34,400.00 Houston Engineering, Inc. 40,990.00 Fargo, ND Motion by Rogness, second by Johnson, and unanimously carried to award RIV\/ Platting for S.A.P. 056-627-013 & 056-627-014 to the low bidder, Ulteig Engineers of Detroit Lakes, MN, in the amount of $21,ogo.oo. OTC Board of Commissioners Minutes February 8, 2011 Page 3 Utility Work for CSAH 83 Project Motion by Rogness, second by Johnson, and unanimously carried to authorize the Highway Engineer to sign an agreement between the County of Otter Tail and Otter Tail Power Company to relocate power line poles for S.A.P. 056-683-10 at an estimated cost of $18,283.82. Joint Wilkin/Otter Tail County Request Highway Engineer, Rick West, reported that Wilkin County plans to draft a joint resolution from Otter Tail and Wilkin counties to request that the Bois de Sioux Watershed District makes the study and interim recommendation for repairs of the Rabbit River blow-out their top priority. Commissioners expressed concern that Watershed Districts are an additional layer of government that has not been responsive to the needs of their citizens. Chairman Lindquist requested that a letter be drafted to state and federal legislators to communicate that Watershed Districts are not the answer for water issues; rather, local officials need to provide that leadership. West Central Regional Juvenile Center Probation Director, Chuck Kitzman, provided an update regarding the WCRJC and reported a 2011 budget of $1,264,371.00 for the secure unit. He reviewed average Otter Tail County usage for CY2010. Caseload/Workload Reduction Grant Motion by Johnson, second by Huebsch, and unanimously carried to authorize the Probation Director to apply for FY2012 and 2013 caseload/workload reduction grant dollars. Human Services Department Human Services Director, John Dinsmore, submitted the Health & Human Services Minnesota Legislative Update dated February 7, 2011. He reviewed proposed Human Services funding reductions, waiver funding, and non-emergency medical transportation services. Mr. Dinsmore presented a listing of the 2010-2011 Otter Tail County Human Services Purchase of Service Agreements. Human Services Agreements/Contracts Motion by Huebsch, second by Rogness, and unanimously carried to authorize the appropriate County officials' signatures to execute the "Cooperative Agreement for Welfare Fraud Investigation Services" between the Otter Tail County Attorney and the Minnesota Department of Human Services (DHS) as presented. This motion also authorized the appropriate County officials' signatures to execute a Home and Community-Based Services Contract between the County of Otter Tail and Gary & Laura Hexum, Oakwood Residence, Elizabeth, MN for the period of February 1, 2011 through June 30, 2011. Approval to Pay Bills & Claims Motion by Froemming, second by Rogness, and unanimously carried to approve payment of the Human Services bills and claims as presented. Award of Generator for Courthouse Physical Plant Manager, Rick Sytsma, and Architect, David Schultz, presented two bids for the generator for the Courthouse campus. Motion by Johnson, second by Huebsch, and unanimously carried to award the generator set for the communication room at the Courthouse to the low bidder, Cummins NPower LLC of Fargo, ND in the amount of $106,300.00 as recommended. OTC Board of Commissioners Minutes February 8, 2011 Page4 Continuing Reorganization Discussion Commissioners requested that the Personnel Board meet at 9:30 a.m. on Friday, February 18, 2011 to discuss the next step in the reorganization process. Commissioners also discussed the need to meet with surrounding counties to discuss sharing services. Equitable Sharing Agreement Motion by Johnson, second by Huebsch, and unanimously carried to approve the Chairman's signature to execute the Equitable Sharing Agreement and Certification relative to forfeiture funds. Shoreland Guide to Lake Stewardship Motion by Huebsch, second by Froemming, and unanimously carried to approve an additional contribution of up to $1,000.00 to the Otter Tail County Coalition of Lake Association (COLA) to pay for a portion of the cost to print the "Shoreland Guide to Lake Stewardship". Minnesota Rural Counties Caucus Motion by Froemming, second by Johnson, and unanimously carried to approve the 2011 MRCC annual membership dues in the amount of $2,100.00. Adjournment At 11 :42 a.m., Chairman Lindquist adjourned the meeting of the Otter Tail County Board of Commissioners until 9:30 a.m. on Tuesday, February 15, 2011.
