Fir Avenue, Fergus Falls, MN January 4, 2011 9:30 a.m. Call to Order The Otter Tail County Board of Commissioners convened Tuesday, January 4, 2011, at 9:30 a.m., at the Otter Tail County Government Services Center in Fergus Falls, MN, with Commissioners Roger Froemming, Chair; John Lindquist, Vice-Chair; Wayne Johnson, and Lee Rogness present. Commissioner Doug Huebsch was absent. Oath of Office Newly elected Commissioners, Roger Froemming (4th District) and Wayne Johnson (2nd District) read and signed their oath of office. Year 2011 Otter Tail County Board Chair Board of Commissioners Clerk, Larry Krohn, requested nominations for the CY2011 Otter Tail County Board Chair. Commissioner Rogness nominated Commissioner John Lindquist as the Otter Tail County Board Chairman for 2011 and a unanimous ballot was cast. Year 2011 Otter Tail County Board Vice-Chair Board of Commissioners Clerk, Larry Krohn, requested nominations for the CY2011 Otter Tail County Board Vice-Chair. Chairman Lindquist nominated Commissioner Lee Rogness as the Otter Tail County Board Vice-Chair for 2011 and a unanimous ballot was cast Approval of Agenda After assuming the Chair seat, Chairman Lindquist called for approval of the January 4, 2011 agenda. Motion by Froemming, second by Rogness, and unanimously carried to approve the Board of Commissioners agenda of January 4, 2011, with the following additions: 10:45 a.m. -Treasurer, Steve Andrews 10:50 a.m. -Facilities Manager, Rick Sytsma Approval of Minutes Motion by Froemming, second by Johnson, and unanimously carried to approve the Board of Commissioners meeting minutes of December 28, 2010 as mailed. Approval to Pay Bills Motion by Rogness, second by Lindquist, and unanimously carried to approve payment of the County Board bills per Attachment A of these minutes. Oscar Lake Project Update Highway Engineer, Rick West, presented a map of the Oscar Lake Outlet Project with elevations taken on December 29, 2010. Lengthy discussion took place regarding the various elevations of Oscar Lake, Lein Lake, and surrounding areas. Wilkin County had requested a berm or rock dam be constructed to reduce flow of water which is naturally flowing over Oscar Lake. Concerns were expressed regarding two roads and a couple of farm properties that would likely be affected downstream if the natural flowage is obstructed. Mr. West and Commissioners Lindquist and Johnson, will attend a meeting with Wilkin County January 5, 2011 to continue discussion regarding this water drainage project. OTC Board of Commissioners' Meeting January 4, 2011 Page 2 Long Term Tornado Recovery County Coordinator, Larry Krohn, and Commissioner Rogness will attend the Long Term Recovery Committee meeting January 5, 2011 at the New York Mills County offices. Purchase of AutoCAD Software Motion by Rogness, second by Johnson, and unanimously carried to authorize purchase of AutoCAD Software from DL T Solutions of Herndon, VA, on behalf of Eagle Point Software Corp. at a bid price of $25,126.99 as recommended by the Highway Engineer. The purchase is payable from the Capital Improvement Fund. Phelps Mill Bridge Restoration Project Highway Engineer, Rick West, briefed the Board regarding the cost and schedule of the Phelps Mill Bridge Restoration project and submitted a handout dated December 21, 2010. He requested approval to move forward with a Federal Transportation Enhancement Grant Application for 2011 funding. Motion by Rogness, second by Froemming, and unanimously carried to authorize the Highway Department to move the Phelps Mill Bridge Restoration project forward one year to gain an additional $120,850.00 in federal funding for the project. Ditch Process Timeline Land & Resource Director, Bill Kalar, submitted a Ditch Repair Process timeline dated December 10, 2010. The timeline indicated an average of 2.4 years from the time a request is received for repair of a county ditch to the beginning of the actual work for the repair/improvement project. On-Call Transport Position Motion by Rogness, second by Johnson, and unanimously carried to approve hiring for an On-Call Transport position as recommended by the Personnel Committee. The position will provide an additional person to assist for required law enforcement transports. Approval of Out-of-State Travel Motion by Froemming, second by Johnson, and unanimously carried to authorize out-of-state travel to Kansas for Lieutenant McGuire for certification on internal affairs investigations as recommended by the Sheriff. The conference is scheduled for February of 2011. County Website Motion by Johnson, second by Rogness, and unanimously carried to designate the Otter Tail County website as the official publication for highway project advertisements for bids as authorized by Minnesota Statute 331 A.12 Subdivision 2. Annual Appropriations Motion by Froemming, second by Johnson, and unanimously carried to authorize payment of the following CY2011 annual appropriations: Annual Appropriation West Central Initiative West Otter Tail Fair Association East Otter Tail Fair Association Otter Tail Country Tourism Association The History Museum Rural Life Outreach MN Red River Valley Development Assn. Approved 2011 20,000.00 16,000.00 16,000.00 10,000.00 20,000.00 1,000.00 800.00 OTC Board of Commissioners' Meeting January 4, 2011 Page 3 County Board of Appeal & Equalization Dates Motion by Lindquist, second by Froemming, and unanimously carried to convene the County Board of Appeal and Equalization on Wednesday, June 15, 2011, at 9:00 a.m. and to reconvene the County Board of Equalization for final action on Tuesday, June 28, 2011, (Minn. Stat. 274.14). Calendar Year 2011 Pocket Gopher Bounty Resolution (M.S. 348.12 and 348.13) Otter Tail County Resolution No. 2011 -01 Upon motion made by Rogness, seconded by Johnson and unanimously carried, the following resolution was adopted: RESOLVED by the Board of County Commissioners of Otter Tail County, Minnesota, that The sum of thirty cents ($.30) be paid out of the General Revenue Fund of Otter Tail County for every pocket gopher killed in said County during the year 2011. Paid only in those cases where the township in which the pocket gophers were so killed shall provide for the payment of at least an additional bounty of forty cents ($.40) for each pocket gopher so killed. RESOLVED further that said payment of such County shall be made by the County Auditor upon certificates executed by the Ch.airman and/or Clerk of the Town Board of said Township setting forth that the township had· issued an9 ,delivered to each claimant a payment for at least seventy cents ($. 70) for each pocket gopher so killed. Stat. 282.05 for the apportionment of proceeds from the sale of tax forfeited lands, and; OTC Board of Commissioners' Meeting January 4, 2011 Page 4 WHEREAS, the County Auditor shall apportion the tax sale proceeds to the taxing district pursuant to Minn. Stat. 282.08, and; WHEREAS, Minn. Stat. 282.08 (4) (b) provides that the County Board may set aside 20% of the proceeds remaining after the value of public improvements, special assessments and bond issues levied on the property have been paid, for acquisition and maintenance of county parks and recreational areas, and; WHEREAS, Otter Tail County has a park and recreational area which would benefit by such an apportionment. NOW, THEREFORE, BE IT RESOLVED, that the County Auditor retains 20% of the proceeds from the sale of tax forfeited lands for acquisition and maintenance of parks and recreational areas from the proceeds to be disbursed according to law. Equipment Lease Agreement Motion by Lindquist, second by Rogness, and unanimously carried to authorize the Otter Tail County Extension Offices (East and West) to lease two copiers/printers from Marco at a monthly lease cost of $402.54 as requested by the Regional Extension Director. Human Services Staffing Human Services Director, John Dinsmore, presented a document outlining a process to make temporary out-of-class assignments permanent effective January 11, 2011. Motion by Rogness, second by Johnson, and unanimously carried to allow internal posting of the Support Enforcement Aid and Financial Worker positions. Mr. Dinsmore presented a document outlining a requested mobility assignment for a Human Services Supervisor. The assignment would be with the Minnesota Department of Human Services for approximately one year working with the next phase of the Rate Setting Methodologies Initiative. OTC Board of Commissioners' Meeting January 4, 2011 Page 6 Depository Resolution Otter Tail County Resolution No. 2011 -03 Commissioner Froemming offered the following and moved its adoption: RESOLVED by the Board of Commissioners of Otter Tail County, Minnesota, that all financial institutions in Otter Tail County, including state and federal banks be and are hereby designated as depositories of County funds.
