Call to Order
The Otter Tail County Human Services Board convened Tuesday, November 9, 2010, at 9:30 a.m. at
the Otter Tail County Government Services Center in Fergus Falls, MN, with Commissioners
Roger Froemming, Chair; John Lindquist, Vice-Chair; Everett Erickson, Doug Huebsch, and
Lee Rogness present.
Approval of Agenda
Motion by Erickson, second by Lindquist, and unanimously carried to approve the Human Services
Board agenda of November 9, 2010 as mailed.
Approval of Minutes
Motion by Huebsch, second by Froemming, and unanimously carried to approve the Human Services
Board minutes of October 26, 2010, as presented.
DWI Court Program
Probation Director, Chuck Kitzman, submitted several documents related to the Otter Tail County DWI
Court program and operational Drug Courts located throughout the State of Minnesota. Mr. Kitzman
talked about the successes of the program and the positive impact on the participant's families.
A discussion ensued regarding various problem-solving court programs.

Motion by Erickson, second by Lindquist, and unanimously carried to authorize the Chairman's

Legislative Update
Human Services Director, John Dinsmore, discussed changes to the Food Support program effective
December 1, 2010. Mr. Dinsmore reported 1,600 food support cases in Otter Tail County the end of
July, 2010. As a result of the expansion of the program, caseloads will likely increase. An additional
State legislative change is the possibility of early expansion of the Medicaid Affordability Act which
would expand eligibility for health care programs in Minnesota. A final determination on the health
care expansion will not be known until January 16, 2011.
Approval to Pay Bills & Claims
Motion by Lindquist, second by Huebsch, and unanimously carried to approve payment of the Human
Services bills and claims as presented.
Adjournment
At 10:00 a.m., Chairman Froemming adjourned the meeting of the Otter Tail County Human Services
Board until Tuesday, November 30, 2010.

Motion by Lindquist, second by Erickson, and unanimously carried to approve the Board of
Commissioners agenda of November 9, 2010, with the following additions:
2:15 p.m. -Attorney Client Privilege Closed Session Regarding 60 Bed CARE Facility
Special County Board Meeting Regarding Ditch No. 16
Approval of Minutes
Motion by Rogness, second by Huebsch, and unanimously carried to approve the Board of
Commissioners minutes of November 2, 2010, as mailed.
Approval to Pay Bills
Motion by Erickson, second by Froemming, and unanimously carried to approve payment of the
County Board bills per Attachment A of these minutes.
Special County Board Meeting Scheduled
Chairman Froemming scheduled a Special County Board meeting at 6:00 p.m. on Tuesday,
November 23, 2010, for the purpose of awarding the bid for the County Drainage System No. 16
project. The Special Meeting will be held at the Government Services Center in Fergus Falls.
WCM Narcotics Task Force Joint Powers Agreement
Motion by Huebsch, second by Rogness, and unanimously carried to authorize the Chairman's
signature to execute the West Central Minnesota Narcotics Task Force Joint Powers Agreement.
Communications Trailer
Sheriff, Brian Schlueter, requested authorization to purchase a negotiation/communications self-
contained trailer with forfeiture funds. Approximate cost was estimated at $11,000.00. Motion by
Erickson, second by Huebsch, and unanimously carried to approve purchase of a communications
trailer with forfeiture funds as recommended by the Sheriff.
Application for Exempt Permit
Motion by Huebsch, second by Lindquist, and unanimously carried to approve an Exempt Permit
Application from Lakes Country Sportsman's Club of Battle Lake for an event to be held at Amor
Rumors Restaurant on February 15, 2011.
REGULAR TO MUNICIPAL ADVANCE RESOLUTION
Otter Tail County Resolution No. 2010 -57
Upon a motion by Rogness, seconded by Huebsch, and unanimously carried, the following
resolution was adopted:
WHEREAS, the County of Otter Tail has obtained the Commissioner's approval of the plans
for the following County State-Aid Project(s):
Project #S.A.P. 056-688-004
AND, WHEREAS, said County is prepared to proceed with the construction of said project(s)
by providing county regular funds to supplement the available funds in the County Municipal Account,
and
WHEREAS, repayment of the funds so advanced by the County is desired in accordance with
the provisions of Minnesota Statutes 162.08, Subd. 5, & 7 and Minnesota Rules 8820.1500, Subp. 9.

NOW, THEREFORE, BE IT RESOLVED: That the Commissioner of Transportation be and is
hereby requested to approve this basis for financing said construction project(s) and to authorize
repayments from subsequent accruals to said Account, in the amounts as herein indicated.
Transfer the Yearly Municipal Construction Allotment, beginning in 2011, to the Regular
Construction Allotment until the borrowed funds are repaid in full to the Regular Construction
Allotment Account.

Construction Update
Highway Engineer, Rick West, briefed the Board on construction projects including the CSAH 88,
CSAH 67, and Water Street Bridge projects. He submitted elevation documentation regarding the
Lake Olaf and Lake Iverson projects.
Economic Development Discussion
Commissioner Huebsch discussed the value of economic development and the potential for Otter Tail
County to tie together and enhance current development efforts throughout the County. Motion by
Huebsch, second by Rogness, and unanimously carried to develop a County-wide Economic
Development Committee that includes representatives from various industries and each county
district. Commissioner Huebsch will chair the committee and requested commissioners to submit
names of individuals willing to serve on this committee.
County Drainage System No. 41
Ditch Inspector, Randy Wasvick, presented a letter from Mary Hall requesting that work be completed
on Ditch No. 41 to return it to a working condition. Mr. Wasvick reported that a public meeting was
held in 2006. A consensus of most of the affected property owners at that time was to opt for no
action. There are now a few property owners asking for action. Motion by Huebsch, second by
Rogness, and unanimously carried to schedule a Public Information Meeting at 6:00 p.m. on
Thursday, December 16, 2010, to present background information to property owners affected by
Ditch No. 41. Commissioner Huebsch also requested that the Ditch Inspector develop a plan to
schedule redetermination of benefits on County ditches that have not been redetermined for many
years.
Price Quotations for Cleaning Air Handlers
Public Health Director, Diane Thorson, and Physical Plant Manager, Rick Sytsma, presented
quotations from two vendors recommended by the Industrial Hygienist for cleaning Courthouse air
handing units and associated intake and return areas in the system as follows:

Lengthy discussion took place regarding the proposed work. The work includes coating, removal, and
replacement of internal insulation systems. It does not include replacing duct work. Duct work in the
law enforcement center is not being addressed at this time due to potential remodeling. Air quality
has been determined safe for employees in the dispatch area. Motion by Lindquist, second by
Rogness, and unanimously carried to accept the low bid of DCINC of Ramsey, MN, in the amount of
$28,096.00, as described. The work will be complete within 30 days with expenses paid out of the
2010 Physical Plant (Maintenance) Operating Budget.
Closed to the Public
At 11 :55 a.m., Chairman Froemming declared the meeting of the Otter Tail County Board of
Commissioners closed to the public to discuss litigation in the matter of architect and contractor
issues with the 60 bed CARE Facility. The closed session is authorized by attorney-client privilege,
Chapter 13D.05 Subd. 3b. Present were all five seated commissioners, County Attorney, Physical
Plant Manager, and Board Secretary.
Recess&Reconvene
At 12: 13 p.m., Chairman Froemming declared the meeting of the Otter Tail County Board of
Commissioners recessed for lunch break. The meeting was reconvened at 1 :OD p.m.
Wind Energy Conversion System Draft Ordinance Discussion
Land & Resource Director, Bill Kalar, reviewed the draft "Wind Energy Conversion System Ordinance"
and discussed potential changes with the Board. Mr. Kalar and the County Attorney will finalize the
requested changes. A Public Hearing will be scheduled with anticipated Ordinance effective date of
January 1, 2011.
Courthouse Facility Master Plan Discussion
Architect, David Shultz, submitted a document entitled "Courthouse Master Plan Update". Mr. Shultz
stated that internal space needs have been reviewed. Discussion focused on the infrastructure
improvements including a new data/communication room with new 800 MHz equipment, electrical
service and emergency power plant, and installation of a boiler and chiller plant. Discussion took
place regarding the proposed generator location and the possibility of using several smaller
generators rather than one large generator due to noise and site concerns. Mr. Hauser submitted a
preliminary General Obligation Bond spreadsheet from Ehlers and Associates. Lengthy discussion
took place regarding funding. Mr. Shultz will meet with the Building and Budget Committees next
week to discuss further details of the project.
Regular Board Meeting Canceled
Motion by Lindquist, second by Huebsch, and unanimously carried to cancel the regularly scheduled
Board of Commissioners meeting of December 7, 2010, due to the Annual Association of Minnesota
Counties (AMC) meeting.
Administration Agreement
Motion by Froemming, second by Erickson, and unanimously carried to authorize the Chairman's
signature to execute renewal of an Administration Agreement with Select Account for the
administration of the County's Flexible Spending Account (FSA), Health Savings Account (HSA), and
Post Employment Health Care (PEHC) accounts.

Adjournment
At 2:45 p.m., Chairman Froemming adjourned the meeting of the Otter Tail County Board of
Commissioners until 9:30 a.m. on Tuesday, November 16, 2010.
