HomeMy WebLinkAboutBoard of Commissioners - Minutes - 08/17/2010MINUTES OF THE ; OTTER TAIL COUNTY BOARD OF COMMISSIONERS ' New York Mills County Offices -Courtroom 118 Main Avenue N, New York Mills, MN Tuesday,August17,2010 9:30 a.m. Call to Order The Otter Tail:county Human Services Board convened Tuesday, August 17, 2010, at 9:30 a.m., at the New York Mills County Courtroom in New York Mills, MN, with Commissioners Roger Froemming, Chair; John Lindquist, Vice-Chair; Everett Erickson, Doug Huebsch and Lee Rogness present. Approval of Agenda Motion by Rogness, second by Huebsch, and unanimously carried to approve the Human Services Board agenda of August 17, 2010, as mailed. Approval of Minutes Motion by Erickson, second by Froemming, and unanimously carried to approve the Human Services Board minutes of July 27, 2010, as presented. Probation Department Update Probation Director, Chuck Kitzman, briefed the Board regarding the hiring of a part time Surveillance Officer. Juvenile secure detention services were also discussed. Human Services Department Update Human Services Director, John Dinsmore, submitted a handout regarding reorganization within the Income Maintenance Programs in response to reduction of workforce due to the hiring freeze policy. He explained the work assignment changes that will occur within the next two months. He also presented a reorganizational plan to be completed within the next year focusing on employees specializing in the intake process and other employees specializing in the processing of paperwork. This "case bank" model of service delivery will be analyzed by the Department of Human Services (OHS) in comparison to the caseload model of service delivery. Mr. Dinsmore spoke to the Board regarding other methods that could be used to replace the current hiring freeze policy. Discussion continued and it was noted that the hiring freeze has prevented employee layoffs. Approval to Pay Bills & Claims Motion by Erickson, second by Lindquist, and unanimously carried to approve payment of the Human Services bills and claims as presented. Approval of Agenda Motion by Erickson, second by Huebsch, and unanimously carried to approve the Board of Commissioners agenda of August 17, 2010, with the following additions: Request for Approval of Labor Contracts Request for Approval of Transfer of Property Documents Approval of Minutes Motion by Huebsch, second by Lindquist, and unanimously carried to approve the Board of Commissioners minutes of August 3, 2010, as mailed. Approval to Pay Bills Motion by Erickson, second by Froemming, and unanimously carried to approve payment of the County Board bills per Attachment A of these minutes. Transfer of Property Motion by Froemming, second by Rogness, and unanimously carried to authorize the appropriate county officials' signatures to transfer the Elbow Lake WAS property (land description attached to Warranty Deed as Exhibit A) from the County of Otter Tail to the State of Minnesota DNR at a purchase price of $71,000. 4-H Update 4-H Coordinator, Janet Malone, and a Summer Assistant/Intern presented EOT County Fair statistics and shared summer camp experiences. Sheriff Department Requests Motion by Erickson, second by Lindquist, and unanimously carried to authorize the Sheriff to replace a Deputy position. Motion by Erickson, second by Huebsch, and unanimously carried to approve out-of-state travel for two deputies to attend the Midwest Organized Crime Information Center (MOCIC) training. Uniforms Taxability Policy Motion by Rogness, second by Lindquist, and unanimously carried to adopt the following Uniforms Taxability Policy: Whereas, the recent IRS audit determined that the County was not properly including certain uniform allowance reimbursements as income; and Whereas, the items on the attached Sheriff's Uniform Policy (Attachment B) identified as taxable should be included as income (other county uniform and clothing allowance policies do not include any taxable items); Now therefore, in order to conform to the Public Purpose Doctrine and the Internal Revenue Code, The Board of Commissioners hereby adopts the following policy: OTC Board of Commissioners' Minutes August 17, 201 0 Page 3 1. The taxable items will be run through payroll, with the appropriate federal and state tax withholding applied. 2. Taxable items may not be purchased with county credit cards or charged to the county. 3. Taxabli items must be purchased at the employee's initial expense, with the authorized expenses being reimbursed. ' 4. Effective January 1, 2011 the Sheriff's Uniform Policy is amended to exclude all the items identified as taxable. ! Adopted August 17, 2010 ' Chair, Ofter Tail County Board of Commissioners Planning Commission Recommendations Conditional Use Permit -Robert & Laurel Ritter: Motion by Huebsch, second by Lindquist, and unanimously carried to approve a Conditional Use Permit to replace existing and failing retaining walls on the property with conditions as recommended by the Planning Commission. The property is described as Pt GL 4, Section 11, Eagle Lake Township; Eagle Lake (56-253), GD. Conditional Use Permit -Woodland Beach Resort Association: Motion by Froemming, second by Rogness, and unanimously carried to approve a Conditional Use Permit to replace a cabin with conditions as recommended by the Planning Commission. The property is described as Pt GL 3, Section 2 of Everts Township; Otter Tail Lake (56-242), GD. Conditional Use Permit -Wayne & Dena Johnson: Motion by Huebsch, second by Lindquist, and unanimously carried to approve a Conditional Use Permit to operate a septic and excavation business with a condition as recommended by the Planning Commission. ,The property is described as SE¼ SW¼ ex RR ex W 70 rods of S 1 rod (39.10 AC), Section 4 of Erhards Grove Township; Unnamed Lake (56-893), NE. Conditional Use Permit -Charles & Barb Hanson: Motion by Erickson, second by Huebsch, and unanimously carried to approve a Conditional Use Permit to construct a driveway and level area for future building site as presented. The property is described as Rt of GL 3 & 4 (14.89 AC), Section 2 of Dora Township; Loon Lake (56-523), RD. Conditional Use Permit-Marlin R & Phyllis A Vig: Motion by Linpquist, second by Erickson, and unanimously carried to approve a Conditional Use Permit for an after-the-fact request to add an addition to the house and earthmoving for landscaping purposes with a condition as recommended by the Planning Commission. The property is described as Anderson Bch 1st Addn -Dane Pr pr Lot 2 Blk 1 & und 1/6 int in Res 1, Section 9 of Dane Prairie Township; Wall Lake (56-658), GD. , Conditional Use Permit-Edna Township: Motion by Huebsch, second by Erickson, and unanimously carried to approve a Conditional Use Permit for an after-the-fact request for a road improvement project on West Little McDonald Drive within the Plat of Hill View Estates. The approval includes a condition as recommended by the Planning Commission. The project is located in the Platted Road corridor of West Little McDonald Drive within the Plat of Hill View Estates from N Little McDonald Dr. to the Lot 12/13 line at 44780 driveway, Sections 4 & 9 of Edna Township; Kerbs Lake (56-1636), NE & Little McDonald Lake (56-328), GD. OTC Board of Commissioners' Minutes August 17, 2010 Page 4 Conditional Use Permit -Dion X. & Brenda J. Darveaux: Motion by Lindquist, second by Rogness, and unanimously carried to deny an after-the-fact request for land alteration for a walking path to the lake (identified as Part I in the request) and refer the request for a service path along the northern lot line (identified as Part II) back to the Planning Commission for reconsideration. The Applicant waived the 60 day requirement to act on the application. The property is described as Lot 1 Blk 1 Johnson Lake Estates, Section 9 of St. Olaf Township; Johnson Lake (56-393), NE. Conditional Use Permit-"Copper Landing at Horseshoe Bay" -Tradeshares Inv. Group: Motion by Lindquist, second by Huebsch, and unanimously carried to approve a Conditional Use Permit to downsize this cluster development from 28 to 10 units with less acreage as presented. The property is described as GL 1, 2, NE¼ NE¼ & SE ¼ NE ¼, Section 22 of Buse Township;Horseshoe Lake (56-834), NE. Conditional Use Permit-Tom & Georgia Dawson: Motion by Erickson, second by Huebsch, and unanimously carried to approve a Conditional Use Permit for topographical alterations for new home construction with conditions as recommended by the Planning Commission. The property is described as Lot 9 & E½ of Lot 10 Cha-Rosa Beach, Section 12 of Scambler Township; Pelican Lake (56-786), GD. Recess At 11 :38 a.m., Chairman Froemming declared the meeting of the Otter Tail County Board of Commissioners recessed for a short break. Public Meeting -Burkel Turkey Farms, Inc. At 11:42 a.m., Chairman Froemming opened a public meeting for comment(s) regarding a permit request from Burkle Turkey Farms, Inc. to increase animal unit capacity at their feedlot located in the W½ of Section 19 in Gorman Township. County Attorney, David Hauser, stated that this public hearing is held on behalf of the Minnesota Pollution Control Agency. The MPCA is responsible for issuing the permit. No comment, either at this public meeting or in writing previous to the meeting, was received. Commissioner Huebsch commended Mr. Burkle regarding the Burkle Farms organization and spoke in favor of the requested permit. Closed to the Public At 11 :45 a.m., Chairman Froemming declared the meeting of the Otter Tail County Board of Commissioners closed to the public to discuss litigation in the matter of foreclosure proceedings relative to the Ethanol Plant. The closed session is authorized by attorney-client privilege, Chapter 13D.05 Subd. 3b. Present were all five seated commissioners, County Attorney, County Coordinator and Board Secretary. Recess & Reconvene At 12:08 p.m., Chairman Froemming declared the meeting of the Otter Tail County Board of Commissioners recessed for lunch break. The meeting was reconvened at 1:35 p.m. Detention Center Exhaust Air Physical Plant Manager, Rick Sytsma, discussed how the air from the Detention Center is exhausted. He discussed the mechanical changes needed to exhaust the air to the outside. A bid of approximately $50,000 for the work has been submitted. Mr. Sytsma recommended waiting a couple of weeks to accept the bid as more information will be available from the dispatch study. 60-Bed CARE Facility OTC Board of Commissioners' Minutes August 17, 2010 Page 5 Mr. Sytsma reported that the commissioning report for the 60-Bed CARE facility focusing on the heating and air conditioning has been submitted. A summary of the report is available. Discussion took place regarding all of the areas of dispute relative to this building including the HVAC system, drainage issue's, and problems with the windows. It was recommended that the final pay request for this project not be paid until issues have been resolved through an arbitration process. 1 Highway Projects After previously advertising, bids were opened for the CSAH 88 Flood Control project at 1 :00 p.m. on August 4, 2010. A motion was offered by Rogness, seconded by Lindquist, and unanimously carried to award S.A.P,. 056-997-004 to Sellin Bros. Inc. of Hawley, MN as the low bidder at the bid price of $588,098.25. Funding for the project will be from the state aid disaster funds. ' Motion by Huebsch, second by Erickson, and unanimously carried to authorize the Chairman's signature to e~ecute a Highway Construction Contract between the County of Otter Tail and Quam Construction Company, Inc. of Wilmar, MN, for work completed on CSAH 67 (S.P. 56-667-32). i Motion by Erickson, second by Lindquist, and unanimously carried to authorize the Highway Department tolenter into an agreement for Addendum No. 1 to the Engineering Services Contract for Johnson Lake:Pumping project (C.P. 5:12 Outlet). The Addendum changes the scope of the project with an additional cost of $7,000 for engineering services. ' Motion by Erickson, second by Huebsch, and unanimously carried to authorize the Highway Department to enter into an Addendum to the original agreement with Houston Engineering, Inc. for the engineering services for the Drawdown of Lake Olaf project (HEI Project No. 5197-003). The estimated fees associated with the expanded scope of services and additional work is $38,539. ' Motion by Erickson, second by Rogness, and unanimously carried to award the Sidewalk Replacement project on CSAH 95 in Parkers Prairie to T & M Construction and Contracting at a project cost of ,$6, 776.50. Motion by Huebsch, second by Rogness, and unanimously carried to authorize the Highway Department to, enter into a Professional Services Agreement with SRF Consulting Group, Inc. for services regarding the Intersection Control Evaluation Report for CSAH 34, CSAH 51 and CSAH 80 Intersection in :Perham, MN. ' Motion by Erickson, second by Froemming, and unanimously carried to approve the Operation and Maintenance Plan, as submitted by the Highway Engineer, for the Lake Olaf Drawdown project. Highway Engi~eer, Rick West, stated that the operations of this project are monitored and during the spring season; the pumping system will be shut down. Grant County Tiger II Grant Application Motion by Rogness, second by Erickson, and unanimously carried to authorize the Chairman's signature on a letter of support to Grant County for the Tiger II Grant Application for the proposed Upper Mustinka River project. This motion does not authorize financial support for the application process. Potential Reimbursable Expenses Motion by Rogness, second by Lindquist, and unanimously carried to authorize the Highway Engineer to seek reimbl,![Sement from FEMA by provided billing assistance for a township. OTC Board of Commissioners' Minutes August 17, 2010 Page 6 Family Services Collaborative Motion by Huebsch, second by Erickson, and unanimously carried to authorize the Chairman's signature to execute a Grant Agreement between West Central Initiative and Otter Tail County Human Services. Otter Tail County is fiscal host for the Caring Connections child care home visiting program on oral health. The grant amount is $10,000. Approval of Labor Contracts Motion by Lindquist, second by Froemming, and unanimously carried to authorize the appropriate County officials' signatures to execute the following Teamsters Public and Law Enforcement Employees' Union, Local No. 320, Labor Agreements for the period of January 1, 2010 through December 31, 2012: Human Services Support Specialist and Public Health Staff Labor Agreement Human Services Professional Bargaining Unit Adjournment At 3:06 p.m., Chairman Froemming adjourned the meeting of the Otter Tail County Board of Commissioners until 9:30 a.m. on Tuesday, August 24, 2010. Licensed officers are also required at times to physically arrest non-compliant subjects that may result in an altercation which causes clothing to be damaged. It is important that officers unifo.rms are kept in good condition at all times, and that officers are protected from the envi~onments and conditions that they are asked to work in. Normal Uniform/ Safety equipment wear Licensed Officer: Because of the position as a Deputy Sheriff it is required that all officers dress alike and that the uniform is kept in orderly, professional condition.
