Call to Order
The Otter Tail County Human Services Board convened Tuesday, January 12, 2010, at 9:28 a.m., at
the Otter Tail County Government Services Center in Fergus Falls, MN, with Commissioners
Everett Erickson, Chair; Roger Froemming, Vice-Chair; John Lindquist, Doug Huebsch and
Lee Rogness present.
Year 2010 Otter Tail County Human Services Board Chair
Board of Commissioners Clerk, Larry Krohn requested nominations for the CY2010 Otter Tail County
Human Services Board Chair. Motion by Erickson, second by Lindquist, and unanimously carried to
elect Commissioner Roger Froemming as the Otter Tail County Human Services Board Chair for
2010.
Year 2010 Otter Tail County Human Services Board Vice-Chair
Chairman, Roger Froemming assumed the chair and requested nominations for the CY2010 Otter Tail
County Human Services Board Vice-Chair. Motion by Huebsch, second by Rogness, and
unanimously carried to elect Commissioner John Lindquist as the Otter Tail County Human Services
Board Vice-Chair for 2010.
Approval of Agenda
Motion by Erickson, second by Rogness, and unanimously carried to approve the Human Services
Board agenda of January 12, 2010 as mailed.
Approval of Minutes
Motion by Lindquist, second by Huebsch, and unanimously carried to approve the Human Services
Board minutes of December 29, 2009 as presented.

H1N1 Vaccine
Public Health Director, Diane Thorson reported that over 10,000 Otter Tail County residents have
been immunized for the H1 N1 flu. Ms. Thorson provided information regarding upcoming pandemic
flu vaccine clinics during the month of January and discussed efforts to vaccinate individuals in
nursing homes, assisted living facilities, and homes plus settings.

State Health Improvement Plan
Ms. Thorson reported on the Golden Start Project which is a nine county project to increase
breastfeeding. She also discussed a Becker, Clay, Otter Tail, and Wadena (SCOW) project to
implement standards of care to address physical activity and nutrition as part of preventive health
exams.
Community Health Advisory Committee
Ms. Thorson presented the current membership on the Otter Tail County Community Health Advisory
Committee. All health care providers in the County are represented on the committee. An update
was provided regarding the activities of the State of Minnesota Community Health Services Advisory
Committee.
Public Health 2009 Financial Analysis
A CY2009 financial analysis by program was presented to the Board. Ms. Thorson reported a year-
end balance of approximately $159,000.00 of revenues over expenditures that are not obligated. She
also reported that $24,657.00 is due to Otter Tail County from the University of Minnesota for
administration of the Falls Prevention Program.

Human Services 2009 Financial Summary
Human Services Directar, John Dinsmore provided his department's 2009 end-of-year budget
summary. He reported a CY2009 budget balance at approximately $767,400.00.
Resolution to Voluntarily Discontinue Administration of the
Energy Assistance Program in Otter Tail County
Effective September 30, 2010
Otter Tail County Resolution No, 201 O -06
The Minnesota Energy Assistance Program (EAP) is a federal block grant, funded through the Low-
Income Home Energy Assistance Program (LIHEAP). The block grant legislation (Title XXVI of the
Omnibus Budget Reconciliation Act of 1981, Public Law 97-35, as amended) gives states broad
latitude to develop programs that assist low income households to meet their immediate home energy
needs.
WHEREAS, in Minnesota, EAP is administered by the Office of Energy Assistance Programs in the
Minnesota Department of Commerce (DOC). The DOC provides grants to local Community Action
Service Providers, counties, tribal governments, and private not for profit agencies to deliver the
program in defined geographic areas, and
WHEREAS, Otter Tail County Human Services has locally administered the Energy Assistance
Program in Otter Tail County for over 20 years, performing admirably in serving an increasing number
of low income citizens and families, especially during times of difficult economic conditions and
increasing unemployment, and
WHEREAS, our rationale for ending our administrative role includes the following factors: first,
anticipation of program staff retirements; second, the majority of EAP programs throughout the State
have been successfully administered by Community Action Programs; and finally, local government
budget constraints necessitate that we focus our resources on statutorily mandated services, and
WHEREAS, on November 17, 2009 the Otter Tail County Human Services Director notified the
Minnesota Department of Commerce, in accordance with their policies, administratively declaring our
intent not to renew program operations for the FY2011 program year, and
WHEREAS, Otter Tail County acknowledges that as the resigning local EAP administrator, we will
provide to both the Office of Energy Assistance and the successor grantee a list of supplies,
equipment, files, and other items to be transferred to the successor grantee, and that this list must
comply with federal 0MB requirements relating to ownership of property purchased with program
money and must be sufficient to promote a seamless transition of program services to clients.
NOW, THEREFORE, IN CONSIDERATION OF THE FOREGOING, BE IT RESOLVED that this
formal Board resolution, signed and dated by the chair of the Otter Tail County Human Services
Board, declares our intent to end our role as the local Energy Assistance Program Administrator
effective September 30, 2010.

Human Services Labor Management Committee
Human Services LMC Co-Chair, Kay Brown presented a summary of an LMC employee survey of
questions about the challenges facing their department as a result of the hiring freeze and a general
down turn in economic conditions. The survey included sample responses.
Resolution Regarding the Minnesota Department of Human Service's
Child Support Service Delivery Report Recommendations
Otter Tail County Resolution No. 2010 -07
The Governor's Office and the Minnesota Department of Human Services have received an
independent study conducted by Deloitte Consulting titled "Analysis of Service Delivery Model"
(ASDM) regarding the Minnesota Child Support Program system. This study has recommended that
the Department of Human Services assume the administration of child support from Minnesota
Counties during a multi-year phase in process.
WHEREAS, Minnesota is ranked 3rd in the nation with regard to total dollars collected per open
case according to the 2009 Minnesota Child Support Performance Report issued by the Minnesota
Department of Human Services; and
WHEREAS, the top three states in the nation with respect to total child support dollars collected per
open case are Pennsylvania, New Jersey and Minnesota, all of which are county administered
systems, according to the 2009 Minnesota Child Support Performance Report issued by the
Minnesota Department of Human Services; and
WHEREAS, high performing and high efficiency child support counties and the citizens they serve will
experience decreased quality and access to child support service if the State of Minnesota replaces
the current system of delivery with a state operated system; and
WHEREAS, there exists other technology driven, county and/or regionally administered, and "best
practices" methods that, if adopted, can dramatically improve Minnesota's Child Support System
without implementing a state take-over of the Minnesota Child Support Program; and
WHEREAS, the process used in moving forward with the study's service delivery recommendation
does not accord with recently enacted "State-County Results, Accountability, And Service Delivery
Reform Act" that promotes local control, flexibility in service delivery systems and are county driven.

NOW, THEREFORE, IN CONSIDERATION OF THE FOREGOING, BE IT RESOLVED: that Otter
Tail County supports strong performance measures for all Minnesota counties with special state
assistance for low performing counties; that through the incorporation of technology and best
practices of other top performing county administered Child Support systems (notably, Pennsylvania
and New Jersey); and through the use of pilot projects, Minnesota's strong tradition of a county
administered Child Support System can be strengthened, improved and streamlined in a manner that
achieves the objectives identified by the above referenced study.
On January 12, 2010, Commissioner Erickson moved the adoption of the above resolution.
Commissioner Rogness seconded the motion to adopt said resolution. The resolution was
unanimously adopted.

Approval to Pay Bills
Motion by Huebsch, second by Lindquist, and unanimously carried to approve payment of the County
Board bills per Attachment A of these minutes.
Friends of Fort Juelson Property
Attorney Katrina Wass, introduced a small representation of a larger group of people who belong to
the Friends of Fort Juelson. The Friends of Fort Juelson have requested that the County accept the
historic Fort Juelson property as a gift from owner, Stanley Rudenske. Ms. Wass provided a letter
that addresses the legal issues involving the title opinion Otter Tail County obtained in February of
2009. She explained the alleged inherited interest of Darlene Soder in the property. At issue, are
credit card judgments against Darlene Soder; however, Ms. Wass explained that the judgments do
not attach to the property and credit card companies cannot legally foreclose on the property. County
Attorney, David Hauser, stated that the issue could be an encumbrance but would only become an
issue if the County were to sell the property, which is not the plan. Otter Tail County has spent a
small amount of money on this project but most of the money to enhance the historic site is from
money raised by the Friends of Fort Juelson. Motion by Rogness, second_ by Lindquist, and
unanimously carried to accept the gift of property known as the Fort Juelson Site: · '
Sanitation Code Revision
Land & Resource Director, Bill Kalar, updated the Board on the State of Minnesota's changes to MN
Rules Chapter 7080 (Sanitation Code). The State adopted a new set of standards adding 7081,
7082, and 7083 to the code. Each section deals with different parts of septic system regulation. In
February of 2008, Otter Tail County was given two years to adopt the new rules. The County made
some changes in May of 2008 and went on record to confirm the County's intention to continue to
implement the pre-2008 rules until the new rules were adopted. Since that time, Mr. Kalar became
aware of concerns regarding the new rules. He provided an e-mail from Gretchen Sabel of the MPCA
stating that changes to the new rules that are supposed to be adopted February 4, 201 O are
anticipated. Commissioners expressed concern that the new rules could double or triple the cost of
installing a septic system without necessarily providing greater protection to the environment.
Mr. Kalar expressed concern that, if the County implements the new rules February 4, 201 O and then
changes are issued in the summer of 2010, confusion results for landowners ar:,d contractors. Septic
system installation consistency also becomes an issue. Mr. Kalar recommended that the County
proceed with a public informational meeting followed by a public hearing and adoption of the new
rules with implementation on January 1, 2011. A preliminary draft of the Sanitation Code Ordinance
needs to be prepared.
Recess & Reconvene
At 11 :55 a.m., Chairman Froemming declared the meeting of the Otter Tail County Board of
Commissioners recessed for lunch break. The meeting was reconvened at 1:10 p.m.
Proposed Watershed District Discussion
Charlie Piekarski and about thirty-five property owners attended the Board meeting to discuss the
proposed Upper Red -Lower Otter Tail Watershed District. Mr. Piekarski stated that people living in
the adjoining townships with Wilkin County are concerned and interested in what might happen. He
submitted general questions regarding the proposal and asked for opinions from Board members.
Pete Waller from the Board of Water and Soil Resources (BWSR) responded to some of the
questions. He stated that BWSR makes the final decision whether or not an area will be created into
a watershed district. BWSR will listen to valid reasons why a watershed district should not be created
or why a particular area should not be included in the district. Mr. Waller explained that Watershed
District Board members would be appointed by County Commissioners except for the initial Board that
BWSR selects from a list provided to them. The tax that is levied is determined by the District Board.
The District Board is required to create a long term plan updated every ten years.

The following concerns were expressed by County Commissioners:
• The proposed district creates unequal representation.
• Criteria have not been identified by Wilkin County which relates to the boundaries selected for
the proposed watershed district.
• Wilkin County needs to explain how they determined the proposed boundaries of the district
and what projects they are planning.
• This is an ad valorem tax whereby the higher ground is worth more so the tax is going to be
higher; however the greater benefits will be realized in the lower areas. The benefit and cost
is not aligned.
• With an ad valorem tax, a new level of government is being created.
• There may be a way to accomplish projects without a new level of government.
The following comments were made by the public:
• SWCD's can levy tax.
• SWCD's and USDA do an outstanding job with programs.
• 100% of the land does not drain -there are many prairie potholes.
• The FSA, SWCD, DNR & USFW already regulate this water -another agency is not needed.
• Grant County's impoundment project was referenced as an example.
DNR Hydrologist, Terry Lejcher explained why the upper Otter Tail River Watershed does not affect
the Wilkin County/Breckenridge area. He spoke in favor of some type of coordination between Otter
Tail and Wilkin counties. Chairman Froemming thanked the public for their attendance and stated
that public information meetings are scheduled on February 1, 2010 in Wilkin County and
February 3, 2010 at the Government Services Center in Fergus Falls to further discuss the watershed
proposal with the public.
Ag Advisory Committee Update
Ag Advisory Committee Chair, Cynthia Johnson updated the Board on the MN Red River Valley
Development Association (RRVDA) and their various ag leadership programs. The proposed Feedlot
Officer position and vacant Ag Extension Educator position were discussed. Ms. Johnson stated that
if the Ag Extension Educator position is not filled, possibly some of those dollars could be redirected
to the 4-H program so that the ag industry receives some benefit. Ms. Johnson serves on the Senate
for Rural Policy at the State level which is working on a change in policy to promote regional
competitiveness for grant dollars rather than every entity competing for the same dollars. County
wide land use was discussed. Commissioners requested that the Ag Advisory Committee research
the opinions of the townships regarding land use regulation.
Recess & Reconvene
At 2:15 p.m., Chairman Froemming declared the meeting of the Otter Tail County Board of
Commissioners recessed for a short break. The meeting was reconvened at 2: 17 p.m.
Weed Meetings/Ditch Viewer Request
Motion by Erickson, second by Lindquist, and unanimously carried to accept the recommendation of
the Ditch Inspector to provide a short presentation on weed law to the east and west township officers
by requesting a time on their respective agendas.

Request to Replace Squad Car
Motion by Huebsch, second by Froemming, and unanimously carried to authorize the Sheriff to
replace a squad car by transferring the insurance dollars from the damaged vehicle from the General
Fund to the Sheriff's Department Operating Budget. The motion also authorizes payment of funds out
of the Capital Improvement Fund for the dollars exceeding the insurance payment.
Closed to the Public
At 2:40 p.m., Chairman Froemming declared the meeting of the Otter Tail County Board of
Commissioners closed to the public for purposes of discussing labor negotiation strategies relative to
the Human Services, Nursing, and Facilities Maintenance collective bargaining unions. Present were
all five seated Commissioners, the County Attorney, County Coordinator, Human Services Director,
HR & Risk Management Coordinator, and Board Secretary.
Open to the Public
At 3:27 p.m., upon conclusion of the closed session, Chairman Froemming declared the meeting of
the Otter Tail County Board of Commissioners opened to the public.
