Commissioners Betty Murphy, Chair; Wayne Johnson, Vice Chair; Kurt Mortenson, Dan Bucholz and Lee Rogness were present. APPROVAL OF AGENDA Chair Murphy called for approval of the Board Agenda. Motion by Rogness, second by Mortenson and unanimously carried to approve the Board of Commissioners' agenda of March 15, 2022, with the following changes: Addition of Letter of Support for Statutory Appropriation for Soil & Water Conservation Districts Aid Change to Item #12 -Speed Zone Study for Silent Lakes in Place of Star Lakes APPROVAL OF CONSENT AGENDA Motion by Mortenson, second by Bucholz and unanimously carried to approve the consent agenda items as follows: 1. March 1, 2022, Board of Commissioners' Meeting Minutes 2. Warrants/Bills for March 15, 2022 (Exhibit A) 3. Human Services & Public Health Warrants/Bills for March 8, 2022, as Approved for Payment by the County Auditor-Treasurer (Exhibit A) 4. Approval of an increase of a current 30-Day County Credit Card limit of $1,000.00 to a 30- Day limit of $5,000.00 for the Assistant Land & Resource Director for expenditures related to office supplies, equipment, and workshop fees (including travel and meals). 5. Approval of a LG220 Application for Exempt Permit as submitted by the Dunvilla Shooting Club Inc. for an event (raffle) scheduled for Sunday, May 1, 2022, at Spanky's located at 34785 County Highway 4 in Hobart Township. 6. Request for Approval of Final Payment to Anderson Brothers Construction Co. for S.A.P. 056- 601-070 and S.A.P. 056-613-007 U.S. FISH & WILDLIFE -REQUEST FOR CERTIFICATIONS OF EASEMENTS USFWS Representatives appeared before the Board and requested certification of four (4) wildlife habitat protection easements. Documentation was previously submitted regarding the requests. After County Board approval, the easement requests will be considered by the State Land Exchange Board. Motion by Johnson, second by Bucholz and unanimously carried, with Rogness abstaining, to approve certification for the USFWS to secure the following habitat easement: Lutheran Brethren Bible Camp, Inc. -Wildlife Habitat Protection Easement: Township 131 North, Range 38 West, 5th P.M. Part of section 2. To be determined by a survey. Township 132 North, Range 38 West, 5th P.M. Section 35, part of the SE1/4. To be determined by a survey. Section 36, part of the W1/2SW1/4. To be determined by a survey. LETTER OF SUPPORT FOR STATUTORY APPROPRIATION FOR SOIL & WATER CONSERVATION DISTRICTS AID Motion by Johnson, second by Mortenson and unanimously carried to authorize a letter be sent to appropriate legislature representatives along with the identified individuals on behalf of the Board of Commissioners in support of statutory appropriation for Soil and Water Conservation Districts (SWCD) Aid in the amount of $22 million per year. SWCDs are a primary source of conservation information, support, and program management for landowners and other local units of government and are funded primarily through the state legislature through the Board of Water and Soil Resources. RECESS & RECONVENE At 8:51 a.m., Chair Murphy declared the meeting of the Otter Tail County Board of Commissioners recessed for a short break. The Board of Commissioners meeting was reconvened at 9:01 a.m. DETERMINATION OF NEED APPLICATION TO EXPAND DAY SERVICES Motion by Bucholz, second by Mortenson and unanimously carried to authorize appropriate County Officials' signatures to submit the Determination of Need Application to the Department of Human Services for the expansion of day services with Productive Alternatives, Inc. at the Perham site. AQUATIC INVASIVE SPECIES (AIS} PROGRAM UPDATE Land and Resource AIS Specialist Spencer McGrew provided a brief overview of the AIS Prevention Program for the 2021 season and reported an increase in compliance and a decrease in inspections due to low water levels and unfavorable weather conditions. He discussed the efforts and goals of the AIS Task Force and expressed appreciation for the support received from other agencies. Mr. McGrew informed the Board that he is seeking two (2) individuals to serve as members of the AIS Task Force and plans to bring back to the Board for consideration once they are identified. Page 2 of 15 Board of Commissioners' Meeting Minutes March 15, 2022 2022 ASSESSMENT ESTIMATED MARKET VALUESNALUATION NOTICES Chief Deputy Assessor Kevin Scheidecker provided a brief overview of the 2022 Estimated Property Valuations. The real estate market has been extremely strong in Otter Tail County due to high demand, record low interest rates and a low inventory of properties. Property owners may see increases of 15-30% depending on the type of property they own. With valuation notices being sent out the end of March, owners are able to appeal their value and classification to the Assessor's Office or their local board of appeal. The increase in property values does not equate to a similar increase in property taxes. GRAYKEY FORENSIC DEVICE -SHERIFF'S OFFICE Motion by Rogness, second by Johnson and unanimously carried to approve acceptance of GrayKey Forensic Device (software) with the first-year license fee donated by Operation Underground Railroad (O.U.R.). The Sheriffs Office will incorporate subsequent annual fees in its budget. SNOWMOBILE PURCHASE Motion by Mortenson, second by Bucholz and unanimously carried to approve the change of DNR grant funds allotted for snowmobile enforcement to go toward the purchase of a snowmobile with the Sheriffs Office budget absorbing the remaining amount. DONATION OF MEDICAL EQUIPMENT AND SUPPLIES Motion by Johnson, second by Mortenson and unanimously carried to authorize approval for the Otter Tail County Public Health Department to donate expired and outdated medical equipment and supplies to various agencies and medical recycling companies during the 2022 calendar year. TAX ABATEMENT AND DEVELOPMENT AGREEMENT RESOLUTION OTTER TAIL COUNTY RESOLUTION NO. 2022 -24 WHEREAS, Blue Spruce Properties LLC, a Minnesota limited liability company (the "Company") have requested the County to assist with the construction of twelve town home residential rental units ("Project"), in the City of Battle Lake, Minnesota, and to grant an abatement to the Company of property taxes to be levied by the County on Parcel ID Nos. 63000990394000 and 63000990394003 in the County; and WHEREAS, On March 1, 2022, the County Board held a public hearing on the question of the Abatement, (as defined below) and said hearing was preceded by at least 10 days but not more than 30 days prior published notice thereof at which all interested persons appeared and were heard; and WHEREAS, the Company and the County have determined to enter into a Tax Abatement and Development Agreement (the "Agreement") providing for assistance in connection with the Project. NOW, THEREFORE, BE IT RESOLVED by the Otter Tail County Board of Commissioners, as follows: The County hereby approves the Agreement in substantially the form submitted, contingent upon the approval of the City of Battle Lake and Battle Lake School District, and the Board Chair and Clerk are hereby authorized and directed to execute the Agreement on behalf of the County. The approval hereby given to the Agreement includes approval of such additional details therein as may be necessary and appropriate and such modifications thereof, deletions therefrom and additions thereto as may be necessary and appropriate and approved by the County officials authorized by this resolution to execute the Agreement. The execution of the Agreement by the appropriate officer or officers of the County shall be conclusive evidence of the approval of the Agreement in accordance with the terms hereof. The Board of Commissioners meeting was reconvened at 10:17 a.m. FACILITIES UPDATE County Deputy Administrator Nick Leonard provided a brief facilities update to the Board regarding the transitioning of departments during construction which includes the Land & Resource Department and Motor Vehicle/Driver's License services transitioning to 419 East Channing Avenue and Probation and Child Support Services temporarily moving to the Government Services Center. The facilities team was commended along with staff flexibility during this transition. Construction is scheduled to begin in May with expected completion in September. LETTER OF SUPPORT -LOCAL ROAD WETLAND REPLACEMENT Motion by Johnson, second by Rogness and unanimously carried to authorize Administration to send a letter on behalf of the Board to Senator lngebrigtsen and Senator Sundin along with other representation as they see fit, regarding support for $10 million Local Road Wetland Replacement. LEGISLATIVE UPDATE County Dep,uty Administrator Nick Leonard provided a brief legislative update to the Board regarding their recent AMC I!3gislative visits. He is monitoring several local bonding requests across many Otter Tail County communities and anticipates· hearing more about the Senate and House bills after the Easter legislative break. WEST SEGMENT-GREAT PLAINS EASEMENT AGREEMENT Motion by Johnson, second by Mortenson and unanimously carried to authorize an easement encroachment consent agreement with Otter Tail County and Great Plains Natural Gas Co. for construction of the Perham to Pelican Rapids Regional Trail. DEVELOPMENT AND IMPLEMENTATION OF U.S. BIKE ROUTE 20 RESOLUTION OTTER TAIL COUNTY RESOLUTION NO. 2022-28 WHEREAS, bicycle tourism is a growing industry in North America, presently contributing approximately $47 billion dollars a year nationally to the economies of communities that provide facilities for said tourism; and WHEREAS, the American Association of State Highway and Transportation Officials (AASHTO) has designated a corridor connecting Point Douglas and the State of Wisconsin, to Moorhead, MN and the State of North Dakota, via the Twin Cities, St Cloud, and Fergus Falls, to be developed as United States Bike Route 20;and Page 4 of 15 Board of Commissioners' Meeting Minutes March 15, 2022 WHEREAS, the Minnesota Department of Transportation has worked with local stakeholders and offered online public comment opportunities throughout the corridor to gather information and review route alternatives; and WHEREAS, the Minnesota Department of Transportation in cooperation with road and trail authorities have proposed a specific route to be designated as United States Bicycle Route 20, a map of which is herein incorporated into this resolution by reference as Draft Exhibit; and WHEREAS, the proposed United States Bicycle Route 20 traverses through Otter Tail County, MN and is expected to provide a benefit to local residents and businesses; and WHEREAS, the Minnesota Department of Transportation will continue to maintain statewide mapping and information regarding United States Bicycle Route 20, convene meetings and facilitate resolving issues and future alignment revisions within the State; and WHEREAS, the County of Otter Tail, MN has duly considered said proposed route and determined it to be a suitable route through the County of Otter Tail, MN and desire that the route be formally designated so that it can be appropriately mapped and signed, thereby promoting bicycle travel locally and throughout Minnesota along the corridor. NOW THEREFORE IT IS HEREBY RESOLVED by the County of Otter Tail, MN hereby expresses its approval and support for the development of United States Bicycle Route 20 and requests that the appropriate government officials take action to officially designate the route accordingly as soon as possible. PHELPS MILL GRANT APPROVAL Motion by Rogness, second by Mortenson and unanimously carried to authorize Board approval for Parks & Trails Director Kevin Fellbaum to submit a letter of application for a grant to paint a (detachable) mural at Phelps Mill. Board asks to see plans for the mural. SPEED ZONE STUDY REQUEST -CSAH NO. 41 RESOLUTION OTTER TAIL COUNTY RESOLUTION NO. 2022 -25 WHEREAS, the Silent Lakes Association has requested that the County of Otter Tail take such action as may be necessary in order to pursue a reduced speed limit on the segment of County State Aid Highway No. 41 between East and West Silent Lake from Silent Beach Road to 407th Street; and WHEREAS, the County of Otter Tail believes that a speed zone reduction would be beneficial in this area. NOW, THEREFORE, BE IT RESOLVED, that Otter Tail County does hereby request that this area be studied by the Minnesota Department of Transportation to determine the need for a reduced speed zone, if any. BE IT ALSO RESOLVED, that Minnesota Department of Transportation proceed with establishing a legal speed zone if the findings of the traffic study are supportive. Page 7 of 15 Board of Commissioners' Meeting Minutes March 15, 2022 REGULAR TO MUNICIPAL ADVANCE RESOLUTION OTTER TAIL COUNTY RESOLUTION NO. 2022 -26 WHEREAS, the County of Otter Tail_has obtained the Commissioner's approval of the plans for the following County State-Aid Project(s): Project# S.A.P. 056-605-012 Project# S.A.P. 056-667-042 Project# S.A.P. 056-608-031 AND, WHEREAS, said County is prepared to proceed with the construction of said project(s) by providing county regular funds to supplement the available funds in the County Municipal Account; and WHEREAS, repayment of the funds so advanced by the County is desired in accordance with the provisions of Minnesota Statutes 162.08, Subd. 5 & 7 and Minnesota Rules 8820.1500, Subp. 9. TAX FORFEITED PROPERTY BY CITY OF PELICAN RAPIDS RESOLUTION OTTER TAIL COUNTY RESOLUTION NO. 2022-27 WHEREAS, on Friday, January 22,1993 the State of Minnesota conveyed to the City of Pelican Rapids, by State Deed No. 0178452, the Southeast Quarter of the Southeast Quarter (SE¼ SE¼), Section 21 Township 136 Range 43 (Parcel No. 76-000-21-0004-000), which was recorded by the Otter Tail County Recorder's office on Thursday, January 28, 1993, as Document No. 740033; and WHEREAS, on Friday, January 22,1993 the State of Minnesota conveyed to the City of Pelican Rapids, by State Deed·No. Q178453, the West Half of the Southwest Quarter (W½ SW ¼) except Jacob's Addition, except R.J. Miller Addition and except tracts, Section 22 Township 136 Range 43 (Parcel No. 76-000-22-0016-000), which was recorded by the Otter Tail County Recorder's office on Thursday, January 28, 1993, as Document No. 740034;and Page 8 of 15 Board of Commissioners' Meeting Minutes March 15, 2022 WHEREAS, the above referenced parcels were conveyed exclusively (Authorized Public Use) to the City of Pelican Rapids for the land spreading of sludge from the City Of Pelican Rapids Wastewater Treatment Facility and therefore, is subject under Minnesota Statute 282.01 to the Rule of Reversion if the property is not used for the authorized public use; and WHEREAS, Minnesota Statute 282.01 Subdivision 1d (c) states the following: "Property held by a governmental subdivision of the state under a conditional use deed executed under this section by the commissioner of revenue before January 1, 2007, is released from the use restriction and possibility of reversion on January 1, 2022, if the county board records a resolution describing the land and citing this paragraph"; and WHEREAS, the City of Pelican Rapids has held title to the above referenced parcels since Friday, January 22, 1993, well in advance of the date listed above; and WHEREAS, the City of Pelican Rapids has made both a verbal and emailed request of Otter Tail County to release the above-described properties from the use restriction and the possibility of reversion by adopting this resolution as authorized by Minnesota Statute 282.01 Subdivision 1d (c); and WHEREAS, the release of the use restriction will allow the City of Pelican Rapids to develop these properties for other legally authorized activities that can be undertaken by the City. For example -housing. NOW THEREFORE BE IT RESOLVED THAT, Pursuant to Minnesota Statute 282.01 Subdivision 1d (c), Otter Tail County by this resolution, hereby releases from the use restriction and the possibility of reversion that part of the of the Southeast Quarter of the Southeast Quarter (SE¼ SE¼), Section 21 Township 136 Range 43 and that part of the West Half of the Southwest Quarter (W½ SW ¼) except Jacob's Addition, except R.J. Miller Addition and except tracts, Section 22 Township 136 Range 43 which has not been previously released from the use restriction and which is currently owned by the City of Pelican Rapids. Note -Previous partial reconveyances/releases are recorded as follows: Part of the Southeast Quarter of Section 21 Township 136 North Range 43 West -Otter Tail County Document 1205696 and Part of the Southwest Quarter Section 22 Township 136 North Range 43 West -Otter Tail County Document 1205697 recorded May 4, 2018. Both tracts were purchased by the City of Pelican Rapids from the State of Minnesota on May 18, 2018, and (State Deed Nos. 0215507 and 0215507) recorded as Document 1206610 and Document 1206611 on May 29, 2018. Part of the West half of the Southwest Quarter, Section 22 Township 136 North Range 43 West-Otter Tail County Document 1192761 recorded 06/30/2017. This tract was purchased by the City of Pelican Rapids from the State of Minnesota on July 11, 2017, and (State Deed 0213800) recorded as Document 1193441 on July 17, 2017.
