Fir Avenue, Fergus Falls, MN January 24, 2017 9:30 a.m. Call to Order The Otter Tail County Board of Commissioners convened at 9:30 a.m. Tuesday, January 24, 2017, at the Government Services Center in Fergus Falls, MN, with Commissioners Doug Huebsch, Chair; Wayne Johnson, Vice-Chair; John Lindquist, Roger Froemming and Lee Rogness present. Approval of Agenda Chair Huebsch called for approval of the Board agenda. Motion by Rogness, second by Johnson and unanimously carried to approve the Board of Commissioners Agenda of January 24, 2017, with the following addition: Economic Summit Report Consent Agenda Motion by Johnson, second by Froemming and unanimously carried to approve Consent Agenda items as follows: 1. LG220 Application for Exempt Permit for Pelican Rapids Jaycees for Ice Fishing Derby on Feb. 4, 2017 7. 2017 Tobacco License for Dalton Corner Store Pay Equity Report Human Resources Professional Stephanie Retzlaff briefed the Board on the County’s Pay Equity Report statistical analysis including salary range and exceptional service pay test results. Motion by Rogness, second by Lindquist and unanimously carried to accept the Otter Tail County Pay Equity Report as submitted and authorize the appropriate County Officials’ signatures to execute the document. The Pay Equity Report will be forwarded to the Minnesota Management and Budget Office for final approval. Criminal Justice Advisory Council (CJAC) Community Services Director John Dinsmore, Probation Director Desta Lutzwick, and Minnesota DOC Regional Director Brian Rubenstein visited with the Board regarding the work of the Probation Services Interim Advisory Workgroup. After lengthy discussion, the following resolution was introduced: A RESOLUTION IN SUPPORT OF THE CREATION OF THE OTTER TAIL COUNTY CRIMINAL JUSTICE ADVISORY COUNCIL Otter Tail County Resolution No. 2017 – 07 WHEREAS, on May 24, 2016, the Otter Tail County Board of Commissioners voted unanimously to authorize the creation of the Probation Services Interim Advisory Workgroup, and; WHEREAS, Commissioner Roger Froemming was appointed to serve on the Advisory Workgroup with Commissioner Doug Huebsch to serve as an alternate member, and; OTC Board of Commissioners’ Minutes January 24, 2017 Page 2 WHEREAS, the purpose, membership and meeting frequency of the Workgroup’s Charter was to focus on the corrections delivery of service systems and promote a sustainable, long-term partnership to influence substantive corrections issues, and; WHEREAS, during the past eight (8) months, the Advisory Workgroup comprised of a multidisciplinary group of members representing Minnesota’s Seventh Judicial District, the Otter Tail Board of County Commissioners, the Otter Tail County Probation Department, the Otter Tail County Sheriff’s Office, the Otter Tail County Attorney’s Office, the Minnesota Board of Public Defense, the Minnesota Department of Corrections, and Lakeland Mental Health Center, has met on a monthly basis to address and identify substantive criminal justice delivery system issues that affect county-wide stakeholders, and; WHEREAS, the Advisory Workgroup has assessed the strengths, needs, challenges and opportunities faced by our criminal justice delivery system and have identified a range of planning goals and focus areas that will serve to guide and direct the work of the Criminal Justice Advisory Council, and; WHEREAS, a Criminal Justice Advisory Council Charter has been created to empower the Council to develop recommendations, action plans, short-term and/or long-term strategy associated with (a) improving funding stability and sustainability, (b) implementing established methods or “best practices” that may help us improve the effectiveness of our services, (c) improve collaboration among key stakeholders involved in serving offenders, families and the community, and (d) improved accountability to those most impacted by the services, i.e., local citizens, elected officials, etc. WHEREAS, we recognize that successful implementation of these recommendations, action plans and strategies will require the close collaboration and cooperation among each of the Council partners. NOW THEREFORE BE IT RESOLVED THAT: Otter Tail County, by this resolution, supports and authorizes the creation of the Otter Tail County Criminal Justice Advisory Council who, in turn, will replace the Probation Services Interim Advisory Workgroup, convene in accordance with its Charter and annually advise the Otter Tail County Board of Commissioners of accomplishments and recommendations. She discussed disaster recovery of land records and digital access to marriage, birth and death records. The 2016 year end Compliance Fund balance was reported as $518,549.04 with a Technology Fund balance of $317,209.51. Assessor Doug Walvatne submitted the County Assessor’s Department End of Year Report. Mr. Walvatne briefed the Board on new construction and market trends by classification. E911 Fees Motion by Lindquist, second by Froemming and unanimously carried to establish the following E911 Fees: New and/or Replacement of the E911 Post and Sign $100.00 Replacement of the E911 Sign 50.00 Fergus Falls Demolition Landfill Licensing Motion by Rogness, second by Johnson and unanimously carried to approve the Solid Waste Department recommendation for Otter Tail County to issue a license to the City of Fergus Falls to operate the Fergus Falls Demolition Landfill effective January 24, 2017, for a ten year period. MINNESOTA POLLUTION CONTROL AGENCY FY 2016-17 GRANT PROGRAM AUTHORIZATION RESOLUITON Otter Tail County Resolution No. 2017 - 09 WHEREAS, Otter Tail County Solid Waste Department has applied for a grant from the Minnesota Pollution Control Agency (MPCA), under its FY16-17Environmental Assistance Grant Program; and WHEREAS, if MPCA funding is received, Otter Tail County Solid Waste Department is committed to implementing the proposed project as described in the grant application; and WHEREAS, MPCA requires that Otter Tail County Solid Waste Department enter into a grant agreement with the MPCA that identifies the terms and conditions of the funding award. BE IT RESOLVED THAT the Otter Tail County Board of Commissioners hereby agrees to enter into and sign a grant agreement with the MPCA to carry out the project specified therein and to comply with all of the terms, conditions, and matching provisions of the grant agreement and authorizes and directs Mr. Douglas A. Huebsch to sign the grant agreement on its behalf. Huebsch, Chair Larry Krohn, Clerk OTC Board of Commissioners’ Minutes January 24, 2017 Page 4 Recess & Reconvene At 10:35 a.m., Chair Huebsch declared the meeting of the Otter Tail County Board of Commissioners recessed for a short break. The Board meeting was reconvened at 10:43 a.m. Land Acquisition DNR Area Wildlife Supervisor Don Schultz briefed the Board on a 237 acre parcel of land in Section 21 of Dead Lake Township adjacent to the DNR’s current Dead Lake Wildlife Management Area (WMA). It is made up primarily of hardwood forest on the upland areas and wetland and swampland in the low areas with about 400’ of frontage on a shallow lake. The acquisition would improve access to the WMA and increase additional public hunting, related recreation and preservation of habitat. Commissioners discussed the need for more parking, payment in lieu of taxes, and the desire of residents to preserve sensitive land from development in this area. REVIEW OF PROPOSED STATE WILDLIFE LAND ACQUISITION Otter Tail County Resolution No. 2017 - 10 WHEREAS, In accordance with Minnesota Statutes 97A.145 Subd. 2, the Commissioner of the Department of Natural Resources, on January 4, 2017, provided the County Board and appropriate Town Officers with a description of lands to be acquired by the State of Minnesota for water and wildlife conservation purposes, and WHEREAS, Lands to be acquired are described as follows and attached as Exhibit B: 237 acre parcel located in NW¼, W½NE¼ of Section 21, T.135N., R. 40W adjoining the Dead Lake WMA NOW, THEREFORE, IT IS HEREBY RESOLVED, by the Board of County Commissioners of Otter Tail County on January 24, 2017, that the State’s proposed acquisition of the above described property be approved. Huebsch, Chair Larry Krohn, Clerk OTC Board of Commissioners’ Minutes January 24, 2017 Page 5 MACSSA Legislative Platform and Priorities Deb Sjostrom, Human Services Director, presented the Minnesota Association of County Social Service Administrator (MACSSA) 2017 Legislative Initiatives. From this list, she discussed the following areas of priority where MACSSA will focus their legislative efforts: 1) Health & Human Services Finance Reform 2) Improving the Minnesota Eligibility Technology System (METS) to manage Medical Assistance (MA) and integrate other Human services Programs 3) Reform Regional Treatment Center and Community Behavioral Health Hospital County Cost Shares Ms. Sjostrom presented a video explaining the issues that Eligibility Workers are dealing with because the METS was designed for signing up for health care insurance but not for making changes. This is creating issues for Human Services workers and demanding additional staff to complete simple changes. Ms. Sjostrom recommended that improvements to the METS be supported by Otter Tail County. Caseworks Software Agreement Motion by Rogness, second by Lindquist and unanimously carried to authorize the appropriate County Officials’ signatures to execute the Caseworks Software Acquisition and License Agreement between Otter Tail County and Next Chapter Technology (NCT), Inc. as submitted by the Human Services Director. Human Services Staffing Motion by Rogness, second by Lindquist and unanimously carried to approve a new Account Technician position to fulfill accounting functions for the Department as requested by the Human Services Director. Motion by Rogness, second by Lindquist and unanimously carried to approve a new Eligibility Worker (HealthCare Unit) as part of the Economic Assistance Programs and as recommended by the Human Services Director. Administrative Ordinance Proposed Revisions Diane Thorson, Public Health Director, presented proposed revisions to the Administrative Ordinance which will be applicable to the food, beverage, lodging rules and enforcement. Motion by Lindquist, second by Johnson and unanimously carried to establish a Public Hearing to receive comments on the Administrative Ordinance proposed revisions at 10:00 a.m. on Tuesday, February 21, 2017, at the Government Services Center in Fergus Falls, MN. Recess & Reconvene At 11:55 a.m., Chair Huebsch declared the meeting of the Otter Tail County Board of Commissioners recessed for committee meetings and lunch break. The Board meeting was reconvened at 1:06 p.m. Discussion Regarding Dock Ordinance Mike Olson, Ten Mile Lake Property Owner, submitted a legal description, drawing and photos of his property in relation to the location of his dock. After lengthy discussion regarding his situation, Commissioners suggested the following solutions: 1) move the patio portion of the dock and re-weld it; 2) move the complete dock over to comply with the 10’ rule; or 3) apply for a variance from the 10’ rule. Land & Resource Fee Schedule Bill Kalar, Land & Resource Director, presented a revised Fee Schedule to include fees for electronic permitting and to correct other fees previously submitted to be effective January 1, 2017. Motion by Johnson, second by Rogness and unanimously carried to approve the Land & Resource Revised Fee Schedule effective January 1, 2017, attached to these minutes as Exhibit C. OTC Board of Commissioners’ Minutes January 24, 2017 Page 6 RESOLUTION TO AMEND THE JOINT POWERS AGREEMENT ESTABLISHING THE POMME DE TERRE RIVER ASSOCIATION Otter Tail County Resolution No. 2017 - 08 WHEREAS, Pomme de Terre River Association purpose currently is to develop and implement plans to improve and maintain the quality of water in the streams, lakes and ground water; and WHEREAS, the participating Counties and Soil and Water Conservation Districts have identified organizational impediments to optimal development of Watershed Management Plans; and WHEREAS, the participating Counties and Soil and Water Conservation Districts have provided motions and resolutions unanimously supporting the collaborative pursuit of a Watershed Management Plan; and WHEREAS, the Minnesota Board of Soil and Water Resources has developed policies for coordination and development of comprehensive watershed management plans, also known as One Watershed, One Plan, consistent with Minnesota Statutes, Chapter 103B.801, Comprehensive Watershed Management Planning Program; and WHEREAS, Minnesota Statutes, Chapter 103B.301, Comprehensive Local Water Management Act, authorizes Minnesota Counties to develop and implement a local water management plan; and WHEREAS, Minnesota Statutes, Chapter 103C.331, subdivision 11, Comprehensive Plan, authorizes Minnesota Soil and Water Conservation Districts to develop and implement a comprehensive plan. NOW, THERFORE, BE IT RESOLVED, that the members of the Pomme de Terre River Association amend the existing Joint Powers Agreement to reflect the following: Article 2 Purpose The purpose of this agreement is the joint exercise of powers by the undersigned governmental units to develop and implement plans with regard to protection of property from damage of flooding; controlling erosion of land; protection of property, streams and lakes from sedimentation and pollution; and maintaining and improving the quality of water in the streams, lakes and ground water: all in accordance with the intent of Section 471.59 of Minnesota Statutes. A. Coordinate with local, state, and federal agencies to encourage landowners to voluntarily change their land use practices to improve the quality of water resources within the Pomme de Terre River watershed. B. Provide other similar or related services and programs as determined by the Board. C. Establish a mechanism whereby additional and/or alternative programs and services may be developed for the benefit of the Parties and in furtherance of the objectives of the Parties. D. Collectively develop and adopt a coordinated watershed management plan for implementation per the provisions of the plan. OTC Board of Commissioners’ Minutes January 24, 2017 Page 7 Article 6 Powers of the Board 6.1 General Powers. The Board is hereby authorized to exercise such authority and powers common to the Parties as is necessary and proper to fulfill its purposes and perform its duties. Such authority shall include the specific powers enumerated in this Agreement or in the bylaws. 6.2 Specific Powers. 6.2.1 Administrative Services. The Board shall establish policies and procedures for the administration of the affairs of the Board. Administrative services shall be provided under the direction and control of the Board. These services shall include, but are not limited to, financial, legal and general administration. The Board may enter into contract and/or agreements with one or more of its member entities as a (Host Entity/Fiscal Agent) to carry out the functions of the PDTRA. The Board shall ensure adherence to the Minnesota Government Data Practices Act. 6.2.2 Employees. The Board may employ, train, pay, discipline, discharge and otherwise manage personnel needed to assist the PDTRA Board in carrying out its duties and responsibilities. Employees of the Board shall not be considered employees of the Parties to this Agreement for any purpose including, but not limited to, salaries, wages or other compensation or fringe benefits; worker’s compensation; unemployment compensation or reemployment insurance; retirement benefits; social security; liability insurance; maintenance of personnel records and termination of employment. 6.2.3 Contracts. The Board may enter into contracts and/or agreements necessary for the exercise of its duties and responsibilities to govern the PDTRA. The board may take such action as is necessary to enforce such contracts to the extent available in equity or at law. Contracts and/or agreements let and purchases made pursuant to this Agreement shall conform to the requirements applicable to contracts and/or agreements required by law (i.e. fiscal management, personnel management). 6.2.4 The PDTRA may apply for and accept gifts, grants, or loans of money or other personal property from the United States, the State of Minnesota, or any other body, organization, political subdivision, or person, whether public or private. The board may enter into any agreement required in connection therewith, and hold, use, or dispose of any such money or other property in accordance with the terms of the gift, grant, loan or agreement relating thereto. 6.2.5 Insurance. The Board shall obtain liability, property and auto insurance and may obtain such other insurance it deems necessary to indemnify the Board and its members for actions of the Board and its members arising out of this Agreement. 6.2.6 Budget. 6.2.6 A. Budget and work plan. The PDTRA will develop an annual work plan budget, dependent on budget reserves and/or anticipated continued Grants and Project funding. The work plan and budget may be modified as needed to meet actual grant or other funding amounts and requirements. OTC Board of Commissioners’ Minutes January 24, 2017 Page 8 6.2.6 B. Budgeting and accounting services. The PDTRA may contract with one or more of its member entities (Fiscal Agent) to provide any and all budgeting and accounting services necessary or convenient for the PDTRA. Such services shall include, but not be limited to: management of all funds, including County contributions and grant monies; payment for contracted services; and relevant bookkeeping and record keeping. The contracting and purchasing requirements of the Fiscal Agent shall apply to transactions of the Board. The PDTRA, through a separate contract or joint powers agreement, shall enumerate the authorities and duties of the Fiscal Agent. The parties shall retain their authority to request reports pertaining to any and all budgeting and accounting services. All interest earned from established PDTRA funds shall be credited back to that same fund. 6.2.6 C. Employee accommodation. The PDTRA may enter into a contract and/or agreement with one or more of its member entities (Host Entity) to provide office space necessary to carry out the duties and responsibilities of administration on behalf of the PDTRA. 6.2.7 Watershed Management Plan 6.2.7 A. Submittal of the Plan. The PDTRA will recommend the plan to the Parties of this agreement. The PDTRA will be responsible for initiating a formal review process for the watershed-based plan conforming to Minnesota Statutes Chapters 103B and 103D, including public hearings. Upon completion of local review and comment, and approval of the plan for submittal by each party, the PDTRA will submit the watershed-based plan jointly to BWSR for review and approval. 6.2.7 B. Adoption of the Plan. The Parties agree to adopt and begin implementation of the plan within 120 days of receiving notice of state approval, and provide notice of plan adoption pursuant to Minnesota Statutes Chapters 103B and 103D. County Administrator Contract Motion by Froemming, second by Johnson and unanimously carried to authorize the appropriate County Officials’ signatures to execute the County Administrator Contract between the County of Otter Tail and John W. Dinsmore as presented. The contract is for a three year period effective February 1, 2017 authorized at a Pay Grade E83, Step 8. OTC Board of Commissioners’ Minutes January 24, 2017 Page 9 Recess & Reconvene At 1:46 p.m., Chair Huebsch declared the meeting of the Otter Tail County Board of Commissioners recessed for a short break. The Board meeting was reconvened at 1:54 p.m. Riparian Buffer Law Commissioner Lindquist introduced discussion regarding HF 167 which is a bill that would repeal the riparian buffer requirement under M.S 103B.101, Subd. 12a; 103E.315, Subd. 8 and 103F.48. WOTSWCD Manager Brad Mergens provided background on the Buffer Law. The DNR established rules for buffer requirements in 1989 but the rules were not enforced. Otter Tail County took action to proceed with a Buffer Initiative in 2015. Mr. Mergens indicated that, in conversations with legislators and senior Board of Water and Soil Resources (BWSR) officials, the proposed legislation to repeal the law is an effort to begin talking about some of the issues with the law. Commissioners discussed the value of environmentally sound farming practices, changes to the law that include alternative practices and flexibility, and positive enforcement to reward good farming practices instead of mandating those practices. The goal is to minimize pollution without stopping development. Commissioners requested a letter be drafted encouraging the County’s legislators to provide funding to reward citizens voluntarily following the buffer law. The draft letter is to be reviewed at the next County Board meeting. Engineering Services S.A.P. 056-634-011: Motion by Johnson, second by Froemming and unanimously carried to authorize the appropriate County Officials’ signatures to execute a Proposal for Engineering Services from Houston Engineering, Inc. for the Reconstruction of CSAH 34 from US Highway 10 to CSAH 35. Productive Alternatives is closing their sheltered workshop and there has been concern that there has not been enough time to transition clients from the sheltered workshop to jobs in the community. Concern was expressed for current clients who may be negatively impacted. Human Services Director Deb Sjostrom indicated that Otter Tail County is developing a request for information in this region asking providers their ideas of what they could do that might be different than how services are provided currently. 2017 County Committees Motion by Johnson, second by Froemming and unanimously carried to approve the 2017 County Committee appointments as presented and attached as Exhibit E. 2017 Crop and Forage Show Motion by Johnson, second by Froemming and unanimously carried to approve Commissioners’ attendance at the 2017 Crop and Forage Show February 1, 2017 at the Bigwood Event Center. They put a photo of everyone they arrest on an easy-to-access public internet site called the (In Custody List) for all to see anytime 24/7. Whatever happened to “innocent until proven guilty”? They’re busy destroying people’s lives before they’ve even had a bathroom break. Clearly, The Eighth Amendment to the United States Constitution never intended for that sort of abuse of power to be allowed. No privacy to quietly reestablish themselves. The constant ostracizing is a set-up to fail. Some people’s children find out about the arrest of their parent at school before they’ve had an opportunity to deal with it in the privacy of their home. What’s more is that they haven’t even been convicted in most cases, which makes this an unacceptably egregious & unwarranted, act. United States[edit] The Eighth Amendment to the United States Constitution states that "cruel and unusual punishments [shall not be] inflicted." The general principles the United States Supreme Court relied on to decide whether or not a particular punishment was cruel and unusual were determined by Justice William Brennan.[3] In Furman v. Georgia, 408 U.S. 238 (1972), Justice Brennan wrote, "There are, then, four principles by which we may determine whether a particular punishment is 'cruel and unusual'." The "essential predicate" is "that a punishment must not by its severity be degrading to human dignity," especially torture. "A severe punishment that is obviously inflicted in wholly arbitrary fashion." (Furman v. Georgia temporarily suspended capital punishment for this reason.) "A severe punishment that is clearly and totally rejected throughout society." "A severe punishment that is patently unnecessary." And he added: "The function of these principles, after all, is simply to provide means by which a court can determine whether a challenged punishment comports with human dignity. They are, therefore, interrelated, and, in most cases, it will be their convergence that will justify the conclusion that a punishment is "cruel and unusual." The test, then, will ordinarily be a cumulative one: if a punishment is unusually severe, if there is a strong probability that it is inflicted arbitrarily, if it is substantially rejected by contemporary society, and if there is no reason to believe that it serves any penal purpose more effectively than some less severe punishment, then the continued infliction of that punishment violates the command of the Clause that the State may not inflict inhuman and uncivilized punishments upon those convicted of crimes." Arbitrariness is the quality of being "determined by chance, whim, or impulse, and not by necessity, reason, or principle".[1] Continuing, he wrote that he expected that no state would pass a law obviously violating any one of these principles, so court decisions regarding the Eighth Amendment would involve a "cumulative" analysis of the implication of each of the four principles. In this way the United States Supreme Court "set the standard that a punishment would be cruel and unusual [,if] it was too severe for the crime, [if] it was arbitrary, if it offended society's sense of justice, or if it was not more effective than a less severe penalty."[4] Humiliation is the abasement of pride, which creates mortification or leads to a state of being humbled or reduced to lowliness or submission. It is an emotion felt by a person whose social status has just decreased.[1] It can be brought about through intimidation, physical or mental mistreatment or trickery, or by embarrassment if a person is revealed to have committed a socially or legally unacceptable act. Whereas humility can be sought alone as a means to de-emphasize the ego, humiliation must involve other person(s), though not necessarily directly or willingly. Sometimes humiliation is a by-product of institutional prejudices, as when racism, sexism, or ageism, or is built right into the structure of our laws, or is part of the unquestioned practices of a workplace.[2] Humiliation is currently an active research topic, and is now seen as an important – and complex – core dynamic in human relationships, having implications at intrapersonal, interpersonal, institutional and international levels.[3] Psychological effects[edit] A person who suffers from severe humiliation could cause major depressions, suicidal states, and severe anxiety states such as post-traumatic stress disorder. The loss of status, like losing a job or being labeled (either wrongly or correctly) as a sexual predator, could cause people inability to behave normally in their communities. Humiliated individuals could be provoked and crave for revenge, and some people could feel worthless, hopeless and helpless, losing sense of reality and may eventually commit suicide.[4] Feelings of humiliation can produce 'humiliated fury'[5] which, when turned inward can result in apathy and depression, and when turned outward can give rise to paranoia, sadistic behaviour and fantasies of revenge. Klein explains, "When it is outwardly directed, humiliated fury unfortunately creates additional victims, often including innocent bystanders ... . When it is inwardly directed, the resulting self-hate renders victims incapable of meeting their own needs, let alone having energy available to love and care for others." He goes on to say, "In either case, those who are consumed by humiliated fury are absorbed in themselves or their cause, wrapped in wounded pride..."[6] A study by researchers at the University of Michigan revealed that “the same regions of the brain that become active in response to painful sensory experiences are activated during intense experiences of social rejection.” In other words, humiliation and isolation are experienced as intensely as physical pain.[7] Human rights are moral principles or norms,[1] which describe certain standards of human behaviour, and are regularly protected as legal rights in municipal and international law.[2] They are commonly understood as inalienable[3] fundamental rights "to which a person is inherently entitled simply because she or he is a human being,"[4] and which are "inherent in all human beings"[5] regardless of their nation, location, language, religion, ethnic origin or any other status.[3] They are applicable everywhere and at every time in the sense of being universal,[1] and they are egalitarian in the sense of being the same for everyone.[3] They require empathy and the rule of law[6] and impose an obligation on persons to respect the human rights of others.[1][3] They should not be taken away except as a result of due process based on specific circumstances;[3] for example, human rights may include freedom from unlawful imprisonment, torture, and execution.[7] 13.02 DEFINITIONS. Subdivision 1. Applicability. As used in this chapter, the terms defined in this section have the meanings given them. Subd. 2. Commissioner. "Commissioner" means the commissioner of the Department of Administration. Subd. 3. Confidential data on individuals. "Confidential data on individuals" are data made not public by statute or federal law applicable to the data and are inaccessible to the individual subject of those data. Subd. 3a. Criminal justice agencies. "Criminal justice agencies" means all state and local prosecution authorities, all state and local law enforcement agencies, the Sentencing Guidelines Commission, the Bureau of Criminal Apprehension, the Department of Corrections, and all probation officers who are not part of the judiciary. Subd. 4. Data not on individuals. "Data not on individuals" are all government data that are not data on individuals. Subd. 5. Data on individuals. "Data on individuals" means all government data in which any individual is or can be identified as the subject of that data, unless the appearance of the name or other identifying data can be clearly demonstrated to be only incidental to the data and the data are not accessed by the name or other identifying data of any individual. Subd. 6. Designee. "Designee" means any person designated by a responsible authority to be in charge of individual files or systems containing government data and to receive and comply with requests for government data. Subd. 7. Government data. "Government data" means all data collected, created, received, maintained or disseminated by any government entity regardless of its physical form, storage media or conditions of use. Subd. 7a. Government entity. "Government entity" means a state agency, statewide system, or political subdivision. Subd. 8. Individual. "Individual" means a natural person. In the case of a minor or an incapacitated person as defined in section 524.5-102, subdivision 6, "individual" includes a parent or guardian or an individual acting as a parent or guardian in the absence of a parent or guardian, except that the responsible authority shall withhold data from parents or guardians, or individuals acting as parents or guardians in the absence of parents or guardians, upon request by the minor if the responsible authority determines that withholding the data would be in the best interest of the minor. Subd. 8a. Not public data. "Not public data" are any government data classified by statute, federal law, or temporary classification as confidential, private, nonpublic, or protected nonpublic. Subd. 9. Nonpublic data. "Nonpublic data" are data not on individuals made by statute or federal law applicable to the data: (a) not accessible to the public; and (b) accessible to the subject, if any, of the data. Subd. 10. Person. "Person" means any individual, partnership, corporation, association, business trust, or a legal representative of an organization. Subd. 11. Political subdivision. "Political subdivision" means any county, statutory or home rule charter city, school district, special district, any town exercising powers under chapter 368 and located in the metropolitan area, as defined in section 473.121, subdivision 2, and any board, commission, district or Copyright © 2016 by the Revisor of Statutes, State of Minnesota. It includes any nonprofit corporation which is a community action agency organized pursuant to the Economic Opportunity Act of 1964 (Public Law 88-452) as amended, to qualify for public funds, or any nonprofit social service agency which performs services under contract to a government entity, to the extent that the nonprofit social service agency or nonprofit corporation collects, stores, disseminates, and uses data on individuals because of a contractual relationship with a government entity. Subd. 12. Private data on individuals. "Private data on individuals" are data made by statute or federal law applicable to the data: (a) not public; and (b) accessible to the individual subject of those data. Subd. 13. Protected nonpublic data. "Protected nonpublic data" are data not on individuals made by statute or federal law applicable to the data (a) not public and (b) not accessible to the subject of the data. Subd. 14. Public data not on individuals. "Public data not on individuals" are data accessible to the public pursuant to section 13.03. Subd. 15. Public data on individuals. "Public data on individuals" are data accessible to the public in accordance with the provisions of section 13.03. Subd. 16. Responsible authority. (a) "Responsible authority" in a state agency or statewide system means the state official designated by law or by the commissioner as the individual responsible for the collection, use and dissemination of any set of data on individuals, government data, or summary data. (b) "Responsible authority" in any political subdivision means the individual designated by the governing body of that political subdivision as the individual responsible for the collection, use, and dissemination of any set of data on individuals, government data, or summary data, unless otherwise provided by state law. Until an individual is designated by the political subdivision's governing body, the responsible authority is: (1) for counties, the county coordinator or administrator. If the county does not employ a coordinator or administrator, the responsible authority is the county auditor; (2) for statutory or home rule charter cities, the elected or appointed city clerk. If the home rule charter does not provide for an office of city clerk, the responsible authority is the chief clerical officer for filing and record keeping purposes; (3) for school districts, the superintendent; and (4) for all other political subdivisions, the chief clerical officer for filing and record keeping purposes. Subd. 17. State agency. "State agency" means the state, the University of Minnesota, and any office, officer, department, division, bureau, board, commission, authority, district or agency of the state. Subd. 18. Statewide system. "Statewide system" includes any record-keeping system in which government data is collected, stored, disseminated and used by means of a system common to one or more state agencies or more than one of its political subdivisions or any combination of state agencies and political subdivisions. Subd. 19. Summary data. "Summary data" means statistical records and reports derived from data on individuals but in which individuals are not identified and from which neither their identities nor any other characteristic that could uniquely identify an individual is ascertainable. All Rights Reserved. 13.02MINNESOTA STATUTES 20163 13.82 COMPREHENSIVE LAW ENFORCEMENT DATA. Subdivision 1. Application. This section shall apply to agencies which carry on a law enforcement function, including but not limited to municipal police departments, county sheriff departments, fire departments, the Bureau of Criminal Apprehension, the Minnesota State Patrol, the Board of Peace Officer Standards and Training, the Department of Commerce, and county human service agency client and provider fraud investigation, prevention, and control units operated or supervised by the Department of Human Services. Subd. 2. Arrest data. The following data created or collected by law enforcement agencies which document any actions taken by them to cite, arrest, incarcerate or otherwise substantially deprive an adult individual of liberty shall be public at all times in the originating agency: (a) time, date and place of the action; (b) any resistance encountered by the agency; (c) any pursuit engaged in by the agency; (d) whether any weapons were used by the agency or other individual; (e) the charge, arrest or search warrants, or other legal basis for the action; (f) the identities of the agencies, units within the agencies and individual persons taking the action; (g) whether and where the individual is being held in custody or is being incarcerated by the agency; (h) the date, time and legal basis for any transfer of custody and the identity of the agency or person who received custody; (i) the date, time and legal basis for any release from custody or incarceration; (j) the name, age, sex and last known address of an adult person or the age and sex of any juvenile person cited, arrested, incarcerated or otherwise substantially deprived of liberty; (k) whether the agency employed a portable recording system, automated license plate reader, wiretaps or other eavesdropping techniques, unless the release of this specific data would jeopardize an ongoing investigation; (l) the manner in which the agencies received the information that led to the arrest and the names of individuals who supplied the information unless the identities of those individuals qualify for protection under subdivision 17; and (m) response or incident report number. Subd. 3. Request for service data. The following data created or collected by law enforcement agencies which document requests by the public for law enforcement services shall be public government data: (a) the nature of the request or the activity complained of; (b) the name and address of the individual making the request unless the identity of the individual qualifies for protection under subdivision 17; (c) the time and date of the request or complaint; and Copyright © 2016 by the Revisor of Statutes, State of Minnesota. All Rights Reserved. 13.82MINNESOTA STATUTES 20161 (d) the response initiated and the response or incident report number. Subd. 4. Audio recording of 911 call. The audio recording of a call placed to a 911 system for the purpose of requesting service from a law enforcement, fire, or medical agency is private data on individuals with respect to the individual making the call, except that a written transcript of the audio recording is public, unless it reveals the identity of an individual otherwise protected under subdivision 17. A transcript shall be prepared upon request. The person requesting the transcript shall pay the actual cost of transcribing the call, in addition to any other applicable costs provided under section 13.03, subdivision 3. The audio recording may be disseminated to law enforcement agencies for investigative purposes. The audio recording may be used for public safety and emergency medical services training purposes. Subd. 5. Domestic abuse data. The written police report required by section 629.341, subdivision 4, of an alleged incident described in section 629.341, subdivision 1, and arrest data, request for service data, and response or incident data described in subdivision 2, 3, or 6 that arise out of this type of incident or out of an alleged violation of an order for protection must be released upon request at no cost to the victim of domestic abuse, the victim's attorney, or an organization designated by the Office of Justice Programs in the Department of Public Safety as providing services to victims of domestic abuse. The executive director or the commissioner of the appropriate state agency shall develop written criteria for this designation. Subd. 6. Response or incident data. The following data created or collected by law enforcement agencies which document the agency's response to a request for service including, but not limited to, responses to traffic accidents, or which describe actions taken by the agency on its own initiative shall be public government data: (a) date, time and place of the action; (b) agencies, units of agencies and individual agency personnel participating in the action unless the identities of agency personnel qualify for protection under subdivision 17; (c) any resistance encountered by the agency; (d) any pursuit engaged in by the agency; (e) whether any weapons were used by the agency or other individuals; (f) a brief factual reconstruction of events associated with the action; (g) names and addresses of witnesses to the agency action or the incident unless the identity of any witness qualifies for protection under subdivision 17; (h) names and addresses of any victims or casualties unless the identities of those individuals qualify for protection under subdivision 17; (i) the name and location of the health care facility to which victims or casualties were taken; (j) response or incident report number; (k) dates of birth of the parties involved in a traffic accident; (l) whether the parties involved were wearing seat belts; (m) the alcohol concentration of each driver; and (n) whether the agency used a portable recording system to document the agency's response or actions. Except for the data defined in subdivisions 2, 3, and 6, investigative data collected or created by a law enforcement agency in order to prepare a case against a person, whether known or unknown, for the commission of a crime or other offense for which the agency has primary investigative responsibility are confidential or protected nonpublic while the investigation is active. Inactive investigative data are public unless the release of the data would jeopardize another ongoing investigation or would reveal the identity of individuals protected under subdivision 17. Images and recordings, including photographs, video, and audio records, which are part of inactive investigative files and which are clearly offensive to common sensibilities are classified as private or nonpublic data, provided that the existence of the images and recordings shall be disclosed to any person requesting access to the inactive investigative file. An investigation becomes inactive upon the occurrence of any of the following events: (a) a decision by the agency or appropriate prosecutorial authority not to pursue the case; (b) expiration of the time to bring a charge or file a complaint under the applicable statute of limitations, or 30 years after the commission of the offense, whichever comes earliest; or (c) exhaustion of or expiration of all rights of appeal by a person convicted on the basis of the investigative data. Any investigative data presented as evidence in court shall be public. Data determined to be inactive under clause (a) may become active if the agency or appropriate prosecutorial authority decides to renew the investigation. During the time when an investigation is active, any person may bring an action in the district court located in the county where the data are being maintained to authorize disclosure of investigative data. The court may order that all or part of the data relating to a particular investigation be released to the public or to the person bringing the action. In making the determination as to whether investigative data shall be disclosed, the court shall consider whether the benefit to the person bringing the action or to the public outweighs any harm to the public, to the agency or to any person identified in the data. The data in dispute shall be examined by the court in camera. Subd. 8. Child abuse identity data. Active or inactive investigative data that identify a victim of child abuse or neglect reported under section 626.556 are private data on individuals. Active or inactive investigative data that identify a reporter of child abuse or neglect under section 626.556 are confidential data on individuals, unless the subject of the report compels disclosure under section 626.556, subdivision 11. Subd. 9. Inactive child abuse data. Investigative data that become inactive under subdivision 7, clause (a) or (b), and that relate to the alleged abuse or neglect of a child by a person responsible for the child's care, as defined in section 626.556, subdivision 2, are private data. Subd. 10. Vulnerable adult identity data. Active or inactive investigative data that identify a victim of vulnerable adult maltreatment under section 626.557 are private data on individuals. Active or inactive investigative data that identify a reporter of vulnerable adult maltreatment under section 626.557 are private data on individuals. Subd. 11. Inactive vulnerable adult maltreatment data. Investigative data that becomes inactive under subdivision 7, paragraph (a) or (b), and that relate to the alleged maltreatment of a vulnerable adult by a caregiver or facility are private data on individuals. Subd. 12. Name change data. Data on court records relating to name changes under section 259.10, subdivision 2, which is held by a law enforcement agency is confidential data on an individual while an investigation is active and is private data on an individual when the investigation becomes inactive. On receipt of a written request, the prosecuting authority shall release investigative data collected by a law enforcement agency to the victim of a criminal act or alleged criminal act or to the victim's legal representative unless the release to the individual subject of the data would be prohibited under section 13.821 or the prosecuting authority reasonably believes: (a) that the release of that data will interfere with the investigation; or (b) that the request is prompted by a desire on the part of the requester to engage in unlawful activities. Subd. 14. Withholding public data. A law enforcement agency may temporarily withhold response or incident data from public access if the agency reasonably believes that public access would be likely to endanger the physical safety of an individual or cause a perpetrator to flee, evade detection or destroy evidence. In such instances, the agency shall, upon the request of any person, provide a statement which explains the necessity for its action. Any person may apply to a district court for an order requiring the agency to release the data being withheld. If the court determines that the agency's action is not reasonable, it shall order the release of the data and may award costs and attorney's fees to the person who sought the order. The data in dispute shall be examined by the court in camera. Subd. 15. Public benefit data. Any law enforcement agency may make any data classified as confidential or protected nonpublic pursuant to subdivision 7 or as private or nonpublic under section 13.825 accessible to any person, agency, or the public if the agency determines that the access will aid the law enforcement process, promote public safety, or dispel widespread rumor or unrest. Subd. 16. Public access. When data is classified as public under this section, a law enforcement agency shall not be required to make the actual physical data available to the public if it is not administratively feasible to segregate the public data from the not public. However, the agency must make the information described as public data available to the public in a reasonable manner. When investigative data becomes inactive, as described in subdivision 7, the actual physical data associated with that investigation, including the public data, shall be available for public access. Subd. 17. Protection of identities. A law enforcement agency or a law enforcement dispatching agency working under direction of a law enforcement agency shall withhold public access to data on individuals to protect the identity of individuals in the following circumstances: (a) when access to the data would reveal the identity of an undercover law enforcement officer, as provided in section 13.43, subdivision 5; (b) when access to the data would reveal the identity of a victim or alleged victim of criminal sexual conduct or sex trafficking under section 609.322, 609.341 to 609.3451, or 617.246, subdivision 2; (c) when access to the data would reveal the identity of a paid or unpaid informant being used by the agency if the agency reasonably determines that revealing the identity of the informant would threaten the personal safety of the informant; (d) when access to the data would reveal the identity of a victim of or witness to a crime if the victim or witness specifically requests not to be identified publicly, unless the agency reasonably determines that revealing the identity of the victim or witness would not threaten the personal safety or property of the individual; (e) when access to the data would reveal the identity of a deceased person whose body was unlawfully removed from a cemetery in which it was interred; Copyright © 2016 by the Revisor of Statutes, State of Minnesota. All Rights Reserved. 4MINNESOTA STATUTES 201613.82 (f) when access to the data would reveal the identity of a person who placed a call to a 911 system or the identity or telephone number of a service subscriber whose phone is used to place a call to the 911 system and: (1) the agency determines that revealing the identity may threaten the personal safety or property of any person; or (2) the object of the call is to receive help in a mental health emergency. For the purposes of this paragraph, a voice recording of a call placed to the 911 system is deemed to reveal the identity of the caller; (g) when access to the data would reveal the identity of a juvenile witness and the agency reasonably determines that the subject matter of the investigation justifies protecting the identity of the witness; or (h) when access to the data would reveal the identity of a mandated reporter under section 609.456, 626.556, or 626.557. Data concerning individuals whose identities are protected by this subdivision are private data about those individuals. Law enforcement agencies shall establish procedures to acquire the data and make the decisions necessary to protect the identity of individuals described in clauses (c), (d), (f), and (g). Subd. 18. Data retention. Nothing in this section shall require law enforcement agencies to create, collect or maintain data which is not required to be created, collected or maintained by any other applicable rule or statute. Subd. 19. Data in arrest warrant indices. Data in arrest warrant indices are classified as confidential data until the defendant has been taken into custody, served with a warrant, or appears before the court, except when the law enforcement agency determines that the public purpose is served by making the information public. Subd. 20. Property data. Data that uniquely describe stolen, lost, confiscated, or recovered property are classified as either private data on individuals or nonpublic data depending on the content of the not public data. Subd. 21. Reward program data. To the extent that the release of program data would reveal the identity of an informant or adversely affect the integrity of the fund, financial records of a program that pays rewards to informants are protected nonpublic data in the case of data not on individuals or confidential data in the case of data on individuals. Subd. 22. Data on registered criminal offenders. Data described in section 243.166 shall be classified as described in that section. Subd. 23. Data in missing children bulletins. Data described in section 299C.54 shall be classified as described in that section. Subd. 24. Exchanges of information. Nothing in this chapter prohibits the exchange of information by law enforcement agencies provided the exchanged information is pertinent and necessary to the requesting agency in initiating, furthering, or completing an investigation, except not public personnel data and data governed by section 13.045. Subd. 25. Deliberative processes. Data that reflect deliberative processes or investigative techniques of law enforcement agencies are confidential data on individuals or protected nonpublic data; provided that information, reports, or memoranda that have been adopted as the final opinion or justification for a decision of a law enforcement agency are public data. (a) For purposes of this subdivision, "booking photograph" means a photograph or electronically produced image taken by law enforcement for identification purposes in connection with the arrest of a person. (b) Except as otherwise provided in this subdivision, a booking photograph is public data. A law enforcement agency may temporarily withhold access to a booking photograph if the agency determines that access will adversely affect an active investigation. Subd. 27. Pawnshop and scrap metal dealer data. Data that would reveal the identity of persons who are customers of a licensed pawnbroker, secondhand goods dealer, or a scrap metal dealer are private data on individuals. Data describing the property in a regulated transaction with a licensed pawnbroker, secondhand goods dealer, or a scrap metal dealer are public. Subd. 28. Disclosure of predatory offender registrant status. Law enforcement agency disclosure to health facilities of the registrant status of a registered predatory offender is governed by section 244.052. Subd. 29. Juvenile offender photographs. Notwithstanding section 260B.171, chapter 609A, or other law to the contrary, photographs or electronically produced images of children adjudicated delinquent under chapter 260B shall not be expunged from law enforcement records or databases. Subd. 30. Inactive financial transaction investigative data. Investigative data that become inactive under subdivision 7 that are a person's financial account number or transaction numbers are private or nonpublic data. Subd. 31. Use of surveillance technology. Notwithstanding subdivision 25 and section 13.37, subdivision 2, the existence of all technology maintained by a law enforcement agency that may be used to electronically capture an audio, video, photographic, or other record of the activities of the general public, or of an individual or group of individuals, for purposes of conducting an investigation, responding to an incident or request for service, monitoring or maintaining public order and safety, or engaging in any other law enforcement function authorized by law is public data. As used in this section, "corrections and detention data" means data on individuals created, collected, used or maintained because of their lawful confinement or detainment in state reformatories, prisons and correctional facilities, municipal or county jails, lockups, workhouses, work farms and all other correctional and detention facilities. Subd. 2. Corrections and detention private data. Unless the data are summary data or arrest data, or a statute specifically provides a different classification, corrections and detention data on individuals are classified as private pursuant to section 13.02, subdivision 12, to the extent that the release of the data would either (a) disclose medical, psychological, or financial information, or personal information not related to their lawful confinement or detainment or (b) endanger an individual's life. Subd. 3. Corrections and detention confidential data. Corrections and detention data are confidential, pursuant to section 13.02, subdivision 3, to the extent that release of the data would: (a) endanger an individual's life, (b) endanger the effectiveness of an investigation authorized by statute and relating to the enforcement of rules or law, (c) identify a confidential informant, or (d) clearly endanger the security of any institution or its population. Subd. 4. Corrections and detention public data. After any presentation to a court, any data made private or confidential by this section shall be public to the extent reflected in court records. Subd. 5. Corrections and detention public benefit data. The responsible authority or its designee of any agency that maintains corrections and detention data may release private or confidential corrections and detention data to any law enforcement agency, if necessary for law enforcement purposes, or to the victim of a criminal act where the data are necessary for the victim to assert the victim's legal right to restitution. Relevant to LPHA’s priorities, the Governor’s budget supports: Sustained funding for the Statewide Health Improvement Partnership (SHIP) at $35 million per biennium. Increasing the MA reimbursement rate to $140 for public health nurse home visits using an evidence-based model, defined as those which are recognized by the U.S. Health Resources and Services Administration and identified by MDH as eligible under the MIECHV program. (This is a positive first step toward providing more stability for family home visiting programs but is more limited in scope than LPHA’s platform, which seeks an increase in the MA rate for all public health nurse family home visits.) $31 million in the FY2018-FY2019 biennium to expand family home visiting programs to pregnant and parenting teens under age 20 using evidence-based and emerging home visiting models. Funding would support both short-term and long-term services, with grants prioritizing community health boards and tribes. The appropriation would increase to $25.5 million per year beginning FY2020. Ongoing funding for the Local Public Health Grant at the current appropriation of approximately $21.5 million per year. Other items of interest in the Governor’s budget include: $118,000 annually to MDH to establish and support a comprehensive, statewide referral system for Help Me Grow. (This is not new funding but a transfer of funds from the Minnesota Department of Education.) An appropriation increase of $1.6 million in FY2018 and $3.3 million each year after for drinking water protection activities. The increase is intended to allow the state to assume greater responsibility for regulating contaminants in public drinking water supplies and help support a 24/7 emergency response for events affecting drinking water systems. It includes a drinking water connection fee increase of 22 cents per household per month to pay for the appropriation. A $500,000 appropriation from the clean water fund for well sealing. The proposal uses funds for cost sharing to help Minnesotans seal unused wells and borings and is expected to increase the number sealed by 200 per year. 2 An appropriation increase of $799,000 in FY2018 and each year after to align retail food regulations between the Departments of Health and Agriculture. The proposal includes two parts: a redistribution of which license fees food establishments pay based on the risk assessment of their food processes and an increase to most food, pools and lodging license fees. $4 million in FY2018 for grants to Minnesota’s 11 sovereign Tribal Nations and two urban American Indian organizations to prevent opioid use and addiction in their communities. A recommendation regarding mental health that funding the state receives from county cost shares at the Anoka Metro Regional Treatment Center and at community behavioral health hospitals be redirected from the general fund to grants that address the underlying issues causing people to remain in state-operated facilities. $2.8 million per year in grants would be directed toward meeting the needs identified by the Governor’s Task Force on Mental Health to improve the continuum of care. $30 million in FY2018 and $30 million in FY2019 to fund the Border-to-Border Broadband Grant Program in Minnesota. The recommendation allows the Department of Employment and Economic Development (DEED) to reserve up to 3% of grant funds for program administration and broadband mapping. $5 million would be reserved specifically for tribal and/or low-income areas in Greater Minnesota. Partner- SHIP 4 Health (PS4H) tackles this reality as it partners with worksites to create a culture of well- ness. Using a collaborative model, PS4H brings together worksites to establish policies, systems, and environments that support wellness. Stoneridge Software, a Barnesville company, participated in the 2015-2016 Worksite Wellness Collaborative. They created a six-member well- ness committee and met via monthly conference call to determine monthly educa- tional topics, identify quarterly challenges, and brainstorms ways to promote the initiative. According to Recruiting and Human Resource Manager LeAnn Moss, “PS4H provided us with endless resources and ideas to promote wellness in our workplace. That’s why healthy habits shaped at childcares last a lifetime! Tastes are being set and preferences shaped; kids are absorbing everything around them. It’s a formative age in every way.” Because of this, PartnerSHIP 4 Health (PS4H) collaborates with ChildcareAlive! to em- power childcare providers to foster environments that support healthy foods and active play. ChildcareAlive! uses fun and engaging activities on-site at childcare settings for providers and children, providing entertaining lessons for children, helpful tips and reci- pes for parents, and valuable resources for providers. ChildcareAlive! guides providers in establishing policy, system, and environmental changes supportive of healthy living. Cindie Van Tassel, childcare provider in Breckenridge, Minnesota, participated in the winter 2016 ChildcareAlive! Program. After assessing the nutritional and physical activ- ity practices at her setting, she received resources, one-on-one coaching, and examples of healthy cooking and physical activities. Cindie attributes the increased healthy eating and active play in her program to ChildcareAlive! and the on-site coaching visits from Krystle McNeal, PS4H staff and registered dietitian. To ensure that these changes would be sustained, Cindie updated the policies in her handbook. These nutrition and physical activity policies reassure current and future par- ents that their children are cared for in a setting that values healthy foods and active play. “It really helped us try new veggies when Krystle made a dip for us. The children looked forward to and responded to someone else encouraging them to try new things,” said Cindie. Page 2 PartnerSHIP 4 Health Nov 2015– Oct 2016 Bike share systems offer economy and convenience while increasing access to physical activity. After just one year, Fargo has the most successful automated bicycle share system in the country. This system became operational with 11 stations in March 2015, and out-performs systems in Madison, Minneapolis/Saint Paul, and Denver. Partner- SHIP 4 Health (PS4H) and Great Rides look to expand the system into Moorhead. The Moorhead Great Rides Expan- sion Committee held its first meeting in October 2015 and hopes to have the first stations operational by 2017. The Fargo-Moorhead Metropolitan Council of Government and PS4H co-authored a planning study published in July 2016 to assist in long-term sustainability. Improving the school wellness environment empowers students to achieve more academically while developing lifelong healthy lifestyle behaviors. To foster healthy school environments, PartnerSHIP 4 Health (PS4H) partici- pates as an active member of school wellness committees, encourages annual review of the wellness policy, as- sists in compliance with USDA meal programs, helps set measurable wellness goals, and offers supportive fund- ing. New York Mills (NYMs) Schools recently strengthened their school wellness policy and utilized PS4H funding to increase access to fresh fruits and vegetables via a salad bar. One NYM student noted the impact of these changes: “In the past our lunches were bland, lacked color or va- riety, and incorporated small portions. Now we have lots of variety and fresh fruit and vegetables, all three in one day. The meals have more color and better flavor. More kids are eating at school and no longer need to leave campus after the meal to fill up.” Superintendent Blaine Novak also commented on the increased satisfaction, “Students and families are really appreciating the salad bar.” PS4H works with nine of 16 districts on salad bar initiatives as well as grab-n-go breakfast and improved healthy con- cession options in addition to physical activity initiatives such as active classroom and active recess. Did you know that babies that are not breastfed have a 30% higher risk of obesity as compared to breast- fed babies? “Partnership 4 Breastfeeding,” an Otter Tail County Coalition, brings together healthcare professionals to share ideas, training tools, and infor- mation in order to support breastfeeding moms. Members include staff from Lake Region Healthcare (hospital and clinic), Perham Health (hospital and clinic), and Otter Tail County Public Health (WIC, Family Nurse Partnership, Maternal/Child). Local public health, hospitals, and clinics began working together during a 2009 SHIP PartnerSHIP 4 Health (PS4H) breastfeeding initiative, and developed and implemented a transparent referral program. PartnerSHIP 4 Health (PS4H) collaborates with schools and other organizations to create environments that encourage physical activity. For example, PS4H partner schools and organizations offer quality physical education, active classrooms, and active recess and embed physical activity opportu- nities into before and after-school programs. Two such organizations, the Boys and Girls Clubs in Detroit Lakes and Perham, partnered with PS4H to offer physical activity training for their 30 staff members in order to prioritize physical activity and make routine efforts to integrate quality physical activity opportunities into their pro- gramming. Perham Boys and Girls Club Program Director, Cori Brown shared, “One of our college leaders has loaded everything onto our SMART TV al- ready and we are ready to rock ~N~ roll with kids! I also shared the resources with my daughter who teaches 1st grade (no use in keep- ing this information a secret!) This will add val- uable enrichment to our programming.” Children that enjoy physical activity tend to stay active throughout their lives. PS4H and these Boys and Girls Clubs serve a key role in helping children and adolescents develop physical activ- ity skills for a lifetime.
