HomeMy WebLinkAboutBoard of Commissioners - Minutes - 06/30/2020 OTTERTAIL COU NTY· MINNESOTA MINUTES OF THE OTTER TAIL COUNTY BOARD OF COMMISSIONERS Government Services Center, Commissioners' Room & Via Livestream 515 West Fir Avenue, Fergus Falls, MN June 30, 2020 8:30a.m. Call to Order The Otter Tail County Board of Commissioners convened at 8:30 a.m. Tuesday, June 30, 2020, at the Government Services Center in Fergus Falls, MN. Commissioners Lee Rogness, Chair; Betty Murphy, Vice-Chair; John Lindquist, Wayne Johnson, and Doug Huebsch were present in the room. The meeting was held via Webex Meeting and was available to the public via livestream due to the health pandemic and declared emergency in accordance with Minn. Stat. Sec. 13D.021 Subd . 1(1). Approval of Agenda Chair Rogness called for approval of the Board Agenda. Motion by Johnson, second by Murphy and unanimously carried to approve the Board of Commissioners' agenda of June 30, 2020 with the following additions: Regular Agenda : Feedlot Public Meetings Public Works Committee: Approach Permits Consent Agenda Motion by Huebsch, second by Lindquist and unanimously carried to approve the Consent Agenda items as follows: 1. June 16, 2020 Board of Commissioners' Meeting Minutes 2. Warrants/Bills for June 30, 2020 (Exhibit A) 3. Approval of an On/Off-Sale 3.2 Malt Liquor License for Bryan Stetz dba Ye Olde Schoolhouse Bar and Grill Child Protection Opioid Epidemic Response Allocation Human Services Director Deb Sjostrom provided a brief background to the Board regarding funds received to assist with child protection services related to opioid and drug use. Otter Tail County received a 6-month allocation of $51,951 and plan to engage in programs offered by the Salvation Army and the Welcome Place to assist families and reduce the number of out-of-home placements. Anthony Nordan with the Salvation Army provided a brief overview of the Pathway of Hope program that assists families and builds a better future for children. Dawn Finn with the Welcome Place provided a brief overview of the Family Development Services program that provides support services to families to help attain self-sufficiency. Staff plans to hold monthly meetings with the Salvation Army and the Welcome House once a month for six (6) months to discuss the process and will report back to the Board in December. Contract with Gallagher Motion by Huebsch, second by Lindquist and unanimously carried to authorize appropriate County Officials' signatures to execute the agreement between Otter Tail County and Gallagher Benefit Services, Inc to complete a request for proposal (RFP) for the county's health insurance benefits. Greater MN Recycling and Composting Grant Application Motion by Lindquist, second by Johnson and unanimously carried to authorize the Solid Waste department to submit a Greater MN Recycling and Composting Grant application to assist with the cost of a front load packet truck and 50 containers for use by Otter Tail, Todd and Wadena Counties to collect agricultural and boat storage film plastic. Solid Waste has secured support from Todd and Wadena Counties who would share in the capital and operating costs and a written agreement would be prepared upon award . Page 1 of 5 Board of Commissioners' Meeting Minutes June 30, 2020 Grant Contract with the Minnesota Department of Veterans Affairs Otter Tail County Resolution No. 2020 -49 BE IT RESOLVED by Otter Tail County that the County enters into the attached Grant Contract with the Minnesota Department of Veterans Affairs (MDVA) to conduct the following Program: County Veterans Service Office Operational Enhancement Grant Program . The grant must be used to provide outreach to the county's veterans; to assist in the reintegration of combat veterans into society; to collaborate with other social service agencies, educational institutions, and other community organizations for the purposes of enhancing services offered to veterans; to reduce homelessness among veterans ; and to enhance the operations of the county veterans service office, as specified in Minnesota Laws 2019, Chapter 10, Article 1, Section 37, Subdivision 2. This Grant should not be used to supplant or replace other funding . BE IT FURTHER RESOLVED by the Otter Tail County that James Olson, the County Veteran Services Officer, be authorized to execute the attached Grant Contract for the above-mentioned Program on behalf of the County. The motion for the adoption of the foregoing resolution was introduced by Commissioner Huebsch, duly seconded by Commissioner Murphy and, after discussion thereof and upon vote being taken thereon, the resolution was adopted unanimously. Rogness, Board of Commissioners Chair Nicole Hansen, Clerk Recess & Reconvene At 9:20 a.m., Chair Rogness declared the meeting of the Otter Tail County Board of Commissioners recessed for short break due to technical difficulties. The Board of Commissioners meeting was reconvened at 9:26 a.m. Probation Department Update Probation Director Michael Schommer provided a brief update to the Board regarding the Probation Department and reported that the restructure of the department over the past several months has allowed the ability to reduce staff and focus on an evidence based approach to guide behavior. He informed the Board that there has been no report of relapse in the DWI program during the pandemic and agents have increased virtual contact and have engaged in wellness challenges to assist with managing mental health. Dependence on the jail and juvenile detention centers have decreased as the department continues to shift their focus and assist clients with overcoming challenges while remaining in the community. Mr. Schommer briefly discussed the Juvenile Justice Reinvestment Initiative and reviewed topics he would like the group to explore. Motion by Murphy, second by Lindquist and unanimously carried to recognize McKenzi Lorrig for receiving the "Rookie of the Year Award" from the Minnesota Association of County Probation Officers for "demonstrating abundant potential and professionalism early in a probation career." Transition Coordinator Position Motion by Huebsch, second by Murphy and unanimously carried to approve a 1.0 Full-Time Equivalent Transition Coordinator position in the Probation Department with Otter Tail County. Support from the Otter Tail Family Service Cooperative and a vacant position that is not planned to be replaced will support the cost of this position. Page 2 of 5 Board of Commissioners' Meeting Minutes June 30, 2020 Approval of LG220 Application Motion by Johnson, second by Lindquist and unanimously carried to approve the request of the East Otter Tail Minnesota Deer Hunters Association to allow for the conduct of charitable gambling on August 29 th, 2020 at Playtime Sports Bar and Grill, located at 43974 390th Street in Rush Lake Township. Noting that the original event was scheduled for April 4, 2020; however, due to COVID-19 the event was postponed until August 29, 2020. Transferring of Funds Motion by Murphy, second by Huebsch and unanimously carried to approve a transfer, in the amount of $6,529 .10, from the Capital Improvement Fund to the Road and Bridge Fund to reimburse costs incurred for the Underground Water Line Replacement Project at the Phelps Mill Park. Request for Funding Motion by Johnson, second by Lindquist and unanimously carried to deny the request of the Red River Basin Commission for funding in the amount of $400.00 for 2020 Minnesota Joint Powers Board Administration Funding. Authorization for Sale of Properties Motion by Johnson, second by Huebsch and unanimously carried to authorize the County Highway Engineer and the County Auditor-Treasurer to proceed with the appropriate advertisements for the following : Sale of house to be removed from 1013 East Fir Avenue in Fergus Falls in preparation for the future roundabout at Fir Avenue and Friberg Avenue. The Public Works Committee has recommended selling the house building and retaining the land. Sale of house and land at 25037 County Highway 27 . The Public Works Committee has recommended this sale . This property was originally purchased by Otter Tail County due to right of way impacts for the CSAH 27 reconstruction project and a new septic system has been installed. Request for Penalty Forgiveness Motion by Lindquist, second by Murphy and unanimously carried to approve the request of Ms. Vicki Evenson for the abatement of accrued penalty in the amount of $507 .20 noting that the documentation provided does support a hardship, as defined in the County's policy, that would allow the approval of the requested abatement. Motion by Johnson, second by Lindquist and unanimously carried to table the request from Badal Roy, also known as Comfort Zone Inn in Rothsay, for the abatement of accrued penalty in the amount of $177.52 until the Finance Committee has determined how to proceed with requests impacted by COVID-19. Approval of Liquor License Motion by Huebsch, second by Murphy and unanimously carried to approve an on-sale liquor and Sunday liquor license for Oakwood LLC dba Oakwood Supper Club and Joseph and Lisa Harlow dba Big Pine Lodge. Canvassing Board Appointments Motion by Johnson, second by Murphy and unanimously carried, to appoint Commissioner Huebsch and Commissioner Lindquist to the Canvassing Board for the Tuesday, August 11, 2020 State Primary Election. The Otter Tail County Canvassing Board will meet at 2:30 p.m. on Friday, August 14, 2020 . Request for Penalty Forgiveness Motion by Lindquist, second by Murphy and unanimously carried to deny the request of Jeanne Patterson for the abatement of accrued penalty, as recommended by the County Auditor-Treasurer, due to a prior penalty forgiveness request and the awareness made to the property owner at that time. Page 3 of 5 Board of Commissioners' Meeting Minutes June 30, 2020 Feedlot Public Meetings The Board of Commissioners will hold virtual public meetings for feedlots when required by the Minnesota Pollution Control Agency (MPCA). Highway Projects Contracts & Bonds : S.A.P. 056-635-035: Motion by Johnson, second by Lindquist and unanimously carried to authorize appropriate County Officials' signatures to execute the contract between Otter Tail County and R.J. Zavoral & Sons, Inc for project S.A.P . 056-635-035 . Resolution Accepting Responsibility as the Sponsoring Agency Otter Tail County Resolution No. 2020 -SO BE IT RESOLVED THAT Otter Tail County act as sponsoring agency for a "Local Road Improvement Program" project identified as Seventh Avenue Northeast & Northeast Industrial Park Street and Utility Improvements, Perham, MN (S.A.P . 056-594-001) and has reviewed and approved the project as proposed . Sponsorship includes acting as the fiscal agent, keeping the project on schedule, and ensuring that all program documentation and requirements are met, with compliance of all applicable laws, rules and regulations. BE IT FURTHER RESOLVED THAT Charles H. Grotte, P.E., County Engineer is hereby authorized to act as agent on behalf of this applicant. The motion for the adoption of the foregoing resolution was introduced by Commissioner Huebsch, duly seconded by Commissioner Johnson and, after discussion thereof and upon vote being taken thereon, the resolution was adopted unanimously. Rogness, Board of Commissioners Chair Phelps Mill Store Historic Building Conditions Assessment: Dated ______________ _ Attest ______________ _ Nicole Hansen, Clerk Motion by Murphy, second by Johnson and unanimously carried to approve YHR Partners' proposal for the Phelps Mill Store Historic Building Conditions Assessment. The cost to perform the assessment will be covered by a $8,500.00 grant received from the Minnesota Historical Society. CSAH 34 Reconstruction Update: County Engineer Charles Grotte provided a brief update to the Board regarding CSAH 34 . Bid opening is scheduled for July 22, 2020 with an anticipated construction start of August/September 2020. Fall completion date of October 2020 and a final completion date of August 2021 . The Perham to Pelican Rapids Regional Trail paving is to follow on project S.P. 056-090-013 fall 2020 to spring 2021 . Commissioners requested first layer of pavement be completed by fall. Public Health Update Public Health Director Jody Lien reported that Otter Tail County has 92 lab confirmed cases of COVID-19, of which 85 no longer require isolation, and one (1) COVID-19 related death. 5,132 tests have been performed in Otter Tail County and case counts are included in the county of which an individual resides, not in the county they were tested. Minnesota has 35,861 lab confirmed cases, of which 31,225 no longer require isolation, and 1,435 lab confirmed deaths. She reviewed county level data related to age range and likely exposure and discussed current modeling for Otter Tail County. As numbers continue to rise, updated modeling anticipates a peak in mid-September to mid-October. The Public Health Department Operations Center (DOC) continues to meet weekly, focusing on providing information and guidance to the public. Concerns were expressed regarding public behavior and following preventative measures to slow the spread . Ms . Lien briefly discussed the opening of long-term care facilities and reported that healthcare partners feel confident they are prepared and ready to respond with the virus.
