Recitals 1. Under Minnesota Statutes §197.608, as amended by Minnesota Laws 2021, 1st Special Session, Chapter 12, Article 1, Section 37, Subdivision 2, the State is empowered to enter into this grant. 2. The State is in need of enhancing the operation of the County Veterans Service Offices (CVSO). This grant must be used to enhance the operations of the Grantee’s CVSO under Minnesota Statutes §197.608, Subdivision 4(a), and should not be used to supplant or replace other funding. 3. The Minnesota Legislature has funded grants to the counties through MDVA for many years. The established practice has been to provide advanced payments of the full grant amount to the Grantee. This has been done to ensure that the counties have sufficient funds available to conduct programming and complete the tasks required by the grant. The counties often have limited cash reserves and do not have the financial capabilities to make grant expenditures first and wait for reimbursements from the State. Therefore, based on their past performance, MDVA is confident that the Grantee will be able to account for the grant funds and abide by the terms of the grant agreement. 4. The Grantee represents that it is duly qualified and agrees to perform all services described in this grant agreement to the satisfaction of the State. Pursuant to Minnesota Statutes §16B.98 Subdivision 1, the Grantee agrees to minimize administrative costs as a condition of this grant. Grant Agreement 1. Term of Grant Agreement 1.1 Effective date: July 1, 2020, Per Minn. Stat.§16B.98, Subd. 5, the Grantee must not begin work until this grant contract agreement is fully executed and the State's Authorized Representative has notified the Grantee that work may commence. Per Minn.Stat.§16B.98 Subd. 7, no payments will be made to the Grantee until this grant contract agreement is fully executed. 1.2 Expiration date: June 30, 2021, or until all obligations have been satisfactorily fulfilled, whichever occurs first. 1.3 Survival of Terms: The following clauses survive the expiration or cancellation of this grant agreement: 8. The Lead Investigative Agency (LIA) is determined based on whether the person involved is receiving services in a licensed setting such as nursing facility (MN Dept of Health) or licensed residential setting (MN Dept of Human Services), or if residing in an independent community setting (county of residence). The three types of reportable maltreatment are identified by Statute: abuse: physical, emotional, or sexual; neglect: caregiver or self; and financial exploitation with or without fiduciary relationship. Current OTCHS team: Candice Jallen/Adult Intake, Sarah Hill/VA Assessor. Back-up VA Assessment provided by Michelle Foreman, Chad Campion, and Randi Resler. Supervisor- Margaret Williams In CY2020: 419 MAARC reports reviewed with 206 screened in for investigation: • Self-neglect makes up 40-50% of reports, consistent over past 4 years • Financial Exploitation not fiduciary relationship, increased slightly over past 3 years • Neglect by caregiver ranks close to financial exploitation as 3rd highest allegation What is Going Well VA Assessor staff work closely with other Human Services service units, City & County Law Enforcement, County Attorney’s Office, Public Health, community providers and the OTAVA Adult Protection Multi- Disciplinary Team to address the needs of identified vulnerable adults. We will continue to offer VA reporting training to community providers and participate in ongoing training to maintain skills & knowledge base. Also, team members participate in regional collaboration with surrounding Counties which provides ongoing opportunity for resource sharing, collaboration and problem-solving. Opportunities for Growth/Areas of Focus: Increase public awareness of adult abuse & neglect issues and how to access the MAARC reporting system. Work to educate involved parties & community service providers regarding best practices in managing the balance of self-determination & utilization of least restrictive alternatives. In 2020 an Adult Protective Services Grant was awarded to OTCHS, and a plan developed to provide additional support to the OTAVA Multidisciplinary Team, provide community education on Adult Protective Services, provide flexible funding as last resort/no other funding available to assist individuals to maintain independence, and purchase accounting software to support APS investigations. Impacts of COVID-19: Anticipated increase reports during height of pandemic regarding availability of caregiver support was not realized. In-person contacts were not completed unless there was no means to complete the work without this, and OTAVA Multi-disciplinary Protection Team meetings were not held. OTAVA has now resumed in virtual format. Community education plan was held pending ability to meet and gather in- person for training post-pandemic and the plan is to address this in the Fall 2021. Respectfully submitted, Marsha Bowman Recording Secretary TO: Otter Tail County Board of Commissioners FROM: Barbara Dacy, Executive Director, Otter Tail County HRA DATE: July 22, 2021 SUBJECT: First Reading of the Ordinance to Establish a Housing Trust Fund Background A “Local Housing Trust Fund” is a financial tool that is defined in state law (Minnesota Statute 462C.16: “Housing Trust Funds for Local Housing Development”). This provision was adopted in 2017. On April 15, 2021, the Otter Tail County HRA adopted Resolution No. 152 Authorizing Consideration of A Local Housing Trust Fund For Otter Tail County to empower the Executive Director to initiate the process to establish the fund. State law requires that the “local jurisdiction” establish the fund, which in the county’s case, requires an ordinance adopted by the County Board. After the close of the public hearing on Tuesday, July 13, 2021, the Board directed staff to prepare the ordinance for first reading. Changes Since Public Hearing The attached ordinance contains changes to the public hearing draft. In summary, the changes are aimed to provide more clarity as to process and eligible expenditures. They are summarized as follows: • Section 1 General Provisions. Added number (5) regarding additional authorized expenditures consistent with state law (down payment assistance, rental assistance, and home buyer counseling services). • Section 2 Definitions. Moved the definition of “Housing Trust Fund” to the correct alphabetical position and renumbered. • Section 3 Housing Trust Fund Accout; Source of Trust Funds. Added additional examples of sources to 3.2.7; “cities and/or townships, and non-profit organizations.” • Section 4 Trust Fund Distribution. A sentence was added in 4.1 explaining that the HRA Board of Commissioners may adopt a policy establishing the process and parameters of loans and grants permitted by the Housing Trust Fund. In 4.2, additional permitted disbursements were added and include down payment assistance, rental assistance, and home buyer counseling services. • Section 5 Term of Affordability. Because it is likely that there will be differing affordability periods for various programs and/or expenditures, a sentence in 5.1 was deleted mandating a 15 year affordability timeframe. A sentence was added stating that the HRA Board of Commissioners may adopt a policy regarding the affordability periods for the Housing Trust Fund programs. In addition, it was clarified that a loan and grant agreement must be executed between the recipient and the HRA. PUBLIC HEARING: July 13, 2021 FIRST READING: July 27, 2021 SECOND AND FINAL READING: Adopted by the Otter Tail County Board of Commissioners on _______________________. Dear Wayne Stein and County Commissioners, July 13, 2021 Thank you for your ongoing support of our economic and community development work in Otter Tail County and thank you for welcoming us to present an update at the July 27 County Commissioner Meeting. We look forward to learning about your goals for Otter Tail County in and beyond this important time of recovery and growth and how we can continue to work together to realize them. Because of your contributions to our Annual Operations Fund, we were positioned to respond to urgent needs during the COVID-19 pandemic. In the past year alone, we provided Otter Tail County more than $1 million in loans and more than $2.2 million in grants such as Emergency Child Care Grants, Small Business Relief Grants, and grants for nonprofit pandemic response through our Resiliency Fund. These investments ensured Otter Tail County citizens had and will continue to have jobs, childcare, and access to essential services. Going forward, we will focus on goals established by the people of our region and outlined in the Minnesota Region IV Comprehensive Economic Development Strategy. We have added two additional planners to our staff to accomplish this work. Our planning team has partnered with Otter Tail County HRA to complete a housing study in Battle Lake, plans for a new housing development in Dalton and we are starting work on a pre-design plan for a housing development in Pelican Rapids. We also added a staff member to our business and economic development team, and we are working on distributing funds through our Economic Development Administration Pandemic Loan Fund. As we emerge from this pandemic, we are reviving our Live Wide Open workforce development campaign. WCI is the federally designated planning organization serving Otter Tail County, MN EDR 4, and we work closely with federal and state governments to manage the distribution of funds in our region. Unlike the other Regional Development Organizations in the state of Minnesota, WCI does NOT levy dollars from our municipalities, which all other RDOs have the capability to do based on population. If we were to do those same calculations, Otter Tail County would come in at around $58,000. In an effort to gradually increase funding from units of government in our region over the next five years, we ask that you consider joining us in this multi-year approach by increasing funding to WCI by 20%. Last year your contribution was $22,500. We ask you to consider increasing your support for WCI to $27,000 in 2022. We look forward to our visit and conversation with you later this month, and we welcome any additional questions you have regarding our work in Otter Tail County and the broader nine-county region we serve. Thank you for your continued support of our economic, community and workforce development efforts. Discussion and Review of Potential Tax Forfeited for Public/Private Sale Listing 1. List of Prospective Lida Lakes Improvement District Board Members as Provided by David Hilber Mr. Stein, I am re-sending this - I originally sent yesterday but realized the email did not have a subject line. Below is a list of potential names for the Lida Lakes Improvement District Board. All of those listed expressed an interest in serving. The 1st seven are our recommendations. They also meet the requirement to have the majority be year-round residents. We had 3 names who were NOT in favor of, or skeptical of, the LID: Gary Storms Shane Peterson Rob Jacobson We recommend Gary Storms for two reasons: He is a year-round resident; he is a former Mayor and has past board experience. If you prefer to go with Shane Peterson or Rob Jacobson, we will need to switch out one seasonal name for a Resident. In that case I would recommend keeping Gary Storms to replace Sheldon Poss. Here are some brief thoughts on our top choices: • David Braton - Instrumental in establishing, well connected around the lake. Willing to listen and ask tough questions. • Brian Graftass - Prior involvement in the LLPOA and assisted with LID investigations on behalf of the LLPOA. • David Hilber - Current LLPOA President. Instrumental in establishing, leading groundwork to draft initial bylaws and budget. • Zach Herrmann – LLPOA Treasurer. Instrumental in establishing, engineer who does lake/water work for a living, keen insight into lake issues • Robert Nielson - Past LLPOA President. Wrote original Lake Lida Management Plan. Retired NDSU PhD. • Sheldon Poss – Owns Poss Woodworks in Fargo. He and his wife have been strong supporters of the LLPOA and LID. • Gary Storms – Owns business in Fargo/Moorhead. A former Mayor and member of several boards. Was not in favor of Ad Valorum funding. Please let me know if you have any questions.
