The Otter Tail County Board of Commissioners convened at 8:30 a.m . Tuesday, October 26 , 2021, at the Government Services
Center in Fergus Falls, MN . Commissioners Lee Rogness, Chair; Betty Murphy; Vice Chair, Kurt Mortenson, Wayne Johnson, and
Dan Bucholz were present.
Approval of Agenda
Chair Rogness called for approval of the Board Agenda . Motion by Mortenson, second by Murphy and unanimously carried to
approve the Board of Commissioners' agenda of October 26 , 2021, with the following additions:

Market Price for the Solid Waste Management Tax
Otter Tail County Resolution No. 2021 -162
WHEREAS, the solid waste management tax requires political subdivisions to identify by resolution a market price if the
political subdivision:
Subsidizes the cost of service at a facility; and
WHEREAS, the political subdivision will be liable for the solid waste management tax based only on the market price amount
identified through this resolution; and
WHEREAS, the market price is identified in state statutes as the "lowest price available in the area." WHEREAS , Otter Tail County
has performed research to identify the lowest price available in the area.

THEREFORE, the county of Otter Tail declares a market price of $70 .24 per ton for a facility, based on a tipping fee amount of
$39.60 per ton at the Dakota Landfill and an additional contracted transportationcost of $30.64 per ton .
The motion for the adoption of the foregoing resolution was introduced by Commissioner Murphy, duly seconded by
Commissioner Johnson and, after discussion thereof and upon vote being taken thereon, passed unanimously.

Independent Contractor Agreements
Motion by Johnson, second by Mortenson and unanimously carried to authorize appropriate County Officials' signatures to
execute the following:
Independent Contractor Agreement between Otter Tail County and Rick West to provide assistance to the Economic
Development and Community Investment Team for projects as designated appropriate and necessary by the Deputy County
Administrator. The agreement is effective October 1, 2021, through December 31, 2021 .
Independent Contractor Agreement between Otter Tail County and John Dinsmore to provide assistance to the Board of
Commissioners in developing and implementing a performance evaluation for the County Administrator and Deputy County
Administrators as deemed appropriate. The agreement is effective October 1, 2021 , through December 31, 2021 .
Actuarial Agreement
Motion by Murphy, second by Bucholz and unanimously carried to authorize appropriate County Officials ' signatures to execute
the agreement between Otter Tail County and USI Consulting Group, Inc. (formerly Hildi, Inc.) for actuarial services as identified
in the agreement and the exhibit for a base fee of $4 ,700 for fiscal year 2022 (fee includes the required actuarial report necessary
for compliance with the appropriate GASB Statements).
Sale of County Owned Properties
Motion by Mortenson, second by Johnson and unanimously carried, to accept the bid of Paul Hovland, in the amount of $230 .00,
plus applicable costs as identified in the sale notice, for the purchase of Parcel No . 60000340268001 and as described property
below:
All that tract of land described by metes and bounds as follows, to wit: Beginning at the Southwest Corner of the Southeast
Quarter of the Southeast Quarter (SW corner of SE ¼ of the SE ¼) of Section Thirty-four (34) Township One Hundred Thirty-one
(131) North of Range Forty-two (42) west; thence North along West line of Southeast Quarter of the Southeast Quarter (SE ¼ of

BE IT FURTHER RESOLVED, that the Otter Tail County Board of Commissioners hereby finds that the repurchase is in the best
public interest, and that it will relieve any undue hardship which has result from the forfeiture .

Approval of Government Acquisition/Purchase of Tax Forfeited Land
(Otter Tail County Housing and Redevelopment Authority)

WHEREAS , the following described property forfeited to the State of Minnesota on August 15, 2019, for non-payment of Payable
2013 through 2016, 2018 and 2019 real estate taxes; and

WHEREAS , on Tuesday, June 8, 2021 , the Otter Tail County Board of Commissioners passed Otter Tail County Resolution No.
2021-112 classifying the above property as non-conservation land and noting that the above referenced parcel would be
acquired by the Otter Tail County Housing and Redevelopment Authority for housing ; and
WHEREAS , on Tuesday, October 12, 2021, the Otter Tail County Board of Commissioners passed Otter Tail County Resolution
No . 2021-160 amending the previous resolution for the purpose of adding sub-totals and reappraising an unrelated parcel; and
WHEREAS , on Thursday, April 15, 2021, the Otter Tail County Housing and Redevelopment Authority Board passed Resolution
No . 154 titled "Resolution Authorizing Acquisition of a Tax Forfeited Parcel in Pelican Rapids , Minnesota " authorizing the
Executive Director to proceed with the steps necessary to purchase the above reference property for rehabilitation or
redevelopment; and
WHEREAS, on Thursday, June 17, 2021, the Otter Tail County Housing and Redevelopment Authority Board passed Resolution
No . 161 titled "Resolution Authorizing Acquisition of a Tax Forfeited Parcel in Pelican Rapids, Minnesota ", which reaffirms
Resolution No . 154 and authorize a purchase amount; and
WHEREAS , on Tuesday, July 13 , 2021, the City Council of the City of Pelican Rapids passed a motion approving the classification
of the above referenced parcel as non-conservation land and supporting the Otter Tail County Housing and Redevelopment
Authority's request to purchase this property for a housing project; and
WHEREAS, the Otter Tail County Housing and Redevelopment Authority has broad powers under Minnesota Statutes, Chapter
469 for rehabilitation and /or redevelopment of blighted properties and for providing affordable housing; and
WHEREAS, the Otter Tail County Housing and Redevelopment Authority has cited Sections 469 .007 and 469 .012 as more specific
laws that empower it to acquire the above referenced property for rehabilitation and /or redevelopment of blighted properties
for the purpose of providing affordable housing; and

WHEREAS , on Thursday, April 15, 2021 , the Otter Tail County Housing and Redevelopment Authority staff presented to the Otter
Tail County Housing and Redevelopment Authority Board the following report regarding the above referenced parcel:
In February, the Pelican Rapids City Administrator contacted the Executive Director to evaluate the single-family home at 117
NW 1st Avenue for potential rehabilitation . The home is currently in tax forfeit status and is in general disrepair. The home was
originally built in 1900 and there have been several additions and modifications over time. The land value is $5,850 and the
building value is $14 ,37 8.
An inspection of the home occurred on March 2, 2021, by the Executive Director and county facility operations staff. A second
inspection was conducted on April 6, 2021, by the HRA Project Manager. The home requires significant rehabilitation due to
significant foundation and structural issues, non-compliant electrical and plumbing fixtures, and the necessity for complete
interior remodeling . Essentially the home would need to be reduced to its shell and potentially demolished .
Staff recommends that the HRA acquire this site through the tax forfeit process . If auctioned and purchased by a private party
the City risks a new owner completing minimal improvements and renting /selling a structure that needs significant
rehabilitation. The site is large enough for new construction for an affordable home. The lot is 50 ' wide and 150' long and totals
7,500 square feet . An alley to the rear of the property can serve as access to a garage . 1st Avenue serves the lot at the front of
the property, however there is a significant retaining wall and concrete steps from 1st Avenue to the ground elevation of the lot
and home . The HRA could request the City work with the Fire Department to use the home as a burn training and then partner
with affordable home partners for new construction . The HRA would likely incur asbestos and lead testing inspection costs
prior to demolition as well as other costs. There are sufficient funds in the Tax Levy account to pay for this initial due diligence
of up to $15 ,000 .
The public purpose is to create an updated , code compliant affordable home in partnership with relevant partners. Staff will
prepare a more detailed evaluation for the Board's review at the meeting . The County Board will likely be taking action on this
parcel in April thus the necessity to take action at the meeting . Staff recommends that the Board adopt the attached resolution
authorizing purchase of the tax forfeit parcel through the statutory process.
WHEREAS , the Otter Tail County Housing and Redevelopment Authority has determined after inspections that the cost to
rehabilitate is significant, there is asbestos in several areas of the home, and that it would be in the best interest of the public
to abate the asbestos , demolish the structure and to redevelop this site with a new affordable housing ; and
NOW, THEREFORE, BE IT RESOLVED, that the Otter Tail County Board of Commissioners approves the purchase /acquisition of
the above referenced property by the Otter Tail County Housing and Redevelopment Authority for less than market value,
which will provide the Otter Tail County Housing and Redevelopment Authority with the opportunity to eliminate a structure
not suitable for rehabilitation and to replace that structure with a code compliant affordable housing unit within the City of
Pelican Rapids .
BE IT FURTHER RESOLVED, that the Otter Tail County Board of Commissioners appraises this property at $1 .00 for sale to the
Otter Tail County Housing and Redevelopment Authority noting an estimated cost for asbestos abatement of approximately
$25 ,000 and an estimated cost for demolition, disposal and fill of approximately $17,600 before the costs associated with the
construction of an affordable housing unit; thereby, making it necessary to offer this parcel to the Otter Tail County Housing
and Redevelopment Authority for less than market value as a means to incentivize the Otter Tail County Housing Authority to
undertake this project.
The motion for the adoption of the foregoing resolution was introduced by Commissioner Johnson , duly seconded by
Commissioner Mortenson and, after discussion thereof and upon vote being taken thereon, passed unanimously.

Extension of Final Plat

Motion by Johnson, second by Bucholz and unanimously carried to grant an extension on the filing of a Plat titled "Arvig Acres"
until November 30 , 2022 as recommended by the Land and Resource Director.
Planning Commission Recommendations
Susanne & Douglas Trenda :
Motion by Bucholz, second by Murphy and unanimously carried, with Johnson abstaining, to approve a conditional use permit
application for Susanne and Douglas Trenda to construct a commercial mini-storage unit, remove current house and septic and
cap well. The existing Foltz building will remain. The storage unit will contain 26 units and be 30 ' x 150 ' overall size. The proposal
is located at 51201 US Hwy 59, Section 1 of Dunn Township; Holbrook Lake (56 -578), NE .
Lutheran Brethren Bible Camp:
Motion by Mortenson, second by Murphy and unanimously carried , with Rogness abstaining, to approve a conditional use
permit application for Lutheran Brethren Bible Camp to operate the existing Bible Camp as a year-round resort and event center
for families to enjoy. All 26 existing living areas and cabins will be used and two (2) activity centers will be converted into
lodging. 11 RV sites will be added and the existing lodge will be used as the event center for family reunions, wedding, etc. The
proposal is located at 13207 Inspiration Tr, Section 17 of Leaf Mountain Township; Spitzer Lake (56-160), NE .
Bayview Shores Association I Joa n Knecht:
Motion by Bucholz, second by Murphy and unanimously carried, with Johnson abstaining, to approve a conditional use permit
application for Bayview Shores Association / Joan Knecht to replace their current 14 ' X 70 ' manufactured home with a 14 ' X 70 '
slab on grade stick home (Unit #8). The proposal is located at 20393 S. Pelican Dr., Section 11 of Scambler Township; Pelican
Lake (56-786), GD.
Recess & Reconvene
At 9:10 a.m ., Chair Rogness declared the meeting of the Otter Tail County Board of Commissioners recessed for a short break.
The Board of Commissioners meeting was reconvened at 9:20 a.m .
Probation Agent of the Year
Probation Director Michael Schommer recognized DWI Court Probation Officer Hallie Metcalf as a recipient of the Judiciary
Award : Probation Officer of the Year, by Mothers Against Drunk Driving-Minnesota (MADD). These awards are presented to
honor and thank all for their dedicated services to Minnesota and their communities and for their partnership with MADD's
mission to end drunk driving and drugged driving.
Out of State Travel
Motion by Murphy, second by Mortenson and unanimously carried to authorize the Probation Director and three (3) staff
members to travel to Atlanta, GA, January 30, 2022 -February 2, 2022, to attend the American Probation and Parole Association
(APPA) Winter Institute. Expenses will be covered by the correctional fee account.
Phelps Mill Foundation Repair
Deputy Administrator Nick Leonard shared with the Board that in 2017 , Barr Engineering Co . designed repairs for the Phelps
Mill building foundations and prepared drawings and specifications for bidding and construction . At that time, funding was
not secured to proceed with the foundation repairs . Earlier this fall , Otter Tail County did secure a grant in the amount of
$275 ,500 from the Minnesota Historical Society for the foundation repairs . As a result, the County needs to update the
agreement with Barr Engineering Co . to reflect their involvement and scope of work on the project's foundation repairs .
Motion by Murphy, second by Mortenson and unanimously carried to authorize appropriate County Officials ' signatures to
execute the agreement between Otter Tail County and Barr Engineering Co .
Motion by Johnson, second by Murphy and unanimously carried to authorize a special Board of Commissioners meeting on
November 30, 2021, at the Government Services Center in Fergus Falls , MN at 9:00 a.m . The purpose of this meeting is to award
the bid for the Phelps Mill foundation repair.
Perham to Pelican Rapids Regional Trail -Engineering Amendment
Motion by Johnson, second by Murphy and unanimously carried to approve the amendment to the current fee for engineering
and right of way services by Houston Engineering and WSB as presented by the Deputy County Administrator.

Easement Encroachment Agreement -Perham to Pelican Rapids Trail Acquisition Project -Silent Lake Segment
Motion by Johnson, second by Mortenson and unanimously carried to authorize appropriate County Officials ' signatures to
execute the agreement between Otter Tail County and Great Plains Natural Gas Co . to allow construction of the Perham to
Pelican Rapids Regional Trail -Silent Lake Segment, within the easement area .
Echo Bay Park -Master Plan
Deputy County Administrator Nick Leonard provided a brief update to the Board regarding property that is in the process of
being donated to the county to be developed as a park (Echo Bay Park). He shared a draft of the master plan and anticipates
final adoption on November 9, 2021 .
Public Hearing Regarding Property Tax Abatements
Chair Rogness opened the Public Hearing regarding Property Tax Abatement related to an application for S&Z Properties
requesting tax abatement for parcel number 82000990068000. Community Development Director Amy Baldwin provided a
brief background and shared that the request for abatement is for up to $45,000 .00 or 5 years, whichever is first.
At 10 :07 a.m ., Chair Rogness opened the Public Hearing for comments from the public.
Marcia Huddleston of Vergas, MN spoke in support of the abatement and appreciated any support from the Board .
Commissioner Johnson commented that this addition will be an asset to the community.
The Public Hearing was closed at 10 :10 a.m . and the following resolution was offered :
RESOLUTION APPROVING PROPERTY TAX ABATEMENTS
Otter Tail County Resolution No. 2021 -164
BE IT RESOLVED by the Board of Otter Tail County, Minnesota (the "County"), as follows :
The County proposes to approve tax abatements in connection with the construction of a two story mixed use building with
commercial space and residential rent units (the "Project"). The County proposes to use the abatement for the Project provided
for in Minnesota Statutes, Sections 469 .1812 through 469 .1815 (the "Abatement Law"), from the property taxes to be levied by
the County on Parcel Identification Number 82000990068000 (the "Tax Abatement Property").
(a) On this date, the Board held a public hearing on the question of the Abatement, (as defined below) and said hearing
was preceded by at least 10 days but not more than 30 days prior published notice thereof at which all interested
persons appeared and were heard .
(b) The County proposes to approve tax abatements on a portion of the County's share of property taxes on the Tax
Abatement Property in the amount of $45,000 for a term of up to 5 years to finance a portion of the costs of the Project.
(c) The Abatement is authorized under the Abatement Law .
2. Findings for the Abatement. The Board hereby makes the following findings :
(a) The tax abatement is the County's share of real estate taxes which relate to the Project being constructed on the Tax
Abatement Property and not the real estate taxes that relate to the value of the land (the "Abatement").
(b) The Board expects the benefits to the County of the Abatement to be at least equal or exceed the costs to the County
thereof.
(c) Granting the Abatement is in the public interest because it will increase the tax base in County.
(d) The Tax Abatement Property is not located in a tax increment financing district.

(e) In any year, the total amount of property taxes abated by the County by this and other resolutions and agreements,
does not exceed the greater of ten percent (10 %) of the net tax capacity of the County for the taxes payable year to
which the abatement applies or $200,000, whichever is greater. The County may grant other abatements permitted
under the Abatement Law after the date of this resolution, provided that to the extent the total abatements in any
year exceed the Abatement Limit the allocation of the Abatement limit to such other abatements is subordinate to
the Abatement granted by this resolution.

Speed Zone Study Request
Segment of CSAH 35 Near Dead Lake
Otter Tail County Resolution No. 2021 -165
WHEREAS , residents have requested Otter Tail County take such action as may be necessary in order to pursue a reduced speed
limit on the segment of County State Aid Highway No. 35 from 37852 Co Hwy 35 to Yaquina Bay Road ; and
WHEREAS , Otter Tail County believes that a speed zone study on a segment of CSAH 35 would be beneficial in this area; and
NOW, THEREFORE , BE IT RESOLVED , that Otter Tail County does hereby request that this area of CSAH 35 be studied by the
Minnesota Department ofTransportation to determine the need for a revised speed zone or zones, if any.
BE IT ALSO RESOLVED, that Minnesota Department of Transportation proceed with establishing a legal speed zone if the
findings of the traffic study are supportive.

execute the Cooperative Construction Agreement between Otter Tail County, City of Wadena and Tri-County Hospital for the
Construction ofTH 10, Wadena CSAH 92 and Otter Tail County CSAH 92 in the City of Wadena.

2021 Permanency and Adoption Report
Human Services Staff provided a brief overview of their role in permanency and adoption and discussed areas that are going
well as well as opportunities for growth. They recognized the weight of the decision to become permanent caregivers and strive
to support and honor this decision by making the permanency process as smooth as possible for the families.
November Adoption Month
Otter Tail County Resolution No. 2021 -163
WHEREAS, adopting a child is a great joy and a great responsibility. The family, serving as teachers can help children learn
character and values, the importance of giving back to their community, and the courage to realize their potential; and
WHEREAS, during Adoption Awareness Month, we honor adoptive and foster parents for giving children a second chance at
happiness; a chance to love and be loved and to reach their full potential in a secure, supportive environment; and
WHEREAS, there are currently approximately 120,000 children nationwide, and more than 700 in Minnesota waiting for an
adoptive family; and
WHEREAS, the majority of the families seeking children for adoption are pursuing the adoption of younger children. Of the
children waiting to be adopted in the State of Minnesota, 64% are children of non-Caucasian background and 46% are
children between the ages of 12 -18 years old; and of the children waiting to be adopted 57% are siblings who need to be
adopted together. Of the children waiting to be adopted, 65% have a documented special need, including physical, mental,
emotional or a behavioral disability; and
WHEREAS, there is a continued need for an increased number of families in the State of Minnesota and in Otter Tail County
who will adopt older children with special needs; and
WHEREAS, both the public and private sectors are working together to encourage our friends and neighbors to open their
hearts and homes to the children and youth throughout the Counties and the State of Minnesota who are still waiting for
their forever families.
NOW, THEREFORE, we, The Otter Tail County Human Services Board, by virtue of the authority vested in us as County
Commissioners of Otter Tail County, do hereby proclaim November as Adoption Month in Otter Tail County. In honor of this
event, we encourage community agencies, religious organizations, businesses and others to celebrate adoption, honor
families that grow through adoption, further an awareness of the changes and issues in adoption and focus attention on
those children who live in the shadow of an uncertain future while they await permanent families.

Human Services 2021 Quarterly Budget Report
Human Services Director Deb Sjostrom provided a brief overview of the Human Services 2021 quarterly budget and shared that
the numbers for 2021 are relatively close to 2020.
Senior Care Impacts
Various local long-term health care leaders shared similar impact stories with the Board regarding staff shortages, suspending
local hospice services, turning away requests for admissions and facing challenges in using solutions posed by the state
agencies. Motion by Johnson, second by Mortenson and unanimously carried, with Rogness abstaining, to offer support to
healthcare partners by authorizing Administration to reach out to the state to recognize this crisis and find short and long-term
solutions.

At 12:11 p.m., Chair Rogness declared the Otter Tail County Board of Commissioners meeting adjourned. The next regular
Board meeting is scheduled at 8 :30 a.m . on Tuesday, November 9, 2021, at the Government Services Center in Fergus
