Tuesday, October 12 , 2021 , at the Government Services Center in Fergus Falls, MN . Commiss ioners Lee Rogness, Chair; Kurt Mortenson, Wayne Johnson, and Dan Bucholz were present in the room. Commissioner Betty Murphy; Vice Chai r was present via Web Ex and is not participating in the vote pursuant to MN statute 13D, specifically related to notice requirements for appearing by interactive means. Approval of Agenda Chair Rogness called for approval of the Board Agenda . Life Insurance & Long-Term Disability Request for Proposal (Rf Pl Benefits Administrator Ryan Black reviewed the RFP bidding process with a recommendation from the Benefits Committee that the county remains with Sun Life Financial for long-term disability and life insurance plans for county employees. This position will be supported through federal and COVID- 19 grant funds and is also included in the 2022 budget. Otter Tail Water Management District (OTWMDl Subsurface Sewage Treatment Systems (SSTSl Loan Participation Contract Update Land and Resource Director Chris Leclair provided a brief update to the Board regarding the SSTS Contract with the OTWMD . He discussed objections by the OTWMD as identified in the memo received by the County Attorney and requested direction from the Board as to how they wish to respond . Motion by Mortenson, second by Bucholz and unanimously carried, with Johnson abstaining, to object to the terms as identified and keep the current proposed contract that was adopted by the Board on August 24, 2021 . Phelps Mill Foundation Repair Deputy County Administrator Nick Leonard provided a brief update to the Board regarding repairs to the Phelps Mill foundation. He shared that Otter Tail County received a grant from the Minnesota Historical Society in the amount of $275 ,500 .00 , with a required county match, and anticipates opening bids on November 2, 2021 and awarding bids on November 9, 2021. Completion of the project is planned for May 2022. Contracts & Bonds -Perham to Pelican Rapids Regional Trail. Silent Lake Segment Project No. #4002-401 Motion by Johnson , second by Mortenson and unanimously carried to authorize appropriate County Officials ' signatures to execute the contract between Otter Tail County and Riley Bros. Construction , Inc. for Project No. 4002-401 . Limited Use Permit Resolution Otter Tail County Resolution No. 2021 -161 IT IS RESOLVED that Otter Tail County enter into Limited Use Permit No . 5617-0054 with the State of Minnesota, Department of Transportation for the following purposes : To provide for maintenance and use by the County of Otter Tail upon, along and adjacent to Trunk Highway No . 59 the limits of which are defined in said limited Use Permit. OTTER TAIL COUNTY SHERIFF'S OFFICE RESOLUTION AUTHORIZING EXECUTION OF AGREEMENT Otter Tail County Resolution No. 2021 -145 Be it resolved that the Otter Tail County Sheriff's Office enter into a grant agreement with the Minnesota Department of Public Safety, for traffic safety enforcement projects during the period from October 1 't, 2021 through September 30, 2022 . The Otter Tail County Sheriff's Office is hereby authorized to execute such agreements and amendments as are necessary to implement the project on behalf of the Otter Tail County Sheriff's Office and to be the fiscal agent and administer the grant. Recess & Reconvene At 9:41 a.m ., Chair Rogness declared the meeting of the Otter Tail County Board of Commissioners recessed for a short break. The Board of Commissioners meeting was reconvened at 9:55 a.m . Request for Public Hearing -Tax Abatement Requests Motion by Johnson, second by Mortenson and unanimously carried to authorize a public hearing regarding an application for S&Z Properties requesting ta x abatement for parcel number 82000990068000 on October 26, 2021, at 10 :00 a.m. at the Government Services Center in Fergus Falls . The project aligns with the priorities found within the Economic Development Tax Abatement Policy and the request for abatement is for up to $45 ,000.00 or 5 years, whichever is first. RESOLUTION AUTHORIZING EXECUTION OF A TAX ABATEMENT AND DEVELOPMENT AGREEMENT Otter Tail County Resolution No. 2021 -146 A. WHEREAS , East Silent Resort, LLC, a Minnesota limited liability company (the "Company") have requested the County to assist with the relocation and rehabilitation of six existing cabins to another area of the resort outside of the shore impact zone; construction of seven new vacation homes; and expansion of lodge facility, and to grant an abatement to the Company of property taxes to be levied by the County on Parcel Identification Numbers 16000330184001 and 16000991082000 in the County (the "Project"); and B. WHEREAS , the Company and the County have determined to enter into a Tax Abatement and Development Agreement (the "Agreement") providing for assistance in connection with the Project. NOW , THEREFORE, BE IT RESOLVED by the Otter Tail County Board of Commissioners, as follows: 1. The County hereby approves the Agreement in substantially the form submitted , and the Board Chair and Clerk are hereby authorized and directed to execute the Agreement on behalf of the County. 2. The approval hereby given to the Agreement includes approval of such additional details therein as may be necessary and appropriate and such modifications thereof, deletions therefrom and additions thereto as may be necessary and appropriate and approved by the County officials authorized by this resolution to execute the Agreement. The execution of the Agreement by the appropriate officer or officers of the County shall be conclusive evidence of the approval of the Agreement in accordance with the terms hereof. Community Development Director Amy Baldwin presented 13 parcels throughout Otter Tail County that have applied and qualified for the abatement. At 10 :03 a.m ., Chair Rogness opened the Public Hearing for comments from the public and no comments were received . The Public Hearing was closed at 10 :03 a.m . and the resolutions found in Exhibit B were offered . COVID-19 Update Public Health Director Jody Lien provided a brief update to the Board regarding COVID-19 and reported an increase in cases across the state and locally. She reviewed current CDC and MOH guidance and current local data and expressed concerns regarding the impact in younger aged groups. Assistant Public Health Director Kristi Wentworth reviewed vaccine data and discussed local impacts as cases and the need for testing increase . She discussed testing opportunities and treatment if experiencing COVID-19 symptoms and is working with school districts to offer mitigation guidance and prevent measure strategies . Ms . Lien reiterated the importance of following public health prevention measures and encourages the public to consult with their healthcare provider and get vaccinated . COVID-19 Mitigation Strategies County Administrator Nicole Hansen shared a memo with the Board that is addressed to employees to provide status information regarding the increasing COVID-19 numbers and highlight mitigation strategies that are necessary to follow over at least the next several weeks . She reiterated the importance of following public health prevention measures and mitigation strategies as these efforts are a course of safety for employees . Adjournment At 11 :19 a.m., Chair Rogness declared the Otter Tail County Board of Commissioners meeting adjourned for a closed session to discuss labor negotiations . The closed session is authorized under M.S . 13D .03 . Present were Commissioners Lee Rogness, Betty Murphy (via webex), Wayne Johnson, Kurt Mortenson, Dan Bucholz, County Attorney Michelle Eldien, County Administrator Nicole Hansen, County Board Secretary Tara Bakken , Attorney Josh Heggem, and Human Resources Professional Stephanie Retzlaff.
