Commissioners Lee Rogness, Chair; Betty Murphy; Vice Chair, Kurt Mortenson, Wayne Johnson, and Dan Bucholz were present. The meeting was held via Webex and was available to the public via livestream due to the health pandemic and declared emergency in accordance with Minn . Stat. Sec. 13D.021 Subd . 1 (1 ). Approval of Agenda Chair Rogness called for approval of the Board Agenda . Motion by Mortenson, second by Johnson and unanimously carried to approve the Board of Commissioners ' agenda of May 25 , 2021, with the following additions : Red River Basin LiDar Data Acquisition Water Patrol Wages Grant Consent Agenda Motion by Johnson, second by Mortenson and unanimously carried to approve the consent agenda items as follows : 1. Approval of the issuance of an On-Sale Liquor License and Sunday Liquor License to H&K Industries LLC dba The Cactus for the period of July 1, 2021 to June 30 , 2022 Tax Forfeited Properties County Auditor-Treasurer Wayne Stein shared that interest was expressed in obtaining three (3) separate tax forfeited parcels . The parcels are located in the City of New York Mills, City of Pelican Rapids and Dunn Township on Midland Beach . Commissioners were encouraged to view the properties and determine a value and Mr. Stein plans to request to offer the parcels up for sale at a future date. Page 1 of 6 Board of Commissioners' Meeting Minutes May 25 , 2021 RESOLUTION DIRECTING STAFF TO DEVELOP COST ESTIMATES FOR CAPITAL IMPROVEMENTS Otter Tail County Resolution No. 2021 -78 WHEREAS , Otter Tail County has completed a facility space analysis and long-range master plan; and WHEREAS , the master plan includes high level cost estimates and phased options based on provided criteria as well as feedback from employees and the County Board; and WHEREAS , soliciting estimates, detailed design and bid specifications are a necessary and logical next step; and NOW THEREFORE BE IT RESOLVED THAT, the Otter Tail County Board of Commissioners direct staff to solicit bids for the following capital projects: Courthouse Courthouse GSC GSC GSC GSC GSC Ottertail Ops Justice Building Highway Highway Courthouse Tuckpointing Security Drop Ceiling Sealcoating Parking Lot Chiller Overhaul 250 Feet of Sidewalk SE Side New Roof -Adm in /Otter Tail Lake Room Caulk Windows Gas Boiler Upgrade 3 Air Handlers Salt Shed Roofs (NYM /BL) Cold Mix Shed BE IT FURTHER RESOLVED THAT, the Otter Tail County Board of Commissioners direct staff to hire the appropriate consultant to develop detailed design plans, cost estimates, and bid documents for the following capital projects based on the facility long- range master plan : 505 (Highway) GSC Courthouse Highway Main Level Conference Room and Lower-Level CDA /HRA Office Space License Center/Land and Resource Probation Battle Lake Garage The motion for the adoption of the foregoing resolution was introduced by Commissioner Johnson, duly seconded by Commissioner Murphy and , after discussion thereof and upon vote being taken thereon, passed unanimously. Page 2 of 6 Board of Commissioners' Meeting Minutes May 25 , 2021 Planning Commission Recommendations Preliminary Plat "Crystal Point" -Beaton Family Trust: Motion by Johnson, second by Mortenson and unanimously carried to approve a Preliminary Plat titled "Crystal Point", which conditions as recommended by Planning Commission , consisting of 9 single family residential riparian lots, 1 single family non- riparian residential lot, 1 Block; and a Conditional Use Permit Application connecting a road from Crystal Beach Road to create 9 riparian lots and a backlot for the plat of the preliminary Crystal Point. The proposed improvements will include the extension of Crystal Beach Road for 1,550 feet. Total Earth Work Yardage 3,681 Cubic Yards and Total Import Yardage 492 Cubic Yards . Please see design on file at Land & Resource Management. The proposal is located at 26140 460th St., Section 3 of Lida Township; Crystal Lake (56-749) RD . Conditional Use Permit "Maple Shores " -Joshua Hanson: Motion by Johnson, second by Murphy and unanimously carried to approve a Conditional Use Permit Application converting a commercial PUD to a residential PUD ; Existing dwelling units at 12, no change proposed , will retain 12 dwelling units. The motion included a condition that the dock system be centralized to the best of their ability or 50 feet from the riparian lot line. The proposal is located at 31026 Co . Rd . 4, Section 3, Dora Township; Loon Lake (56-523), RD . Conditional Use Permit -Lyndon & Kimberly Johnson: Motion by Johnson, second by Mortenson and unanimously carried to approve a Conditional Use Permit Application to build a 64 x 168 cold storage building next to existing cold storage buildings. Need permission for using as a commercial use (storage). No additional signs . No additional lights. The proposal is located at 47628 East Lake Lizzie Rd , Section 28 of Dunn Township; Lake Lizzie (56-760), RD . William & Jasmine MacFarlane: Motion by Johnson, second by Bucholz and unanimously carried to approve a Conditional Use Permit Application requesting a permit to create an access path on their property to safely get from the upper portion of their yard , down the bluff to the lower yard . The proposal is located adjacent to 23558 Lida Dr, Section 20 of Lida Township; Lake Lida (56-747), GD . Shoreland Management Ordinance Motion by Johnson, second by Mortenson and unanimously carried to consider adopting the Shoreland Management Ordinance at its regularly scheduled meeting on June 22 , 2021, at 10 :30 a.m., at the Government Services Center in Fergus Falls . Highway Items Contracts & Bonds -2021 County Wide Crack Sealing Proiect: Motion by Johnson, second by Mortenson and unanimously carried to authorize appropriate County Officials' signatures to execute the agreement between Otter Tail County and MP Asphalt Maintenance, LLC for the 2021 county wide crack sealing project. Otter Tail County Winter Maintenance Study: Motion by Mortenson, second by Bucholz and unanimously carried to authorize appropriate County Officials' signatures to execute the agreement between Otter Tail County and SRF Consulting Group, Inc., for professional services for a county highway operations study. Otter Tail County Fall Auction: Motion by Murphy, second by Mortenson to authorize appropriate County Officials' signatures to execute the contract between Otter Tail County and BidOnward .com Auctioneers for the public on line auction of used county assets. Motion by Johnson, second by Bucholz and unanimously carried to table the motion to execute the contract with BidOnward.com Auctioneers until June 8, 2021 to allow the County Engineer to research other venues for public on line auction . Pavement & Geotechnical Evaluation Agreements: Motion by Johnson , second by Bucholz and unanimously carried to authorize appropriate County Officials' signatures to execute four (4) agreements between Otter Tail County and Braun lntertec for the pavement and geotechnical evaluation for the following projects : S.A.P . 056-635-043, CSAH 35 Recondition Project, S.A.P. 056-651-021 , CSAH 51 Recondition Project, S.A.P . 056-658-005, CSAH 58 Recondition Project, and S.A.P . 056-660-013, CSAH 60 Recondition Project. Page 3 of 6 Board of Commissioners' Meeting Minutes May 25, 2021 RESOLUTION REVOKING COUNTY STATE AID HIGHWAY Otter Tail County Resolution No. 2021 -79 WHEREAS, it appears to the Otter Tail County Board of Commissioners that the highway hereinafter described should be revoked as a County Aid State Highway under the provisions of Minnesota Law, WHEREAS, the County of Otter Tail and the City of Parkers Prairie are jointly pursuing the reconstruction of County Aid State Highway No. 95 under project S.A.P. 056-695-002, WHEREAS, the County of Otter Tail agrees to fund the County's share of the reconstruction project's cost through Wheelage Tax Revenue for County State Aid Highway No. 95. NOW THEREFORE, BE IT RESOLVED, by the Otter Tail County Board of Commissioners that the road described as follows, to-wit: County State Aid Highway No. 95: From the intersection of Minnesota Trunk Highway 29 (Otter Avenue) and East Colfax Street in the City of Parkers Prairie then east on East Colfax Street to the intersection of East Colfax Street and South Douglas Avenue then north on South Douglas Avenue to the intersection of South Douglas Avenue and CSAH 42 (Soo Street) a distance of0.14 miles. Be , and hereby is revoked as a County State Aid Highway of said County, subject to the approval of the Commissioner of Transportation of the State of Minnesota . BE IT FURTHER RESOLVED, that the County Board Clerk is hereby authorized and directed to forward two certified copies of this resolution to the Commissioner ofTransportation for consideration of revocation of said road or portion thereof. Rick West Retirement MCEA Proclamation President of the County Engineers Association Brian Giese recognized Public Works Director Rick West for his years of service with Otter Tail County and the Minnesota County Engineers Association. He presented a proclamation to Mr. West and proclaimed Tuesday, May 25, 2021, as Richard K. West Day. In Recognition of Rick West's Public Service as Otter Tail County Public Works Director Otter Tail County Resolution No. 2021 -80 The following resolution was offered by Commissioner Johnson, who moved to recognize and honor the public service of Rick West: Whereas, Rick was appointed the County Engineer for Otter Tail County on November 5, 1990, and served in that role until April 30, 2018; and Whereas, Rick has served as the Public Works Director since April 17, 2012; and Page 4 of 6 • • • • • Board of Commissioners' Meeting Minutes May 25 , 2021 Whereas, prior to working for Otter Tail County, Rick served the public in Hubbard County, MN , and Mercer County, ND, as the County Engineer, worked as a consulting engineer for Interstate Engineering, and , as an engineering technician, testing concrete and soil conditions for the Anti-Ballistic Missile System in North Dakota; and Whereas, for over 40 years, Rick has responsibly administered long range planning and developing, project evaluation, safety assessment, and overall improvement of roads; and Whereas, Rick 's accomplishments include, but are not limited to, the following : David P. Brand Safety Award : Presented to only those who demonstrate the highest standards in public safety over their career. 2016 National Association of County Engineers (NACE) Rural County Engineer of the Year 2017 Minnesota Towards Zero Death Star Awards Leading development of the long-range Otter Tail County Transportation Plan which included working collaboratively with partners such as cities, townships, and Mn DOT to plan for and maintain over 1,700 miles of paved roads in the County. Outstanding public service and commitment to residents and visitors through thoughtful leadership earning the respect of county officials, colleagues, citizens, and engineers both state and nationwide. Whereas, Rick has championed local road safety at the local, regional , state and national levels, is recognized for his efforts to raise awareness to keep citizens and road crews safe, and provided skilled leadership, making those he engages feel valued and important. THEREFORE, BE IT RESOLVED THAT: Otter Tail County Board of Commissioners recognizes the many years of professional service , leadership, and commitment provided by Rick, and we express our utmost gratitude and appreciation for his many years of dedicated public service to the residents of Otter Tail County and the State of Minnesota . The motion was duly seconded by Commissioner Murphy and , after discussion and commendation thereof, and upon vote being taken thereon, the resolution was adopted unanimously. The Board of Commissioners meeting was reconvened at 10:18 a.m . Red River Watershed Li Dar Data Collection Commissioners received notice from the Red River Watershed Management Board they that plan to proceed with a LiDar data collection for its member watershed districts. Public Works Director Rick West plans to request GIS Lead Developer George Meyer to research further and provide the Board with more information at the June 8, 2021 Board of Commissioners meeting . Boat and Water Safety Grant Motion by Johnson , second by Mortenson and unanimously carried to authorize appropriate County Officials' signatures to the execute the 2021 State of Minnesota Annual County Boat and Water Safety Grant Contract Agreement to accept funds in the amount of $44,591 .00 (Project ID R29G70CGBLA 19) to assist with Water Patrol wages . U.S. Fish & Wildlife Service Tour Commissioners plan to participate in a tour with the U.S . Fish & Wildlife Service on August 17, 2021 and requested staff to coordinate with East and West Otter Tail County SWCD's to arrange to meet with them in the afternoon . Ditch 45 Redetermination Order Motion by Johnson, second by Murphy and unanimously carried to authorize appropriate County Officials' signatures on the Redetermination Order for Ditch 45 as presented by the County Attorney. Page 5 of 6 Board of Commissioners' Meeting Minutes May 25 , 2021 Tax Abatement Policy Modifications Community Development Director Amy Baldwin provided a brief overview of the changes to the Tax Abatement Policy and provided a red line version in the supporting documents. The policy supports various areas of development and growth throughout the county and the changes were reviewed and recommended by the Community Development Agency (CDA) to align with the priorities of the county and reflect the policy of the CDA . Motion by Mortenson, second by Bucholz and unanimously carried to approve the modified Tax Abatement Policy as presented by the Community Development Director. Request For Public Hearing Community Development Director Amy Baldwin presented an application for tax abatement from Summers Holdings, LLC, a commercial business looking to build in the City of Vergas . The abatement would follow the same guidelines as the Single- Family Tax Abatement Program and the City of Vergas also plans to participate in the abatement program for this application. Motion by Johnson, second by Bucholz and unanimously carried to authorize a Public Hearing regarding a request for tax abatement for Summers Holdings, LLC on June 8, 2021 at 10 :10 a.m . at the Government Services Center in Fergus Falls , MN . Business Community Community Development Director Amy Baldwin reported that she has been monitoring legislative conversations regarding budgets and potential additional business supports. Half of the allocations from the American Rescue Plan have been received and discussions on how to best invest the dollars have begun and recommendations will be brought to the Board at a later date. Countywide Emergency Operations Center (EOCl Emergency Management Director Patrick Waletzko briefed the Board regarding operations of the Countywide Emergency Operations Center (EOC) and shared that they continue to demobilize and move into a recovery phase . He recognized that the county continues to operate under Resolution No . 2020-27 (Local Emergency Declaration) and plans to bring a recommendation to the Board to rescind the declaration end of June beginning of July 2021 . Public Health Department Operations Center Public Health Director Jody Lien reported that Minnesota has approximately 599 ,234 lab confirmed cases and 7,370 lab confirmed deaths. Otter Tail County has 5,803 lab confirmed cases of COVID-19 and 78 COVID-19 related deaths, of which 35 were long term care related . She reported a steady decrease in cases but recognized that Otter Tail County is still at a higher rate of circulation . Ms . Lien reiterated the importance of prevention measures and vaccination and expressed concerns regarding the impacts on younger age groups. Assistant Public Health Director Kristi Wentworth reviewed data related to COVID-19 vaccine distribution and continues to focus on promoting and educating those who remain hesitant to receive the vaccine . The Public Health Department Operations Centers plans to fully demobilize by July 1, 2021 and is working to incorporate response efforts in their day-to-day work. County Operations County Administrator Nicole Hansen reported that the county is operating in alignment with the Governor's Order regarding masking and discussed extending the Emergency Paid Sick Leave until June 30, 2021 to support staff as the school year comes to an end . She anticipates the Emergency Paid Sick Leave along with several policies created due to COVID-19 will end when the Emergency Declaration is rescinded . Board of Commissioner meetings are planned to be open to the public once restrictions end on May 28 th and will continue to be available for viewing via livestream.
