Call to Order
The Otter Tail County Board of Commissioners convened at 8:32 a.m . Tuesday, March 9, 2021 at the Government Services Center
in Fergus Falls , MN . Commissioners Lee Rogness, Chair; Wayne Johnson, Kurt Mortenson and Dan Bucholz were present in the
room. Commissioner Betty Murphy was absent. The meeting was held via Webex and was available to the public via livestream
due to the health pandemic and declared emergency in accordance with Minn. Stat . Sec. 13D.021 Subd . 1 (1 ).
Approval of Agenda
Chair Rogness called for approval of the Board Agenda . Motion by Johnson, second by Mortenson and unanimously carried to
approve the Board of Commissioners' agenda of March 9, 2021 with the following modifications.
Addition : Approval of a seasonal liquor license
Addition : Approval of a charitable gambling permit
Addition: Legislative Update
Remove : LMHC appointment
Remove : Economic Development District Nomination
Consent Agenda
Motion by Mortenson, second by Bucholz and unanimously carried to approve the consent agenda items as follows:
1. February 23, 2021 Board of Commissioners ' Meeting Minutes
2. Warrants /Bills for March 9, 2021 (Exhibit A)
3. Human Services & Public Health Warrants/Bills for March 9, 2021 (Exhibit A)
4 . 2021 Human Services Contract Renewals
5. Approval of a Seasonal On-Sale Liquor License for Fair Hills
2021 Probation Comprehensive Plan
Probation Director Michael Schommer provided a high-level overview of the 2021 Comprehensive Plan for the Probation
Department. The mission and vision of the plan is to enhance public safety and sustain long-term behavior change of those
entrusted to the department's supervision by applying evidence-based practices and being a leader in community supervision.
He expressed concerns regarding the projections of revenue and potential budget shortfalls but is optimistic adjustments can
be made to the current budget to accommodate.
County Ag Plastic Recycling Inter Service Agreements
Motion by Bucholz, second by Mortenson and unanimously carried to authorize appropriate County Officials' signatures on the
agreements between Todd and Otter Tail Counties and Wadena and Otter Tail Counties as it relates to the film plastic collection
program.
Prometheus Motorcycle Club Zoo Run
Motion by Johnson, second by Mortenson and unanimously carried to waive the Otter Tail County Exhibition and Shows
Ordinance for the Prometheus Motorcycle Club's 36 th Annual Zoo Run event scheduled for June 2021 . This approval is subject
to organizers following current public health guidelines and executive orders and providing security, adequate portable
facilities, insurance, and notification to law enforcement regarding the event which has been past practice . All proceeds from
the event are donated to the Chahinkapa Park Zoo in Wahpeton, ND .

Charitable Gambling Permits

Motion by Bucholz, second by Mortenson and unanimously carried to approve the conduct of Charitable Gambling under
Exempt Permit X-03648-20-020, by the East Ottertail MDHA Chapter on Saturday, April 10, 2021 at Playtime Sports Bar & Grill,
which is located at 43974 390th St. in Rush Lake Township. The permit was originally issued in 2020 for an event that was
postponed due to COVID-19 and will be honored by the Minnesota Gambling Control Board.
Motion by Bucholz, second by Mortenson and unanimously carried to approve the conduct of Charitable Gambling under
Exempt Permit X-04982-20-012, by the Finn Creek Open Air Museum on August 22, 2021 at the Finn Creek Air Museum, which
is located at 55422 340 th St. in Deer Creek Township . The permit was originally issued in 2020 for an event that was postponed
due to COVID-19 and will be honored by the Minnesota Gambling Control Board .
Seasonal On -Sale Liquor License
Motion by Mortenson, second by Bucholz and unanimously carried to approve the issuance of an on-sale six (6) month seasonal
liquor license to Hillside Beach Holdings, LLC dba Elks Point Bar and Grill.
Tax Increment Financing District -City of Perham
Motion by Johnson , second by Bucholz and unanimously carried to acknowledge the receipt of a letter from the City of Perham
dated March 1, 2021 regarding modifications to the development program for District No. 2, to establish Tax Increment
Financing (TIF) District No . 43 and removal of parcels from TIF Districts 2-24 and 2-29 . The proposed Tax Increment District
would be a housing district.
Phelps Mill County Park 2021 Fee Schedule
Deputy Administrator Nick Leonard reviewed the changes to the Phelp Mill County Park Fee Schedule with the intent to be
open in 2021 as COVID-19 restrictions allow . The changes will allow to the park to open safely and help ensure larger groups to
comply with their use permit.
Motion by Johnson, second by Mortenson and unanimously carried to approve the Phelps Mill County Park 2021 Fee Schedule
as presented . The fee schedule can be found on the Otter Tail County website and is effective April 1, 2021 .
West Central Initiative Board Member Nomination
Wayne Johnson informed the Board that he has reached his six (6) year term limit on the West Central Initiative Board and that
his seat will need to be filled by another Commissioner. The Board plans to nominate a Commissioner at a later date when all
Commissioners are present.
Legislative Update
Deputy Administrator Nick Leonard provided a brief update to the Board regarding Legislation . He reviewed focus areas and is
monitoring the implications of the new Federal stimulus bill for local units of government. Otter Tail County is schedule to host
the 2021 Minnesota Governor's Fishing Opener May 13 th -15 th and Mr. Leonard is hopeful the event will continue to move
forward , with the understanding there will be restrictions due to COVID-19.
Lead for Minnesota Fellowship Host Agreement
Community De v elopment Director Amy Baldwin informed the Board of a fellowship program offered by the Lead for America
organization. The program selects, trains and places leaders in high leverage roles and works closely to create a project scope
that tackles a major challenge facing the community. Ms . Baldwin requested that Otter Tail County take the opportunity to be
a host and dedicate the efforts toward broadband development.
Motion by Johnson, second by Mortenson and unanimously carried to authorize appropriate County Official 's signatures on
the agreement between Otter Tai County and National Lead for America, Inc. The two (2) year agreement is effective August 1,
2021 and broadband funds will be re-leveraged from the CARES funding to assist with costs .
Countywide Emergency Operations Center (EOCl
Emergency Management Director Patrick Waletzko briefed the Board regarding operations of the Countywide Emergency
Operations Center (EOC) and recognized that March 17 th will mark one (1) year since a local emergency was declared . He
announced that the Smart911 emergency alert system will be used to notify subscribers and new users of vaccine updates to
ensure information regarding eligibility and availability is reaching all residents . The public can subscribe by texting
"COVIDOTC " to 67283 or by logging into their account and selecting "COVID Updates" on the alerts tab .

Public Health Department Operations Center
Public Health Director Jody Lien reported that Minnesota has 490,483 lab confirmed cases and 6,556 lab confirmed deaths.
Otter Tail County has 4,883 lab confirmed cases of COVID-19, of which 4,823 are no longer contagious, and 71 COVID-19 related
deaths. For more detailed information regarding Otter Tail County COVID-19 data, visit https://ottertailcountymn .us/content-
page/covid-19-health-information/. She reflected on the past year since the first COVID-19 case was reported on March 6, 2020
and reiterated the importance of masking , social distancing and practicing public health measures as cases increase slightly in
Otter Tail County. Ms. Lien recognized other variances of the virus that are circulating in Minnesota and reviewed data related
to the distribution of the COVID-19 vaccine . As eligibility for the vaccine expands, the Public Health Department Operations
Center is focused on messaging and utilizing all platforms to outreach to eligible groups .
Business Community
Community Development Director Amy Baldwin provided a brief update to the Board regarding the business community and
reported that the Community Development Agency continues to work through applications for the recent COVID-19 relief
funding and plan to finalize awards by Monday, March 15 th• Ms. Baldwin plans to assist businesses in connecting with vaccine
resources as eligibility expands to the next phase and will continue to monitor the federal relief and how it may further assist
with the pandemic.
Internal Operations and County Planning
County Administrator Nicole Hansen provided a brief update to the Board regarding internal operations and county planning .
County services remain stable, and employees continue to comply with precautions within the workplace to help mitigate the
spread of the virus .

At 11 :29 a.m ., Chair Rogness declared the meeting of the Otter Tail County Board of Commissioners recessed for a short break.
The Board of Commissioners meeting was reconvened at 11 :36 a.m .
RESOLUTION
BRIDGE REPLACEMENTS 2021 -2025
Otter Tail County Resolution No. 2021 -48
Motion by Johnson, second by Mortenson and unanimously carried to adopt the following resolution :
WHEREAS , Otter Tail County has determined that the following deficient bridges on the CSAH, County Road , Township and
City systems require replacement or rehabilitation within the next five (5) years as listed in our 2021-2025 Highway and Bridge
Improvement Plan approved by the Otter Tail County Board of Commissioners on October 22, 2019; and
WHEREAS , Bridge Number 56527 on CSAH 41 over the Star Lake Channel has been included in the list due to criminal activity
that has caused the need for replacement; and
WHEREAS , the list of the proposed bridge replacements for the 2021-2025 Bridge Replacement Program is in Exhibit C; and
WHEREAS , sufficient local funds for the replacement or rehabilitation of these bridges are not and will not be available, so that
funding assistance from State Transportation Bonds is necessary for the County, Townships and Cities to proceed; and
WHEREAS , Otter Tail County intends to proceed with replacement or rehabilitation of these bridges as soon as possible when
State Transportation Bond Funds are available.
BE IT RESOLVED, that Otter Tail County commits that it will proceed with the design and contract documents for these bridges
immediately after being notified that funds are available in order to permit construction to take place within one year of
notification.

Transfer Station Attendant
Motion by Johnson, second by Bucholz and unanimously carried to approve a 0.25 full-time equivalent (FTE) Transfer Station
Attendant in the Solid Waste Department. This position is included in the 2021 budget and will assist with the increased
workload and maintain staff levels.

OTTER TAIL COUNTY SHERIFF'S OFFICE
RESOLUTION AUTHORIZING EXECUTION OF AGREEMENT
Otter Tail County Resolution No. 2021 -50
Be it resolved that the Otter Tail County Sheriff's Office enter into a grant agreement with the Minnesota Department of Public
Safety, for traffic safety enforcement projects during the period from February 15th, 2021 through September 30 , 2021.
The Otter Tail County Sheriff's Office is hereby authorized to execute such agreements and amendments as are necessary to
implement the project on behalf of the Otter Tail County Sheriff's Office and to be the fiscal agent and administer the grant.
The motion for the adoption of the foregoing resolution was introduced by Commissioner Mortenson, duly seconded by
Commissioner Bucholz, and , after discussion thereof and upon vote being taken thereon, passed unanimously.

WHEREAS , Otter Tail County proposes to construct a multi-use trail, from TH 10 8 to 440th St . located generally along 260 th Ave,
410th St, 268 th Ave, 415 th St., and CSAH 41 and in the below locations; and
Sections 25 , 26, 34, 35 ofT136N , R42W
Sections 15, 16, 21, 28, 29, 30 ofTl 36N, R41 W
WHEREAS , the reason for the construction of this multi-use trail is to provide a multi modal public transportation facility
between Perham and Pelican Rapids for pedestrian and bicycle use ; and
WHEREAS, this multi-use trail is necessary to provide for a safe transportation facility serving the needs of the pedestrian and
bicycle traveling public between Perham and Pelican Rapids; and
WHEREAS , Otter Ta il County has a right to acquire the right of way after an award of damages has been filed with the County
Auditor in accordance with Minnesota Statute, Section 163.02 and 163 .12; and
WHEREAS , all necessary additional highway rights of way, trail rights of way, and /or temporary construction easements have
been acquired for this construction except for 22 tracts :

BE IT FURTHER RESOLVED that the Otter Tail County Attorney is authorized to file the necessary documents in court and
represent the county in this matter.
