Commissioners Lee Rogness , Chair; Betty Murphy, Vice-Chair; Wayne Johnson, Kurt Mortenson and Dan Bucholz were present in the room . The meeting was held via Webex and was available to the public via livestream due to the health pandemic and declared emergency in accordance with Minn. Stat . Sec. 13D.021 Subd . 1 (1 ). Approval of Agenda Chair Rogness called for approval of the Board Agenda. Motion by Johnson, second by Murphy and unanimously carried to approve the Board of Commissioners' agenda of January 12 , 2021 with the following modifications: Addition to Regular Agenda : MCIT Board Vacancy Economic Growth & Community Investment Committee to Begin at 12:45 p .m . Finance, Property & License Management Committee to Begin at 2:45 p .m . Consent Agenda Motion by Murphy, second by Mortenson and unanimously carried to approve the consent agenda items as follows: 1. January 5, 2021 Board of Commissioners' Meeting Minutes 2. Warrants /Bills for January 12, 2021 (Exhibit A) 3. Human Services & Public Health Warrants/Bills for January 12, 2021 (Exhibit A) 4 . Human Services Contracts Resolution to Adopt and Implement the Buffalo -Red River Comprehensive Watershed Management Plan Otter Tail County Resolution No. 2021 -06 Whereas, Otter Tail County is a member of the Buffalo -Red River 1 Wl P(BRR); and Whereas, Otter Tail County has been an active participant in the development of the Buffalo -Red River Comprehensive Watershed Management Plan (Plan); and Whereas, Otter Tail County recommended the BRR submit the Plan for State approval on September 22 , 2020; and Whereas, the Board of Water and Soil Resources (BWSR) North Region Committee met on October 7, 2020 and approved the plan according to Minnesota Statutes 103B .101, subdivision 14; and Whereas, the BWSR Board approved the plan at their October 28, 2020 meeting; Now; Therefore, Be it Resolved, Otter Tail County hereby adopts and will begin implementation of the Plan for the area of the County identified within the Plan and serve as a substitute for the Otter Tail County Local Water Management Plan as per Minn. Stat. 103B for the duration of the state approved Plan . Rogness , Board of Commissioners Chair Page 1 of 5 Dated: January 26 , 2021 Attest ______________ _ Nicole Hansen, Clerk Board of Commissioners' Meeting Minutes January 12, 2021 Resolution to Adopt and Implement The Bois de Sioux -Mustinka Comprehensive Watershed Management Plan Otter Tail County Resolution No. 2021 -07 Whereas , Otter Tail County entered into a planning agreement Memorandum of Agreement to development the Bois de Sioux -Mustinka Comprehensive Watershed Management Plan; and Whereas , Otter Tail County has been an active participant in the development of the Bois de Sioux -Mustinka Comprehensive Watershed Management Plan (Plan); and Whereas , Otter Tail County recommended the Bois de Sioux -Mustinka Policy Committee submit the Plan for State approval on 9 December 2020; and Whereas , the Bois de Sioux -Mustinka Policy Committee submitted the Plan for State approval on December 4, 2020; and Whereas , the Board of Water and Soil Resources (BWSR) North Region Committee met on January 6, 2021 and decided to recommend the Plan be approved according to Minnesota Statutes 103B .101, subdivision 14 at the BWSR meeting on January 27,2021 . Now; Therefore, Be it Resolved, contingent on BWSR approval the Otter Tail County hereby adopts and will begin implementation of the Plan for the area of the County identified within the Plan and serve as a substitute for the Otter Tail County Local Water Management Plan as per 7 038 for the duration of the state approved Plan . Rogness, Board of Commissioners Chair Dated: January 26, 2021 Attest _______________ _ Nicole Hansen, Clerk RESOLUTION TO ASSUME ADMINISTRATION OF THE MINNESOTA WETLAND CONSERVATION ACT FOR THE CITY OF OTTERTAIL Otter Tail County Resolution No. 2021 -08 WHEREAS, the Minnesota Wetland Conservation Act of 1991 (WCA) requires local government units (LGUs) to implement the rules and regulations promulgated by the Board of Water and Soil Resources (BWSR) pertaining to wetland draining, filling and excavation; and WHEREAS, Minnesota Rules chapter 8420 have been adopted by BWSR in accordance with the rulemaking provisions of Minnesota Statutes, chapter 14, for the purpose of implementing WCA; and WHEREAS, Minnesota Rules 8420.0200, Subpart 1, Item E allows a county, city, or town to delegate implementation of chapter 8420 and the act to another governmental entity by the passage of resolutions by both parties; and WHEREAS, both parties must provide notice to BWSR , the Department of Natural Resources, and the Soil and Water Conservation District of the delegation, including a copy of the resolution and a description of the applicable geographic area, within 15 business days of adoption of the resolution; and WHEREAS, City of Ottertail has passed a resolution delegating the implementation of Minnesota Rules chapter 8420 to Otter Tail County. Page 2 of 5 Board of Commissioners ' Meeting Minutes January 12 , 2021 THEREFORE, BE IT RESOLVED that Otter Tail County hereby accepts the authority and administrative responsibility to implement WCA as the LGU within the legal boundaries of the City of Ottertail as of 12 January 2021 in accordance with Minnesota Rules, Chapter 8420 . The motion for the adoption of the foregoing resolution was introduced by Commissioner Murphy, duly seconded by Commissioner Bucholz, and , after discussion thereof and upon vote being taken thereon, passed unanimously. Adult Mental Health Local Advisory Council (LAC) Appointment LAC Co-Chair Beth Nelson provided a brief update to the Board regarding the Otter Tail County Adult Mental Health LAC. Social Services Supervisor Margaret Williams provided an overview of the roles of the LAC as outlined by statute and requested the Board to appoint Laura Holmquist as a member of the Otter Tail County Adult Mental Health LAC. Motion by Johnson , second by Mortenson and unanimously carried to appoint Laura Holmquist as a member of the Adult Mental Health LAC. 2021 Committee Assignments County Administrator Nicole Hansen informed the Board of certain committees/Boards that do not require an alternate . The Board briefly discussed and thought it to be beneficial to keep the alternate Commissioner should the primary not be available to attend meetings. It is understood that dependent upon the By -Laws for external committees and boards, the alternate commissioner may not be able to cast a vote . Association of Minnesota Counties (AMC) Voting Delegates Motion by Johnson, second by Murphy and unanimously carried to appoint County Administrator Nicole Hansen, Deputy County Administrator Nick Leonard and Emergency Manager/Safety Program Liaison Patrick Waletzko to serve as voting members for the AMC. Minnesota Counties Intergovernmental Trust (MCITl Board Vacancy MCIT is seeking a qualified individual to fill a mid-term vacancy on the Board of Directors due to the resignation of a Polk County Commissioner. The Board briefly discussed the opportunity and encouraged Commissioner Murphy to apply for this position . Motion by Johnson, second by Mortenson and unanimously carried to authorize Commissioner Betty Murphy to apply for the MCIT vacancy on the Board of Directors and endorse her application . Deadline to apply is close of business day on February 3, 2021. Recess & Reconvene At 9:33 a.m., Chair Rogness declared the meeting of the Otter Tail County Board of Commissioners recessed for a short break. The Board of Commissioners meeting was reconvened at 9:42 a.m. Ditch 45 Re-Determination Hearing Motion by Johnson, second by Bucholz and unanimously carried to reschedule the re-determination hearing for Ditch 45 to Monday, April 5, 2021 at 7:00 p.m . at the Prairie Event Center in Parkers Prairie, MN . L0923 Bridge Replacement Motion by Johnson, second by Mortenson and unanimously carried to approve the proposal from Braun lntertec Corporation for the completion of a geotechnical evaluation for the proposed Bridge L0923 Replacement project S.A.P. 056-675-035 . 2021 Updated Highway Project List Motion by Johnson, second by Murphy and unanimously carried to approve the updated 2021 highway project list as presented by the Assistant County Engineer. Retainage Reduction Assistant County Engineer Matthew Yavarow informed the Board that the retainage will be reduced on the following projects according to state statute : S.A.P . 056-601-068 & Etc., CSAH 1 & CSAH 88 Resurfacing, S.A.P . 056-635-035, CSAH 35 Resurfacing and S.A.P . 056-615-018, CSAH 15 Bridge (Orwell). Board of Adjustment Appointments Motion by Murphy, second by Mortenson and unanimously carried to re-appoint Douglas Larson, Michael Donoho, Terry Marthaler, and Thomas Lee as members of Board of Adjustment serving one (1) year terms expiring December 31 , 2021 . Planning Commission Appointments Motion by Bucholz, second by Mortenson and unanimously carried to re-appoint Jack Rosenthal, Rod Boyer, Richard Gabe, David Wass, Bruce Stone, and Rick Wilson as members of Planning Commission serving one (1) year terms expiring December 31, 2021. RESOLUTION REGARDING APPOINTMENTS TO THE OTTER TAIL COUNTY COMMUNITY DEVELOPMENT AGENCY BOARD Otter Tail County Resolution No. 2021 -09 Whereas, the Otter tail County Board of Commissioners is charged with making appointments to the Community Development Agency Board, as authorized by M.S . 469 .1082, Subd. 8; and Whereas, the Otter Tail County Community Development Agency Board is comprised of nine members, two of which must be County Commissioners; and Whereas, the terms of two current Community Development Agency Board members are expiring ; and Whereas, the balance of the term of the seat vacated by former County Commissioner Doug Huebsch needs to filled . Now; Therefore, Be it Resolved , that The Otter Tail County Board of Commissioners hereby makes the following appointments to the Otter Tail county Community Development Agency Board : Reappointment of Betsy Roder to a six-year term on the Otter Tail County Community Development Agency beginning February 1, 2021 and ending January 31 , 2027 Reappointment of Greg Swanberg to a six-year term on the Otter Tail County Community Development Agency beginning February 1, 2021 and ending January 31, 2027 Appointment Commissioner Kurt Mortenson to the balance of the seat vacated by former County Commissioner Doug Huebsch effective immediately and ending January 31, 2023. Rogness , Board of Commissioners Chair Page 4 of 5 Dated : January 26 , 2021 Attest ______________ _ Nicole Hansen, Clerk Board of Commissioners' Meeting Minutes January 12, 2021 Public Health Update Public Health Director Jody Lien reported that Minnesota has 437,552 lab confirmed cases and 5,711 lab confirmed deaths. Otter Tail County has 4,464 lab confirmed cases of COVID-19, of which 4,313 are no longer contagious, and 57 COVID-19 related deaths. For more detailed information regarding Otter Tail County COVID-19 data, visit https://ottertailcountymn.us/content-page/covid-19-health-information/. As data reflects a steady decrease in cases, concerns were expressed regarding an increase in the seven (7) day rolling average. Ms. Lien informed the Board of new variances of the COVID-19 virus that are circulating in Minnesota and expressed the importance of following Public Health prevention measures to prevent the spread. 1,650 vaccines have been administered thus far in Otter Tail County and the first phase is planned to be completed by the end of January. Environmental Health licensing fees will not be reduced or waived for 2021 and Public Health is promoting programs available through the Community Development Agency to meet the needs of businesses. Countywide Emergency Operations Center (EOC) County Administrator Nicole Hansen provided a brief update to the Board regarding the Countywide EOC. She reported that the EOC is providing logistical support to Public Health to assist with administering the COVID-19 vaccines and are focused on identifying facilities to organize larger vaccine events to accommodate the groups in the upcoming phases . Business Community Community Development Director Amy Baldwin briefed the Board regarding the business community. She reported that the Community Development Agency Board reviewed and finalized the guidelines for the distribution of funds allocated from the State of Minnesota to support organizations impacted by the COVID-19 pandemic and launched the county relief program on Friday, January 8, 2021. All businesses are encouraged to apply and the deadline for applications is January 25, 2021 . Internal Operations and County Planning County Administrator Nicole Hansen provided a brief update to the Board regarding internal operations and county planning and reported that the County continues to operate safely while managing the spread of the virus . Closed to the Public At 11 :17 a.m., Chair Rogness declared the Board of Commissioners meeting closed to the public to discuss matters regarding the purchase of property located at 19248 340 th St., Pelican Rapids, MN, Parcel No. 50000220158004. The closed session is authorized under M.S. 13D.05, Subd. 3(c)(1). Present were Commissioners Lee Rogness, Betty Murphy, Wayne Johnson, Kurt Mortenson, Dan Bucholz, County Attorney Michelle Eldien, County Administrator Nicole Hansen, Deputy County Administrator Nick Leonard, County Board Secretary Tara Bakken, Public Works Director Rick West, Assistant County Engineer Matthew Yavarow, and Highway Maintenance Supervisor Cristi Field. The closed session was concluded at 12:06 p.m. Adjournment At 12:11 p.m., Chair Rogness declared the Otter Tail County Board of Commissioners meeting adjourned.
